10th Circuit Says "Be Fetal"

This decision is from earlier in the year, but here's a link to it.

As we read it, if an officer arrives at a situation where information was directly available (in this case, a CIT incident where the caller/wife had information directly applicable to the mental illness of her husband), then it is incumbent upon  officers to safely assess the situation, gather the information, then address the situation. Otherwise, you will be held liable if shit goes sideways.

The Department is calling it something along the lines of Time as a Tactic. We're calling it "Smart Policing in an Uncertain Environment."

Either that or "Avoiding the Ghetto Lottery Trick Bag."

Loss for words, I’d bet those judges would feel different if they were doing the job. Based off their ruling, if the person is “crazy” give them more space. How about we don’t respond, have call taker ask if anyone is close to him and if not the police aren’t going. Clueless.

Officers were never CIT trained in academy, an officer is not a psychologist. Mental calls should be handled by the fire department they have ambulances. A wagon is not meant for mental transports.

CIT training is the city’s way of saying you will be held responsible for anything that happens while you work. Make no mistake about it, it is not to help you but it’s sole purpose is to hold you accountable and the city is off the hook. Congratulations you are now all psychologists too along with being mental health specialists.

And your CIT trainers are PO’s that filled out a nojo. The city is hanging you out to dry.

And on top of that, the use of force that’s being taught is completely contradictory to the 10th District ruling. The ruling says basically you, as a police officer, can not escalate any situation which would lead to deadly force. That will allow the offender to defend himself with any use of force he or she deems necessary.

CAlls for service regarding “mentals” should only handled by tactical teams. They are better equipped to deal with the issue. The department could call them for example the 765M (M for mental) team. They could be given extra training in dealing with these sensitive issues and would act as a team to de-escalate the incident peacefully. Just a thought.

What a miscarriage of justice. He did everything right. Don’t know if the camera will help keep you from being charged but will aid in you acquittal. Appears they just wanted this guy charged and the went to the grand jury with that purpose in mind, dam the evidence

Then these people have problems with their kin, have 9-1-1 transfer the call to 3-1-1 and request sending in the County Hospital CIT Psych Ward to do the job they ignore or don't treat.

They’re telling police to go into the danger zone to sort out the callers dysfunction, assess, evaluate, draft a prelim plan, notify a supervisor, additional support, set a perimeter, and wait it out until....what?
Or just tell the nut to knock it off?

These people want police to do all the fight work, and we all know jail is not an option, even when the shit hits the fan with that violent combative jag, the onlooking, video cams all on, the complainant has a change of heart.
They always change their tune in civil ‘settlements’ court.

Fools rush in, but giving the feral nut a announcement means they gots time to barricade, hold/harm hostages, booby trap, load up, plan an ambush, set a fire or plan an escape (a good thing). Had one DD (just wanted him gone caller) barricaded, so he jumped out the 4th floor window, landed on grass, without missing a step, he hightailed back into the shadows. Easy 1-E.

These are not police creating these plan of actions, they’re social justice theorist twits.

If Chicago CookCo IL can ignore Federal laws and impede the enforcement by Federal agents, then the best we can expect is to not get overly involved...ever. Case report, advise warrant.
