Not Mine - Swearsies!

That suburban arrest report summary with the humorous narrative we posted about on 26 May?

Here's the backstory and it's pretty much what everyone thought it was:
  • On the evening of Friday May 19, 2017, police officers in suburban North Riverside pulled over a vehicle at 7200 West Cermak Road for an apparent traffic violation. Their curiosity aroused by the overwhelming aroma of marijuana wafting in the air, officers searched the vehicle and, unsurprisingly, discovered a loaded .380 pistol in the glove compartment. While attempting to unravel the mystery surrounding ownership of the illegal weapon and enduring another boring ritual of finger-pointing and repeated denials from passengers, officers eventually turned their attention to the occupant of the front passenger seat of the automobile, Alejandro Avila. Police at the scene discovered soon afterward Avila was a known felon with an endless string of gun and drug-related arrests attached to his name and an unmistakable affiliation with Chicago’s infamous Imperial Gangsters. An organized cabal of goons with influence over several expanses in Chicago and in nearby suburbs, its members’ clubhouse fun and games include murder, attempted murder, aggravated battery, aggravated assault and narcotics trafficking. Predictably, Mr. Avila swore blind he had no knowledge of the weapon.

    When the matter was turned over to the Cook County State’s Attorney’s office, what began with a breathtakingly mundane traffic stop which should have amounted to a foolproof victory over crime in court peaked with Cook County State’s Attorney Kim Foxx refusing to bid for a felony weapon charge against Avila for possession of a loaded weapon. Foxx’s utterly preposterous rationale for declining a felony weapon charge was honoring Avila’s “word,” a denial he was aware the loaded weapon rested in the glove compartment in front of where he was seated. Foxx’s faith in Avila’s denial came despite his rich history of lawlessness and threats to civil society, all of which is common knowledge to Foxx’s office. While questions persist over whether the State’s Attorney’s office would achieve a conviction in court and it remains a possibility the case endures, Foxx’s office declining a felony charge based on a known felon’s “word” remains an absolute outrage.
So the suburban cops wrote a quick narrative for what ended up being a RWOC (release without charges) report and put the blame squarely where it belonged - on Kim Foxxx.

We've been a part of many arrests where everyone in the car caught charges for whatever contraband they were transporting. We've also seen people (or folks) step up and take the weight to protect a girlfriend or a shorty or someone relative with a clean record.

But that wasn't even attempted by the State it seems. Everyone denies it, so nobody catches a case - that's a brilliant bit of political horseshit right there.

So far, only the alternative media (Medium.com) is paying any attention to it. The rest of the media has abdicated all responsibility to the taxpayers.

Off topic, but in relation to your earlier posts: there's a running them here. This city is not a very good place to live in, regardless of the neighborhood. Many of us, including myself, support the current FOP. So, in doing so I ask this: Start battling this at every turn. Corruption in this city is never going to end. Sorry but the way you describe it this case does not have the elements. Part of the statute is he must "KNOWINGLY" possess the weapon . If it's in plain view at his feet or even visible under the seat you have a case to make although anyone who has dealt with felony review knows the state always likes a statement. In this case the guy doesn't even have to deny it. All he has to do is say nothing. Either way even though common sense says it's his you can't prove knowledge. Now if the narrative would have read " As RO approached the vehicle he observed the offender open the glove box........ " etc then I would hope it would have been approved. But in this day and age of body cams, dash cams, cell phone cams creative writing is not the smart thing to do so fuck it and let them kill each other.

The "community" has the likes of father Phaker who by the way has been awful quiet lately. They have these blm nitwits too. They go out and hoop and holler, march and make headlines. The normal, law abiding citizens have no voice. There should be well deserved outrage with Fox and especially with cases like this. Looks like we have another Mosby here who is clueless. Laws do not matter to these types only agendas. Is it any wonder that police are being shot at more frequently ? Why the hell isn't the Superintendant of police screaming to anyone that will listen about this crap ? Law abiding citizens should be disturbed by whats going on around them . Hiding from this reality will not make it go away. There needs to be an uprising of good people to take back this city from those in power who dont seem to care about the ever escalating violence and lack of prosecutions.

Yes when this was first reported by your website, I copied the image and passed it around. No one thought it was legit. I even sent it to all the media outlets, a few alderthieves and Robin Kelly. That is the congresswoman who while running for office starting crying when speaking about gun control. Not a person responded. Not a fucking one. With that being said, my kids are grown, all college graduates, so fuck you Chicago. The politicians who make the laws do not give a hit unless a photo op is involved or they are getting a taste.

If the prosecutor doesn't think she's likely to convict (proof beyond a reasonable doubt), it's literally misconduct to prosecute- even if bare probable cause is reached. This was a turd of a case, regardless of how many times you've seen some dumb hoodrat plea out instead of fighting it.

What La Kimesha and her assistants fail to understand is the fact that there are over 100 suburbs in Cook County. Some of these towns are in more than one county (Barrington is in 4) and see the difference that venue makes in charging/prosecuting. Some of the communities are not in the Prickwrinkle sphere of influence and will go to any lengths to illustrate Crook County's soft stance on crime. Hopefully, the lame stream media will be forced to tell the truth once their competitors cover the story. Their gushing over Kimesha during the primary election will eventually turn sour. Let her arrogant stupidly bring her credibility down. If you're an officer in one of the towns that support the Prickwrinkle, Dart, Foxx agenda - take heed and tread cautiously.

The ASA claimed it's a directive to review from the top...the reasoning?? SOME judges are lenient if the guy tried to register. This is all off of their word with ZERO proof of an attempt.

Was out and about last weekend and ran into a friend , ex police who is now an investigator with States Attirney. He said the job has turned to Shit. Kim Foxx hates the police and shows it without hesitation, especially Chicago Police and has made this very well known. their new game(uuw/felon arrest) is to C.I. the felony case. we were told by an asa K. that he/she was not denying felony charges... "we're" continuing the investigation. so we asked the asa what is the exact meaning of continuing the investigation. the asa related that we/cpd could not determine proof of possession of the hand gun buy offender (which was bullshit by the way) and that the asa would need the results from forensic testing. wtf?! so who gets in contact with the r/os when/if the prints do come back to jagoff... the state is not going to test for dna on a gun case in cook county. and I'm betting that if by some miracle that even if all of the above happened and cpd arrests jerkoff the asa still wont approve charges. rant over..sorry.

Recently there was a car chase in my district. For the love of God- read the vehicle pursuit policy. It has so many restrictions and open/subjective language in it ("continuous balancing test") that you would have to be very stupid in order to engage in a vehicle pursuit.

I don't know which statute you're reading, but "knowingly" is nowhere in the UUW statute. One who has a handgun in his possession is in violation of the statute, knowledge is not a requirement. By your reasoning, dude can walk around with a gun in his backpack and not be in violation of the law because there's no proof of knowledge. Sorry, but every subject in that vehicle is in possession of that gun. Get your "statute knowledge" in order before slamming others.

How much time did the Denial of Felony take? Almost immediately or after a few hours?

Midnights is a tough time to get an fresh ASA, but they get their orders from a higher authority anyway.
I'm sure the ASA wrangled with a supervisor and was also put in place.
Hard to believe nobody in the car was locked up for UUW and all went home RWC.

Question: Could the gun been checked for prints (handle, barrel, etc.) and if the accused's print was on the gun would they not have a case? Or if the print of anyone of the occupants was on the gun would they not have a case as someone had to place it in the glove compartment and probably wasn't wearing gloves at the time. For the record that may not be the actual case report. I work the burbs. We use clear to process. We do not use it for case reports. Nothing I ever wrote in the narrative box in clear has been reviewed by a boss or submitted. It just stays in clear. Mt case report is done in a completely different program.

So by this Police rationale, if a Policeman had previously been accused of some transgression(s) related to his job, then all future accusations should be believed. The guys past bears no relationship to this incident. Was it his gun, probably; but not even a jury in DuPage
County would find this guy guilty. The ASA on Felony Review probably saved those cops from being sued over a bad arrest. Too bad they didn't see any further actions which might have tightened up the case. Oh well, at least they got a gun off of the streets!

Said that particular PO is using his contractual right to get days off when people below him need time and can't get it because of this PO. Lt then went on to say that he would call this PO out during roll call to all the other POs so that they knew who was screwing them over.

You may be confusing the need for knowledge with "inferred knowledge." Either way, you need knowledge. THat certainly doesn't mean the offender has to out-and-out admit knowledge, it can be implied no doubt. But knowledge is needed any way you look at it.

The gun in a closed glove box in front of the guy is not constructive possession. And yes unfortunately sometimes you have to just eat it and inventory the gun or drugs and let them walk. You can print it and swab it for r a and submit for comparison. And if it takes a year so be it you come back and get him in a year. Yes it can be done. Obviously you have no experience with investigations or anything involved. Or you big shot you can grow some balls and say you saw him put it in the glove box but those days are over.

Dumb Comment. If a witness identifies them - you may have a case whether they admit it or not.
However, in the gun case, with a passenger in a car-- and the gun in a closed glove box-- with no admission or witness to say the shitbird put the gun in there--you can't prove knowing possession.
It's not a matter of taking the shitbird's word for it. That's the copper's whiny interpretation. Without an admission by the offender, or prints, or a witness, you can't prove possession. It doesn't matter how many felony convictions he has.

You might want to read it before you open your big stupid mouth again
Key Points: Constructive possession is established when the state demonstrates that the defendant: KNEW of the weapons presence and exercised control over the area. According to People v. Daniel Smith the only person that constructive possession would apply too would be the owner of the car/driver. Basically just substitute CAR for BAG and you have your constructive possession on driver, not passenger.
P.S. I'll take a DOG over a reckless, no nothing, super cop any day of the week.
