Baltimore Case Evaporates

That autopsy report the DA wanted to keep quiet? And keep away from the officers' attorneys? No wonder - it just destroyed major elements of the prosecution:
  • Freddie Gray suffered a single "high-energy injury" to his neck and spine — most likely caused when the police van in which he was riding suddenly decelerated, according to a copy of the autopsy report obtained by The Baltimore Sun.The state medical examiner's office concluded that

    Gray's death could not be ruled an accident, and was instead a homicide, because officers failed to follow safety procedures "through acts of omission."

    Though Gray was loaded into the van on his belly, the medical examiner surmised that he may have gotten to his feet and was thrown into the wall during an abrupt change in direction. He was not belted in, but his wrists and ankles were shackled, putting him "at risk for an unsupported fall during acceleration or deceleration of the van."
What we would call First Degree Murder, Maryland calls "depraved heart" or something similar. That charge would appear shot to hell. The elements of what we would call Second Degree Murder also seem to be lacking. Negligent Homicide? It's a stretch.

So pretty much 61 buildings were burned, 350 businesses damaged, and 113 Officers injured over an accidental death in custody - possibly as little as braking to avoid a collision. And guess which officers were the transport officers? All for the bullshit "racist police" narrative.

That state's attorney should step down. She damaged a whole city by her blatant incompetence. Now she cannot be trusted because she definitely is NOT impartial or objective.

A question from a citizen....

I understand that it is BPD POLICY that all prisoners must be buckled in, but is it a LAW that all occupants of a vehicle must be strapped in??

The BPD can certainly punish the officers for violating BPD policy, but can the officers be charged with a crime if they are not required by law to strap all occupants in?

I'm thinking of the van as a winnebago. Occupants are free to walk around while on the highway, so what is the difference with Freddie Gray getting up and walking around?

This is what I have been saying all along. An officer can be aggressive as long as he follows the letter of the law and general orders. My partner and I work our butts off. Everyone calls us Da Working Poleece. Every single night we come in with at least two heads. Sometimes even a triple! Plus we come in with good arrests. Guns, dope, warrants, 501's, PSMV with heads in the car, etc. Not dopey DOPW, pissers, or a signed complaint arrest, etc. Guys you can be proactive and still cover your butt. Just do everything by the book.

An African-American man who was also under arrrest and being transported in the van along with Freddie Gray told investigators the van was not driven in an erratic manner, and that an agitated, enraged Gray was beating the back of his own head against the wall of the truck. This account was quickly dismissed by the Baltimore mayor, prosecutor and media as unimportant because it didnt fit the narrative of police brutality. This purposely ignored testimony will become a major factor in the defenses of the officers.

Freddie Gray, M/1,25 was arrested April 12 after running from officers patrolling the Public Housing development at the Gilmore Homes. Transport Officer William Porter M/1, and Transport Officer Caesar R. Goodson M/1, the driver of the van used to transport unseat belted in Freddie Gray on April 12. Not even looking the wagon is safe, anymore! I'm bidding for a desk assignment, wait is this an eight hour post, 8.5 hours, 10 hours?

Dam the truth and the possibility of an actual accident happening that was totally unintentional. The thought for them of charging a bunch of cops with murder was just to self serving. They had to push forward no matter what. It's sickening and has had a rippling effect in Baltimore and across police throughout the nation. Nobody wants to be the next "Baltimore 6" for just doing their job.

In Illinois even a violation of a department rule or policy that results in death is considered to be official misconduct. Cases like this have been successfully prosecuted.

Assuming this is a real post, which is debatable, I'll answer.
You can do every single thing by the book, by the laws, by the rules, and still find yourself on the wrong end of an investigation or a Federal lawsuit. I lived through mine, but my relationship suffered, my stress level went through the roof and my work was affected every time I second-guessed myself.

Work as hard as you want to. Fine. But do NOT be naïve about what can happen. Bad things CAN and DO happen to good people.

Any arrest incident can blow up in your face even if you are following the rules.
All of these recent anti-police incidents were cops just doing their job & trying to

I always used to say, that on any given midnight shift, anyone could end up doing the "Daumer".

When those cops in Milwaukee had the crazy acting naked asian come running up to them and then have a literate, calm, composed guy [Daumer] come up and explain that his buddy was just having a bad trip and that he would see to his safety, the cops had a sigh of relief and 19 Pauled it.

The citizens couldn't imagine how such a scenario could have exiisted and that no action by the police was taken.

Then again, the good citizens have no idea as to how common such a seemingly outrageous occurrence is during the hours of darkness in the ghetto. The bizarre is normal for us.

So, don't step on your Daumer!

I agree with the comments that this was an accident. And, possibly aided by negligence by the officers. I would think they will be fired, but prosecuted for homicide? I doubt when a change of venue occurs. If you say the type of wagon they are using it is a CPD throwback where they added seatbelts to the metal bench seats. Chicago had injury law suits 25 years ago and then changed their transport wagons. Seems like Baltimore did not want to spend the money. I would think that some of the blame when it comes to civil suit time will fall on the city .

There are some posts and poor photos showing Freddie Gray in custody of the officers who chased him down. Gray`s head is fully down on his shoulder and it appears that he has wet his pants. A commenter said the posture and wetting may be an indication of neck and spinal damage which occurred during the "take down". The thrashing around inside the "paddy wagon" may have been the result of final frantic efforts to get air into a damaged body.

The autopsy reports that I have seen make no mention of such a possibility.

Well, it was NEVER a murder case. Shame on her for charging. However, they did not secure him in the rear and he died. There has to be some accountability. What that is, I don't know. I also reject the idea his treatment was related to his race.

I am a firm believer in this theory. Do you really want to risk your ass for a Felony arrest. Do it right or just dont do it at all.

Baltimore is a screwy place anyway. But my gut tells me that the failure was not criminal intent by the officers (though there may be negligence) but rather outdated methods and systemic failure. Never liked the wagon. Better to load 'em up and get them away from the scene a.s.a.p. Too many times I've seen situations turn to shit because the asshole wasn't taken away immediately.

I was not condoning nor applauding their actions/non-actions in my post. The point was to try and give the citizens who read this blog, a perspective on what the police deal with every day that they coundn't imagine in their wildest dreams.

Engage in an enjoyable activity like going to a baseball game or attending a social gathering, even if you don't initially feel like it.
Avoid spending long periods of time alone.
Maintain a healthy, balanced diet.
Take care of yourself. Pamper yourself.
Break tasks up into small chunks spread out over time to make them more achievable.
Spend time with friends or family. Talk to a trusted person about what you're going through.
Postpone important decisions until you're feeling better. If you have to make an important decision, discuss it with others because feeling depressed can cloud your judgment.
Get professional help when needed.

Remember, no matter what you do when you're depressed, feeling better takes time. You may have to get weeks of depression treatment before starting to feel better, but trust the depression will lift over time. Please call EAP, reach out for help.

Been exhausted for years, myself.

1. You ain't got nothing to prove to nobody anymore. You are your own worst critic. This produces excellence. It can also drive you nuts. Don't run other people's dialogue in your head.

2. Uh....be sure to eat and drink enough, and then a little more. Sleep is fantastic.

3. Family and good friends will help float you through.

4. Get "counseling," outside viewpoint, as well.

5. You got a lot more strength going for you than you know right now. That is what got you where you are in the first place, right? 99% of people couldn't do it. Stand tall on that & stay strong.

6. If you are inclined to, pray. Talk s__t with God directly. "If you only had faith the size of a mustard seed..."

You WILL be OK, my friend.

7. Smile.

8. Laugh. "Male runnin down the alley. He wearin' a red shirt.

Criminal charges always seemed like a stretch here but why not wait for the wrongful death suit to take its course? Sounds like negligence, not criminal intent unless the prosecutor has evidence we don't know of.

But then did the lack of evidence stop anyone from rioting in Ferguson?

Call them. They're there for you not the department. Who cares what the department says about you. Please do it.

This^^^

We had a guy in our district who didn't call EAP and went another route. Not good.

EAP has resources to keep stuff on the down low, others you call may not have that luxury. Call EAP- they know the system and will work within it to help you.
