$1?

Nothing like using a sledgehammer to kill a gnat:
  • A 22-year veteran Chicago police officer was fired last month over charges he stole a $1 bag of trail mix from Walgreens.

    Aaron Pena was known as the "mayor of 26th Street" by residents in the Ogden District for his helpfulness in the community, according to testimony before the Chicago Police Board released Wednesday.

    City attorneys alleged that Pena went to the Walgreens in the 1900 block of West Cermak Road in August 2007, bought two bags of trail mix and then took a third from the store without paying. Pena was recorded on store security cameras.
And he had had a stroke in 2005? A stroke that affected his memory? And Walgreens had refused to prosecute, partly for this reason?

Sorry, but after reading certain cases that have gone before the Police Board, seeing certain perverts, drunks, molesters, and clout jockeys do far worse and get promoted on top of it, this is just confirmation of a system gone nuts. Just off the top of our heads, here's a partial list of people still collecting paychecks:
  • Sgt with a lengthy history of sexual harassment beefs who took numerous photos of unwilling female subjects on traffic stops, might make lieutenant shortly. Mommy was a deputy don't you know;
  • PO evicted from a house and two Department Motorola radios worth more than a few thousand dollars apiece are located inside;
  • PO who had his Department vehicle stolen, went home without reporting it, blamed the next watch for losing the car while two jagoffs were out doing traffic stops on citizens;
  • And does anyone downtown really want us to bring up a number of bosses who have cost the City thousands for various beefs?
And this guy gets canned for a buck? Was he even given the option of retiring for twenty-two years and a stroke?

UPDATE: A few more instances of people who shouldn't be collecting a check because they cost the City more than a dollar:
  • The stalking, domesticating ADS, demoted to Lieutenant, after running a civilian's plate and stalking her at home, fired and re-hired after misdemeanor conviction - largish payout;
  • the out-of-state LT (Michigan?) arrested, plea deal, rehab - daddy was a big boss - again, civil suit
  • Did the PO doing the armed robbery of Starbucks get fired?
And to the commenter who says, "stealing is stealing," no shit. And Theft still requires something called "intent." And something else called "prosecution." And another thing called a "conviction." None of which provably existed.

UPDATE: We're looking for people who cost the City more than a dollar or put the City on the hook for big dollars. While we're all familiar with persons who ought to be in jail for various offenses, we aren't talking about them now. Hence, a number of comments off subject will be deleted for the time being.

Don't forget a certain lieutenant from 018 arrested out of state and charged with a felony sex crime (see the ch. 5 news archive). Later allowed to plea to a non-violent misdemeanor, took a few months on the medical for alcohol rehab, and then right back to the good times. Oh, almost forgot, his old man was an ADS.

as a recruit.Always wanted to be a cop,would go out of his way to help you out,wether he was on or off duty.Sorry to see it end like this Amigo,you were always one of the good guys that covered our backs.Thank God I have less than a month on this job.

Hey SCC, you made great points except you left out the names of these assholes and didn't even mention the circumstances involving the bosses. What gives? I know you probably won't post this but seriously, you make an excellent argument so why not let the cat out of the bag and at least give the initials, unit of assignment and in the cases involving the bosses at least the general facts of what happened. The rest of our guys and the public should be made aware of this stuff every time a case like this comes up. Let me help ya out starting with a commander whose name sounds like FIGG but uses the letter T who tested positive not once but TWICE for drugs. Once for weed and again for cocaine. But I guess he did have reasonable excuses such as my girl sprinkled some cocaine on her vagina and didn't tell me before oral sex... and mY daughter made some brownies with marijuana and left em in the fridge with out telling me. This guy didn't even serve ONE DAY suspension... NOT ONE!!! But I guess having a stroke can't compare to those stellar excuses.

LET PEOPLE KNOW JUST WHAT A JOKE THIS DEPARTMENT HAS BECOME!!!

Chalkie visited 008 today.

A wake was taking place for a Latin Saint from the 9th district that was shot and killed by a Latin King earlier in the week.
While a saint gangbanger was in the parking lot of the funeral home heading in to pay his respects to his fallen homie, he got shot and killed. Guess the even the weather can't help out J-Fed's murder stats. And didn't there used to be some unwritten code even amongst piece of shit gangbangers that this kind of stuff was off limits. Getting pretty brutal out there.

keep that morale tumblin right down hill. I still consider myself a "worker" and usually get pretty upset at the bitter guys on this job but, im not so sure how much longer this working non sense is going to last with this regime in charge. this guys was actually well liked and respected by the public and gave the chicago police a good name... he wasnt a guy that brought discredit to the department... he had citizens show up and testify on his behalf on how great of an officer he was... great ruling j-fed. i know it was "all the police board" making the decision but you and your little tool bag mayor can go f' yourselves... there is a report of one homicide in 008 tonight and another shot in 008 who is not looking too good. i dont wish death on these men even though they were gangbangers, but every person who has died since you took over.... thier blood is on your hands j-fed and mr. mayor. your b.s has caused this entire mess. im done!!!!

In August, CAPS deputy director Beth Ford, was suspended for a month for failing to report that she had wrecked a city car, which she had been driving for more than a year despite not having a valid driver's license for three years. Ford is also a civilian city employee.

I have heard from several people that this recently fired PO has had a problem with "sticky fingers" for some time, and not only at Walgreens in the Little Village area. Yes, there are other people still currently raking in paychecks at much higher rates of pay than he was who should be fired as well, but don't paint this guy as a saint.

I'm not afraid to say who the Sgt is that SCC is talking about. The Sgt's last name is Breimon (not sure if spelling is correct). His mommy's last name is something like Peska (I don't know how to spell it). The deputy who is credited with creating CAPS.

I'm not going to call him a rapist. That is not what he did. He is a stalker and loves to sexaully harass citizens and flirt way to much with female's on the job. What this goof did do was basically kidnap (we could go with unlwaful detention or restraint, I'm being nice) a citizen and under color of authority make her take her clothes off while he took pictures of her on his digital camera.

He denied the whole incident and in his report and had himself logging a few cars on a man with a gun call on the other side of the dist. A camera on the building where the woman said the Sgt took her showed otherwise. His car along with hers drove right past it. Amazingly the charges were dropped, she got paid, and the SGT won his hearing recently and kept his job. Even if you say he was having an affair with this woman and the incident is blown out of porportion he completely lied on a report. Sounds like a rule violation to me.

The good Sgt is smart and did well on the Lts test. I think if the Sgt was smart he would pass on the promotion. The media covered this story heavily back when it happened. I don't think J-Fraud would be to happy with this one on the news.


Now onto the stealing is stealing comment. Nobody on this job has worked 8.5 for 8 every day of their career, nobody!!!!! That is stealing and its worth a hell of alot more than a dollar. Those without sin shall cast the first stone. We are all sinners so shut the fuck up!!!

The problem is what SCC said. The disparity in punishment for infractions.

I don't personally know this officer, and can't condone his actions. I understand the stroke defense, however, this same condition should preclude him from duty status on the department. If his defense was occasional memory loss due to a stroke, the department should accept it on condition that he retires, or find him an inside job on limited duty status----the department surely has done it for others. If this was offered and not accepted, maybe FOP should consider retaining different council.
As for all the comments on all the bosses-----those are just the tip of the titanic sinking iceberg!!!!

That Sgt charged with a sex crime, son of former deputy Jan P. is now back to work in another district, he had been in 019. Someone got to the victim/witness with a bag of greenbacks no doubt. She declined to come to court and it all went away.

What else is there to this trail mix story? The Sgt. beat the criminal case but the department still had plenty of evidence to fire him, yet they did not.

Let's see, Sgt. sexually harassing a citizen on a traffic stop late at night, alone vs. PO who stroked out and later taking a dollar bag of trail mix.

Sgt is working, PO is fired.

Sgt.'s mother is former high ranking ADS Jan P. (and probably is still working in a high place for city, she was director of security at Navy Pier after retiring from CPD)

PO's mother is not.

That seems simple enough.

A simple case of Chicago "how ya' doin" clout at work. The PO wasn't smart enough to have a different mother, that's all.

I once was at the hardware store and found the pieces I needed to do the job put them in my pocket and walked out the door without paying because I was thinking about the project I was doing. After getting to my car I realized that I didn't pay the $2.00 and went back in and payed. People can be absent minded sometimes, especially after a stroke or when you're old.

Is it correct that this guy was warned before? If so, this is the type of behavior that makes us all look like shit. He may not deserve to be fired but he sure was dumb. Big corporations are never gonna let you just walk in and take something. Even at these small stores at least attempt to shove a buck at the cashier. If there is a camera in the store it at least shows that you attempted to pay, don't let these store clerks own you for a bottle of water. Reminds me of the Sergeant in 008 (now a lt.) who ignored the the request of the owner of the store on 63/Kedzie to quit taking cigars. Think his ass was saved by another sergeant.

If you look at the monthly meeting minutes posted on the Chicago Police Board's web page, you'll see they went from reinstating about 80% of police officers a few years ago to firing 80% of the officers that are pending separation!

Pretty scary stuff.

The word at Corp. Counsel's office downtown is that Daley wants the Police Board to seperate all officers eligible for separtion. Period.

You guys aren't going to see guilty rulings with reinstatement by the Police Board any more. You're either not guilty and reinstated or your found guilty and separated.

Daley wants to close the layoff gap and one of the easiest ways to do it is to get rid of police officers that are up for separation. Especially officers that are collecting higher salaries, like Officer Pena.

You fire a 22 year veteran making over $ 80,000 a year and replace him next year with 2 new officers at $ 40,000 a year and you get 2 for the price of one. Simple math, unfortunately not good if you are a Chicago Police Officer right now.

I'm not a police officer, but thank you guys for what you do.

For those officers that are in 30 pending separation, you guys are in for a rough ride. Good luck with your cases.

Well 15 years ago AP was an asshole who didn't show up on jobs, got? free stuff everywhere he went and never acted like the real police once that I saw. If you called for help the next beat over from him he wasn't coming. Rumor has it he was stealing for years. Walgreens just got tired of it.

I hear you, but I have to tell you, even though it should not absolve the use of drugs by any sworn member, while on the job, Frank Trigg was a heck of a nice guy. He was my Supervisor and he was aces. He was the best, by far and way ahead of most of his Hispanic and Caucasian counterparts with chevrons. Frank treated everybody on the watch with respect and he did not micro-manage. Frank and I are not of the same ethnicity, but it did not matter to Frank. He was a good guy.

Even so, if you pee hot, you should be fired, but as far as the drug testing goes, you must understand, when it first started in 1983 (?) the process was not fullproof. Even years after it started there were holes in the process, such as chain of evidence, etcetera, and some members that gave a hot sample during those first years were able to save themselves because of the technicalities. Eventually, all the technicalities were eliminated and the process became fullproof and unbeatable, as it is now, but it was not intially unbeatable. There was a good number of people that fought legally and were not fired during the first few years of testing because of a technicality in the process, not because of being connected. Straight up.

Before you make your judgement over this former officer I must tell you that AP fought in Vietnam as a combat soldier when many his age were doing anything and everything to avoid serving their country. And no he wasn't a "kick ass" type of patrolman. But he did the job and worked many side jobs to get by. Years ago, while off duty he walked into a currency exchange which was being robbed by three armed offenders and took all three into custody with no one getting harmed. No dept recognition nor did he seek any. Yea, it was a stupid thing he did but was it worthy of termination?

I remember the now shuttered 7-11 at Diversey/Long used to give free drinks and snacks to the police. Looked like roll call in there most of the time. There were a few who always offered to pay, and then thanked the clerks each day. The clerks really appreciated that and would tell us how the indifference and arrogance of the ones who walked in without acknowledging them and then walked out again with an arm full of pop and chips, again without any acknowledgment, really was starting to get under their skin's. Then a few guys went in there and had the balls to fill a lunch size Igloo cooler full of lunch meat and other assorted items and walk out without paying. The clerks started clamping down a bit on the freebies. Not long after that, while the clerk went to the bathroom in the back since there were cops in the store at the front, the clerk sees the dumbass coppers on the CCTV in the back shoving all the smut mags from behind the counter under their vests and sticking packs of cigarettes into their pockets! The guy never beefed but from that point on cops were only allowed fountain drinks and coffee from the small paper cups they kept behind the counter. The clerk did make sure to tell all the other officers exactly why and who was responsible. Those pukes should have been charged and fired! They're probably bosses today!

Unfortunately, the guys that have been winning their cases at the Police Board are not out of the woods either.

Apparently, under Weiss's order, Mara Georges has been instructed to appeal all cases won by officers at the Police Board. Not sure if this is coming from Weiss or ADS Kirby, but Kirby is definitely pushing this issue with Georges's office.

Since August, the Police Board has fired 6 officers and reinstated 1. The officer that was reinstated was found not guilty by a vote of 9-0, a perfect unanimous vote.

The officer went thru retread at the academy for a month and was reinstated back to his unit of assignment.

The record shows that on 10 Nov 08 Georges's office filed an appeal to have the decision reversed! WTF?

Think about it, there are no filing fees for the City to file an appeal. No matter how nonsensical the facts of the appeal may be, they can still file an appeal by law.

Corp. Counsel attorneys are on salary, so there is no extra expense other then there time involved in the appeal process.

In the meantime, the department can re-strip the officer and keep him in restricted duty status until the appeal is done. Or worse yet, they can serve the officer
30-days pending seperation, again, and keep him in a no-pay status pending the outcome of the appeal.

The appeal process takes anywhere from 6 to 9 months.

They get you coming and going. Nice department we work for.

This is PRECISELY why I always put cash on the counter or in the tip cup when they refuse my money. You are in a store, it's guaranteed that you are on film. Even if they give you that "No,no your money's no good here", put something down on the counter. I have actually left the store without the coffee when they wouldn't take the money. All it takes is one complaint.I know someone will say that per the goofy test we have to take every year (the name escapes me right now) that a gift is ok as long as it's less than whatever amount of money. NONSENSE! Don't take anything these guys give you, they always want something in return.They want you to clear the store of miscreants, lock this guy up (but won't sign a complaint), make people leave from in front of the store, blah,blah,blah. Up yours shopkeeper! I don't know this Officer from Adam but I do see a precedent set here. It makes perfect sense (to the city) to get rid of him and not pay his pension. He's a nobody, not connected, not related, no juice, no clout, and they can and will(and did) make an example of him. 22 years of service AND a Vietnam Veteran and they destroy him for a dollar! Are you kidding me? No they ain't, and they would do it to you too. So next time you are at Dunkin's or 711 or some Ma and Pa's, take my advice, set some cash down on the counter where it can be plainly seen by the camera or refuse the coffee and walk out. A dollar!

That Sgt charged with a sex crime, son of former deputy Jan P. is now back to work in another district, he had been in 019. Someone got to the victim/witness with a bag of greenbacks no doubt. She declined to come to court and it all went away.

What else is there to this trail mix story? The Sgt. beat the criminal case but the department still had plenty of evidence to fire him, yet they did not.

Let's see, Sgt. sexually harassing a citizen on a traffic stop late at night, alone vs. PO who stroked out and later taking a dollar bag of trail mix.

Sgt is working, PO is fired.

Sgt.'s mother is former high ranking ADS Jan P. (and probably is still working in a high place for city, she was director of security at Navy Pier after retiring from CPD)

PO's mother is not.

That seems simple enough.

A simple case of Chicago "how ya' doin" clout at work. The PO wasn't smart enough to have a different mother, that's all.

Not only did he serve in Vietnam, but his father, who was an Army lifer, was killed in a helicopter crash in Nam during the time that Aaron was serving there. I remember when the Vice Lords were still active in the CHA Henry Horner Homes in the 013th District there were two mission team guys, Schultz and Gancel, who were aggressively building dope cases on them and particularly proactive in locking these mutts up. So one day some jack legged bullhorn reverend appears at the 013th District desk with one of his congregants, T-Fly, aka Terrence Young, a Four Corner Hustler demanding to speak to Commandedr Pestka. Then Commander Janet Pestka wisks them into her office and then summons Schultz and Gancel off the street and into her office. She begins to berate Schultz and Gancel right in front of the two mutts and directs them to lay-off Terrance Young. The upshot? Terrence Young was the dope dealer who caught on a federal overhear conspiring with Fifteenth District copper Pac-Man and Co. to rob other dope dealers in the 015th District four months later. They're all doing serious federal time right now.

Pestka humiliated Schultz and Gancel who broke their asses trying to put these pieces of shit in jail. Shortly after the indictments came down in 015 Pestka addressed the watch roll calls and tact teams and stated she would personally walk anyone working for her to the front gates of the penitentery if they got caught stealing. Pestka was a POS. Another connected turkey whose coward son terrorizes women. He'll get his, yet.

Before you make your judgement over this former officer I must tell you that AP fought in Vietnam as a combat soldier when many his age were doing anything and everything to avoid serving their country. And no he wasn't a "kick ass" type of patrolman. But he did the job and worked many side jobs to get by. Years ago, while off duty he walked into a currency exchange which was being robbed by three armed offenders and took all three into custody with no one getting harmed. No dept recognition nor did he seek any. Yea, it was a stupid thing he did but was it worthy of termination?

AP would be asleep in his car at Domestics while his partner was inside with the family. Please dont think that he did anything on this job, unless it was for himself. AP was very easy to talk to, seemed to always be upbeat and smiling. Good qualities in a person. But leaving everyone else to handle all the Police work during your shift makes it easy to be upbeat and carefree. He should be thanking OLD and NEW PO's for carrying him for years. Spend some of the money he made for nothing and buy us presents for X-mas or something..... Marquette Ranger with a tired back (AP's weight caused it)

Please explain to me the term "kick ass?" Its an oxymoron after telling the blog he prevented an armed robbery while alone, involving three offenders and arresting all of them! Please Clarice, entertain me with one of your "kick ass" stories! Quid pro quo!

hey after 22 years and a stroke he should have retired. no doubt the "MAYOR" has most likely been getting things for free and didnt he needed to pay. to bad for his family they are the victims. cops can be some the most generous and cheapest sons of bitches. im sure there will be a benefit for him yes there are bosses who have nothing happen and its unfair. how about the po who got a retired relatives star and then went to court on his cases and racked up tons of ct time. ok the po took time then got promoted to sgt. point being if you are related to or know someone you will be fine. But if your the MAYOR of 26th st and come back to work after a stroke because you love your job you get fired. again im sorry for his family. gee aunt bea he was your officer couldnt you give him a break for a truly stupid mistake i guess not there are too many white shirts save first. right COMMANDER Brown

wow this officer Pena once con a female ,who works at St Anthony's Hospital(maria) out of $10,000 back in 1992.He told her that he was selling his building ,and as soon as he did the closing he would gladly repay her.This poor girl is still waiting for her money back including interest,but this outstanding officer(Pena) never did repay her as of this date 11-23-08 and blow nothing but smoke ,when she mentioned it to him.

Hey, jerry is a freak and should be fired, this AP flaked and forgot to pay for a extra bag of trail mix.

But we forgot about the female cop on the northside 7 yrs ago who's finger slipped on her trigger discharging a round into a moving vehicle, causing a man to lose his eye and then being detailed to the mayor's detail and several DUI's undocumented of course or the korean broad who was called off a chase on the 290 running into a poor citizen, killing him. Biggest city pay out to date on a single officer so far. And now teaching you how to use your AR - 15.

OHHHHHHHH the stories we all have. And most of them are'nt even commen knowledge, be we all have them. I can go on and on and on.

Bosses, I've got bosses too.
