- Case #2 -Chicago Police Sgt. John Herman was sentenced Friday afternoon to 25 years in prison for raping a woman while on duty.
Cook County Judge Joseph Claps found Herman, 42, guilty of three counts of aggravated criminal sexual assault and one count each of kidnapping and official misconduct on Dec. 10.
So let's get this straight...if the disgraced Sergeant had killed the victim, he'd have only been entitled to 13 years? Talk about your sentencing discrepancies.
And again, heading off people who are going to misinterpret what we typed, we are not defending Herman. We don't think he was a rapist, but Herman is a pervert who should have been caught by screening before hiring and probably should have been fired for previous actions.

Sorry, but I feel no sympathy at all for Herman. He and his ilk have been allowed to continually embarrass this job for years. He'll probably receive a reduced sentence upon appeal, but I won't lose sleep over this man one way or the other. I can think of a certain Capt. in 011 working 2nd watch who should have probably caught the same deal many years ago. Fire them all, and if/when necessary, prosecute their shady asses as well. Those among our profession who cannot conduct themselves honorably or professionally off duty or on, this is your wake up call to leave now.

You wear a badge you set yourself to a higher standard. You fuck up, the penalties will be greater. On the other side, there are higher penalties -- on the books at least -- for harming a police officer. One shithead kills another no big deal. He gets 10 years. Kill a police officer; get the death penalty (hopefully).

What is the rational behind the common attitude, and results, concerning if an accused pleads guilty, ie., plea bargain, he/she gets the low end on sentencing, but if the accused goes to trial, 'forcing' the prosecution to prove the accused is guilty, then the high end on sentencing is imposed?
How is the guilt of an accused any worse, and deserving of more severe punishment, whether the accused admits guilt or is found to be guilty?
And why isn't it a clear violation of the essence of just punishment for there to be a difference in punishment severity, based solely on the accused compelling the accuser to prove the accusations at trial?
Seems like clear and obvious extortion is taking place here, with the prosecution being the extorter and the accused being the extorted.
And the presiding judge, of necessity, must be a part of the extortion.
How is this, by any stretch of the imagination, justice?

Wrong. The academy stopped training and now the priority is physical fitness. Classes are dropped to make time for exercise and BMI. Ethics, law, case reports are cut. Instead, they focus on running and weight lifting. Mayor ordered more exercise. Why hire recruits with college when fitness is the top priority? Half of the recruits have trouble understanding law and writing a narrative but they can lift and run.

My question is why this mantra is repeated every time society shoves it up a coppers ass for something they would get a slap on the wrist for. Take the fact that Herman was a Chicago Police Officer out of the equation and the Cook County State's Attorney's Office rejects this case over the phone! I agree here. In different circles john acted in a myriad of ways. He wouldn't use good sense in some areas but was generous and appropriate in others. He shit and then stepped in it. Give it a break already.
The idiot gangbanger took a plea. WE ALL KNOW how that works. Shaky witnesses, weak evidence, inexperienced ASA, increasing workloads, a good sales pitch by a defense attorney and a quick conviction for the ASA. Not unlike the dicks and their clearance rates. Look at the big picture. We all know the system doesn't treat each case equally for punishment. After reading the previous comments it leads me to beleave that most haven't spent much, if any, time in court. Stick to traffic...that is, if you aren't a lurker.
I am sure if this was a face to face talk instead of a public site many of us would be talking about some real skeletons out there that are bigger than these story. And, damn shame a good Marine died this way. That is the biggest tragedy out of both stories.
Herman was not offered any deal in which he would get no jail time. Whoever says he was is wrong. The state never offered to drop the sexual assault charge, never. This crack whore went into the 006th District and demanded $5,000 at the desk when she first made the allegation. She later brings up the $5,000 demand to a female detective. Three 006th district desk people and a detective testify that the "victim" asked for $5,000. You think a total of four people would lie under oath? Judge Clapps says the female detective lied, that don't make it true. That's his opinion. This "victim" is well known as a mental in the 006th District. She caused a disturbance in the Walgreens next to the station once and was stabbing herself with a knife in the store. A friend of mine is an investigator for the state at 26th and Cal. They had to put the "victim" up in a hotel for three days before the trial to try and get her sober. She still managed to get drunk, so they actually had her basically locked in her room the night before the she testified. Had an ivestigator at the hotel that night to mack sure she didn't get high or drunk.

The mayor micromanages the academy. For some unknown reason, he watches the academy very closely and will listen to recruits, not staff or ads. Every month, new rules. Even white shirts at 35th street try to manage academy. Training is a low priority. Look good and run. Some one else can complete a case report.
I am inclined toward the idea that those who are supposed to be enforcing the law have a higher duty to obey the law, and ought to have a higher penalty for disobeying it.
That is a separate issue from the unconscionably light penalty imposed for the murderer.
