This Again?

  • The ABC7 I-Team investigated allegations of Chicago police bartering with arrestees, allegedly letting them off the hook to get guns off the streets.

    Chicago police take an illegal gun off the streets about once an hour.

    South Sider Charles Stokes, 35, said he and a friend were known to police and, he believes, targeted by officers for the gun squeeze. The men said they were arrested by Chicago police and told if they could come up with guns no charges would be filed, and gave the I-Team video allegedly showing it happen.
We certainly hope that the picture being painted here has a plausible explanation. Those days are dead and gone. You want to make deals for guns, you're shortsighted and you're begging to be set up. While it might seem like a noble effort, cops are not authorized to overlook one violation of the law because something "better" might be out there. You have, for all intents and purposes, kidnapped someone off the streets and substantially restricted their movement, while operating under the color of law. That isn't anything to be involved in these days.

In short order, COPA will be looking for cops to hang, and if it isn't for a shooting, it'll be for procedural violations similar to what is being written by the media and some persons of doubtful character. Regardless of the outcome, it isn't a process you want to be anywhere near. Not today.

We deleted about five comments that claim that this is "good police work" and that "nothing stops you from using a criminal to further a separate investigation." No shit. But that isn't what's described in the article. Again, we certainly hope the media is making a mountain out of a molehill, but we've been here too long not to have heard about situations as the one being described. Yes, you're taught to investigate; yes, you can question a subject (post Miranda) about other crimes. What you cannot do is "make a deal" on the street or RWOC someone whom you have caught dirty for the initial crime. You are headed for disaster.

Reminds me of what I saw in 015 in the 90's. Tried to explain to the newer coppers that doing this was illegal and for the most part the advice of an old timer fell upon deaf ears. You don't catch some goof with drugs, then be dumb enough to bring him in the station cuffed and play lets make a deal and then let him walk out in front of everybody. Retired now and honestly I am amazed at the stupidity of some of these so called police officers. Could care less anymore if these guys go to jail but thanks all you new hard charging types because you've made it hard for those of us who fought the fight for over 30 years to even tell people we are retired CPD.

I once ran into a guy in 011 who said he could get us all kinds of shit for a little cash. Im talking full autos, hand grenades, Techs, all kindashit. Now reading this here you'd say that only a moron would believe a guy like this and of course I didnt but his presentation was so fucking smooth I could bet he's ripped off young coppers in 011 before with this act. That or talked his way out of getting pinched.

Never believe these assholes and never , ever trust them. They know how weak we are now and have nothing but contempt for us anyways so they arent above Lie'ing or jamming us up. Far from it. With that said, I don't see a problem with, and I doubt the vast majority of "non-criminal" citizens would have a problem with, officers offering to let them keep their vehicle (instead of an impound) in exchange for information on the whereabouts of an illegal firearm, or information used to obtain a search warrant on a stash house etc... Again, you'r'e still locking up the accused and charging him accordingly, but also using officer discretion (allowed by law) to not impound the vehicle.

The days of a quick UUW have been long gone for a couple years now.

There is no place for making deals for freedom on the street, in this day and age. It makes no difference how may stats for guns "surrendered" or "turned-in" some boss wants. If a boss presses you for that kind of activity and you are in a specialized unit, put in a PAR go back to Patrol and sleep well at night. If you are in Patrol (like a TACT Team) and bosses pressure you, ignore them. Ask to go back on a watch and answer calls.

There is only one way to make deals with bad guys, and that is done on an official basis with the States Attorney's or the U.S. Attorney's Office. If you're not in a position to present the facts for cooperation to either prosecutorial office, don't do anymore than your job calls for. You will end up going to jail.

With that said, I don't see a problem with, and I doubt the vast majority of "non-criminal" citizens would have a problem with, officers offering to let them keep their vehicle (instead of an impound) in exchange for information on the whereabouts of an illegal firearm, or information used to obtain a search warrant on a stash house etc... Again, you'r'e still locking up the accused and charging him accordingly, but also using officer discretion (allowed by law) to not impound the vehicle.

Discretion? Are you fucking soft? You are allowed discretion in a very limited number of traffic offenses where there might be a valid excuse for the transgression. An impound is a half-a-grand in fines, another $150+ in towing fees, plus the $10 bucks a day storage. Rahm isn't going to allow you that sort of "discretion" and the City Council didn't allow you that sort of "discretion" when they wrote the law.

This is a true story; my late partner and I were watching a corner known for selling stolen CTA bus transfers, this was more or less 25 years ago. We used binoculars and my partner says the guy isn't selling transfers. We arrested him for cocaine possession and he blurts out he cant go back to prison having just gotten out on a burglary sentence.
He offered to turn on a murder, not just any murder by the murder of a Federal Informant, more like an execution that took place inside the stairwell of a building outside of the public view.
The primary offender was a well known heroin/cocaine supplier to the BPSN/El Rukn gang.
We talked for quite a while about what to do with this guy as we had no way of verifying his story and had little faith in contacting OCD, Gangs, or the Area.
But we had the guy on possession and he wasn't walking out of the station to laugh or brag about bustn a lie to walk.
We told him to offer his story to the PD' in Br 25 and tell him to contact the Fed's. And he did, although he sat in CCJ while spilling his guts to the "G" it was all true. He turned over as a Fed witness and went into protection and testified leading to a conviction of the main man and his subordinates for Life in Fed' Pen, no parole as this was a punishable by death crime.
Our case against him went to trial and he came into the trial court escorted by US Marshall's and we testified just like he never cooperated, no deal was cut, he took time served.
We got our arrest, a conviction and the Fed's solved a major for them in addition to taking out the south of the border connection with a large seizure to boot.
No glory, no Honorable, no Commendation just satisfaction. Search Alexander "The Ghost" Cooper.
Flipping somebody should never be like a fish, catch and release, hold the catch in the system till he gives you something that's worth a conviction, not yours.

I remember the roll call when Sarge informed us in no uncertain terms, "That shit aint acceptable anymore". Stop It!

Hey genius, there is no "law" about towing a car for a criminal offense other than for DUI. It is a city ordinance that says tow cars. So an officer not towing a car and using discretion for anything other than a DUI is not a violation of the ILCS. Unless you want to show me where it says "you cannot turn the insured vehicle of an arrestee over to a valid passenger with the arrestees permission".
