At least that's the message we're getting at the Valadez Trial:
- At today's Trial which sarted at 11am in room 606. There was a Cook County Sgt telling everyone they had to cover up and could not show their blue shirts because the judge ordered it. There were many who despite what she had to say entered the court room and sat with blue shirts showing anyway..Ans the ones who had covered up, immediately took off their covers to show their Blues. Good for you guys!!
We're pretty sure officers are still citizens, afforded the Rights enshrined in the Constitution to observe legal proceedings in an open and free judicial system. But we suppose that dozens of gang bangers hanging out in the courtroom and intimidating jurors is more acceptable to Cook County judges as was evidenced last month where the result at a sparsely attended trial ended up acquitting a scumbag of attempting to murder two Chicago Police Officers - a trial marked by dozens of gang bangers sitting in the audience.

The host said they asked the FOP and they told WTTW no one was available. The show was about shutting down police stations and the police department cuts. Can someone please update the trial proceedings regularly? I would love to attend the closing arguements on my own time in full uniform if anybody knows when that might be? Just to comment on the cabdrivers getting off from tickets. The cabbies all use the same attorney. And he is very successful at pleading them out to lessor charges or just getting the tickets dismissed (for no apparent reason). Even with the cops in court. If you remember the scene from Goodfellas when Henry gets pinched and his attorney smiles at the judge. Well thats exactly how this attorney is treated at traffic court. And when you question the state they just say sorry thats what the judge wanted to do. Very shady.
Alot of these judges are fucking nuts. They give probation to people with 50 arrests , and they give time to first time offenders. Thats why I never vote to keep a judge in.

Judge Alonso is a pretty fair judge from my experience in his courtroom. He's a former public defender who defended most of the garbage he was assigned knowing full well what they were.
More often than not he's pro police.
I don't know--they've banned pins that have pictures of victims--I would think it IS possible for a judge to ban uniforms...anybody know for sure?

SCC, who is the judge in this case? It would be nice to keep a running list of the cop hating judges that the supporters of CPD can use while voting. Keeping the names of these judges out there for all to see and a brief description of the reasons they are on the list just might be enough pressure to get these judges to change their ways.
I find it repulsive that the Cook County Sheriff's would order sworn Chicago Police officers to cover their uniforms while in attendance at a trial. I don't see how it is legal or enforceable. I understand, as you suggest SCC, that judges have considerable lattitude in controling their courtrooms. But, provided that members of the audience are not creating a disturbance or otherwise intimidating others in the courtroom, how can they regulate or determine how people dress - especially other members of the Executive Branch of Government. As you also point out - there was no hasseling of the gangbangers at the aforementioned trial in which those scumbags were acquitted. So why restrict the actions of law abiding coppers exercising their Constitutional Rights?

Among other things, they can set the dress code though. The judge did not ban cops from the room, just uniforms.
I don't know how it is in Chicago, but many court rooms no longer have uniformed bailiffs. Some have no bailiffs at all.
It is not unusual for judges not to allow a defendant's shackles be visible to the jury, thinking it is prejudicial (which it probably is).
Another common thing is not to allow the defendant to appear in prison garb.
It is best not to do anything that a higher court might deem prejudicial. You don't want this guy having a re-trial because there were a bunch of cops in the room "intimidating" the witnesses.

Lots of rumors about how the UCPD is going to change its operations shortly. The current rumor is that our patrol boundaries are going to be moved even further west, all the way to King Drive, and soon. Our north patrol boundary is going to be moved further north also. Why they wish to do this with our reduced patrol strength
as it stands now is anyone's guess. We've lost a lot of personnel over the past two years under

I was at court on Monday, just prior to the jury selections starting. I was told at that time officers would be required to cover their police shirts. At first I was upset, but then it was explained to me that the judge ordered this because there was worry that if the verdict is "guilty" the defense would claim a mistrial due to jury intimidation. It actually made sense to me. We, as officers, do have our rights, but we don't want to give this crackpot ex-cop lawyer any ammunition to win an acquital or a mistrial for that matter. My suggestion would be this, if you are in the hallway where all the thugs and villians are, show your blue and have your weapon exposed. When you enter the courtroom, put on an over shirt but leave it open and unbottoned, exposing the blue or white shirt front. They will still know who we are, while respecting the orders of the judge. Kind of a compromise, for the sake of Alex, his family and justice.

Bottom line fop president is "scared like." Watch him do any interview he does not look into camera but away like a scared little boy. Remember ladies and gentlemen the courthouse is run by a Chief Judge, a lot of times the trial judge has already been given his or her orders on how to handle the proceedings form this person. And also, the court house is public, but the county-Sheriff's Dept- has the right to require that anyone entering a courtroom has to follow the decorum or edicts set by the pre-trial motions. Wear your covers, be present, show your support... From a Deputy Sheriff, with numerous friends and family on CPD, stay safe and godspeed to you to make it home from every tour-of-duty.
The judge never verbally ordered it to any one in open court and the judge seemed fair. the Cook County Female Sgt said that the Judge ordered police to wear covers. She was the one telling police that they had to wear covers. wether the judge ordered the court officials to enforce or not, we will never know.

I seem to recall that a cop killer won a new trial because, in part, of all the uniformed officers in court. Defense claimed that prejudiced their shitbag murderous client.

I sat in there for the morning session yesterday in full uniform as did many others. So either a lot of people didn't hear this order or choose not to follow. If the POS defendant's people can wear their best hoodies, I can wear my uniform. Miss you Alex.
As long as the officers weren't causing a disturbance in the courtroom (yelling, and the like) then anyone can dress in any way to attend a court proceeding. If people can wear t-shirts that request specific individuals be freed on charges or the like, then why can't uniformed LEO's wear their uniforms. If I were a uniformed LEO, I would have complied with the request of the Cook County LEO (he was only following orders - which he probably didn't agree with anyway), and as soon as court proceedings started I would have removed the cover-up and displayed my uniform. If the judge has an issue, then they can explain in open court what that issue is. And not hide behind the bench and make a sweeping decision without explaining the reasoning behind it.
I'm surprised the city would let you wear the uniform off duty. Very big no-no in departments where I have worked.

My take on the up coming contract talks is if We, as CPD officers do not lose anything we have in our current contract is a win for us. It is a sad outlook but it is the truth. If the new FOP leadership does not give anything up then it is a win. In my honest opinion I think we are doomed. Shields is going to get punished by our new Mayor.

Did anyone hear actually HEAR THE JUDGE order this? Judge Alonso is a fair judge who I have gone to for search warrants and COHs on many occasions. He is not anti-police, and I doubt he would arbitrarily make such a ruling. If he did, the explanation is likely to avoid a future defense appeal issue claiming the jury was intimidated into a guilty verdict by such an obvious police presence.
As a law-abiding ex-soldier, I'm more afraid of cops in my neighbourhood than of criminals - which is bloody messed up. It feels as if political pressure is pushing cops towards treating Criminals with kid gloves, while coming down hard against the honest Citizen.
Two hypothetical scenarios, to demonstrate where the administrative and political pressure lies:
1. Cop arrests a drug dealer who just stabbed a guy - did he read him his miranda rights? Were the handcuffs put on too tight? Does this cop have a history of targetting ethnics for arrests (regardless of the fact that most drug dealers have an excess of melanin)? Better let this scum bag out on bail, for the sake of 'fairness'.
2. A Citizen with a CCW flushes a pair of human turds down the toilet, who were threatening him and his girlfriend late one Friday night - we'd better throw the book at this guy! Seize his weapons, don't let him out on bail, might even want to investigate him for domestic violence, since he's clearly a violent psychopath.
We've twisted things up so that the good guys are labelled as evil racists, and the bad guys are victims of circumstance.
Cops have a lot more common sense, I think, than they're allowed to excercise - we all suffer under the weight of Policies and Procedures written anonymously by egghead academians, who've never thrown a punch in their life.

I believe he is an Associate Judge, not an elected judge. If your not aware of the process, Cook County Judges are elected by the voters, associate judges are elected by their peers with no expiration on their term. The only way to remove an associate judge is by having his peers vote to have him removed. Associate judges make a little less each year in salary but don't need to run for office. It wouldn't surprise me that the chief judge would make sure all big cases get assigned to associate judges, this way their decisions won't having any affect on getting elected again. It's sad!
Judges think thy sit at the right hand of God. They are just lawyers wearing black robes.

I attended a couple days of the previous Att. Murder trial in Judge Howard--the NG. There were not "dozens of Gangbangers" on either day. There were 4 or 5 people who appeared to be there for the defendant, and when I was there, 7 or 8 Police and ASAs. I guess the story gets more comments when the numbers are exaggerated.
If you're asked to put on a cover garment, just do it. Everyone in the courtroom knows you are the police with a cover garment on or not. The judge can decide anything he wants in his courtroom. It's the closest thing to a dictator we have in the US.
If the judge looked out his window & saw all those thugs in his backyard....I'd bet he'd want all those Blueshirts showing up in his backyard!!!
No issues today as far as us covering up our uniforms. And McCarthy attended for a couple hours too.

By now all that Department should have done it is done.Children are receiving pension,benefits And medical.It would be nice for the children if it would be classified In performance of duty.....Ex wife can shop for a lawyer.
In the meantime Memorial Fumdation issued a check to the family immediately after funeral /in thousands/ and it was delivered in person.Foundation also pays all or substantial education bills.You just have to provide a necessary bills, paperwork and or prove hardship.
Officer was so well liked.....10 -1 Benefit for his children would be very appropriate .There ate many layers in the ranks....get organized,set up a trust funds for them.Take time....it can be done.

FYI, if a sheriffs deputy is given a order by a judge on the bench the deputy must follow the order or be held in contempt of court and Face possible discipline from their department. Bill schield is 100 % correct. It's not about you and it's not about the police department, it's about justice for Alex! I am a 16 year vet of CPD and I have to say it sickens me to see how officers act now a days. There is some sense of entitlement. For example officers getting angry when they don't get their police discount or something free, parking illegally in their personal car, disobeying traffic laws off duty. Officers that pull over motorists and yell at them and then let them go. The officer says it's about respect, do you really think that they respect you now that you yelled at them, write them or don't pull them over. Talking to all citizens in a disrespectful manner for no reason.
When we stop thinking we are better than anyone else and start being more humble and professional the more respect we will get. You can't expect to be held in a higher regard but then cry foul when you mess up and the court gives you a stiffer penalty because you are a police officer.
So the next time you are given a police discount be grateful - don't demand it because nobody owes us anything, not even respect! Remember respect is earned not assumed. Treat every citizen as if your dealing with God until the situation dictates otherwise. I don't know maybe I'm wrong and you will probably criticize my spelling and grammar ,but I know this department and it's officers are alot different than when I first came on. No I'm not a suck ass or a clout hack or a house mouse. I would like to think that I would be labeled by my peers as being the working police during my career. I've even been screwed by the department(callback). I think it's important that officers who have time on and know better to start speaking up before it's to late. I would say if you disagree with me I would say you have a personality flaw of insecurity and it's only a matter of time before you get caught on camera doing something wrong. Remember there is nothing wrong with being proud to be a police officer but there is something wrong when you expect stuff because you are a police officer! I am also a 16 year veteran, have worked in several districts and a unit. I have to say that your comments were spot on. I have trained many officers and have always advocated the things you talk about, the golden rule is still the foundation of civilized society... I am never "entitled" to a discount, free passes or a break when stopped for a traffic violation either by CPD or other municipalities... but I am humbled and appreciate it when those courtesies are extended to me...

I am not Billy Schield, b t allow me to provide an answer. If the defendant is acquitted there is no provision for an appeal by the State since he has already been tried and acquitted. To try him again would be double jeopardy. So unless the intimidation is bad enough for the judge to declare a mis-trial before a verdict, it is a done deal.
I have been in attendance everyday in my blue shirt nothing was said to me about covering it up. Mr. Wortham (older black gentleman) has been in court everyday all day. Thank you Sir!

Something you didnt mention that drives me nuts is I see P.O.'s on this job that look like thugs, or something out of Sons of Anarchy. SUGGESTION: How about the 10th District and the Gang Unit methodically check all the plates on all the cars parked in the garage and around the court building. Probably would come up with a few BFW, narco and child support warrants. You might even catch a lawyer.

you are both full of shite! i am a Deputy and i have been working the trial since it started. The first day our SGT told officers to cover up, thats cause the Judge told her to say that. She didnt care if you actually did, but as long as she said it, she was doing what she was told. Judge Alonso is very pro-police and a stand up guy, he is worried about Carroll filing an appeal. If we wanted to enforce something we would. Doesnt matter who you are. Anyone standing in that courtroom has been told by myself to sit down, its just plain old respect for the court. I even told McCarthy to sit down, he said "sorry officer" and sat down. On Wednesday it was so packed that it was one out and one in. Gastons brother came up to the door with about 5 shitheads smelling like booze, I did not let them in. They are not wearing gang colors or flags or whatever the hell you said, You must not have been in that courtroom. Ive been watching them ever second of that trial. Do you really think we are on the side of this piece of shite Gaston or Carroll? You got to be kidding me. I have spoken to A CPD SGT and LT about the covers, after i explained it, they were in disbelief of the rumors spreading and said sorry if anyone was giving us a hard time, which no one was, everyone i have dealt with from CPD has been very respectful and kind so far in this trial. I had the honor to work with Officer Insley at 376...he was jammed by the department but was always a Class Act!!! I agree with him 100%.
First of all, SCC, thank you for all of your posts regarding the trial and for keeping everyone up to date. Secondly, I did hear from an officer that a Sgt informed him that he had to cover up before walking into the court room. That was the first I heard of it and I never heard it come directly from the judge and nobody from the states attorney's office that is working with my family ever mentioned anything like that to us. So I honestly do not know where it came from. After seeing the "tactics" of the defense attorney, I am just going to assume that the reason is so that in the future, this defense attorney doesn't play dirty and want a mistrial stating that the jury were "intimidated" by the officers (as ridiculous as that may sound to us). Even my family and I have to be careful while we are in there. Of course, nobody can tell us NOT to cry or have any emotion, but if we feel that we are going to break down, we are asked to leave the court room and that is also so that the defense doesn't say that we "tainted" the jury or distracted the jury, etc. At this time, we just want everthing to go smoothly and not give the defense any opportunity to declare a mistrial or use anything against us. I do feel horrible because I was the one that asked if all officers could please show up in their uniforms! I hope you now understand! And I don't believe that any officer was not allowed inside the court room. On the first day, once all the benches were taken up, people were allowed to stand against the wall. That was the only day people were allowed to stand. If an officer or any person is not allowed in it's because there are no seats available. As soon as somebody walks out, the next person waiting in the hallway is allowed to come into the court room. Sorry for any incovenience this may have caused but I am grateful for all who wait patiently in the hallway. Last but certaintly not least, I want to thank everyone who has been attending. I know that with work, school, children, etc it is difficult but thanks to the ones that show up, even if for a couple of minutes. Mr Wortham has attended every single day and he is there first thing in the morning and walks out in the evening with us! It truly means the world to us considering we know what this man has gone through! Mrs. Flisk and her daughter have also attended. Unfortunately, I cannot mention every single name as there have been so many people there from the Superintendent, FOP members and countless officers, but please know that we are so greatful for each and every one of you and your support. YOU truly give us the strenght to walk into that court room every day and be in the same room as the defendant! And for those who cannot attend, please do not worry about it, as all we ask for are prayers! THANK YOU!!
