Quick Hits

Covering a bunch of little stories.

First up, this has happened here. Now, elsewhere, too:
  • A Berwyn police dispatcher accused of sharing confidential police information with local drug dealers and selling criminal history information from a private police database was arrested last week, police officials said Friday.

    John Flynn, 29, of Berwyn, is charged with one count of official misconduct and one count of bribery, the Cook County state's attorney's office said.
Just a heads up for everyone applying over in Berwyn.

Then we have another political move by the state's attorney's office:
  • The Cook County state's attorney's office may reopen an investigation of an off-duty Chicago police officer accused of drunken driving in a Thanksgiving crash that killed two young Cicero men on the North Side, officials said Friday.
  • A Cook County judge last Friday dismissed the charges against the officer after witnesses testified at his hearing that they didn't believe he was drunk. The case's quick dismissal drew strong criticism from the victims' families, who with the support of several prominent lawmakers, have spent the last week urging the state's attorney's office to reconsider the decision. A lawyer for the victims' families said a Thursday afternoon meeting with Bob Milan, the top assistant to State's Atty. Richard Devine, indicated the case may be reopened.
Let's see - Milan lost in the primary, his boss is leaving, no matter who wins he's going to be fired and if he gets sued for malicious prosecution the Cook County taxpayers are on the hook for the judgment. We expect a Grand Jury indictment to be handed up before March.

And remember, Drew is still innocent:
  • After four years, three autopsies and an exhumation, the death in a bathtub of Drew Peterson's third wife, Kathleen Savio, was called murder on Thursday.

    "We have been investigating this as a murder since reopening the case," Will County State's Atty. James Glasgow said in a written statement announcing the new autopsy had determined her death was a homicide. "We now have a scientific basis to formally and publicly classify it as such."

    Peterson, 54, a former Bolingbrook police sergeant, has not been named a suspect in Savio's death.
Poor Drew. So much bad luck in his life.

The judge made the correct call in this case. The alleged victims were intoxicated,speeding,drove through a red light,have criminal histories and are member of an infamous street gang.

There is NO evidence that the police officer was intoxicated. Any administrative evidence CAN NOT be used in a criminal proceeding.

This is just another with hunt against a police officer.

I saw Stacy Peterson while riding the Trans-Siberian railroad from Vladivostok to Moscow last week.

She boarded the train at Irkutsk and got off at Novosibirsk. She was wearing a paisley babushka and was accompanied by a large, swarthy, middle-aged man who spoke Farsi.

I saw that goof COok County Commissioner Maldonado and the retired Cook County Judge, another Puerto Rican, on the news. Along with a Mexican State lawmaker.

Do you think they'd have their panties in a bunch if the two guys who died were white, black, asian, etc? And nowhere in the report does it mention the witnesses said the two dead guys casued the accident. I wonder their BAC level.

So Anita Alvarez needs them to get elected and Dick Devine wants to go out good. They are going to try to crucify this PO.

Good thing for his defense, once they go to the Grand Jury, a Cook County Judge already threw out the case for lack of evidence.

Tell me that this DUI case wasn't already discussed numerous times at the highest levels of the ASA's office.

This is all Alvarez. The entire office is gathering around her to save their jobs. Milan's people are out, and the new Alvarez clan is going to cover her ass for the general election against Perica.

This is a big battle over hispanic votes.

We can only hope a decent judge pitches this case right before the election in November.

it seems unfair to me to reopen a years old death case and then claim it was homicide without any new evidence, other then suspicion that he may have offed another wife (and no real evidence there, or none public).

I don't know this guy, and he seems like a bit of a scum bag, but everyone is entitled to fairness from the criminal justice system

True dat!!! The Legion of Doom knows full well that cars with FOP stuff are driven by Super Heroes. The Legion follows Super Heroes' cars all the time and will take out a Super Hero or his family if given half a chance. It's because we are crime fighting machines.

Exactly how does that help the defense? Do you think this would be the first time a case was presented to a grand jury after a prelim judge NPC'd it?

It's all just an intellectual debate because unless you are reading something else, so far only the PLAINTIFF/AMBO-CHASER is saying the case is being reopened. That guy still has to make JA and the City pay through the nose - he has to say that kind of stuff.

I wouldn't have voted for Allen no matter what. One of his relatives and a 38th Ward sponsee, both City supervisors, treated me poorly at work. I'm a female and remembered them on election day.

It came in during the probable cause hearing but the judge said the calculations of the state's expert was not scientific enough in his opinion. The state used the administrative results in court! Don't same they can't be used, they were used!

ASA Mike Smith the head of Gang Prosecutions has left the office to work for Tom Dart. He and Alvarez hate each other. Milan and Scott Cassidy, the chief of Special Prosecutions Bureau(Gangs, Narcotics, Cold Case), will also be leaving soon. Alvarez hates them and they hate her. Also hearing that Alvarez and Jim McKay are not the best of friends. McKay is now the head of Narcotics and a great prosecutor. He did the trial of Murray Blue who killed P/O Daniel Doffyn in 015.

But what if it involved & off duty CPD Sgt & a 20yo female who "allegedly" killed herself w/his gun?
Strangely this supervisor contaminated the scene by picking up his weapon? But not to worry swept under the rug by a whos who of CPD Brass @ the time. The Sgt is still working to make sure you get to your travel destinations.

Not exactly correct.

At a probable cause hearing, just like in a grand jury, the state can use evidence that would not be admitted at trial. The most commonly used inadmissible evidence is hearsay.

Just because the state brought this up in a PC hearing, does not mean it would be used at trial.

The bigger problem is the appeal the SA filed in another copper-DUI case where the SA argues that this back calculation nonsense on an admin test is admissible at trial.

That decision is still pending.

McKay might be a great prosecutor but he took ABSOLUTELY no interest in anything narcotics related. Any type of involved narcotics case ( long term, wires .etc.) he did not have a clue and could care less. He spent half the day upstairs at Homan working out.

So, where and when did this all begin, the ability of 'the state' to get an indictment using 'evidence' totally inadmissible at trial?

You'd think that this alone would result in an essential defect in the seeking of 'justice', as in the potential for indictments being brought against either essentially 'innocent' individuals or substantially 'innocent' individuals, depending upon the specific charges being brought relevant to the actual criminal acts being alleged.

How often is this tainted process used as leverage or as an act of intimidation?

How common is it for the representatives of 'the people' to be seeking not truth and justice, but merely 'victory'?

How often would those employed in law enforcement object to these practices, were it not that said practices were being applied against others employed in law enforcement?

And how often have those employed in law enforcement participated in these tainted processes?

What does all of this mean, relevant to not only getting a 'fair trial', but even getting treated fairly and honestly prior to being accused of committing a crime and/or being indicted for same?

what a fucking joke crook county is. If they really wanted to jam a copper they would of done it with Wesley Scott Cicero pd. I hear the ASA wanted to toss the case didnt want anything to do with it. So the message is if you are a white copper you are getting hammered. If you are a minority it might look bad for election time. Stay safe and get a tan.
