Dumbest Comment Ever

Someone posted this stupidity:

  • You do not have a bid if you are a buy back.

This came up during our hiatus, and we regretted not being able to address it at the time.

The Department's contention was that when your day off was cancelled, you had neither a watch nor a day off group, so they could deploy you at will. We believe the FOP lost this in front of the arbitrator, a ninety-something year old Biden clone.

What the actual f#$%? 

  • if you don't have a Day Off Group on your actual days off, then what's the point of even scheduling days off?
  • if you don't have a Watch, whats the point of bidding for one every year? 
  • for that matter, what's the point of having scheduled Start Times if the City can just willy-nilly schedule you for Third Watch or Midnights whenever your non-existent days off come around?

Someone could be working what was their Friday on Third Watch and run up against a cancelled day off, and the City/Department could say, "You're working First Watch on your cancelled day off," meaning it was right back into a squad car for a back-to-back shift. Seventeen hours minimum

And that shift could be anywhere in the city.

You ALWAYS have a Day Off Group, a Watch and a Start Time. That's the point of seniority. Otherwise, the Contract is a joke and you are essentially a slave to the whims of the Department. 

There's a lawsuit in there somewhere. Unless the City wants to pay cops for every off-duty hour spent on-call, blowing up their chances to be with their kids, attend family functions and generally unwind from an increasingly stressful atmosphere, then we're sure a bunch of people would take the overnight approximate 40% raise.

Lawsuit would fail due to it being awarded by the arbitrator already.. that’s non binding. Judge would throw it out and refer it back to the arbitrator decision where he could reconsider it if he wants.. but even that is only after a certain amount of time.. these are the risks you run by going to arbitration. You win and the city can’t touch you.. you lose and there is nothing you can do to challenge it.. non binding decisions…

I had Deb Kirby pull that on me when I was coming off of my Furlough.My watch was 0600 to 1400 hours. With second longest seniority on the watch. But on my first day back to work they threw me on a detail starting at 1900 on New Year’s Eve working until 0200 on New Year’s Day. Took the assignment but while out on street we met up with plenty of special event units. Like Canine, Mounted and Marine. All were carried on sheets as working New Years day. So they all made the overtime. And I was carried working on December date.

When I recovered from the night standing in the cold I filed a grievance for the shift change without compensation. Kirby went nuts! She tried to talk to me on several occasions trying to settle the matter. But it went to mediation and I won. Won a full week of overtime. And then Kirby started to assign me for details all the time. This was answered with a grievance, she was not following seniority. I won that without mediation. Kirby never spoke to me again. I was really broken up about that…….

Isn't the rule 8 hours off between shifts. No matter how they change your schedule due to "emergency" Also you are not the desk bid, review officer, watch secretary or caps. OT officers will not work in administrative position on the OT day.

It is 9 hours minimum between shifts on your 2nd RDO cancelled and your regular worked scheduled day.

Absolutely nonsense. As A WOL I contacted the MLAS about this very question. All bid spots, repeat All bid spots, must be honored when RDO’s are cancelled. This was during the St George riots. O’Neil was the Director, back as civilian after retiring. You have a desk bid, you work the desk on your RDO. Question asked: what if multiple bidders from different watches are working at the same time? Answer: if you are a successful bidder you work the desk. Also told they must work the desk and can’t work on the street even if they wanted to. To work the street bidders must relinquish the bid spot. Now stop with this nonsense about bids not being honored, they are.
