Daley Sued? Hahahahaha!

Shortshanks running as a reformer, pissing off the aldercreatures, alienating citizens, corporations, his own patronage army and now this?
  • Mayor Richard Daley was sued today by his top ethics officer who claims that the mayor wrongly suspended him.

Anthony Boswell, executive director of the mayor’s Office of Compliance, earlier this month was suspended for 30 days without pay after an inspector general’s investigation found that he had allegedly mishandled a student intern’s sexual harassment complaint. Daley said at the time he was following the inspector general’s recommendation by disciplining Boswell.[...]

Boswell also sued Inspector General Joseph Ferguson, claiming Ferguson had “blatantly exceeded” his authority in investigating Boswell, who heads an independent office.

When it rains, it pour, eh Dick?

Yea... anyone can sue anyone. But why doesn't the FOP sue over some of our fine officers wrongful placement into that behaviorial program. That is just wrong. Collect the dues and turn your head. We will never forget FOP. We are so fed up with other people suing over b.s. and yet this situation was an actual violation of civil rights. Just incredible how no one stepped up to the plate for the officers. We have had cell phone dealers, insurance agents, candy coated peanut salesmen come into the district stations hawking their wares, and not one attorney from FOP take the case. We just find that incredible. Everyone talks big about this officer Cozzi, but no one talked big about the officers wrongfully put into the behaviorial program. We think as officers, our own would stick up for us. On those calls where you faced that hidden corner...we were there. On those calls when the bad guy wanted to take you down...we were there. On those calls when we found the gun that the bad guy dropped and you couldn't find it..we were there. We are not being dramatic, just honest. All those tickets we bought for benefits, retirement parties, birthday parties, baby showers, etc., we attended. And for what? To stand alone? I guess so. Thanks a lot. It hurts more than you think.

Boswell has two years left to go on his contract. This could get interesting. I wonder if he and his lawyer are looking for a golden parachute at this juncture.

Former Sexual Harassment Officer Andra Gomberg was allegedly threatened with termination for refusing to fix a case. She was a 15 year City veteran and is now working for the Chicago Board of Education.

Federal Monitor Noelle Brennan filed some damning paperwork about Boswell in federal court. She alleged that Boswell was stonewalling her office and was not in substantial compliance with the Accord.

So you have the Mayor, Inspector General, Federal Monitor, Corporation Counsel, and former Sexual Harassment Officer alleging this guy is a dog. His first deputy who allegedly helped fix the Sexual Harassment case resigned abruptly rather than take the suspension.

My question is did Boswell report these hiring irregularities to Federal Monitor Noelle Brennan? He was hired to institute a fair hiring and promotion process free from political corruption.

This high end drama, with the prominent political players and compliance officials is better than the soaps on television.

To the post on ( Yea...anyone can sue anyone) What a great written comment. You got it straight. As a 20 year and some month veteran of this job, I emphasize with you. If you guys or gals can come up with something specific I will stand by your side. The FOP as far as I can tell are somewhat reluctant to help because IT DIDN'T HAPPEN TO THEM. I know at this writing of three guys that were placed in the program. ALL GOOD GUYS and not as soft as puppy sh*t as some a-holes have poked fun of the PROGRAM as we call it. If any kinds of studies our done, the PROGRAM is one of the things in the department that was actually damaging to the department. 20 years ago I took an office oath about not discrediting the department. The job HAS been good to me. I have made friends in a lot of the departments and made a good living. The department though made a humongous mistake. The guys were apologized to by the department ( I have seen the apology letters ) And here's a little secret. The bosses of the guys placed in the PROGRAM actually felt bad for their " working policemen ". Yes, ALL bosses aren't bad. And we know now that all the guys placed in the PROGRAM are now like cult heroes. Did those people placed in the program get CR numbers. Yes they did. Were those CR numbers warranted. No. No, they weren't. The guys were just doing their job. And for doing their job they got jammed and discredited and as funny as it sounds they were stripped naked before a doc and told they had no choice and HAD TO GIVE BLOOD AND URINE SAMPLES. Can you imagine doing that act to one of the mutts on the street. The media would blast you out of this world. The attorneys would be lined up around the corner seeking 20 million dollar lawsuits for their mutt client. But since the victim in this case is a cop. It don't mean squat. Hang in there guys, some of us haven't forgot. Shame on you FOP.

When you taske the retirement you receive the same health insurance as an active duty officer so your lifetime limit remains at 1.5 million which follows you into medicare and continues with the city supplemental insurance. Not a large limit as most insurance companies now offer at least 3 million. The 1.5 million with the city has been in effect for many years, am not sure how long, but hasn;t been increased in over 20 years

Well, all those well documented cases against Brown don't seem to have dimmed his star at all, wouldn't you say? Demoted for a time, exposed in an out-of-state newpaper as a man who misrepresented his credentials when applying for a west coast PD Chief's job, and a few short months later.....PROMOTED! I truly think Daley has lost it.

His kingdom is collapsing around him - by vitrue of his own ego.

He resents the police and fire departments because although we command a large chunk of the city budget, aside from controlling the appointment our mostly-less-than-stellar-brass, he's got no real control over the rank-and-file.

Our bosses can't make us take the day off on election day to electioneer at a polling place, we can't be forced to buy tickets to this benefit or that benefit, We don't have to "voluntarily" contribute to the crooked alderman's election campaign. We don't have to go door-to-door to protect our job.

We can stop writing tickets/ANOVs and stop making all but necessary arrests and there's absolutely nothing this jag can do about it!

Sometimes, despite the crap we take from above, you've gotta admit; you CAN still have fun on this job!

Dump Daley in 2011!

Vote out ALL incumbents!

Demand term limits for ALL elected positions!

Her attorney was Susan P. Malone.

Read one of her decisions (2005) yourself at
http://cases.justia.com/us-court-of-appeals/F3/422/611/569523/

I loved the line in the decision upon not getting promoted: "It is almost like learning that there is no Santa Clause [sic] anymore. . . ."

Yeah, that's it, no Santa Claus anymore. Can you believe a supervisor (Lt) of the Chicago Police Department actually said that in front of the Appellate Court?

She will max out in another year and slip off into retirement with her multiple 6 figure cash payouts and 75% of Captains pay. That ought to be about a $90,000 per year pension. Not bad, I would testify about Santa Claus too for that kind of retirement dough. Shit, I'd add the tooth dairy, the Easter Bunny and Crusader Rabbit! Make 'em pay!

The limit applies only to the PPO health coverage. If you are in a HMO, there is no limit. Something to consider as you get older. One catastrophic illness can wipe out that 1.5 mill easily.

Sexual harrassment is a serious crime.

Boswell is right...he is an Independent reporting directly to the Mayor. The Mayor can only fire him during his term by going through City Council. The city will act like it will fight this, then give him back the 30 days pay to avoid the trial. Good job Tony Boswell.

===============================

I wish the managers where I work at thought like you. Sexual Harassment is evil and sick. Thank you for letting me know that there are still some good people out there.

If anyone ever sexually harassed underlings on my watch, male or female, I'd come down on them like a ton of bricks.

Maybe Mayor Daley can't fire Boswell, but there is probably nothing in his contract about the location/condition of his office or other assorted perks.

The insiders at City Hall can be pretty imaginative when they want to be.

Thank you for the link to the case and the attorney's name. I won't criticize the Lt. too much for the Santa Clause metaphor. Going through the Federal Court system is a rough experience. I got tripped up during a deposition myself a few years back.

I thought that I was a tough woman until I tangled with the barracudas down in the Corporation Counsel's office. They were more brutal than the men.

Word is that lawsuit was filed because Corporation Counsel, Mara Georges, herself stonewalled settlement negotiations, so he could leave with his name intact. Big-swinging dick-lawyer from D.C. is representing Boswell pro bono, so the city is not going to be able to grind him out over legal fees. Word also is that his lawyer is salivating over taking Daley's deposition. In short, it's doubtful this is going to get swept under the rug and go away.

2/23/2010 03:37:00 PM
Anonymous Anonymous said...

I downloaded Boswell's lawsuit and his lawyer is listed as being from downtown Chicago and licensed to practice in IL. It was an adobe document, so I couldn't cut and paste the information.

Daley lowerd the gauntlet shortly after Shakman Monitor Noelle Brennan filed a critical report accusing Boswell of stonewalling her to the Federal Court. Daley wants to get out from under the Shakman Decree, probably to resume business as usual regarding hiring/promotions.

The action with Mara Georges happened in 2008 and the woman in question quit to go to the private sector. I think that Daley wants him out of town because he failed to get out from under court scrutiny and pissed off the Monitor in the process.

One thing is for certain, I don't believe for a nanosecond that they give a rip about the intern who was Sexually Harassed. This poor kid was being used as a pawn in a power struggle.
