Now, the Lawsuits

  • The Chicago Police Board fired a sergeant and three officers Thursday night over the alleged cover-up of the murder of Laquan McDonald by a police officer.

    The decision appeared to turn on infamous police dashboard camera video of the fatal shooting that contradicted the officers’ police reports.

    The nine-member board found that the officers exaggerated the threat posed by the 17-year-old McDonald in order to justify the actions of Officer Jason Van Dyke in shooting the teen 16 times. McDonald was high on PCP when he refused police commands to drop a knife while walking away from officers on a Southwest Side street in October 2014.

    The board voted unanimously to fire Officers Ricardo Viramontes and Janet Mondragon as well as Sgt. Stephen Franko for several rules violations, most importantly making false statements. All but one board member voted to fire Officer Daphne Sebastian as well for bringing discredit to the department and preventing the department from achieving its goals, though the board held that she did not make a false statement.
And the bosses (above sergeant) escape any culpability - even then-Chief of Patrol Special Ed.

Keep your ears open for any fundraisers to defray the costs of a lawsuit, one that will put Special Ed, McNaughton and Roy on the stand under oath. We will publicize them to the maximum of our ability.

The bosses have no less a responsibility to ensure actions by Department members comport to Department Orders/Policy and ordinances/laws when reviewing/investigating an incident before them. They are just as culpable for their lack of due diligence, as they would hold others to.

In 024 and probably elsewhere...days off cancelled for some to be sent to 011, 1800 - 200 on Saturday, while the tact team(we have 4 teams, with no power cars anymore) can stay in the district to display their blue jeans. What message does this send to the 3rd watch officers????? Volunteers and then Tact should be sent to fill these spots. Perhaps maybe our Commander will rethink this strategy. Just sayin

Wow! As a Sgt approving a TRR in a police shooting all you’re really doing is making sure everything is in there. You’re not making a finding or anything. That’s for the street deputy. So for them to fire the Sgt who wasn’t even on scene and just made sure that the trr had all the info in there is atrocious. It’s disgusting. I’m so sorry for him. That could’ve been any Sgt on the department and they would’ve done the same thing this Sgt did. Just pass it along to the deputy. Just not right.

This has been a comedy of errors!
When this incident first went down the Department secured reports and statements from anyone that was there!
Even if these officers did not see anything? There was a report. This is normal in any shooting!

After the original finding of a justified shooting by Detectives and IPRA and one year went by the Mayor was re-elected.
So with the heat after release of the video, And the review by the IG and new COPA unit?
The evidence has been manipulated again. All for political purposes!

Since there is no reliability in the original investigation can you trust the re-investigation due to politics?
Can any officer trust what he enters on a report? Can a detective trust and use what is written in any report?

With the conviction of VanDyke,
The acquittal of three other officers in criminal court for making false reports!
Now the termination of officers for false reports in a case that I would not trust even if I was there and witnessed it myself?

I was taught as a new Detective, “If it’s not in the Q&A it has not happened”
Well here is the opposite.....If it’s in the reports use it against the reporting officers.

Let’s forget the trauma and stress of any shooting. Let’s use any mistake as if it was intentional and criminal in nature!

Many years ago a police officer was accused of alleged misconduct, the Superintendent fired him the board fired the officer!
It was all easy to fire the officer until the court reviewed the evidence where the Judge asked where was the evidence?
During the reply by the city attorneys the only evidence the city had was the investigators opinion!
Within seconds the Judge reinstated the officer, with these words, “if the evidence does not exist then the termination is wrongful”

This is a perfect example for all sergeants, ONLY BECAUSE THEY ALLOW YOU TO WEAR A WHITE SHIRT DOES NOT MAKE YOU A MEMBER OF THE CLUB, A BOSS, OR UPPER MANAGEMENT.

You are nothing but a person in a white shirt that makes sure REAL BOSSES wishes are adhered to. This poor Sergeant only made sure all reports and notifications were done. As far as for approving reports all he does is makes sure UCR, date, time, location, notifications, spelling, grammar, etc on a report is correct. They do not tell the or should not tell the officer what to write on their reports.

Everyone from Lieutenant and above who signed off on this OIS got to resign or retire in good standing with the department and keep their pensions. The only white shirt who had to go through disciplinary hearings and fight criminal charges were the blue shirts and the single white shirt.

So to all my brothers and sisters who think because they wear a white shirt they are part of management, this OIS incident shows and proves that you are closer to being a BLUE SHIRT more than being close to being a real WHITE SHIRT. Stop being dicks to PO’s , riding them, pushing REAL BOSSES quotas on them, etc because at the end of the day when shit hits the fan you will be thrown underneath the bus with the blue shirts!

Now they will say these officer's lied, so their earlier decision was based on misinformation(not their fault). Of course they have been hiding behind this ever since during the trial as well.

The real crime is not only that the MacDonald incident is now "back in the news" , now they will again talk constantly of the shooting talking like this just happened and bringing up the shooting to make it out like such events happen every day besides bringing up other historical fake garbage (the gentle giant or even Saint Skittles) to further ostracize the police and call them racist along with Trump and all the law-abiding citizens of European ancestry. Obtain the best legally skilled attorney(s) for this type of representation. Put the bosses under oath and lock in their testimony. Same for the Big Dogs (Rahm and company). Drag the evil cabal into the sunshine and fillet their asses in court. Be ruthless and uncompromising in the pursuit of justice Chicago style. Make every one of their sleepless nights be filled with "night sweats" and misery. May they constantly worry and relive their culpability in their miscarriage of justice. May they be constantly be asked by family and friends what are you hiding and what is the truth. Relish in the knowledge you will be a public spectacle as attorney's call on you to speak the truth under oath.

The City policy makers and the Community want a certain level of police services so it becomes incumbent to provide them the police services they want and deserve. You are paid to provide basic police services. Meet the basic level of job related requirements. Follow the letter of the law, Orders, Directives and Policies. Nothing more and nothing less. Fill out the reports accurately even if it takes hours to complete, act on written complaints, use common sense and move to the next call for service. When asked about the violence in the Community refer them to the occupant of the Mayor's Office or the Supt. Office. You are following their policies and procedures.

Remember your actions are constantly being monitored by the City and its all encompassing resources (e.g., electronic monitoring), the watch dog organizations and the Community. Provide all concerned the basic police requirements they want and deserve.

By following these simple rules, policies and regulations you will be assisting policy makers in making and keeping Murder City #1.

That piece of shit Laquan McDonals was not murdered; he was shot and killed in the commission of a crime as police attempted to control an armed, dangerous and unstable subject.

If you watch the tape closely, you'll see LM turn at the last split-second toward police as if to lunge at them, whereupon JVD discharged his weapon in an attempt to terminate the threat.

That's how I see it. Inflammatory statements like "The MURDER of Laquan McDonald by a police officer" only serve to deepen the divide between police and "da community."

I've sat in front of "investigative panels" for other things. Make no mistake, my freedom was not at stake for what was being investigated but, it amazed me how no matter what you say and what you think of the strength of your position is, if they had an agenda for you, you're going to be found guilty. It's an awful thing to experience and jail wasn't on plate in any of these proceedings. My heart goes out to these coppers, they weren't going to let you escape without the obvious pound of flesh being removed from your hide.

Now, these poor coppers get to try to find a new job with the scarlet letter loudly and clearly affixed to them. If this was indeed an unjustified ruling, I don't know, I wasn't at the original incident, I know nothing about it, I hope they have the means and stamina to pursue getting their jobs back.

Yes, they were able to leave and retire. They also had the time on and vested enough to do so. If any of the officers in front of the police board had enough time on to leave and collect they also would have been able to. Alot of people higher ups backed up JVD and paid a price for it.

That weekend is the perfect time to make a statement citywide.

They get caught. Witness & clear independent video. They go to jail.

As of July 15th, I've now been retired 13 years. The District Christmas party when those who have retired during that year, get their 'atta boys', retirement plaque, and recognition of service, congratulatory letters. This is done on the stage and you are given the microphone to say a few words. Say a few words, I did. My full, retirement acceptance speech, was:

"Run silent,run deep!"

Handed the mike back to the Captain and exited stage right. The look on the the commanders face was priceless.

Much to my dismay, my grandson recently became a sworn officer on a different department. I constantly give him the benefit of my experience in the form of advice. My most recent advice to him was, do not arrive at any scene if you are not needed there. Stay off the air, and be a block or two away, so that if help is needed, you are available, but don't put yourself AT the scene.

What happened to these officers, if they were not assigned to that call, is a textbook example of how you can get jackpotted, just for being on scene, when you should never have been there in the first place. I also told him to keep off the radio, but if need be, keep your words to a minimum. Words of wisdom.

Answer your calls, and nothing more.

The judge in the trial refused to allow police brass testimony in Jvd trial as I recall. The sergeant is getting the worst deal . He was not there and did see the video. The brass also were not on scene but did view video and signed off on case, especially the street deputy .

What happened to these officers, if they were not assigned to that call, is a textbook example of how you can get jackpotted, just for being on scene, when you should never have been there in the first place. I also told him to keep off the radio, but if need be, keep your words to a minimum. Words of wisdom.

Weird what you said about going to the scene. One officer who was fired had a partner that wanted to go to dinner and not go to the scene and assist in trying to take McDonald into custody

Read the contract. For the FOP or any union official (that includes unit and watch reps) to call for a job action is grounds for decertification and your firing for even talking about it. At least a CR# that you would be on your own.

What a disservice to officers. Do your job, at minimum, retire and move far away. People outside of Chicago Illinois still respect CPD. It is an honorable and difficult job that only courageous people are willing to do. How wrong the meritorious promotional system has been for years and the fixed promotional exams. There are so many fine men and women who go to work on the streets of Chicago everyday with zero expectations of going home each night. These brave people deserve so much more than what the city and the department have dumped on them. Not one officer should ever have to worry about serving time or losing everything to meet political gains. It’s a disgrace, an embarrassment, and a violation of officers rights. The old/real Chicago Police Department, years ago, may have involved some unconventional ways of conducting police work, but CPD was the most respected police department in the world at one time. The political correctness and need to use someone and/or something as an example to appease those sensitive and uneducated people in society needs to end. People need to take responsibility for their own decisions and actions. Families-all races-need to take responsibility of their children and of each other and stop placing that responsibility on police officers. Laquan McDonald was one of the many children in our country that was born to a drug addicted mother who couldn’t take care of him so the tax payers paid for his upbringing via the system. That is sad and unfortunate but does not excuse his biological mother and/or family from intervening and taking responsibility of him at any point in his childhood. As a result, like many other children in the system, he fell apart, had many issues, then used drugs and alcohol to solve his problems. Well to those uneducated liberals out there those unsolved childhood problems become unsolved adult problems and systemically become a police problem. The officers involved in this case went to work responded to this job and did what they each perceived to be just and right. It will forever be wrong and unjust to punish officers for doing their jobs. If an officer has no other chose but to use deadly force, and someone dies as a result, that officer did his/her job-PERIOD! Shame on any supervisor that EVER tells an officer to falsify a report to save his or her own ass-and then walks away without the balls to own up to such an abuse of his/her position of power.

Retired CPD—no officer should ever have to go through the crap this department currently shovels!

The fired officers now need to hire an attorney who specializes in labor law and unlawful termination. It will be a long and expensive journey. The depositions of the command chain to include Johnson should be interesting . I sure hope there is a fund for them .the logic that the department used to fire the sergeant is puzzling

The BEST sergeant that I ever worked for in 011 was Mike Mulligan and he always ended roll call simply by saying "back each other up." And to that point, the BEST dispatchers on Zone 10 were Stan and Nick who reaffirmed what you touched on about staying off the air. When the shit hit the fan and the "10-1" went out the first thing they ALWAYS said was "We know your going just go and STAY OFF THE AIR." Unfortunately though today with all the wonderful "technology" out there I think your fucked either way. Thoughts and prayers TO ALL wearing the "star" these days. Law Enforcement is DONE!! PLEASE don't kid yourselves! And to all who are out there; STAY SAFE!!

That’s how much resources are assigned there. Up north, on a 10-1, you’ll be waiting for help cause there’s only 4 beat cars working, and tact don’t take calls.

I tacked the whole case.
When the judge ruled the brass was not going to testify, I knew JVD was screwed , the fix was in. Well it was already in from months before , but that, you could really see the "pre-planning".Run all the way back to Rahm and them sitting on the vid.

Everything is on film now, be it dash cam, body cam, cell phone, or other video. Document it. Don't have a name, then state unknown. They refused, then their name is Refused.
This is what we are supposed to be doing. It's about time we do it.

Blue cards do nothing to lower crime. If you are curbing vehicles specifically for the purpose of issuing a blue card, You are Wrong!
ISR's should only be used to cover your ass. They are for when you thought you had the elements of a crime, but didn't. If you are stopping people, or pulling them out of cars, with the primary intention of doing an ISR, You are Wrong!

PCI's? What an insult to law enforcement everywhere, as if our positive interactions are so few they can actually be counted. Obviously, if you are asking dispatch for a PCI (unless you are sneaking in an extra lunch), You are Wrong!

Our job is not about number generating for bosses to look good at Comstat meetings. We need to do our job. We need to document what we see, what we deal with.

We are currently in contract negotiations with a mayor who believes police should have a pay cut (her words). Show her what we are dealing with. Document it. Do your job.

I'm the original poster, and my "stay off the air" as much as possible and, with the least said, when you must, was in essence, a reiteration of my stand on staying away from scenes to which you are not assigned. The fired coppers got jackpotted by their, on scene 'written words', five years after the incident. Words spoken on the radio can also come back to bite you in the ass.

I understand your north versus south 10-1 advice, but I spent the majority of my time on the job in the deuce during the 80's, so my understanding of north side policing policing conditions are very limited.
