Welcome to Our World

  • The Chicago Firefighters Union is expressing outrage that a man convicted of attacking two fire paramedics walked out of court this week with a virtual slap on the wrist.

    Jonathan Soto of Bartlett was charged with four counts of aggravated battery for the 2011 incident, but a Cook County judge convicted him on only a lesser misdemeanor charge.

    "My complaint is with the system that allows this to happen," said union president Tom Ryan. "We are going to make it our mission to make sure that if this happens again, that we are going to do anything in our power to make sure they are punished to fullest extent of the law."

Evidently, no one told them this was Cook County and the jagoff got 1 year supervision and 20 days of community service.

Hello, if you sign complaints you need to show up in court. I has a medic sign complaints on a shitbird and she never showed up to court. I saw her on the street short time later asked her why didn't she show up and she told whats the point.

Sorry the hose puller got hurt, however, this is nothing new in Chicago. We get battered, abused, and injured and NOTHING happens to the offender. I'd like to see CFD try to do something to prosecute to the fullest extent..because if it doesn't work for us, it sure as hell ain't gonna work for them.

every single gun case I've had over the last several years, resulted in a plea agreement for 18 months..all reckless discharge or uuws..its a joke, I dont even have to testify becuz of ASA's deals for a conviction...in each case i had,
dude was out in 9 months and involved in another crime...sorry I quit!

I wonder who was and what the A.S.A. presented to Judge Linn.

Is Judge Linn worried about the "Cop Vote"? Certainly not, our number are being depleted, cops don't vote and when they do the vote NO on judges anyway. So why should he do anything for the "Cop Vote"?

The "Firefighter Vote", here he may have awakened a sleeping giant. We haven't done anything since the Cathy Touhy/Judge Pasarella incident and when was that?

let me guess...he pled guilty of simple battery.
sad thing is, that's probably not allowed.
If he was charged with Agg battery PO/Fire, then they (states attorneys) probably let him plea out to the lesser charge. Problem is, simple battery is NOT a lesser included charge to Agg Bat P/O, or Fire.
They pull this shit all the time, but technically, it's not allowed.

Surprising. Judge Lynn usually takes a dim view of those who mess with first responders. I had a case in front of Lynn many years ago from an off duty ptj I was working. I wound up with three felons charged with resisting a police officer
Although it was only a misdemeanor charge, judge Lynn sentenced all 3 to pretty much the maximum, 11 months in County. How things have (apparently) changed.

Linn is a former ASA also, go figure. If was a PD or a bottom feeding defense lawyer, you could understand.....but he used to be on our side. Another Judge who figures getting beat up is part of the job.

Soto will fuck up again, hopefully out in DuPage, Kendall or Kane Counties and then he'll get his finally.

Years back, Chicago Police Officer Brenda Sexton was beaten to death with a baseball bat by her boyfriend and left to be discovered by her small children, battered beyond recognition, lying in her blood soaked bed. The coward then fled. He was spotted by Police in Wisconsin and ran off into the woods. During the search, a Milwaukee County Sheriff's helicopter went down, killing both Deputies. The coward pled guilty in front of Judge Linn and received 60 yrs. A couple of weeks after sentencing, Judge Linn called everyone back into court and announced that he had been thinking about it and decided he'd been too harsh. He then chopped ten years off of the sentence (allowing for the very real possibility the coward might get out some day). Brenda's family and the families of the two Wisconsin Deputies were devastated. After having achieved some sense of closure, all of the wounds were reopened and the families were forced to endure a display of compassion for the cowardly offender. Who did Judge Linn care about more, the victim's and their families, or the coward responsible for the deaths of three police officers?

sorry brothers, but this crap has been going on for years with us. Saw the news story the other night when the female paramedic told of her and her partner getting attacked in the ambulance and although its sad but where are the reporters when we as police get attacked, injured and faced with that and much more? We've been victims of crimes all the same but..... oh thats right we're all bad press for the the city. Thank God the paramedic and her partner were ok and it didn't turn into something worse but hey, if you're just feeling /noticing this because you're finally on the receiving end of being victimized, then put in a good word for us when you put up that fight because our voices fall on deaf ears

From a troll: As I citizen I have to wonder why Tom is so outraged? As SCC points out, this happens all the time when the cops are attacked by a jagoff like Soto. You know what Tom, if he assaulted me, Joe citizen the same thing would happen. If I am not correct, the charges are the charges at the time of the incident, they are pled down in a deal between the S/A and his counsel, puke like Soto takes the hit on a lesser charge and I read in the paper he is sentenced to time served, he gets time on the Sheriff's work crew (SWAP) or coummunity service. (Which is also funny because assholes like Soto do NOT serve the community, they are burdens on the community) Then in 6 months or so I read about him assaulting, beating up some woman or someone else. Am I wrong? I would like to know Sotos record, now that would add flavor to the story for sure. And since he is a jagoff, I know he has a record. Merry Christmas to all the first responders and be safe, always support each other.

What do you mean by "welcome to our world". Firefighters and paramedic have known this for a long time and experienced people fighting with them for a long time. Police officers have tools on their duty belt that serve as a deterrent while firefighters and paramedics don't have those tools.

It would be nice if they allowed us to carry a taser, pepper spray and a baton.

We can't afford to have these guys in jail so, the powers that be, tell these judges to let them go. Unbelievable! It's no better in family court where judges keep letting these deadbeat parents get their kids back! Most of these judges see things, every day that is worse than what's in front of them. They don't care. That is why I vote, every single time, No, to re-electing judges. Straight down the line, NO! These judges are never going to lose their jobs. It's probably more paperwork for them if they give jail time! Anyone assaulting a paramedic /FF or member of the CPD should have jail time. Next time I hope you fill the court room with blue and see if the judge lets the offender go then. I'm thinking not so much.

People talk about reforming the police department- hell what they really need to be talking about is judicial reform. We have a serious flaw in the whole system because it only holds officers accountable for their part. There is a major part on the judges and attorneys that is never held accountable- and they hold the most power in actually rendering punishment or freedom to those who are unlawful. There should be no arbitrary ruling for crimes against officers, firemen, teachers, or any public employee- the charges are automatically aggravated in those instances which makes it a felony. A judge should be mandated to follow strict sentencing guidelines on those cases, and if they fail to do so they should be subject to removal/suspension just as we are.

Same thing happened to me when I got into it with a drunk shoplifter who was not going quietly. Wound up with a nice injury and had to get shots afterward. Charged the ahole with resisting on top of the theft. When it came to court, the fkn retailer was a no-show, so that charge was dropped. Then the ahole SA wanted to reduce the resisting charge to disorderly or some lower bs charge, with an open court apology from the pos who would be mandated to complete rehab program. I refused. They called us before the judge and guess what- resisting charge was dropped and I got a bs apology and they got supervision. This whole city/county/state is a fkn joke and they give two sh*ts about you- take that to the bank.

Linn refuses to find anyone guilty of armed robbery with a firearm because he doesn't believe in the mandatory minimums. He'll only find them guilty of other dangerous weapon and they end up getting 4-5 years instead of 20.

Look at the the recent story in India where thousands are protesting the capture of the rape suspects. In Chicago, protesters would defend the offenders. At Juvenile court , you rarely see a resisting arrest or agg batt against a cop go forward . Almost always dropped by State .
Also, it seems like 90% of the cases are i-phone robberies which are always pled down to theft from person. Burglaries are always pled down to criminal trespass. Another change I've noticed over the years is no more theory of accountability. Many cases are being dropped against multiple offenders who were present for the crime.Years ago, if you were caught in a stolen car , or in a car with a gun, everyone was charged and prosecuted , now, thats' pretty rare.
Since a theft or a criminal trespass is so many detention points less then a robbery or a burglary, fewer and fewer delinquents end up being held on new arrests ,
All this has led to the climate of "ain't nothing going to happen".

It sickens me seeing what goes on everytime I'm in court. If the sheep of this county only knew. The police know the truth.

A man who yelled an expletive at former Chicago Mayor Richard M. Daley on his final day in office was sentenced Friday to three years in prison.
Janusz Kopycinski, 31, yelled "F*** the mayor!" and spat in the mayor's general direction as a crowd gathered outside City Hall as Daley left one last time as mayor on May 13, 2011, according to police, the Chicago Sun-Times reports.
Police officers proceeded to request identification, causing Kopycinski to run. Police made chase and one of the officers was grazed by a moving CTA bus during the pursuit.
The officer sustained minor, non-life-threatening abrasions in the grazing, but the injury was enough for charges against Kopycinski to be elevated from misdemeanor resisting arrest.
Kopycinski, who testified in court that he meant no harm to anyone, was found guilty in April of aggravated battery to a police officer and resisting arrest in the incident, NBC Chicago reports.
The man faced up to seven years in prison, charges further elevated in light of a 2007 arrest for battery to police where Kopycinski was found guilty but mentally ill.

This is exactly how the system works here in Cook County. I got Agg Battery to P.O. and the ASA had him plead guilty to a misdomeanor battery and a "large fine". As the ASA told me, this way he couldn't sue me and besides, Judge Howard never finds anyone guilty and I should consider myself lucky he took the deal.

From a citizen troller: Whoever thinks (12:22 6:28am) this would not happen in Du Page is not entirely correct. This happens here too. I read about people charged with assaulting suburban police here and quite often those charges are either pled down or in some cases dismissed (especially if no one got hurt) but the more serious charges stay. I guess the good news is they get slammed on the more serious charges and one thing is correct: Soto is a jag off and he will get locked up, probably in Du Page and he will do jail time. I would just love to know his criminal history because you can just tell he has one. I guess the answer to Tom being irritated is maybe the firemen and parmedics should start punching back aholes like Soto. Some of them guys are in pretty good shape and I do not think unfortunately for the police that if the FD punches someone up, people are going to be inflamed, no pun intended.

I have heard from more than one source who work in the courtroom everyday that the judge is told how many "spots" the jail has, i.e. how many prisoners the jail has room for. I am guessing that the judges use their sentencing powers based on this formula, deciding on God knows what criteria to send in only a chosen few that will not overload the jail. What a lovely ass-backward system, eh? I could not believe it when I heard this, but I suspect it is the truth.

So let me get this straight; an offender can punch you, beat you and he will walk out with misdemeanor or probation. But if you do the same you will be charged with a felony, convicted of a felony and you will lose your job. Keep up the aggressive police work. Chicago and Cook County appreciates it.

Had a POS armed rob 3 women at Sutherland Elem doing Market Day. He got caught, Judge Linn sentenced to 17 yrs.. Then had another hearing and reduced to 12 because no one from community was there to object. Course no one new about new hearing

Maybe between all those that serve, we can put together a list of all those political assholes on the bench, pass it around and everyone get together.

Kind of like a list of which judge is naughty or nice.....

Maybe as we vote to dismiss, the BS will stop. I think all firefighter and coippers in Crook county could nail a few....

At Juvenile court , you rarely see a resisting arrest or agg batt against a cop go forward . Almost always dropped by State .
Also, it seems like 90% of the cases are i-phone robberies which are always pled down to theft from person. Burglaries are always pled down to criminal trespass. Another change I've noticed over the years is no more theory of accountability. Many cases are being dropped against multiple offenders who were present for the crime.Years ago, if you were caught in a stolen car , or in a car with a gun, everyone was charged and prosecuted , now, thats' pretty rare.
Since a theft or a criminal trespass is so many detention points less then a robbery or a burglary, fewer and fewer delinquents end up being held on new arrests ,
All this has led to the climate of "ain't nothing going to happen".

I'd like to see CFD try to do something to prosecute to the fullest extent..because if it doesn't work for us, it sure as hell ain't gonna work for them.

I got a conviction for Agg Bat to PO on a shirtbird drunken animal. Nothing previous so probation but a conviction. Then I sued him and got 10k in my pocket and he paid my lawyer. Not bad considering. This after Ed Burke's Finance Committee refused to pay my medical bills, they said "there is no conclusive proof this occurred in the performance of your duty."

Agg Bat to PO, I was arresting officer, box 1, no one in box 2. I got a broken hand during the arrest and the fuckwad Burke says "no conclusive proof it occurred in the performance of my duty."

Slowing down and becoming what young hair gels think is an old timer dog ass doesn't happen over night. I still did my job, just not aggressively. I backed up my partners and answered calls, just after several incidents like that there was no go get 'em lock 'em up shit left in me.

After 20 years you learn what to go all out for and what to sit back on. To the youngsters it looks like being a dog ass, to me it looked like being careful.

All I know is the CPD and CFD have a lot of friends in the communities as well as their own friends and family. If you guys strongly come out against these assholes that get elected there will be a lot of respectful people following you. It's really important that we start forcing our will on these crooks. Maybe starting with MADIGAN/ Daley for governor. This shit has to stop. A lot of people will go as you guys go. Think about it. Get real LOUD.

You are 100% correct. After 16 years I've had too many bites off the rotten apple that is Chicago cook county. Time and time again they tell us we aren't very important to them. The slowing down isn't being a dog, but just a survival tactic. Now I'm just a lot more picky when choosing my battles.

Well hopefully now the FF Union will take the lead because we know the FOP and its members don't. Families have to BEG coppers to stop by courtrooms while the gang bangers fill entire courtrooms.

Gangbangers don't have 1 or 2 jobs, childcare duties, and they are most likely not pursuing a degree.

they didn't waste any time convicting abbatte of aggravated battery--- although she suffered no serious or debilitating injuries it did occur in a place of amusement which was the angle the asa used to hang cementhead--- the fire department should just lobby to get the back of an ambulance declared a place of amusement and they should have no problem getting convictions in the future....

Years back, Chicago Police Officer Brenda Sexton was beaten to death with a baseball bat by her boyfriend and left to be discovered by her small children, battered beyond recognition, lying in her blood soaked bed. The coward then fled. He was spotted by Police in Wisconsin and ran off into the woods. During the search, a Milwaukee County Sheriff's helicopter went down, killing both Deputies. The coward pled guilty in front of Judge Linn and received 60 yrs. A couple of weeks after sentencing, Judge Linn called everyone back into court and announced that he had been thinking about it and decided he'd been too harsh. He then chopped ten years off of the sentence (allowing for the very real possibility the coward might get out some day). Brenda's family and the families of the two Wisconsin Deputies were devastated. After having achieved some sense of closure, all of the wounds were reopened and the families were forced to endure a display of compassion for the cowardly offender. Who did Judge Linn care about more, the victim's and their families, or the coward responsible for the deaths of three police officers?

I remember the case well along with this interesting sidebar.
Annually, when our members attend the National Memorial in Washington DC (13-15 May)to "Honor All Our Fallen" there's a final ceremony at the Capitol Bldg.
When the names from Illinois are read the Chicago Police contingent fall in at attention and hold a salute until all the names are read from Illinois.
That particular year, we were reminded of the loss of our two brothers from Wisconsin in the helicopter crash helping us find the killer of one-of-our-own.
A boss, I believe Dan Dugan, coordinated the CPD contingent again to fall in during the reading of the names of the two Wisconsin Deputies and salute them as a final farewell and sign of respect.
The families and their Department were impressed and grateful of our display of respect and honor. It was a small gesture in return for their 'Ultimate Sacrifice.'
Rest in Peace all our brothers and sisters in law enforcement and fellow first responders, Rest in Peace.

I you do not put the offender in the hospital and all you do is cuff then felony will not be approved.

Now if you break his jaw or a couple of fingers the state eats that up.

Use full force not that half ass stuff you use not to get sued.

Once Again, No Justice

Ridiculous:

A former CTA bus driver was acquitted Tuesday on charges that he lied about being beaten up by an off-duty Chicago Police sergeant.

But although 43-year Ricardo Mendoza was cleared of disorderly conduct and obstruction of justice, Cook County Judge James Linn lambasted him and called him “selfish and greedy” for filing a federal lawsuit against the city.

“None of this needs to be in court,” Linn said, referencing Mendoza’s criminal case and apparently the $1 million he was seeking in his pending civil suit tied to the Sept. 12, 2009 incident.

The judge all but called the former CTA employee a liar, but his lawyers are proceeding apace with their lawsuit for "damages," even though no damages can be documented.
