Planting More Guns

That's the only explanation. The jury certainly ate it up (Channel 2 coverage):
  • Now, almost four years later, Ware's mother and her attorneys have won a wrongful death judgment from a federal civil jury. The City of Chicago has agreed to pay $5.25 million in damages.

    During the trial, before federal judge Joan Lefkow, attorneys for Ware's mother argued that the victim, who was shot six times from behind, was in fact, unarmed and that police placed the weapon in the car later.

    "People from all walks of life spent a week of their time listening to the evidence and concluded that this gun was planted,” said Jon Loevy, the Ware family’s attorney.
In-fucking-credible. In this day and age, planting a gun at a crime scene. People still believe this shit. Not only believe it, but are prepared to award damages based on it.

We'd sure like to see which city, county and state politicians this lawyer makes contributions to. $5.25 million based on a justified shooting. Channel 7 also has coverage.

what I'm wondering: a) what kind of job did the lawyers for the city do putting on their case?; b) what rulings, if any, were issued by the judge that may have limited the city's efforts to introduce evidence favorable to their case?; c) why didn't the judge eventually overrule the jury (i.e., take the case away from them); I mean, where was "the evidence" that a weapon was "planted"? What planet are these people living on?.....

I enjoy planting guns, that's how my summer is spent. When the weather gets nice, I spent hours carefully cultivating Guns in my garden and when they reach full maturity, I carefully harvest them. I then spend an afternoon in my basement canning them in Ball Jars to preserve them. I then distribute them to all my POLICE friends for future use as "DROP Guns" to plant on people.

You can tell which drop guns come from my garden by looking at the glass jars they are in. Mine all have lables that read, "Officers..In case of emergency, break glass and place in close proximity to the subject you wish to "put a case on"

Not too long ago, I was involved in a law suit where the planitiff was represented by Loevy and Loevy. During the conferences and depositions, I asked the Corporation Counsel, (who's name I won't mention) why the City settles so many police related cases. The corporation counsel told me that in the 15years that the particular attorney had been working for the city, a trend had been noticed. I was told that juries were much more anti police and less sympathetic to us, and more sympathetic to those that were suing us than in years past. What a sad commentary on the way that things are now, and explains why the Corporation Counsels office does some of the things that they do.

Guys and girls it has nothing to do with how the case is put on, this case was presented fine, the judge ruled that the city couldn't introduce evidence that the pos was involved in a shooting and vehicle pursuit the day before or why he was even a paraplegic- a gang shooting! had the jury heard that evidence they may have come to a different decision, if they agreed to 5 mil there will be no appeal. Alot of these cases settle early on when it becomes appearent thst the cost associated, i.e depositions, hiring experts etc, is more than what they offer and usually payout, the juries do believe the city and police less and less, count on more than 90% of all these cases to settle. Sad but true.

In your rush to impugn the integrity of Judge Lefkow, whose husband and mother were murdered by an unhappy litigant, the attorneys and the jury, you overlooked one very significant piece of evidence --- THERE WERE NO PRINTS ON THE GUN AND THE GUN APPEARED TO HAVE BEEN WIPED CLEAN!!!! Please tell me how you would have ruled in light of that evidence.

Please also tell me who had a greater motivation to lie or plant evidence at the time of the incident?

Also a settlement agreement waives any right to appeal. There will be no appeal of either the Judgment in the liability phase or the monetary settlement.

The city wanted to settle the Anthony Porter suit by giving him millions, but the private attorney ;who happen to be black, said hell no we can beat this and he did. Anthony Porter got what he deserved, ZERO. Judge Lefkow is a moron. You have to take some responsibility for your own safety. Like security doors, alarms,motion sensor lights etc. etc. Librals are sheep happily going to the slaughter house, unfortunately they like to take us with them. It seems as though it would be not so different from any other crime. With all the resources that go into investigating bank robberies, you'd think people would choose an easier path, but there's been a rash of those recently reported. The judge may appear to be master and commander on her chamber, and she really almost is, but she must craft her decision within the existing federal statutes and the law of evidence. The law of evidence, as given life within the Federal Rules of Evidence, is extremely complex. The issue here would be evidence of prior bad acts covered under F.R.E. 404(b). As much as you would like to enter evidence of prior bad acts to show propensity-that they did it before and they must have done it in this case-it simply is not legal. You can get the very same evidence in for the limited purpose of showing motive, plan, lack of mistake or to ipmeach the credibility of the witness. In this case the would be witness is dead so no impeachment. You just can't bring in evidence because it might helpt the police

It is actually much harder than you might think. Just for a moment imagine that you tried to do that right after a Shooting. As soon as the shot are fired half of the neighborhood is outside wondering what happened. A lot of them actually walk out with cameras and video recorders. Now with camera phones you have no idea who is watching you. I have been on the Police Dept for almost 20 yrs and I can honestly say that myself and those who I have worked with would not put our careers, house and freedom on line by planting evidence not to mention my family. In the case listed I was actually on the scene after the fact and The gun was there. The Offender was known to carry a gun, was involved in a shooting the day before and there were 911 calls that he was driving around with a gun and had fled in his car an hour before the shooting. Also he was a known gang banger and was paralyzed by another gang during a drive-by. I hope this helps. One thing I have learned over the years court has nothing to do with right or wrong, It is the better attorney. And it is much easier to be a defense attorney. We and the ASAs have to tell the truth. they do not, they just have to try and get their client off.

this attorney is extremely harmful to the police. have been deposed by his firm and it was not a pleasant experience. give him a jury in cook county and even a shooting that would easily make it htrough a roundtable might look questionable in court. with less than 10 yrs on this job i'm rapidly coming to the conclursion that defending a citizenry that would happily screw a p.o. in court just isn't worth it. go to your assignments , complete your reports; all the other stuff (surveillance, search warrants, vehicle pursuits, flying to hot jobs) just isn't worth it in a city that routinely screws those willing to sacrifice themselves for it.

I lost a UUW trial about 5 years ago. I had witnesses and had recovered 3 guns from the gangbanger. Anonymous phone call led me to him (on a public street) and his hidden guns under a hood of a broken down car. Eyewitnesses who saw him put the guns there came forward and gave statements to the ASA and testified in court. Jury found him not guilty and we were able to speak to the jury after the verdict. A nice little old lady told me that it was impossible for the shithead to have put the guns there because there were no prints on the gun. I explained that it is extremely difficult to get prints from a gun and she replied that she did not believe me because "They always recover prints on CSI". No bullshit, this happened. Then the judge informed the jury of his lenghty rap sheet for weapons violations and armed robberies and the juries mouths dropped. Oh yeah, they had already found him not guilty! Gotta love those bleeding heart liberals who watch too much tv.

I work the traffic car , in my west side district. I handle mostly traffic accident, dui, and when there is squad car chase, the aggravated fleeing eluding. I always caring in the trunk of my squad car a whole duffle bag full of guns. You never know when a drunk driver may become, violent and I may have shoot him, right in the middle of a busy intersection with hundreds of motorists with camera cell phones.

The problem is the "CSI effect". People watch these shows thinking that prints, DNA and other evidence can easily be collected and matched from a crime.

"Wiped clean"? This is just closing argument hyperbole to describe that a sucessful print could not be collected.

Be smart, use your own police skills, ask questions and don't accept what you read and hear when you know better.

Here's a CPD CSI lesson for all you coppers that are unaware of our forensic capacity. I hate hearing coppers that sound like the mopes and housewives sitting at home watching too much TV.

The recovery of "figerprints" is not an automatic just because you say so. Believe me when I tell you, they are:
1. Not that easy to find.
2. Not always clear enough/readable (smeared/smudged).
3. Not always recoverable (pourous/textured surfaces)

If you see dude inside the "steal," but catch him after he fled from the car, ***You MUST identify him as thee dude that was inside the steal*** There can be NO doubt in your voice! If you expect "fingerprints" to be found for you to "make the case" because you are NOT SURE, then you have already lost the case.

In UUW cases: The best areas on a gun to find "fingerprints" are the areas that are not handled as much (the slide & frame). Dude usually holds a handgun around the hand grips. All kinds of oils and sweat there but hand grips are usually textured, so prints cannot be recovered. ***Dude was stopped with gun on his person OR Gun was tossed, immediately recovered, and dude apprehended without losing sight of him***

Bonus points for voluntary admissions.

Point of lesson: You should NOT request forensic processing, "just because," especially if your paper and testimony is solid. "Fingerprints" won't always be there because you know dude was there.

Robberies, Agg batteries, CSA's, and Homicides are more serious crimes, so obviously, they get more attention. More on those later.

Hey small cock, just stay behind your desk and quake the next time someone comes in to ask for a traffic accident report. Then when you are done with that tell some more stories on how it used to be, not that you would know, but you know, you hear stories from those "outside coppers" and you like them, so when you get a civillian or PPO in earshot you like to tell them, but when you tell them you are the copper who did it. Sad thing is you stretch the truth even more because you don't know what else to do because anyone who will listen to you doesn't buy it from you anyway so you feel the need to lie some more. Let me tell you the real story of that day. I was one of the officers involved in the very beginning of what became Wares last day. Our team had received info that a named homicide offender was in a white car in an alley. As we went over there one tac car hit the alley and shortly after the car chase started. I was a passenger in a tac car that eventually became the lead chase car. This guy used a CANE to press the gas and brake peddles and drove the hell out of that car. Not to mention all the cars he hit during the chase. The chase was called off and then we heard the shots fired call a few minuts later. Dude drove right to his house and stopped in front. However, before he stopped he led a gang car on a short chase and threw a semi-auto pistol out of the car. That was the one Cline was talking about. Did I mention the car was stolen too? Also, the paramedics found a sack of rock in his pants after they pulled him out of his car. And yes there was a revolver in the car. Not outside. We were the third car on scene and he was slumped accross the front seat and the revolver was on the passenger floor. When the officer recovered the weapon he had to reach into the car from the rear passenger window to unlock the front door and open it. I was in court for two days last week and have been livid since I read what the scumbag lawyers said. Not to mention John Gormans eagerness to get evidence from scumbag Loevy to go after all the officers involved. The only justice from this whole thing was that piece of shit getting his before he was able to hurt the officers. The gun that he threw out, the car chase, the stolen car, and the crack could not be mentioned during testimony in the civil trial because Lefkow barred it. It was in the tank from the beginning. Not that I agree with it, but by settling, the City actually saved the officer who shot from having to pay punitive damages.

The judge may appear to be master and commander on her chamber, and she really almost is, but she must craft her decision within the existing federal statutes and the law of evidence. The law of evidence, as given life within the Federal Rules of Evidence, is extremely complex. The issue here would be evidence of prior bad acts covered under F.R.E. 404(b). As much as you would like to enter evidence of prior bad acts to show propensity-that they did it before and they must have done it in this case-it simply is not legal. You can get the very same evidence in for the limited purpose of showing motive, plan, lack of mistake or to ipmeach the credibility of the witness. In this case the would be witness is dead so no impeachment. You just can't bring in evidence because it might helpt the police

In a civil trial, character evidence is almost always inadmissible under Fed Rule 404. The evidence that the now dead thug had a gun in his possession is not character evidence. It is evidence of sh**head's motive, which is almost always admissible. The fact that the thug was wanted in a homicide is not character evidence, it is evidence of the "reasonablness" of the officer's response.

Why are corp counsel bad lawyers? City clout. Can't be fired for incompetence. Which is what is wrong with every single city dept. including the police.
