Still Grau?

  • The police blotter: Rumor circulating among Chicago Police Department wags is Deputy Supt. Charles Williams has asked for packing boxes to be brought to his office. Hmmm. Does moving out mean moving up . . . to the top spot? Stay tuned.
First up, the last time someone was this obviously the "front runner," Daley did a 180 and picked Hillard over Ramsey, leading to all sorts of hurt feelings and resignations.

Second, since when has Daley ever done anything someone like Sneed says he will? Daley uses tame columnists like this constantly to deflect attention from various mini scandals constantly brewing.

Third, why would Williams need moving boxes? After the Superintendent is sworn in, he just has to walk out of the media room, grab the first 10 coppers he sees in the hallway, ask them if they like where they're working, then have them move everything across the hall to his new office. Trust us, when they name a new Superintendent, there are going to be a boatload of coppers lined up outside the room who will move all manner of file cabinets just because they want to.

If Williams is asking for moving boxes, hopefully, he's moving out.

Alderman Allen is also suggesting that the City of Chicago hire some very high priced lawyers to prosecute Jon Burge by tolling the statute of limitations.

You didn't mention the arrest of the four illegal aliens in the news over the last two days.

One was arrested at O'Hare Airport on his way to Mexico City after committing a homicide in 017.

Two arrested in Barrington Hills growing $4,000,000 worth of marijuana in the Cook County Forest Preserves.

One was driving a hazzardous material tanker in Indiana with no citizenship and no CDL or DL. The Indiana State Police RWOC. Incredible....

Just poor,oppressed,undocumented workers trying for a better life in AmeeriKa.

There are 55,000 registered Hispanic voters in Chicago -- about 13% of all registered to vote.

Not a big enough voting block to sustain multiple department heads, the Puerto Rican community/voting bloc is even smaller.

Unfortunately,I don't believe Hiram Grau is getting the nod.

As a white guy on the job, I wouldn't be offended by Grau being named Superintendent (though I don't know him, never met him, and never saw him in person). However, as a police officer on the job, I would be seriously offended by Williams getting the job (he has destroyed the patrol division, fucked up the Jefferson Tap incident so as to get Cline forced out, and we don't need that shit spreading throughout the rest of the department).

Ald. Anthony Beale (9th) opened the can of worms when he called the behavior of S.O.S. officers "another form of abuse of power. ... It happened 20 years ago and it's happening today."

Starks denied that complaints against S.O.S. officers were swept "under the rug," noting that many people file an initial complaint but fail to follow through.

But, he said, "We have to improve our supervision all the way down to the sergeant level to ensure compliance by our officers and let our officers know that they are being monitored, they are being watched, they are being held accountable and there's an expectation of professionalism."

The Chicago Sun-Times reported last week that more than 1,200 complaints have dogged 57 S.O.S. officers over the past five years, but only four of those complaints have led to discipline: a 15-day suspension and three reprimands.

Aldercreature Allen is a total moron. We, in his area, have been trying to get him out for years. He does nothing for us. He lets all these illegals 'expand' their homes to let so many famillies in them...up to 13 different families in one house. The East Euro's comiing in, remodel and then turn to section 8. He doesn't listen when complaints are registared. We have to call the city inspectors to try to help "cure" the problems. This has got to stop. The police can't do it all.

From what i can remeber when i heard this term back in college is that when the statute of limitations tolls, that means it has been legally suspended -- in other words, the clock stops running for a certain period of time -- and the five or however many years a state sets their limitations for a crime gets further away. hope this helps.

You, thats the answer! It was ONLY the front line supervisors fault. Don't mention the fact that the leaders at the top of this organization developed and sustained a culture in SOS where only heads counted. Get those guns any way that you can. Dope too. There was a supervisory deficit there, for sure, as evidenced by the hoodies, no badges nor nametags visible and all the other small signs that there was an endemic problem. But lets remember that the supervisors were giving the leaders what they wanted....heads and numbers. Quality did not count, only quantity. Dana and Phil stood up time after time and praised the work being done there. And I know that the great majority of officers and supervisors were trying to do the right thing. But now in the typical hypocritical manner of the leaders of an organization which is being dragged through the mud (see major league baseball and steroids) the leaders cry " hang em high", forgetting the way that they trumpeted the past numbers. Just like Daley going along with all of this investigating of Burge and the area 2 guys. Daley was elected Mayor based on the arrest, conviction and sentencing of all of the really bad guys who went to jail in those days, and he KNEW about the allegations of mistreatment which were leveled at that time. And remember I said allegations. Where was his sanctimony then, the back stabbing prick.

All of these fucks have to remember that they can't have it both ways.

Not an attorney, but as I understand it (and I may be a bit off, "tolling" means both parties agree to extend the time in which the case needs to be settled or prosecuted. Like that's gonna happen.

Does it really fucking matter who is the superintendent? Yes! If we had an outsider beholden to nobody then perhaps we'd get some fair promotional exams, assignments, etc. But the problem is that we are used to the bullshit clout babies running things. So I guess it really doesn't matter after all.

Like 12:14 said, the PDTS still wont work. The manpower will still be short. Retards will still be in positions of authority. Reverends will still hate the police (they will just do the brother handshake with the superintendent before calling press conferences).

Yes, we do have it. And it doesn't cost anything.
Look in FOP book under "EAP" (Employee Assistance Program) for the number (sorry, don't have it on me at the moment). It's now over at St Michael's House (Adams/Paulina), so at least there's easy parking. See if you can get an appt with Kathleen. I thought she was great. Best of luck to you.

If I may preface this comment by saying I am a Burge Supporter, but I also believe he did what needed to be done for the sake of making an arrest and clearing the case.

What everyone fails to realize is that there is no Statue of Limitations on Official Misconduct.

A statute of limitation "tolls" when there is an ongoing criminal act related to the original criminal incident. Thus, the offender can be charged for the original crime long after the statute of limitations would have lapsed.

Here's how it works. . . Offender committs a sexual assault of a young woman in 1978. Since it's a felony, the statute of limitations is three (3) years. So, if charges are not brought within this time frame, he is, depending on the age of the victim, in the clear after three years. Now, here is how tolling changes the game. Suppose this same offender rapes the same woman again in 1980, 1982, 1984, 1986, 1988, 1990, 1992, 1994, 1996, 1998, 2000, 2002, 2004 and 2006. When he is finally arrested in 2007, he can be charged with all the 15 separate crimes because it was ongoing and the statute tolled with each new crime.

That's how tolling works.

Research "Care a Lot" I believe it's on Central just north of Devon. Can't remember age wise but I've been really happy with their other location at Bryn Mawr/Milwaukee. What a great idea for some of our stay at home spouses, get licensed and become an "off hour" day care/preschool for coppers only. Since they are raising their own, the money taken in could reduce a part timer or two. Just a thought....

Statute of limitations in criminal cases

The Statute of Limitations requires that cases be initiated within a certain period. In Illinois, the statute of limitations for misdemeanors is 18 months and for most felonies, 3 years. Some crimes carry longer SOLs. For example, a few years ago the SOL for sexual abuse of a minor was extended to 10 years after the child turned 18. There is no SOL for murder.

Once you are charged, the SOL stops and speedy trial rights begin. There are certain statutory provisions that "tolls" the SOL, meaning that the time stops running, for whatever time that condition continues.

The only example of this that I can remember from law school is that the person was a fugitive or was continually out of state. Burge has been out of state, but his "crimes" occurred long enough before he left that this isn't an issue.

You can't retroactively change the SOL after the SOL had already run. When the SOL changed for child sex abuse, the courts prohibited charges where the SOL had already run before the law was changed (only applies to cases going forward).

For civil cases, the SOL is usually two years. You can extend the SOL under certain circumstances -- like you DISCOVERED the circumstances long after the wrong was committed. In child sex abuse cases, victims claimed that they had repressed the memories so they just "discovered" that they were injuried by the abuse when they started counseling, for example.

The other circumstance is when you engage in a "course of conduct." The IL Supreme Court ruled a couple of years ago that the SOL started to run on domestic violence at the time of the LAST incident. So if a person was abused for 10 years and they filed suit within 2 years of the last incident, all of the abuse was within the SOL.

That would have probably applied to Burge for 2 years after the last incident. Again, the incidents were known way back when. SOL has already run.

(The sexual abuse cases against the church are going forward because the victims are claiming fraud by the church tolled the SOL.)

I don't think that there is a way to legally get at Burge this late in the game, expensive lawyer or not.

Long answer, but clarity requires space. I think like a lawyer even at 4am.

Tolling requires that the Defendant has made himself "unavailable" for arrest and/or prosecution - he's in hiding, has fled the country, has gone underground by assuming an alias or otherwise hiding his identify and whereabout. Don't think any of these apply to Burge. And by the way, those who think they can take Burge's pension are just blowing smoke and trying to grab headlines. No such authority exists. . .

Of course lack of leadership is the problem at SOS. The city just gave frank radke the annual leadership award. He was in charge of special functions the entire time that the sos crew was robbing and stealing, before he retired. He was the patron to Finnigan and others in that crew.
Maybe we can bring him back for a high paid, post retirement job consulting for the department on leadership.

FYI, someone I know took their child out of there as it was discovered to have way too many kids there with less than ideal supervision for the kids...a perfect recipe for a horrible "accident" or "mistake" to be made at the expense of YOUR child (possibly).
