Carry a Taser? Or Don't?

  • The city of Chicago has agreed to pay $9.5 million to settle a federal lawsuit filed by a man who was severely injured when a police officer jolted him with a Taser and he fell and hit his head on the pavement, court records show.
So what did the Officer do?
  • Jose Lopez was injured in July 2011, as officers were aiding paramedics who had been called to the Little Village neighborhood, where Lopez was experiencing chest pains. Lopez repeatedly refused medical treatment and officers alleged that he took a swing at them before Officer [...] tased him, according to court records.
The officer was cleared by the Department - no discipline whatsoever - because he acted in accordance with training, using a tool supplied by the city, using the level of force appropriate for the situation. And a group of jurors bought the story sold by the plaintiff attorney that an assailant is somehow deserving of money because of the Law of Gravity.

How about you don't do drugs, and don't attack paramedics/police? Why bother taking a taser out? If you use it, you get sued anyway.

Officers will now be issued pillows to be placed under the subject's head prior to the head striking any hard object. Orders will state that two officers are to carry out the act of placing a pillow beneath the subject's head. One officer to Tase the subject and the other officer to run around the subject waiting for the subject to fall; the officer ready to slip the pillow between the subject's head and hard surface.

A judge in a wrongful death trial of Michael Brown awarded the parents of Michael Brown an undisclosed sum of money in the millions. Remember a Grand Jury, the FBI and the DOJ Civil Rights Section found no fault with what Officer Wilson did. But a liberal judge did.

No need to get mad. This is a learning opportunity. If he refuses medical treatment then 19P. Not our problem if he isn't willingly going to the hospital.

I take the taser but never will use it, I don't even want to use my gun, or any impact weapon. Damned if you do, damned if you don't. I will only use any force whatsoever to protect myself or my partner or another comrade. other than that, sorry, citizens, this is what you have backed us up against a wall. our livelihood and freedom is not going to be jeopardized in these times where everyone hates cops and wanting us all in prison and jobless. Sorry folks

OT. Rev Corey Brooks on Blacks leaving Chiraq in today's Fibune. "Some neighborhoods may succumb to gentrification". Lol. I thought succumb was a bad thing. I guess I didn't learn much in public school. He seems to be concerned about the hood being revitalized with taxpaying productive members of society. I'm very happy to be spending my pension in the Sunshine State. Good luck dealing with influential members of the "community" who've got it all wrong.

The Police did nothing wrong. A review of the Officer's actions show he acted within the law and the policies of the CPD.
This is liberal democrats rewarding one of their voters and showing how wonderful liberal democrats are to the rest of their voters.
The fact that not one dime came from them is unimportant, it's all taxpayer money. Obama's redistribution of wealth plan in action.

I have a question: If paramedics show up to a 9-1-1 call and the patient refuses treatment, why don't they just leave? Why should a paramedic have to do battle with someone in order to treat them? Don't they have forms they can have the guy sign saying he refused treatment? Then when he dies from that heart attack, his family can't sue the city. As it is, maybe being tased was just what the guy's heart needed.

Also, how is it that the City of Chicago can fund the ghetto lottery but not first responders pension funds?

You have to take the taser out if you're trained. Don't leave yourself open to an inspector or Sgt. You don't have to use it though......

Not true. Just read the other day that the "parents" of deceased gentle giant thug Michael Brown have been paid somewhere around $3 million tax payer dollars to settle their wrongful death suit. Wrongful death? That asshole deserved to die. We now pay the thugs and their families for committing crimes. The earth needs a giant asteroid strike to cleanse all this shit from the planet. We are screwed if things keep going the way they are these days.

I always thought it was bullshit that people call us to take idiots to hospitals. You don't wanna go then don't, end of story. Once a hospital called us to detain a person who was a walk-in and had some itch on her ass. Then she changed her mind and wanted to refuse treatment but the hospital didn't want her to go so they called us. Everyone wants us to solve their bullshit problems.

At what point would the Good Samaritan be a wiser decision? Acting in the capacity of a feral ghetto urchin doesn't pay nuffins.

No matter what ghetto affair one gets involved with, the ensuing tragedy always comes back to reward the aggressor.
(Had this assailant fell on his own, the standard Ed Burke Finance Div. uncontested payout is about $15,000.)
I never understood why some legal experts insist we all have to fight and corral uncooperative transports.
We all have a duty to protect, but to what degree of self-harm are obligated to sustain?
Does arresting an injured maniac provide any relief or denial of monetary compensation?
Nope.

I recall long-long ago a 025 domestic incident gone bad with a cracked out doper assailant that fought with police and eventually was gravely injured because of his violent aggression and resisting.
All the hindsight (and case law) and only the First Responders are put on the hook for getting involved with persons in altered states of minds. Not the family, not the doctors, no the politicians.

In this instance, no liability is on the affected Officer or paramedic...just the City.
This award will probably be re-settled way lower, but for it to even reach past the initial deposition and on to the council floor is nuts.

Stand alone and be a clown boxed punching bag will certainly help Rahm's bottom line.
He's actually encouraging it.

the officer should also sue the city for putting him in that position. The city never tells the public how not to behave or face consequences from the police, they only tell them they would punish the police, so the city put those damages on to that officer and for what, just another vote. Disgraceful.

Back in the days had a couple of these sessions in the back of an ambo - mainly because the "victim" was not of sound mind. Now - wouldn't touch it. Tell the medics you'll file a case report in event of later charge of "patient abandonment" and let them rip the IV's etc out and go on their merry way.

And having the report makes the later death investigation a whole lot easier.

Police Safe & Proper. You are on your own.

PS - Also agree with the office who states Taser use for self or other 1st responder safety only. Drug ingestion and electronic stimulation do not mix.

Yes he did and there were 47% percent less lawsuits filed once the bottom feeding lawyers found out it wasn't gonna be an automatic payday for them. Actually can't believe Daley let him do that.
