J-Fed Flees to Avoid Jail

(sarcasm, silliness and poetic license in interpreting these events)

Seeks to avoid a "Contempt of Court" charge:
  • Chicago Police Supt. Jody Weis has refused a federal judge’s order to release the names of officers who have at least five citizen complaints filed against them since 2000.

    U.S. Magistrate Judge Maria Valdez had given Weis until 4 p.m. Friday to do so.

    The list was being sought, along with a list of excessive-force complaints, by attorneys suing the city over an allegation that an officer falsely arrested and used excessive force against two children.

First off, all kidding aside, this is a good move. Anything that pisses off Flint Taylor, scumbag attorney extraordinaire, is a good move. Everyone knows this wasn't J-Fed's decision - it was Corp Counsel. The Cline regime refused to release the names also. Taylor, the plaintiff attorney, says the list would be under tight control for this case only and is only to be used for statistical purposes.

Bullshit. That list would be "accidentally" leaked within 10 days as part of some filing or brief or inter-office communication and blamed on some "intern" who didn't know any better and then, oh well, since the cat is out of the bag, we might as well make the whole thing public and some judge would "admonish" the law firm to put in place some safeguards so this never happens again.

Secondly, a large portion of this list is already the subject of an appeal in the Federal Courts, and obeying this Magistrate's order would be counter productive when an appeal is already ongoing for what is essentially the exact same list.

In any case, the claim that...
  • ...to hand over the list because it would, "compromise officers’ performance, threaten safety, reduce morale and improperly impugn many officers’ otherwise well-deserved good reputations.”
...is disingenuous at best. Handing over a list of unproven and unsubstantiated allegations that in many cases have no basis in reality would be morally abhorrent and quite possibly a violation of an Officer's Civil Rights. If an accused person is cleared in court or cleared by investigation, there is no way in hell a judge allows a single mention of his previous history under any circumstances in the future. It would be overly prejudicial to the supposition of "innocent until proven guilty." But should this list be released, every single time an Officer is called to testify in a criminal or civil case, attorneys will be throwing this in their face. And it will continue for the entirety of the Officer's career (Officer, isn't it true that in the early 2000's, you were named on a list of officers...)

Don't think it won't happen.

On a side note, there were a couple of comments appearing in yesterday's posting regarding this supposed "stand" by J-Fed.

* Just because J-Fed's name is on the refusal, it doesn't mean he directed it to be so. this was an issue for the Cline administration long before J-Fed;
* Don't go thanking J-Fed for his stand on behalf of all the blue shirts. you obviously have no clue as to the roles of previous players;
* To the asshat accusing us of not being fair, posting stuff that tears the Department apart and cowards for not posting this earlier, we state the following:

(#1) we don't post stuff that tears the Department apart - we post stuff that points out the ignorance, apathy and incompetence of the administration that tears the Department apart. Don't blame the messenger;

(#2) this site runs itself for 20+ hours a day. We post articles at midnight for the next day and don't even see the site until comment moderation time. If you want to volunteer to give up time with your family, boyfriend, inflatable woman, etc, jump right in junior. We have a life outside of the blog;

A few people at work today said, "Good move, Weis" and I reminded them that this has been going on since way before Weis and it was the policy and was decided way before Weis. He's just doing what he was told to do. No way would he make this kind of decision without the Hall telling him what to do.

Patting Wuss on the back for this and demanding everyone commend him is ridiculous. He's shown his true colors over and over again, going back to his repeated attempts to screw over the poor FBI whistleblower guy.

Don't be bought off by one press release, guys. He's just another 'man behind the curtain' with no substance and no heart.

Well i think this shows that at least J-Fed isn't just throwing us under the bus on this. He could just as easily handed over the list and then we would all be totally up in arms that he did that. I think this at least shows he's putting forth an effort on our behalf.
Most likely if it wasn't for the incident when he was brand new and got the CR# from riding on some call he would have no clue how easy people can just get a CR on you. Shit, i'm surprised that 90% of the dep't isn't on that list. If you've been on for over 5 years and make even a decent amount of arrests and stops you're bound to piss someone off and their retaliation is to get a bullshit CR on you. It's almost always not sustained, but non the less it counts toward your number of CR's.
I just can't imagine if this passes along with all the other stuff going on right now with the cpd why in the world guys are going out there and actually working besides answering calls and such.
THE PUBLIC, BOSSES, MEDIA, MAYOR DON'T HAVE OUR BACKS!
They will all throw you and your 200 honorables and 10 dept commendations under the bus in a heartbeat if you're caught doing anything at all you shouldn't.

5 CR#'s since 2000? Hell that's the majoriety of the department. In my nearly 12 yrs of service I have well over 1000 arrests and about 10 CR#'s that have never been sustained and several unfounded and exonerated, but to the public it would appear I was a bad cop and we know no one will explaine to the public what the findings mean. 5 CR#'s since 2000 is actually a low number. A CR# can be for any stupid thing not even citizen related. I know someone that just got a CR# because there was minor damage to a police vehicle that she did not notice. DUMB! If this happens it would truely kill what's left of the morale on the job. It is wrong in so many ways to print the names of cops making them appear bad when they are good cops. Now coppers would have to explaine to their family and friends how the system works and that their name being in the media means nothing. I guess it's better to do as little as possible!

All statistics can be manipulated to serve the purpose the reporter is trying to convey. SO this is nonsensical drivel by the attorney's, and I certainly hope someone in CORP Counsel filed a motion for a STAY ORDER pending the higher courts ruling on the matter.

And what is their intent, if they cannot conform their statistical reports with redacted names?? What kind of statistics do they really need for names to be mentioned.


There are too many variables in a "routine" day on the job, for any useful statistical formulations to be compiled.

It will be interesting to see how this plays out, and if Weis is truly going to stand behind his troops and serve contempt of court time.

Perhaps if he does, I might even vote for him as MAYOR!!!

Maybe the Mexican Govt can use J-Fed there. Hope he's job hunting while soaking up the sun...maybe Shortshanks can fax over a recommendation letter to the Mexican Prez. Weis can truthfully tell the Mexicans that NOW he knows what works and won't! Then we can work on getting a real LEADER here to get our own PD back on track. The whole last year was a total embarrassment, and it looks like we're going to look even worse by the end of this year (if THAT's possible!).

The city of Chicago has more attorneys per-resident than any other city in the US and we need income! Economy is going down hill and no body has any money for us to sue! There is only one reason why these bosses do not want the cr file to come out. Some of our great exempt members have numerous cr complaints and if this came out,this would show how certain exempt members get crap swept under the rug and it would be a mess.I.E. A former deputy chief,stripped to lt. for stalking his ex wife. How about our great deputy ms who had a sustained cr complaint for sexually harassing a female p.o. and actually cost the city money in a lawsuit. The point i am making is that do not think for a minute that jfed is doing this because he has our backs. He is doing this to protect these hypocrite bosses who have gotten away with crap that would of got a blue shirt fired.

If the department and the "union" would have had some forethought as to the consequences of retaining non substantiated CR#'s, the department and it's hard working officers would not currently be the subject of debate. The department will be forced to find "inside" jobs for many officers if this list is published. Because, as was noted in this article, every officer listed will now have all credibility questioned in court and will make those officers/department/city TARGETS for future civil suits.

---Does anyone know the background of the judges who are ordering the dissemination of this information? Were they former private defense attorneys? Public defense attorneys? What are their relationships; past, present, family, friends, with the civil law firms which will benefit from the dissemination of this information?

what I don't understand is, what does a list of names (of people with at least five complaints since 2000) have to do with a lawsuit against one guy? I think that the judge's decision is wrong, and G. Flint (long tome cop hater) is using his case to fish for other bait; another troubling aside...why, if state law requires a sworn affidavit for a complaint, and if no affidavit is obtained, does IAD require the investigating Sgt. to continue the case to identify the officers (if possible) and list their names on the summary sheet? The case (w/o affidavit) is classified as unfounded, but an officer(s) still gets tagged with a CR....unfair, morale buster, (fill in the blanks)...

This is NOT the same old list. That question is under appeal for an old lawsuit.

Flint wants a brand new updated list for his brand new lawsuit.

That other list is old news. That recorded beefs between 1999-2003. They want a list for 2004-2009. They are updating their records.

Congrats to J-Fed. At least he gave a public explaination as to why this release should be denied.

What the public does not know is that it is a very common tactic among defense lawyers to file false charges against the arresting officer so they can cut a deal in court. Before I retired, I was subject to at least 5 of these my last few years. Go easy on my client, and we will not treaten you family and home. This is something the public is never told.
Also, the city refuses to go after anyone who makes a false complaint against a police officer, and in this state, you can never get action against a lawyer.

As someone who is on the list there is no one to thank for not releasing it. This is a financial move plain and simple. Releasing this list would open the floodgates to more lawsuits against the police particularly against the people on the list. This is the citys only reason for keeping the list secret. Jody is doing what da mayor told him to do.

In the end, the federal courts will decide whether it gets released or not. Not the police superintendent.

He may or may not be hiding to avoid dealing with the issue. Or he might have just gone on a previously scheduled vacation.

It may be that while he is gone an underling will release them to the court. Thats the kind of weasel behavior I might expect from a fed.

does this include log numbers. i have several log numbers where i did not have to write or answer to any allegations and it never went past the sgt.. they were just started as log numbers but the affadavit was never signed and no actual cr number was generated.. is there a difference....and are log numbers kept in your file?.. do witness statements count? by the way....yes, im new so let the jokes begin... but anyone have any idea about this.

Just wanted to mention once again how it took the department a few hours to clear bartender B of all wrong doing when drugs and guns were found in a condo she owns and then the supt said she is not culpable in spite of the fact the city ordinance states she is culpable as the landlord.

Wrong they forgot to come clear and were called out on the air by 1520 on the 3rd watch. I have no idea who this stroke Sgt. is but he would not be backed up by me that is for sure.

The kicker is after he calls them out and tells them to meet him in 015 he has to get back on the air and cancel because his car broke down and wouldn't start.

What's even better than that is that the dispatcher asks if he would like a car to come sit withhim and he then declines. As if anyone would help you after that anyway. Sarge you a goof plain and simple.

You should really think about what you just did to yourself, if you need help cars may come but they make take the long way there. Getting your ass kicked on the scene is one thing but waiting a few minutes for someone to help you out can seem like an eternity.

GPS is not activated until you log unto PDT. When logging on, if you tab past the vehicle number the system will prompt you to insert it. This was not required in the past. This is now used to activate the pdt. Fuck 'em! do not log on until you are done with your errands and/or booty calls.

The situation with police, as opposed to say Postal Workers, is that they are PUBLIC servants and their work records and complaints against them are a matter of public record. Further, a Freedom of Information Act claim can be filed and the information can be obtained.

I am pretty pissed. Do a post on this SCC. Reference each district and how little resources, including manpower and cars are available. Simply said, if you don't have a car to drive, how the hell can you expect us to do our job, I don't care who the Superintendent is or who the Commander is. Fact is fact!

The Watch Commander would like us to push the guys to make more arrests, do more contact cards, stop the savages from killing each other while we do school absentees, midnight has to do curfews and while we are at it, be nice to the little old ladies we pass by on the street.

Sometimes we get a little fresh air with outside units coming in, so yes, we may slow down a little, but that is to keep us going once they leave since we get so little help. Weis took the Gang Teams that worked with the Tact guys and the beat guys in identifying crime and making arrests. If I had an hour, I would tell you about all the things we did last summer and when school started to curtail the violence between the shit heads. For the last 7 periods, we have been down 10 plus cars. The garages tell my guys the same thing, no pool cars and if we do get a car, it is not worth driving due to safety and smell issues. We have the manpower to man more than just a few Rapids and all of the Beat cars, but no cars to put police officers in. How do we do curfew missions, seat belt missions, put up 06 cars and mission cars within the district with no fucking cars for them to drive? We are held accountable for some shit we have no control over. How can we make arrests, do missions, do contact cards or whatever if we can't get a fucking car. It has been the absolute worst the past 2 months and now the Watch Commander is in our ass. Stand up for us and tell the truth the next time you are in one of those bullshit accountability meetings. Tell them how they set us up to fail, then act like a light bulb went off when they see crime going up each and every day.

Here's another thought that was brought to my attention from my gal pal with the legal/pro-cop background: Police officers are public servants that is correct; however, she points out that they are city employees and should have the same rights as other city employees so there is no "disparate treatment" (spelling?) and she points out that no list of park district employees' discipline records would ever be published or any list of Streets & San employees' discipline records so we (police) should expect the same level of employee privacy, despite being so called public servants. She also points out that if said list should be published, we could individually or collectively argue that we were treated differently than other city employees and were violated in a way (ways) that no other city employees have been.

Secondly, a large portion of this list is already the subject of an appeal in the Federal Courts, and obeying this Magistrate's order would be counter productive when an appeal is already ongoing for what is essentially the exact same list.

They are essentially the same list sorted under different parameters, that's all. Thanks for reading so astutely.

yeah AND??? How does a referral make him responsible for a federal indictment??? J-Fed is in total control of the dissemination of all CPD personnel information. The judge in this suit asked for it. He could have given it and nobody would say boo.

He didn't just refuse the list, he gave a public explanation that giving out the list would unfairly tarnish the reputations of police officers.

There are aldermen screaming for the list. The papers are screaming for the list. Flunky lawyers are screaming for the list. The mayor isn't saying anything about the list.

At least J-Fed publicly came out against this witchhunt.

Of all the things the media has done to bring down this department, this list is the worst. Imagine targeting officers simply because they continue to work hard in these rotten ghettos. Every single one of those names spend most of their time locking up animals on the south and west sides. And these guys are the ones the papers want to embarrass in front of their family and friends. It's a fucking disgrace.

Are you even from this planet? Or are you that ignorant? State's Attorneys, District Attorneys, US Attorneys ALL pick and choose what cases they are going to prosecute. And you have zero experience in any sort of law enforcement or legal forums if you don't know that.

The fact remains that this case didn't even pique the interest of the US Attorney until J-Fed brought it up, and the US Attorney put it to a Grand Jury which returned the lowest possible charge in existence.

The law is not applied equally. You want to bet this was a favor granted to a former "federal co-worker?" Don't bet your house on it.

They want 5 CR#'s since 2000? Hell that's the majoriety of the department. In my nearly 12 yrs of service I have well over 1000 arrests and about 10 CR#'s that have never been sustained and several unfounded and exonerated,

Would it be a violation of the officer's civil rights to release his name along with a bunch of other people even though he has not been charged convicted of nay crime,and in fact has been cleared of everything with out so much as conducting a small investigation into what would happen if the officer's personal information was leaked to the public or it's dire results.Can any Lawyer or other Legal expert help out with this info. please.I ask because you know what will happen,what someone has already posted the info. will accidently be leaked out and who cares if it belongs to a P.O.,they wil try and make sure the P.O. will not be able to seek Legal/monetary remedies through the courts because he/she is a public offical.
