Oh This is Priceless

  • A veteran Cook County judge was hit with a misdemeanor gun charge after sheriff’s deputies saw him drop a pistol last week in the lobby of the county’s main criminal courthouse, authorities said.

    Judge Joseph Claps, who has presided over felony criminal cases at the Leighton Criminal Court Building, was reassigned last week to “nonjudicial duties” pending a meeting Wednesday of the circuit court’s executive committee, a spokesman for Chief Judge Timothy Evans’ office said.

    Claps was walking in the lobby of the courthouse at 26th Street and California Avenue on July 3 when two deputies noticed a handgun fall out of a jacket draped over the judge’s arm, according to a sheriff’s incident report.

    Security cameras captured the gun tumbling out of Claps’ jacket as well as the judge picking up the silver pistol and putting it in his pants pocket, the report said.
What does a judge need a gun for? In court especially? Can't he just leave it in his car like Rahm and Toni expect everyone else to do? And now that he's been charged, does that negate him hearing a gun case ever again in the Cook County system?

This Judge was a 30 yr colonel in the military. He had a concealed carry and Dart nailed him on a technicality. This was nothing but granstanding on the Sheriff's part but would we expect anything different from little Tommy. Just curious why darts personal security guard was not charged when he shot himself in the foot outside his office. Darts really good at throwing others under the bus but seems not to hold himself to the same standard.

HEY!
I've walked through that lobby a couple of times when I had to report there for jury duty.
I would have felt MUCH more secure and safe if I was packin'.
Never have I seen such a collection of losers that looked ready to take me out if I so much as glanced the wrong way at them. Now since I have a severe case of old white man resting bitch face, I pretty much tried to scurry past all of them and not draw attention to myself.
I DON'T BLAME THE JUDGE AT ALL.
Good luck to him.
BTW I bet he used the line that doesn't have to go through the metal detector and body cavity search. Right?

Many, many years ago, there was an Irish judge (like that is news) at gun court who carried his shit under his robe and more than once displayed it to eliminate some outlandish, foolish shenanigans from a goof at the front rail. In those days, he shocked the shit out of them! He was one okay, tough sob! And AFAIK nobody ever beefed on him. They might have figured, hey, it's gun court, why wouldn't he have a gun?! And, he never returned a gun to an arrestee. He might have cut a few loose, but they knew damn well enough not to ask for the gun to be returned. Those were the days it was fun to be at court even after having worked 1st watch. Okay, it still sucked, but it was fun to watch!

You would think the Judges who are the court system would have some type of exemptions added to the law. They are dealing with a lot of very bad people on an every day occurrence. They see lots of victims and don’t want to be one.

First off congrats to Officer Realmo. You can see the politics of city is so screwed up they will waste time and money on cases that should never have gone to court.

Second the judge has carry conceal permit. And is now being charged with violating carrying in prohibited area. This rule is way to vague.

After being retired for two years and having my LEO card. I have been the subject of carrying in areas prohibited also. But the officer and supervisors on scene had enough common sense to stop the nonsense and dropped all matters.
One was in movie theater. Second was restaurant. Wearing small size .380 inside of belt. And cannot figure how anyone saw the holster or pistol

Another political matter that has run a muck.

Local governments can't dictate where you walk with a legal fire arms in PUBLIC AREAS.

His defense will be he was going to put it in the lock box at the county building which you must pass the security area to get to.

This is a little late,but just saw the great pictures of Johnson, Jesse and Phuger arm in arm at the march. Think there’s any chance of getting one of the pictures framed and hung up in every station lobby and roll call room. Someone should lobby the folks to demand it is done. Maybe Fluger could march that it is done. I personally would like to see the picture in the roll call room everyday just in case I start to forget.

The judge should use the old axiom from my army days: admit nothing, deny everything and demand proof. It wasn't me on the video and I did not have a gun. I dropped my cell phone. Nothing inventoried. By the way, I don't blame him for carrying a gun. I do. This city is not safe. Judges have been carrying concealed guns way before it was legal to do so.

He is a judge who listens to all sides of an argument and then does his best to rule honestly and fairly. Tough but fair. I wish him the best.
Judges with CCL's should be allowed to carry in the courthouse and anywhere else.
I believe many of the prohibited places listed in the carry law ought to be eliminated, such as the Cook County Forest Preserve and municipal parks. Also, violations of the listed prohibited places should not be a criminal violation. Read the Missouri carry statute and learn.

I understand this is a Cook County Building, but still what is the charge ? Would a Retired Law Enforcement Concealed Carry Holder, be in violation of a statute, by bringing a firearm into this building.

The issue here is not about a judge being allowed to possess a gun, but not in a courthouse. He like everyone else is supposed to be protected in court by the screening at the entrances, the sheriffs deouties and the CPD officers
He has a FOID card and a carried concealed permit so he can legally carry before and after work at the courthouse

The case where COPA tracked down the 2 chumps weeks after the bar incident and persuaded them sign complaints for theft and battery. I've got a feeling these chumps are gonna have to cough up more than chump change. They fucked up and shoulda let it go. Instead, they got jived by COPA trying to railroad RR.

This case is going to get tossed. The Sheriff looked at the video two days later and charged him while never recovering the gun. The Judge should say it was a ham sandwich and tell Farts raiders to go F themselves. I seriously cant believe the stupid comments on here when you have someone who has a license to carry get railroaded. So Tom Dart is allowed to carry weapon as a sworn officer in the courthouse but the Judges cant. That should scare everyone even more. If something went down I rather have that military vet Judge backing me up than the Sheriff.

The judge was an army officer so I have no issues with whatever he is packing. If I were him dealing with scumbags all day I would want to be armed all day everyday - my PJs would have a holster.

Oh yeah - your point was probably that the (so-called) Sheriff is disarming LEOs in the courthouse, which is just stupid and backwards and Crook County in every way. OF COURSE LEOs should be armed in a courthouse, but at-least this way there is one armed good guy in the building.

I understand that this is the judge that convicted a police on flimsy evidence,accused the investigating detectives of lying and sent the cop to prison. The case was overturned on appeal and the appellate judges said there was no evidence to support a conviction

Makes his presence known,waits for backup, then reacts.No more cuffs,by yourself, in the middle of the forest.
Had he taken some action on said asshole, that sure as shit would have been recorded to be used against him.

OT Went to markam court several times last summer with my daughter trying to evict a destroyer of worlds from her rental house. hellhole indeed. a total circus full of the dregs of society. the court guards and court personel didnt look much better. guards sleeping in chairs in full view. inside the court rooms i never saw any justice done, no one prepared, defendants clueless and no one seemed to worried about a bad outcome. everyone gets a pass and goes out to party in the hall with their posse. what a monsterous drain on the crook county tax payer who crosses the tees and dots the i s so the dont get in "trouble". what a worthless one sided justice system we have. mutts handled with kid gloves at every level so they dont feel disrespected. years ago i got a speeding ticket downstate. desided to go to court and take my little boy with and make a fishing trip out of it. feelings of doom spread over me as i listened to the judge explain that if your here your guilty and if you fight the charge youre insulting the court and the officer and wasting the courts time and you will pay for same. worked out ok for me but i saw some massive fines and people led away in cuffs for traffic. i will never break ordinance in that county. ever. people get the govt they deserve. crook county is the new calcutta and the people love wallowing in their own shit. exit stage left, its the only answer.

20 some years ago, I as a PO had to go in the basement of a Cook Cty courthouse and lock up my weapon before appearing in a court.... Maybe they don't do that any longer...????

As a LEOSA carrier (Retired), NO I can not enter the building with my weapon...

After being retired for two years and having my LEO card. I have been the subject of carrying in areas prohibited also. But the officer and supervisors on scene had enough common sense to stop the nonsense and dropped all matters.
One was in movie theater. Second was restaurant. Wearing small size .380 inside of belt. And cannot figure how anyone saw the holster or pistol

The no gun stickers apply to CCW license holders, not LEO's (or retired) carrying under the National Law Enforcement Officer's Safety Act. While you can be denied entry by owners while carrying a weapon, it's not illegal as it would be under CCW regulations.

separation of powers clause, equal protection under the law, Illinois UUW statute, FOID Act, many arguments to be made that the Judge has an affirmative defense for his conduct...a judge inside his chambers is his sanctuary place the judge has every common law jurisprudence principles to possess his firearm for self defense....when was the last time that you sat in side the judge's chambers with the ASA, defendant, defendant's attorney and the sheriff deputy then all of a sudden the deputy steps out of the judge's chamber for courtroom responsibilities now the judge is armed and can defend himself and others to prevent great bodily harm/death....when the defendant snaps!

Sometimes when you are a police officer you have to act on your own while waiting for backup. Only offender that was on the video was the drunk and then to say the victim could have turned into an offender is really stretching it. He could have at least to the guy to calm down and be quiet

OT. I wonder if COPA is gonna pay the legal fees and damages that those 2 chumps are gonna have to pay when Brodsky sues em? Rialmo case is what I'm referring to. The guy knew it wasn’t his coat and still signed the complaint for theft? Why they included the theft charge is beyond me. Sounds like some investigators don’t know their job.

Is COPA going to pay their legal expenses? Are you high? COPA probably never informed them of the fact that this could go against them if they lost in court. When the legal bills come in, don't bother calling COPA. They might be better off pre-emptively settling with Rialmo.

Another question: Who made the case report? IAD? Was it made the night of the incident? Or later? CPD would have had to pull RD#. Was it routed to a Detective Area?
