A second category, which includes more serious offenses such as Resisting or Obstructing Arrest, Assault, Misdemeanor Aggravated Assault, Battery, Aggravated Battery to a Police Officer, Reckless Conduct, Mob Action, Obstructing Identification, are infringements to law among which Foxx’s office will not proceed with prosecution without evidence furnished from body-worn camera.

When I called the ASA’s office to inquire about my AGG BAT TO PO arrest I was told “if there’s no video there’s no case.” I explained this arrest took place during the riots and no BWC’s were issued. His theory was that how will we justify an arrest if we know the DA will most likely drop the charges. This was before all this new bullshit started. I know some arrests are avoidable, but the game is over. Let the city crumble.

—this is an option, in fact I have had this done in several cases. Especially when there are multiple offenders-get one to stipulate to the facts of the case and you can use it to impeach them on the stand if they testify for another or in the civil suit. Problem is the ASAs are too lazy to even do this.

Gather some evidence, take that evidence straight to a grande jury seeking specific arrest parameters for XYZ specific charges according to the warrant their True Bill VERDICT authorizes based on that evidence. If the evidence you collected only rises to the level of authorizing a search warrant rather than a arrest warrant, so be it. This is for a grande jury to decide (and then a judge to so order).

Spent 20 years in the Detective Division and NEVER once advised a P/O to put misdemeanor charges on an arrestee when the ASA rejected the felony. I doubt ANY detective has advised you to do so, and if it did occur, your W/C should have refused. That's what they get paid for. To make decisions that protect their officers.

She did a pretty decent job of a CDTP case in juvenile court. Unfortunately, it was a hung jury and the 14 year old walked, only to commit murder the following week. If only she had had the offender actually identified in open court, it might have gone the other way.
I'm from western PA, retired cop. Lived in the loop for 2 years loved it. Moved back now a rural chief (R). We'll hire yinz all. Good work,cheap housing, shitty winters.
