Probation

Four years worth for defending himself:
  • A University Park grandfather placed on probation for gunning down a dog owner after the man’s puppy urinated on his prized lawn was “absolutely relieved” he won’t go to prison.

    But relatives of Joshua Funches, who was shot to death during the May 9 confrontation, were outraged that Charles Clements will not serve time behind bars.

We're just glad a 70-year-old veteran doesn't have to take a beating from a 23-year-old punk. In the end, this wasn't about a dog peeing on the lawn, but about a bully biting off more than he could comfortably chew.

This WAS NOT as the media has been selling it...

The man in question was an otherwise totally law abiding citizen who took pride in his well kept lawn. He is an enormous asset to that community and a role model for all. Some shithead was letting the dog piss on his lawn. The guy, being a Marine, was not intimidated and went out to tell the shithead to get the hell out of there. It escalated, the old man showed a gun, the thug decided to 'show his manhood' and started throwing punches. Being elderly, he shot in self defense. Period, end of story. This is no different than the old lady who was getting attacked by punk kids with bricks and shot in self defense.

This was not over a lawn. It was over the right of a homeowner to stand up for his property. Should the shithead feel 'dissed' and raise the stakes, that homeowner is permitted to defend himself in turn. We cannot continue to let these assholes run roughshod over our neighborhoods because we're too afraid to tell them to fuck off, for fear that they will take it to the next level. OK, take it to the next level, asshole. Some homeowners aren't afraid to dance. This guy wasn't.

Probation was too harsh. I'd have dismissed the charges all together. Still, accepting probation as a token sentence given the gravity of the outcome (which was entirely a result of the shitheads actions), society came out way ahead on this one. I'd pin a fucking medal on this guy.

That the DA saw the same facts we all did yet still felt compelled to charge this guy with Second Degree Murder was a travesty in itself. That twelve people actually convicted him is positively disgusting. Thankfully, the last safety valve of justice actually worked this time and the Judge used his discretion to do the right thing. Bless that judge. Let this burn in real good to all the LE out there. These are the same 12 people who will be trying YOUR case, if it ever comes down to it. Lets face it. Illinois is pro Shithead.

Anyone who has read this story should know that the altercation did not stem from the dog urinating on the lawn: it stemmed from the dead guy pushing and cursing an old man who asked said person to keep their dog off his lawn. If the dead guy had been polite about it and apologized, instead of insulting and pushing the homeowner, he would be alive today.

This is the the first case of justice properly administered in Illinois that I have head or read about in a long long time.

What did the punk say to the former marine? "Next time you pull a gun you better use it?"

OK, how did that smart ass comment and the punch in the face work out for you there Mr Funcheese?

When are the nit-wits around here going to realize that an old man is no match for a young thug under most circumstance? Oh, he was a Marine! He is an old man and a former Marine. I don't care if he's Attila the Hun, he's old and would have a hard time beating stupid in a fight. The law-abiding among us are not required to cower in fear and piss ourselves because a young monster is doing as he pleases. Old people are rightly afraid of young monsters and are entitled to defend themselves from what could be a crippling beating by using whatever tools they have available to defend themselves.

I don't know if everyone is a wear that this guy had received several awards for his lawn. And some thug came down with his dog to mess with this guy who never bothered anyone. When the old fella told the thug to go somewhere eles and reason with this thug, the thug used fowl language and punched the old guy. The thug got what he had coming when the. Old guy shot him. The thug was like a terrorist in the neighborhood. I am so happy that the judge seen it for what it is.

They were all crying about the poor young man that was murdered by the gun toting bad man..

I stopped and asked a supervisor for directions one night..He was friendly and professional.

As I understand the facts, the punk pushed, hit and cursed the old man. The old man feared for his safety, reasonably believing that death or great bodily harm was next, if he did not act. He shot his attacker in self defense, and should have been found not guilty.

Momma on front page of Tribune complaining about justice. The Tribune should address the issue of poor parenting instead. Raising thugs to push around elders, shame on her. Good to see some Judges don't compound bad jury decisions with undeserved punishment. That defendant deserves a medal and thanks from his neighbors for helping clean up the neighborhood.

All prosecutions are selective and often political. Last time I checked, it was a felony to batter a senior citizen. So why was he even prosecuted? The Old Marine is a credit to the Corps and his training. Now there is one less shithead on earth.

Don't correct the first poster for saying DA instead of ASA. We all know what the person meant and who they were referring to. After reading the post, its obvious that this individual is one of the few citizens who sees things like we do and now you just made a comment that could possibly change his mind about the way he/she sees the police.

When citizens post on here, they can use any language they want you moron and if they say 'DA', ASA, or whatever, they shouldn't have to worry about some jagoff giving them stern instructions.

If I was a citizen and you said that to me, I'd be pissed.

Funches was obviously a movie buff. The use of that over-used line "if you pull out a gun you better be ready to use it." Big mistake. Marines don't pull out guns unless they know there going to need them.
