[Alleged excessive force vs. Cabrini Green Gang Banger] While there was never enough evidence to convict him, a jury, as you may well know, may not have been so professional in their opinion. The fucking guy falls asleep during OPS statements, and nods like a junkie in court! I just don't understand how he retains his profiable partnership with the Department!!! And yes, my comments are from personal experience, not hearsay!
At least the guy from the sgt's union, Kuzas (SP?) is a fucking great defense attorney. Slimy? Yes. No problems defending scum of the earth? Yep...but he has balls and he wins!

I would like to introduce Second City Cop (SCC) blog readers to my friend "TYRONE" (NOT his real first name).
Like me, Tyrone is a retired member of the Chicago Police Department. He is bright, black, personable and was an outstanding asset and credit to the CPD. He currently resides within a 100-mile radius of the Chicago Loop.
As a covert operative, Tyrone was the first member of the CPD to infiltrate the Illinois Chapter of the Black Panther Party (BPP).
I first met Tyrone through my then partner, also a brother, when we were assigned to the 11th District, 4001 W. Fillmore St. Later, my partner would join Tyrone in infiltrating Hampton's BPP.
Tyrone and I met last month. We remain in contact as recently as this evening. For obvious reasons and under no circumstances will I divulge the actual identity of Tyrone.
In a forthcoming thread by week's end, I will convey Tyrone's experiences as a "member" of the BPP. He was extracted from his assignment on the day before the December 4, 1969 pre-dawn raid on the BPP apartment at 2337 W. Monroe St.

When suing the City of Chicago, discuss the following legal concepts and remedies with your attorney.
"constructive discharge"
"front pay" as well as "back pay"
"punitive damages"
Roddy has won and lost. It may be time for retirement.
I recall a case where it was alleged from a valid source and then thru transcripts that current FOP steered the officer's wrong and it cost them their jobs. This is not the case mentioned above. I have seen officer's at the board who have lost their jobs as well.
As to Bella, he would not be at the police board unless he was a witness. Plea in my mind is reference to court. If Bella did advise prior to court he would be out of his league only an attorney should make such an adverse advisement. I have no knowlege of whether the prior statement on the blog is accurate or not.
The Police Board is the administrative hearing level for your job. You loose, no more job. Hard to win when you go to court after this level. Trust this IAD and the city will pull dirty games at the start and till the end. Your head count for IAD possible promotion for the investigator and a budget reduction for the city. 2 for 1.
At the board level the officer up for firing is present along with representing council, the city attorney or attorney's and hearing officer. Witness's are called in one at a time this includes the officer's character witness's. The accused officer can have one indivdual present to watch the show, more of an emotional support for the officer. At no time will you ever see the board, LOL. The production and that's just what it is, will be taped with video. Been around that block. The Police Board is suppose to watch the video and read the full transcripts, the hearing officer also asks question during hearing and has authority to act as an impartial balancing factor. To the reading of full transcripts by the full board much debate on that one.
Some feel they should seek their own attorney, this will come out of your own pocket. FOP is suppose to give you a choice, that does not always happen they do select at times. Choice of your own lawyer, an officer with no money coming in may be hard pressed to tally up the cash for a private attorney. Some of those that have gone through or are going through separation swear by going outside the box of FOP choices and do find attorney's that will set up a payment plan. Remember 30 days pending and Police Board means for the most part after 30 days you dont get a dime you loose benefits. Now you further your fight.

I think you're all missing the point on why the charges against Vander May were dismissed. Bryan is not a hero and likely will not get his job back. Yes, he was scapegoated, and a lot of other people were involved in this incident as well. Since he could be identified on tape, this City through him to the wolves. OTOH, the victim/offender couldn't or wouldn't identify him. Alas, no ID, no case, reasonable doubt w/o a confession. Incompetent states attorney, most likely both in bringing charges and in prosecuting same once brought. I've known quite a few coppers who claimed that they were "the Real Police". They usually had less than pleasant thoughts about their fellow officers who didn't agree with them. Many of them got fired. Most took serious time and some even went to prison.
The day of kicking the shit out of people is over!!! You do it now and you will pay the price!! There are quite a few Real Police officers working as engineers and plumbers now because they thought that kicking the shit out of people was still part of being the Real Police.
Being the police is about investigating crimes, identifying the offenders and putting him/her in jail. It does not include beating anybody or stealing from anybody.
Having said all of the above.....a Police Officer must be prepared to physically defend himself and others BUT he must know when to stop!!!

While it is great news that the PO beat the criminal charges, all of you seem to think that this automatically means he will be reinstated. This couldn't be further from the truth. Just because you beat a criminal case does not mean you keep your job. The Police Board can still fire you with ease and there is nothing you can do about it. You may appeal a Police Board decision, but only on the grounds of unfair prosecution, failure to admit evidence, or procedural fault. Your appeal IS NOT A RETRIAL of the facts of the case. Cops routinely beat criminal cases yet linger for months at 311, receive horrific punishments, or even get discharged. Any time a copper stays out of the joint, it is a good day, but his problems are still very real.
Did you know the Police Board can suspend you for any length of time and it has always been that way? Yes, the board can give you four years off if they want and there is nothing you can do (it has happened and this is completely different from Fat Phil now being able to suspend you for a year) Don't EVER listen to the FOP and their legal advice. I personally known coppers who have been jammed up seriously or fired as a direct result of FOP's advice. Greg Bella has no business giving police advice and in every matter I personally know of has been dead wrong.
If you have any type of heater case, do not solely rely on the FOP recommended guys, Roddy, Needham etc. Spend your money, put stuff in hock, rob a bank, but somehow at the very minimum get outside counsel. The first things both Roddy and Needham will want to know is how much clout you have and who it is. It is all backstage politics that you will never be a party to, nor informed about. The entire process is a revolving door and the city has to get so many bodies fired each year. It will take roughly six months to get your hearing over, maybe more, maybe less depending on the severity of your case and the heat involved. That is six months that you have zero benefits with the city and no salary. Also, the great irony is that although you are terminated from the Chicago Police Department techincially, you are still subject to all the rules and regulations of the City of Chicago. Don't for a minute there think you can lead a normal life. There is nothing legitimate about the Police Board, 30 days pending or the entire process.
From my personal experience, if you are fighting a case on your own and have misdmeanor charges that will go to trial, figure as a minimum around $20,000+, federal cases $50,000 plus. This is just the beginning of your losses, not to mention your loss of salary and paying your attorney to represent you at the Police Board. You are talking currently a minium retainer of $7,500+ from Roddy or Needham just to go to Police Board (if you are not covered by FOP).
Don't believe a word I said, that is fine, but it is on you. You could be stripped any day at any time for just about any bullshit allegation nowadays and find yourself lingering at 311 for years, until the axe falls and then your 30 pending becomes reality. If you have any doubt, ask any copper who did time down there, and trust me there are lots of great girls and guys down there on trumped up bullshit. Be careful and hire the most aggessive lawyer you can find if you ever have a criminal or Police Board case. Been there done that, trust me. Stay safe always.
PS To the 12:18 poster, your post was very infromative and sounds like you went through the wringer, my only point of contention is that you are technically not guaranteed any character witnesses before the Board. You may only call witnesses on your behalf who have some evidentiary or direct impact on the case. For example, if you are jammed up in a bar fight, you won't be able to get your tact Lt., Commander, Sergeant, etc down there to tell the board how stand up a guy you are, unless he or she was involved in the incident. Your positive accomplishmetns are read into rhe record at the beginning but that is all you will receive in that regard.
Nobody is suggesting that you can't fight back.....nobody is suggesting that a handcuffed person can't be an assailant....however if he is handcuffed and you knock him to the ground it's over just like in hockey....you cannot justify beating him once he is handcuffed and on the ground nor can you justify beating a person who has surrendered to you and is no longer attacking you. I know you may not like it but that's the way it is kids. If you don't like it, then go ahead and do it your daddy's way and get fired or worse....get locked up for it!!!

The police board takes up immense time, and when your pockets are emptied you have to hustle up chump change, just for fare in order to just show up for their numerous status calls. I watched the tape at the above link. You need to watch it a few times to follow the events. The first three kicks occur right when the offender goes to the ground. They look more like an effort to move his arm or leg out from underneath him. There is one good kick right before the offender is stood up. All this over that? You can't even see if it landed, there is no way you can tell who that is, and the offender said he wasn't beaten. I was skeptical of the whole thing until I watched the video. Talk about a political prosecution. Thank you Terry Hillard. I didn't think my opinion of you could sink any lower, but it has. I've only dealt with A.S.A.'a from the Public Corruption Unit a few times and they are very eager to prosecute the police. Fortunately I had a good CDR at the time who told them we weren't locking up the police on speculation. There is really is a different standard of probable cause at 26th Street for the police. You sir are a liar....Illegal aliens are not allowed to vote. Legal residents are not allowed to vote. Persons with proper visas are not allowed to vote. Only United States citizens are allowed to vote. Immigrants are signed up to vote at the federal building as soon as their swearing in ceremony is over. They probably have a higher percentage of people who go out and actually vote than people born right here in the USA.
The Democrats were simply ensuring that the people who were exercising their First Amendment Rights were also registered to vote thereby ensuring that the representatives were not wasting their efforts for a bunch of people who do not or cannot vote.
