Its great to see that three outstanding police men that were getting screwed by the system have come out on top. The sad part is they are one of many that are sitting in call back even though they are innocent. Hopefully they will get released from the POW camp soon. Good luck guys!!!

Good news indeed.

There certainly was no crime committed here.

One could argue why this happened from a variety of angles, but certainly not from a criminal point of view.

One could argue a variety of points about what, how and why this event happened, but certainly this event did not have any criminal intent.

Now, let's see if J-Fed will try do something asinine and make an example of them because he won't be happy with the results. If he does, it will show that the "J" in J-Fed stands for jagoff.

Wow! The courts did the right thing. Its amazing how a bar fight without real injuries became an aggravated battery. I have had people stabbed and the asa has turned it down. But if you are a CPD and you brush by somebody you better get your lawyer ready.

OT buddy of mine just did a alderman complaint in which he did a surveillance. He just was given a CR today saying that he made a false report in that the GPS for his vehicle was never at the location of the surveillance. GPS does work so watch out.

They just can't accept the fact that this was BULLSHIT to begin with, and was likely never anything more than an altercation in a bar. How it ever became aggravated battery is beyond me? Deputy U.S. Marshal John Ambrose was convicted today by a federal jury of leaking sensitive information about a cooperating mob witness.

Ambrose was found guilty of charges of theft and disclosure for leaking that mob turncoat Nicholas Calabrese was cooperating with law enforcement. He was acquitted on two counts that he lied to federal authorities.

so the criminal case went nowhere-- now how does the administrative case go forward-- it looks bad for these guys as the police board resonates what j-puss and kirby want-- the police board has been deep sixing guys since they were embarassed by the "cozzi" decision. it has nothing to do with being a professional and everything to do with a personality contest-- another big reason to do nothing-- how would you like to come home and tell your wife that you just got stripped and you may be losing your job soon.. bye bye house, possibly marriage, benefits, children's activities, pension.... it's ok , there are plenty of jobs out there where you can make 35 dollars an hour-- no problem-- when you get into that squad car, sit on your hands and you will see your pension-- you want to fuck with people, be prepared to lose everything for a city and entity who doesn't even know your name and could give two fucks about you.

The verdict is just in that there was more than reasonable doubt as to what happened here.

This is still not a "victory" for the image of the CPD. It would have been better if calmer heads had prevailed. I still have little idea of who is ultimately to blame for the stupidity that occurred that night. Probably enough blame to go around. Charging the officers with felonies was "silly, silly, silly".

I am glad Planey came out ok. He seemed to be the least culpable and the most likely to get screwed for waving off the on duty officers.

The only good thing that came from this is that sexy Phil Cline was forced out. The bad things are that JFED replaced him and Fat Phil is now treating the Police Memorial Fund as the financial equivalent of a visit to Old Country Buffet.

Malicious prosecution, ah yes, a classic case. As per usual, prosecuted because it was in the media. After 20 years in the Detetive Divison, I've truly had it with Cook County State's Attorneys. Just think of how many murders, aggravated batteries, etc. were REJECTED due to MUTUAL COMBATANTS. People lay dead from the fallout of gangbanger shootings, but Crook County ASA'S won't approve a case. But if a P.O. is accused, that case is approved and indicted before the detectives have completed the investigation.

Judge Gainer's always been a decent guy. They're not all bad, and he just proved it. Took a lot of balls to do what he did, knowing the liberals would kick his ass in the media over it. for everyone saying that jfed is going to throw this one to the feds...your wrong. everyone saying this obviously does not know how the feds operate. the feds only get involved if they know they have a 100% solid winnable case. the fact that this case was already found not guilty and that the witnesses and victims have been impeached in court on testimony, the feds wouldnt touch this. the only reason they went after cozzie is because j-fed brought it to him on a platter. cozzie was caught on tape but also pled guilty to the charge. these guys fought it and won... just like the sos thing, those guys case will never be picked up by the feds because one of the two alleged complaintants died of a heart attack and is out of the picture and the second has already contradicted himself over two dozen times in interviews, depositions and investigations by iad, ops, and the state... so with charges dropped and all the double talking neither of these will be picked up by the feds.... there is a reason the feds have a 95% conviction rate, they only go after the slam dunk cases they know they can win.... so relax guys, your gonna have to deal with the lawsuit and might have to pay a little but your still gonna have a job and didnt wind up in jail, take a few breaths boys and enjoy the rest of your career... you will be fine and good luck!

Many of you are talking out of both sides of your mouth and you know who you are. If you respond to this post then you are guilty of talking shit about the people involved in these two separate incidents and situations. Next time anyone says any shit about the next cop or cops in a situation think first before you say shit. At any given moment on this job our lives could change dramatically at any given second and we ourselves could find ourselves at call back or any desk job stripped of our police powers. It could happen to any of us and trust me it is not a good feeling. We all need to think first before we say anything about the next scandal to hit the newsstands. We need to always stick together and support one another because it could be you or me wrongly accused one day. For the first time tonight I saw some more of the video. (Fox News 9pm) It wasn't even much of a bar fight.
I noticed for the first time, a man surrounded by a couple of friends, sitting at a table, obviously crying. I saw a guy walk up to him with a pool cue and say something, and the seated guys friends end their game. Some pushing, some shoving.
You see a guy and his friends at a bar, its late, your drunk, their drunk, one is crying.

If you are stupid enough to mess with the guy, you get worse than you got that night.

I saw restraint. He deserved much worse for being stupid.

I seen at least a dozen bad bar fights, this was a shoving match.

i have never seen aggravated battery charges for a broken nose in or out of a bar. for those that don't know out there, you have to be shot for the offender to be charged with aggravated battery in cook county, and at the time you were shot you must have been sober, never been arrested, prepared to sit in a police station for 48 hours, etc...

Obviously, the verdict is good news. I believe that we should give a bit more credit to Judge Gainer though.
We have all seen the bar fights. Go into 018 on any weekend and see the civilians punching each other in the snot locker at all the drink-joints. The ASA will NEVER even 'consider' Felony charges of Aggravated Battery unless there is SEVERE and/or PERMANENT damage to the victim. However, if there's even a 'remote' chance that the near death individual may have threw the initial punch, even in self-defense to thwart off an attack, the ASA calls them 'mutual combatants' and tells them to go with Simple Battery.
Judge Gainer has seen that. He knew, after a complete review of the evidence that the ... ah-hem, "alleged victims" started the shit, and lost. That normally would have been the end of the story.
But when they found out that they were coppers,they got their slip n' fall attorney who figured that the bad publicity of the CPD lately would carry them through a criminal case, then... CHA-CHING!
Based upon past performance the city would settle out of court and the lawyer would get his 1/3 leaving the coke-head civilians with thousands of tax free dollars as well.
Judge Gainer saw through this charade and had the balls to acquit the three.
It's not over though. The city is incapable of defending these civil cases in court so they hire private law firms. The law firms charge so much $$ for their services that the City merely settles for an amount that's normally less than the private lawyer fees and dismisses the possibility of a large judgment since all civil ($$) suits vs. the city are 'jury trials' and we've seen how gullible they are.
I had a Corp. Counsel tell me that they were going to 'settle out of court' on a BS false arrest incident... even though the arrestee PLEAD GUILTY in court and stipulated to 'all' the facts in the arrest as true and accurate.
So... Bottom line, good luck to the 3 coppers and Thanks Judge Gainer for doing your job according to law, despite the public pressure and politics.

So a case based on lies, drug dealer testimony, circumstantial evidence, and a guy who had already been found not guilty in court. HMMMM. Verdict of admin. case: 3 year suspension! People have no problem letting murderers go free..

..but god forbid a cop in a mutual combat situation isnt found guilty of Agg Batt. Even thou if they were private citizens they wouldnt have been charged with anything ..worst case simple battery.

Child molesters get bail...no problem. A cop gets his RIGHT to a bail ...OH NO!!!

Right, but its going to be a lot harder on these plaintiffs to cash in. The lying plaintiffs in this case will settle for some token city cash and, more importantly, the officers won't lose a penny out of their own pockets.

It should be a lesson to all officers. DON'T MISS COURT. Even for misdemeanors. If you don't want to go to court, then don't make arrests.

Criminal trials/motions/PC hearings are a great way to pin down offenders, witnesses, etc... It makes it a lot harder for the criminal to bring all his friends to a PI attorney and concoct a BS story months down the line.

Even in misdemeanor PC hearings, many of these thugs plead guilty to time served just to get out of the courtroom, which can be a big hurdle to jump if they decide to sue later.

That's why it was so disappointing to see cops miss court for the SSI parade arrests.

The best way to protect yourself from getting sued is to make damn sure you are in court when that criminal case gets called.

OT buddy of mine just did a alderman complaint in which he did a surveillance. He just was given a CR today saying that he made a false report in that the GPS for his vehicle was never at the location of the surveillance. GPS does work so watch out.

I work at 26th and Cal and and have had my moments with judge Gainer. He is a fair no nonsense guy that has integrity. He will no doubt face negative feedback for his decision. As far as Paul Powers is concerned, he is still our brother in blue regardless of his time on the job. Stick together CPD.

The CPD brass and Mayor's Office are terrified.

They have refused to release arrest numbers for a comparison to the pre-JFed years. Why?

Felony arrests are down almost 50%, which means Cook Co. takes in less than 1/2 the number of arrestees for bond court that they did in 2006. Third chairs have been removed from criminal courtrooms. Murder trials are beginning in 1-2 years.

Meanwhile, Agg Batts with handguns are WAY over 2006 numbers and the mayor's office is terrified that dramatic increases in homicides in May and June will draw international attention, sinking the Olympic bid.

Street coppers have stopped getting guns and drugs. Detectives have stopped pressuring witnesses. Homicide clearances will drop to an all-time low this year.

J-Fed is sinking in low morale. The word is that they will do ANYTHING to boost activity.

Two years from now, the city will do ANYTHING it can to put coppers into jail for getting the activity that they asked for.

We won't be fooled again!

As a dedicated CPD employee for 27 years, I have a few questions and since I know the Superintendent reads this Blog, maybe he can take a moment to answer the top 10 questions I have read over and over again via SCC for us, the troops, not the media.

1. What happened with the case involving Mike Masters, your Chief of Staff, when he was questioned for more than 3 hours standing accused of interfering with an investigation?They brought up very valid points and questions didn't they?

2. What happened to the case where he is listed on the arrest report's narrative as an arresting officer for new years eve in 007? I have a copy and it clearly states Mike Masters Chief of Staff, Sgt. Hamilton etc.

3. What happened with the investigation into Asst. Supt. Cuello's property (condo in 008) where a search warrant was conducted, her daughter was home and that fact was never documented, assault weapons and major drugs were found? Were all guidelines followed by CPD and was a thorough follow-up investigation conducted by IAD, Problem Buildings, the City's Law Dept? What is the status of the CR#?

4. What is the status of the investigation of sensitive items being stolen from IAD, the 5th floor, right across from your office?

5. How is it that you keep creating specialized units and manning them with cars, supervisors and officers when NOT ONE of the high crime districts are at their manpower complement nor are they anywhere near where they should be in relationship to equipment?

6. You found money to put a GPS in cars with over 70,000 miles, and those same cars happen to run like crap, but no money for equipment? On that same note, why is it that the specialized units and the lower crime districts get equipment first? Why was 2211 A created? Last I checked, that is not where the homicides are in 022.

7. Why are all of the good pilot projects always conducted in 001, 018, 020 and 016?

8. Why was your Chief of Staff known to illegally carry an unregistered weapon in Chicago, allowed to have specialized training utilizing CPD resources and personnel, allowed to schedule himself for the power test and allowed to practice shooting on a CPD range and he is not a sworn member of this department nor any other police department?

9. Why was a CR# closed that was obtained by Commander Crump Hales in 003 against an insubordinate Sergeant, whereas your Chief of Detectives witnessed and did nothing? What happened to that CR#? Did D.S. Dugan and Chief Juan Rivera have it Administratively closed?

10. We would like to know your line of thinking......Why do you keep moving personnel around? Why is it that we have not had a solid year without major Exempt changes? Didn't you pick them in the first place? How can the Exempt do their job when they are constantly second guessed by you and your people, the non police? Who is your policy group and how were they selected? Why don't they do details? How are you leading by example? Don't your drivers all have take home cars, their own parking spaces and make overtime on a regular basis when the districts had to cut back on OT? How did you decide not to pursue Asst. Supt. Cuello, Mike Masters and Chief Byrne, but you saw fit to pursue Cozzi and all the other old cases that you have directed to have re-opened? Do you know your 3rd in Command's history? Does she have any street experience. She does have a lot of personal time with many staff members, but other than that, what else can you credit to her? I can regurgitate numbers, run stats and talk a good game. PPO Davidson also has more time on the street than your 3rd in Command has in her entire career!

Yeah, I recall. On-duty officers accused of excessive force against a MINORITY. Scenario is much different, to include the Gilfand brothers having lawsuits against other bars over barfights and arriving back at the Jefferson Tap 2 hours after this incident, threatening the owner. Much different.

Very well stated. However, I'm sure none of your questions will be answered or acted on. It's the old adage, "do as I say, not as I do." The lowest on the totem pole will get disciplined and the higher-ups who have caused any problems, infractions or discredits get swept under the rug and disappear. Indeed, it is up to dept. members to ask questions why this continuous to occur. This is smeared transparancy at best.

A recent lateral move on the Cmdr in IAD to another unit tells you that perhaps that Cmdr was doing her job and it was getting too uncomfortable for those on the 5th fl. None of these shennanigans will stop until Daley is out.

Kudos for Judge Gainer for doing his job and not letting the case be swayed by the media. It is refreshing to see a judge do the right thing and tell it like it is. It is also interesting that in his written decision he addresses the inconsistncies in the victim and witness statements. We should demand that this be addressed by the Corp Counsel when it comes to a civil trial, but I really don't expect that to happen. Congrats to Jeff Planey, I am so very happy for you. You and your family have been in my prayers during this long ordeal.
