Admin Blow Allowed

Looking for a direct link to the decision. In a nutshell, the Appellate Court is allowing an Administratively ordered breath test into evidence in what initially appears to be a direct attack upon the Garrity protections afforded peace officers nationwide.

That being said, we're attempting to see how narrowly this exception is being written. There certainly appears to be a bit more than a simple DUI in this case. Numerous allegations are being made and it would be hoped that these are the basis for the Garrity exception rather than just walking all over the rights afforded every other citizen of Illinois. We have stated many times before, we aren't above the law, but we certainly aren't under it either.

In the meantime, we remind everyone that the Department is not joking around with this. Walk, cab, designate a driver, make a hotel reservation, call J-Fed, call anybody, sleep it off in the station locker room (you wouldn't be the first).

With all of the Xmas/retirement parties coming up, it's prolly a good idea to set aside a few 20's for a cab ride for door to door service. It's either that or park the sled a few more blocks away from the venue and walk it off. If "they" follow you, you can duck into allies, double back, shuffle real slow, or just balls out run to the ride. But rememeber; once you're behind the wheel and the key is in the ignition, you are a DUI.

Be careful and stay safe.

2 Glasses of wine with dinner will put me over .08 even if I'm on foot or not driving. A six pack at a family bbq will put me over .08 even if I'm on foot or not driving. Allegedly being the police reduces you to .04, uh 3 sips of a beer (off duty or not). This is fucking ridiculous and literally insane.

i can't believe that we still have officers that don't get it. we still have officers that are going to try and find a way to go out and have a few and still drive home. what is wrong with these people? i have no sympathy for coppers who get caught drinking and driving. every squad car in the city as well as the suburbs has cameras and microphones. if you get caught you are screwed. you can't expect any fellow officer to risk their job to help you because you are too stupid and proud to take a $20 cab ride to avoid all the problems. it's very easy to avoid the problems. take a cab!

Just read this Illinois Appellate decision. All three justices concur. It's a pretty broad interpretation and effectively circumvents the Garrity decision. In a nutshell,this in effect removes any protections we had during a DUI arrest! Except for any statement or admissions uttered during the immediate administrative investigation interview. DON"T DRINK and DRIVE!

.08 is the law of the land. You do NOT have a right to both get drunk and drive a car. Plenty of cops out there, like myself, who will explain the error of your ways to you as you are read your Warning to Motorist.

Ladies and gents. I am outraged like everyone else. Remember this, The dept can no longer make you blow now as part of the administrative process. Don't blow trust me!!!!! If your off duty that is.

The next officer who gets a DUI will be the test case. The test officer of this case was given a direct order to blow into a tube or lose his job. The officer was also told that this process is administrative and won't be used against him in a court of law. Now that the admin blow can be used it brings in the 4th amendment. The deputy in reality has now lied to to officer JA. This is an illegal search and seisure!!! We can lie to suspects or use trickery but we cannot coherce a statement buy threatning to lose a job to proceed in a criminal trial.

JA will be back on street one day 3 or 4 years down the road. Unfortunately he will be broke by the time he gets his job back.

This case had been a biggger miscarriage of justice than Mike Mette in my opinion. Mette had a bad judge. JA is having law rewritten. This stinks of politics for a man who had the right of way.

Where is the ACLU for JA??? His civil liberties are clearly being violated!!!

Ever seen how a boss handles a party? A drink, pleasantries all around, and Vaya Con Dios. Maybe they teach that in Exempt school, right after how to choose a personal secretary, but, it seems a good policy in these troubled times.

The old days, drunken cameraderie are gone. That is a good thing. Too many of my friends bit the bullet even in those relaxed times. It's a job, lots of folk with or without the degrees are unemployed. Be wise, not sorry.

Don't drink and drive. Real freakin' simple. If you feel an overwhelming need to get drunk and you are out, sleep it off in the back of a pickup. My brother, who shamed the family by becoming a fireman, bought a pickup partially just for that purpose.

As the commenter with the "college" comment. Bite me, asshat.

Just because you graduated from the police academy doesn't give you the right to drink and drive, blow stoplights, beat your wife etc etc.

If you look at many, if not most, of the recent embarrassing incidents involving sworn CPD members, alcohol often played a large role. Along with a genetic predisposition to being an asshat.

I suspect even the cases involving alleged on duty corruption or brutality often involve cops who like "the sauce" a little too well.

There's no shame in getting help for an alcohol or mental health issue. There is shame in getting behind the wheel of a car while drunk.

Or bring a designated driver such as the wife or girlfriend. What should have been done in this case was to coordinate all the Christmas parties into the same week. With the manpower shortage, could they cover them all???

I think we are all forgetting something here. As stated at the FOP meeting.....This Change in the law comes from an argument the a traffic court ASA made. Thats right an ASA from traffic court. Its up to you the PO. I dont and never will give a States Attorney a break. They are not your friends, they will hang you in a second. No breaks to judges, or States Attorney's. Better yet if you do get a judge or States Attorney, notify the media immediately!

I wasn't sure if this was a joke, but in case it wasn't let me help your little mind out just a bit. Regardless if a copper has an education or not will not prevent him from writing another copper if he is involved in accident while he is drunk! There is at least one other driver/witness involved, and if there are passengers or multiple vehicles, What are you going to do Officer?, not D.U.I him. Education or not, you're going to call for your Sgt. and lock him up due to the circumstances, unless of course you want to be on the news for not taking action against a fellow P.O., because we all know the first call someone will make is to the news since you didn't do your job. Education has nothing to do with what type of action you or I would take. I worked for a living before becoming the police, and had my education long before, as well as my common sense. Why don't you get with the 21st Century and realize education is not the enemy. It's the news media, 35th street, and the supervisors. Not the bosses, but the supervisors.

The City is violating your constitutional rights now by ordering you to blow.

You have a right to refuse to provide evidence against yourself in a criminal prosecution and by ordering you to blow and using this evidence against you to prosecute you that is essentially what they are doing. The shithead does not have to give statements incriminating himself, WHY SHOULD WE HAVE TO???

If you are involved in an incident where you are ordered to blow and and there is the remote possibility that you will be charged with a crime respectfully refuse citing that the order is a direct violation of your federally protected rights and therefore the order is unlawful. If the Department seeks to terminate file your lawsuit in federal court and watch the $$$ roll in. Make sure that you name every boss, IPRA person and IAD a-hole who threatened you with termination for exercising your rights on the suit.

Back when I was on the job, and it wasn't all that long ago, some of us coppers went out of their way to protect a brother officer from being jammed up. I risked my ass numerous times to protect innebriated officers, both off duty and on, even if an accident was involved. Perhaps times have changed, but you are still a no balls mother fucker if you jam up another copper. For those of you who say, why should I stick my neck out, I have a family, blah, blah, blah, all I can say is that the chickens will come home to roost one day. Of course it's better not to drink and drive, but this job makes incredible demands on your body and soul, not everyone is a saint. Me, I don't drink at all. But you all need to stick together and if there is ever an instance where you can go the extra mile for another copper, do it.

State wide crime fell 3.1 percent last year.
Murders fell 4.3 percent to 752 last year.

So for the state average (including Chicago's increase) to be down crime must really be down in the rest of the state. Probably at least double the state average (including Chicago). Which means Chicago is actually experiencing a 30% or greater increase versus the rest of the state. How can that be explained away by the economic situation or other factors?

the statute, before that 1982 change was different, but in 1982 it all changed.

the court compared forcing a blow w/ forcing a criminal to give his fingerprints .... same thing

Dear fellow officers...if you haven't learned it by now, you probably never will. This is one of the few jobs that you are held to a higher degree of integrity and compliance of the law. I have NO problem with that. I knew what the job was prior to taking it and I understand what I have to do to keep it. NO excuses for drunk driving or how your legally bound by higher standards we are or the bypassing of laws that protect others. If you want to drive around shitfaced, be my guess, but don't expect that the piece of cheap metal in your wallet is going to help you in any way, shape, or form. Based on the ruling, simply put, the 5th amendment does not protect an officer from having to submit physical evidence, i.e. blood, urine, breath test. As applied to the police, there is no protection and any such evidence can be used against the officer in a subsequent criminal trial. The resulting point is that, the 5th amendment as cited by the court states, that no person “shall be compelled to be a witness against himself”, does make a distinction between oral testimony or physical evidence, it is the court that makes that distinction. The evidence that is being sought is just as relevant as oral testimony in that it is by way of a bodily function, much as oral testimony that the court cites as only being protected by the 5th amendment. Had the physical evidence been outside the body, i.e. the gun used in the assault, etc, then the court would have been correct in its logic of physical evidence being allowed based on its interpretation of the 5th amendment. But the court is mistaken, IMHO, that giving bodily fluids or breath test is not the same as giving oral testimony, and can not be suppressed from use in a later criminal proceeding, though given under administrative order and the fear of losing the job is a compelling reason to give the sample or statement, and promised that said statement or act would not be used later. If this ruling is allowed to stand without further appeal there is nothing that then bars the state from prosecuting you later. This ruling is the unraveling of the cloth thread by thread. If allowed to stand administrative rights are nothing more than a witch hunt for the state later.

1)Is it still a DUI if you are sleeping in your car with the radio on? Or do you have to be sitting in the backseat with the keys in your pocket?

2) Why .04? Even .08 is an arbitrary number. My wife can down a 6 pack and be okay to drive..I have 3 and there's no way I'd even attempt it. We're all different. Why are they busting your hump over nothing?

Having read the opinion, I agree with SCC and this decision is pretty narrow. The court focused on the probable cause to arrest the officer for DUI and aggravated assualt. The key seems to be probable cause for the DUI. Just another reminder for us to avoid getting hammered and getting behind the wheel.

I'm not a cop, but I've been reading these blogs for the past few months. I've been dying to get on the CPD for years now. Since I started reading these blogs, I've had second thoughts, "Do I really want to deal with this bullshit?" and then I hear my cop friends talk about how they love to wake up every morning because of the job, and how great and rewarding it could be. I want the same thing they have, a job they enjoy. They are the only one I know that love waking up to go to work, everyone else is just a fucking zombie. I wish Daley would stop bullshiting and hire more recruits already. Fuck!!!!!!

This should be a major concern for EVERYONE. Whether you drink or not, essentially the appelate court is saying that we as officers do not have the same rights as an average citizen. If the average joe is allowed to refuse a breathalyzer how in the hell can we NOT BE? i undersatnd the administrative issue, however we either need to have it in our contract that we CANNOT be disciplined for refusing or we have to bring this to the Illinois Supreme court. I mean this is ridiculous. Who is fighting for US? The thugs are given the most outrageous rights and ways to beat cases but we are continuosly FUCKED! Im so tired of just using the blog to vent, when in the fuck can we organize as a group and march or protest? DO SOMETHING. We rip the ghetto rats on here but you always see them making noise and getting whatever the fuck they want. WE NEED TO BE HEARD. Last time I checked, in order to use someone's confession or in this case, statements against them, it has to be given freely and voluntarily. That's why Miranda exists, and the fifth amendment should apply. How is this any different than threatening to take someone's children away from them unless they confess to a crime. If I'm afraid I'm going to lose my job, how can I give a voluntary statement that can be used in court. Any detectives or lawyers have comments on this?

I know the court said that consent was not an issue as to whether to allow the blow evidence ... but that's looking backwards in time from the court's point of view ... What about when IAD is sitting in front of you saying "If you don't blow you'll lose your job automatically" .. isn't that coercion?

I know the court drew a line between testimony/physical evidence, saying that only testimony is governed by the Garrity case ... but WTF? What if you killed someone - God forbid - and they tell you "give up the gun or you'll lose your job" ... and you give up the gun. Hell I feel the self incrimination thing applies to more than just testimony ... giving up physical evidence against your self can be far more damning that testimony.

I guess that's where I part w/ the court's decision: The Garrity rule should apply to more than just testimony, it should also apply to physical evidence.

The 5th Amendment says you should not be forced to incriminate yourself. If being forced to give up physical evidence against yourself is not self-incrimination I don't know what is.

Anyway, I think that's the weakness of the court's decision.

I read the whole thing and it's really really bad. basically, and I'm no law student, the appellate court states in summary that it doesn't matter that you're ordered under threat of termination, if you're under arrest for DUI - ANY blow is admissible due to the fact that it is physical evidence. administrative investigations taking place prior to probable cause existing - different story. coerced statements (made under duress) - different story.

unfortunately, the only logical solution is to NOT DRIVE DRUNK!!! if you find yourself in the hot-seat though, you're better off not blowing and just appealing the suspension/termination. on the other hand, some old timers have related methods like the "attempted blow" where you're not refusing, but you provide insufficient samples. . . . can you be administratively punished? you complied right? stress related hyperventilation? who knows. . .

also, seems like you're allowed to secure council prior to them adminstering a blow, so just call some fucking lawyer from dekalb and tell him to get on tomorrow's fastest plane. heavy drinking will only last about a day in your system. . . . . . do you get paid overtime for administrative investigations?

I am not an attorney but after reading the ruling it appears that Garrity does not apply to physical evidence. Rule #1 do not drink drive. Rule #2 if you fail to follow rule #1 refuse all chemical testing as well as administrative breath test. It WILL be used against you in court. You will probably lose your job but a DUI conviction will also get you fired. At least you will have a chance of beating DUI in court.

Faking the breath test and the next step is a compulsory blood draw to collect the evidence. Read the court decision. The key is probable cause. Who will articulate probable cause? Who will write the paper and administer field sobriety tests? White shirts are not cpabale of developing a DUI case. The truth is, stop drinking and driving. Avoid the issue.

Off Topic... SCC here is a question to ponder and debate: Are Tac and Gang Teams the reason we as a collective brotherhood have no teeth in contractual issues with the City? By this I mean that the voluntary nature of these teams allow the powers that be to use these officers to supersede the contract on a daily basis (ie. changing DOG's and hours whenever they want, assigning to missions outside their district, etc...) basically pimping these officers out. THATS NOT THE WHOLE STORY. That was alledgedly the last thing that was taken and the store finally had enough of it/him.... Dont forget though, the store just wanted him to not come back, the Department did what they did because of the complaint and witnesses. Too many people were involved and it allegedly was on-going. AP should of used his head and been smarter than that. He was a great guy and served his country well in Vietnam as well as this Department. He allegedly made a mistake and they severly punished him. Theft isnt something you want to be accused of as a PO. I am not an attorney but after reading the ruling it appears that Garrity does not apply to physical evidence. Rule #1 do not drink drive. Rule #2 if you fail to follow rule #1 refuse all chemical testing as well as administrative breath test. It WILL be used against you in court. You will probably lose your job but a DUI conviction will also get you fired. At least you will have a chance of beating DUI in court.

We are supposed to enforce the laws, at least, last time I looked that was the deal. DUI penalties usually include a drivers license suspension, sometimes lengthy. Possessing a valid drivers license is a condition of employment. The police department will not let you come to work with a suspended drivers license, not just not drive a car, you cannot be on the payroll.

Lines have to be drawn somewhere. The rules are clear. Police officers cannot both get caught driving drunk and remain a police officer. Pick one, whichever one you like, if your idea of a good time is driving around drunk and you don't mind too much getting arrested for it and demand your right to keep doing it, fine, have a great time. But don't expect the Chicago Police Department to also supply you with a well paying job.

In other countries you get one shot at driving drunk. Get caught and you lose your license to drive forever. And in many you go to prison.

Only here, in Chicago, Cook County, Illinois, can a police officer argue how unfair it is that they would not be allowed to be police officers after they get caught driving drunk. That argument is simply indefensible.

And please don't bring up that alderman and judges etc. also have to obey the law. We police officers have the front lines of the law enforcement franchise, we hold the power of arrest, if you catch a judge or alderman driving drunk it is within your power to arrest said individual and charge them accordingly.

And if you do catch a judge, alderman etc, remember to immediately call
1-800-784-6397, thats NewsRadio 780, so they can dispatch a news crew to the station for appropriate news media attention.

I do agree with the post about not attending the unit holiday party. It's always been about making the commander look good. To pretend like we all love to work for him or her. To give the illusion that we are all happy in our unit.

I realize that most Xmas parties also honor the year's retirees, and they don't deserve to be screwed. I'll throw in the extra bucks to buy the retirees' gifts, but I won't buy a ticket for the party.

2. I don't want to work with you if you are going to suck up my oxygen and complain about my grammar.

3. Your excited friends must have little to no time on the job. Therefore, I conclude that you failed some portion of the exam and are waiting to be rescored.

4. It's not "these blogs." It's this blog.

5. Refrain from dropping the "f" bomb. It might make you sound more like your grammar is less poor than it actually is.

Yes disbarment, like Judge McGinnis, you do realize she is a lawyer right? Firemen may by disciplined, but they are not getting fired or taking major time. Doctor, the Doc who killed Kanye Wests' mom has been arrested for DUI multiple times and is still performing surgery and killing people. So stick it up your ass stupid. Theory and application are two different things.

Um...you asked a question about the grammar used on this blog and failed to use a question mark at the end of your sentence. This would mean that you cannot punctuate properly-which I belive counts as grammar. Please get off this blog. You are a moron and no one cares about what you think on this blog and probably in life either.
