Admin Blow Allowed
Looking for a direct link to the decision. In a nutshell, the Appellate Court is allowing an Administratively ordered breath test into evidence in what initially appears to be a direct attack upon the Garrity protections afforded peace officers nationwide.
That being said, we're attempting to see how narrowly this exception is being written. There certainly appears to be a bit more than a simple DUI in this case. Numerous allegations are being made and it would be hoped that these are the basis for the Garrity exception rather than just walking all over the rights afforded every other citizen of Illinois. We have stated many times before, we aren't above the law, but we certainly aren't under it either.
In the meantime, we remind everyone that the Department is not joking around with this. Walk, cab, designate a driver, make a hotel reservation, call J-Fed, call anybody, sleep it off in the station locker room (you wouldn't be the first).

With all of the Xmas/retirement parties coming up, it's prolly a good idea to set aside a few 20's for a cab ride for door to door service. It's either that or park the sled a few more blocks away from the venue and walk it off. If "they" follow you, you can duck into allies, double back, shuffle real slow, or just balls out run to the ride. But rememeber; once you're behind the wheel and the key is in the ignition, you are a DUI.
Be careful and stay safe.

the whole truth is if cops didnt have college they wouldnt d.u.i. a cop they have no common sense.no street smarts no job before c.p.d.how can they deal with a working person they never worked'
Fucking Incredible! When does it end. FUCK THE POLICE - PLAIN AND SIMPLE. NO MATTER WHAT. I am going to file a huge lawsuit against this city if I get fucked with no matter how petty and no matter what the scenerio or case is. They are headhunting like no tomorrow, no contract, fuck with the workers and promote and leave alone the dogs. Juice you're in, no juice - you get nuttn'.
2 Glasses of wine with dinner will put me over .08 even if I'm on foot or not driving. A six pack at a family bbq will put me over .08 even if I'm on foot or not driving. Allegedly being the police reduces you to .04, uh 3 sips of a beer (off duty or not). This is fucking ridiculous and literally insane.
The Pension fund will end up this way. Guarantees all over the place until it is challenged and then some political hack judge will decide that there are exceptions.
i can't believe that we still have officers that don't get it. we still have officers that are going to try and find a way to go out and have a few and still drive home. what is wrong with these people? i have no sympathy for coppers who get caught drinking and driving. every squad car in the city as well as the suburbs has cameras and microphones. if you get caught you are screwed. you can't expect any fellow officer to risk their job to help you because you are too stupid and proud to take a $20 cab ride to avoid all the problems. it's very easy to avoid the problems. take a cab!

Sounds like this guy is blogging while drunk.
Don't drink and drive and it will never be a problem for you. Anything else and you become a criminal.
Just read this Illinois Appellate decision. All three justices concur. It's a pretty broad interpretation and effectively circumvents the Garrity decision. In a nutshell, this in effect removes any protections we had during a DUI arrest! Except for any statement or admissions uttered during the immediate administrative investigation interview. DON"T DRINK and DRIVE!

Then move to Alaska. There are lots like you up there. You would get along real good with all the drunk indians and drunken back woods folks.
.08 is the law of the land. You do NOT have a right to both get drunk and drive a car. Plenty of cops out there, like myself, who will explain the error of your ways to you as you are read your Warning to Motorist.
I am hugely drunk right now.....should I call 911?
Ladies and gents. I am outraged like everyone else. Remember this, The dept can no longer make you blow now as part of the administrative process. Don't blow trust me!!!!! If your off duty that is.
The next officer who gets a DUI will be the test case. The test officer of this case was given a direct order to blow into a tube or lose his job. The officer was also told that this process is administrative and won't be used against him in a court of law. Now that the admin blow can be used it brings in the 4th amendment. The deputy in reality has now lied to to officer JA. This is an illegal search and seisure!!! We can lie to suspects or use trickery but we cannot coherce a statement buy threatning to lose a job to proceed in a criminal trial.
JA will be back on street one day 3 or 4 years down the road. Unfortunately he will be broke by the time he gets his job back.
This case had been a biggger miscarriage of justice than Mike Mette in my opinion. Mette had a bad judge. JA is having law rewritten. This stinks of politics for a man who had the right of way.
Where is the ACLU for JA??? His civil liberties are clearly being violated!!!
When boldness is required, be bold. When common sense is required, use it.
Ever seen how a boss handles a party? A drink, pleasantries all around, and Vaya Con Dios. Maybe they teach that in Exempt school, right after how to choose a personal secretary, but, it seems a good policy in these troubled times.
The old days, drunken cameraderie are gone. That is a good thing. Too many of my friends bit the bullet even in those relaxed times. It's a job, lots of folk with or without the degrees are unemployed. Be wise, not sorry.
Don't drink and drive. Real freakin' simple. If you feel an overwhelming need to get drunk and you are out, sleep it off in the back of a pickup. My brother, who shamed the family by becoming a fireman, bought a pickup partially just for that purpose.
As the commenter with the "college" comment. Bite me, asshat.
Just because you graduated from the police academy doesn't give you the right to drink and drive, blow stoplights, beat your wife etc etc.
If you look at many, if not most, of the recent embarrassing incidents involving sworn CPD members, alcohol often played a large role. Along with a genetic predisposition to being an asshat.
I suspect even the cases involving alleged on duty corruption or brutality often involve cops who like "the sauce" a little too well.
There's no shame in getting help for an alcohol or mental health issue. There is shame in getting behind the wheel of a car while drunk.

The pension fund has been looted for years. With the States,Chi-towns,Crook County budget in constant crisis your pension may not look the same .

Or bring a designated driver such as the wife or girlfriend. What should have been done in this case was to coordinate all the Christmas parties into the same week. With the manpower shortage, could they cover them all???
Cops should be held to a higher standard.Time for all the nonsense to stop.
I'm applying for another dept in a state far, far away from here.
I think we are all forgetting something here. As stated at the FOP meeting.....This Change in the law comes from an argument the a traffic court ASA made. Thats right an ASA from traffic court. Its up to you the PO. I dont and never will give a States Attorney a break. They are not your friends, they will hang you in a second. No breaks to judges, or States Attorney's. Better yet if you do get a judge or States Attorney, notify the media immediately!

Seriously, this IS city of chicago, county of cook, state of illinois so is anybody really suprised by this??? Anybody and I mean ANYBODY that is stupid enough to do anything for this shithole anymore is just plain retarded. Remember, we ARE NOT above the law and despite what SCC says, in the eye of the public WE ARE BELOW THE LAW. Fuck them and this city. Stay home and enjoy a nice barbeque with the family/friends. If someone calls the cops and they demand you blow, do what every shithead in the ghetto does, walk in your house, slam the door in their face and don't answer. Sorry, I was in the basement and didn't hear the doorbell or you knocking.

Thank G-D Tom Plienes is defending the FOP member. He is very sharp.
does this mean that the police can now act like the rest of the citizens. you pile up the ride and you are full boat, run like hell. then call 311 and report your car stolen-- works for the dogs all the time. some municipalities even allow you to report car stolen on internet without actually ever speaking to a p.o.
Remember you are supposed to be an example to the community. Drunken nonsense has no place on this job.
Be careful boys and girls it is a new dept., and you will be fired and lose everything drink at home and stay home that is all!
REMEMBER, YOU ARE THE POLICE AND UNDER THE LAW AND NEW ADMINISTRATION WE ARE LESS THAN THE AVERAGE CITIZEN. UNDER J-FED'S ADMINISTRATION YOU SHOULD NOT APPEAR IN PUBLIC UNDER THE INFLUENCE OR STONE COLD DRUNK. THE DEPARTMENT WILL SEEK TO PUNISH YOU IF YOUR FOUND IN PUBLIC INTOXICATED AND EVEN WORSE IF YOU ARE ARMED WITH YOUR WEAPON. BE VERY CAREFUL WITH ALL THE PENDING HOLIDAY PARTIES. AVOID CONFLICT WITH ANYONE WHILE INTOXICATED. YOU ARE NOT THE AVERAGE CITIZEN. REMEMBER J-FED IS UNHAPPY AND THE MAYOR IS STILL TRYING TO FILL A BUDGET GAP.
We are now second class citizens! Read the whole ruling.....
Thus, we find that the holding in Garrity, which is based upon an application of the fifth amendment privilege, is inapplicable to this case.
the whole truth is if cops didnt have college they wouldnt d.u.i. a cop they have no common sense.no street smarts no job before c.p.d.how can they deal with a working person they never worked'
I wasn't sure if this was a joke, but in case it wasn't let me help your little mind out just a bit. Regardless if a copper has an education or not will not prevent him from writing another copper if he is involved in accident while he is drunk! There is at least one other driver/witness involved, and if there are passengers or multiple vehicles, What are you going to do Officer?, not D.U.I him. Education or not, you're going to call for your Sgt. and lock him up due to the circumstances, unless of course you want to be on the news for not taking action against a fellow P.O., because we all know the first call someone will make is to the news since you didn't do your job. Education has nothing to do with what type of action you or I would take. I worked for a living before becoming the police, and had my education long before, as well as my common sense. Why don't you get with the 21st Century and realize education is not the enemy. It's the news media, 35th street, and the supervisors. Not the bosses, but the supervisors.
The City is violating your constitutional rights now by ordering you to blow.
You have a right to refuse to provide evidence against yourself in a criminal prosecution and by ordering you to blow and using this evidence against you to prosecute you that is essentially what they are doing. The shithead does not have to give statements incriminating himself, WHY SHOULD WE HAVE TO???
If you are involved in an incident where you are ordered to blow and and there is the remote possibility that you will be charged with a crime respectfully refuse citing that the order is a direct violation of your federally protected rights and therefore the order is unlawful. If the Department seeks to terminate file your lawsuit in federal court and watch the $$$ roll in. Make sure that you name every boss, IPRA person and IAD a-hole who threatened you with termination for exercising your rights on the suit.
how 'bout at least naming the parties so we can look it up ourselves SCC?
It's OVER!!!!!
Back when I was on the job, and it wasn't all that long ago, some of us coppers went out of their way to protect a brother officer from being jammed up. I risked my ass numerous times to protect innebriated officers, both off duty and on, even if an accident was involved. Perhaps times have changed, but you are still a no balls mother fucker if you jam up another copper. For those of you who say, why should I stick my neck out, I have a family, blah, blah, blah, all I can say is that the chickens will come home to roost one day. Of course it's better not to drink and drive, but this job makes incredible demands on your body and soul, not everyone is a saint. Me, I don't drink at all. But you all need to stick together and if there is ever an instance where you can go the extra mile for another copper, do it.

OFF TOPIC
State wide crime fell 3.1 percent last year.
Murders fell 4.3 percent to 752 last year.
http://abclocal.go.com/wls/story?section=news/local&id=6513739
So for the state average (including Chicago's increase) to be down crime must really be down in the rest of the state. Probably at least double the state average (including Chicago). Which means Chicago is actually experiencing a 30% or greater increase versus the rest of the state. How can that be explained away by the economic situation or other factors?
Oh, you're talking about drinking, I thought you were talking about Admin blows to get into 019th District CAPS Office
to find the case go to:

Don't drink and drive, and,
IF YOU BLOW ADMINISTRATIVELY THEY ARE GOING TO USE THE RESULTS CRIMINALLY ....
bitch and whine all you want, this ain't gonna change
the main thing that I got from the case was in 1982 the DUI statute was rewritten so that consent is not required
the statute, before that 1982 change was different, but in 1982 it all changed.
the case law is not even vague or ambiguous ... and that Garrity protection stuff only applies to statements you make ...
the court compared forcing a blow w/ forcing a criminal to give his fingerprints .... same thing

WHAT??
Dear fellow officers...if you haven't learned it by now, you probably never will. This is one of the few jobs that you are held to a higher degree of integrity and compliance of the law. I have NO problem with that. I knew what the job was prior to taking it and I understand what I have to do to keep it. NO excuses for drunk driving or how your legally bound by higher standards we are or the bypassing of laws that protect others. If you want to drive around shitfaced, be my guess, but don't expect that the piece of cheap metal in your wallet is going to help you in any way, shape, or form. We make a decent buck, HIRE a cab or designate a driver. The days of boozin and shootin your guns in the air are officially over. Now have a Merry F*ckin' Christmas and be careful.
Based on the ruling, simply put, the 5th amendment does not protect an officer from having to submit physical evidence, i.e. blood, urine, breath test. As applied to the police, there is no protection and any such evidence can be used against the officer in a subsequent criminal trial. The resulting point is that, the 5th amendment as cited by the court states, that no person “shall be compelled to be a witness against himself”, does make a distinction between oral testimony or physical evidence, it is the court that makes that distinction. The evidence that is being sought is just as relevant as oral testimony in that it is by way of a bodily function, much as oral testimony that the court cites as only being protected by the 5th amendment. Had the physical evidence been outside the body, i.e. the gun used in the assault, etc, then the court would have been correct in its logic of physical evidence being allowed based on its interpretation of the 5th amendment. But the court is mistaken, IMHO, that giving bodily fluids or breath test is not the same as giving oral testimony, and can not be suppressed from use in a later criminal proceeding, though given under administrative order and the fear of losing the job is a compelling reason to give the sample or statement, and promised that said statement or act would not be used later. If this ruling is allowed to stand without further appeal there is nothing that then bars the state from prosecuting you later. This ruling is the unraveling of the cloth thread by thread. If allowed to stand administrative rights are nothing more than a witch hunt for the state later.
Robert L. Parker
Coupla questions for you guys:
1)Is it still a DUI if you are sleeping in your car with the radio on? Or do you have to be sitting in the backseat with the keys in your pocket?
2) Why .04? Even .08 is an arbitrary number. My wife can down a 6 pack and be okay to drive..I have 3 and there's no way I'd even attempt it. We're all different. Why are they busting your hump over nothing?
I'm going to be drunker than Spaulding Smails in Caddyshack at my Xmas party!

The Daley Show
"After Mayor Richard Daley pushed through his first city budget for 1990, the Buildings Department was headed by a commissioner, two deputy commissioners and an assistant commissioner," the Tribune reports.
"By this year, the mayor's budget has ballooned to include two managing deputy commissioners, a first deputy, five deputies and six assistants - even as the department has far fewer workers."
When Todd Stroger does it, he's a hack. When Richard M. Daley does it, he's an international management darling.
"The City Council is set to trim eight high-level managers from the Buildings Department when it votes on Daley's 2009 budget Wednesday.
"While Daley is cutting non-union top bosses, those layoffs will only partially offset the dramatic growth in upper-echelon management during Daley's reign. A Tribune analysis of city budgets found that since 1990 the number of department heads, deputies and assistant department heads has risen from fewer than 200 to almost 350, despite the slow shrinking of the city workforce."
just remember boys and girls....all it takes is a drink or two and being in "actual physical control" of a motor vehicle and its a DUI. Like SCC said, walk, cab it, or make someone the designated driver that night.
Having read the opinion, I agree with SCC and this decision is pretty narrow. The court focused on the probable cause to arrest the officer for DUI and aggravated assualt. The key seems to be probable cause for the DUI. Just another reminder for us to avoid getting hammered and getting behind the wheel.
I'm not a cop, but I've been reading these blogs for the past few months. I've been dying to get on the CPD for years now. Since I started reading these blogs, I've had second thoughts, "Do I really want to deal with this bullshit?" and then I hear my cop friends talk about how they love to wake up every morning because of the job, and how great and rewarding it could be. I want the same thing they have, a job they enjoy. They are the only one I know that love waking up to go to work, everyone else is just a fucking zombie. I wish Daley would stop bullshiting and hire more recruits already. Fuck!!!!!!
P.S. Why do so many of the people "blogging" on here have such bad grammar. Wow!
the department can blow on my unused and often neglected nightstick
This should be a major concern for EVERYONE. Whether you drink or not, essentially the appelate court is saying that we as officers do not have the same rights as an average citizen. If the average joe is allowed to refuse a breathalyzer how in the hell can we NOT BE? i undersatnd the administrative issue, however we either need to have it in our contract that we CANNOT be disciplined for refusing or we have to bring this to the Illinois Supreme court. I mean this is ridiculous. Who is fighting for US? The thugs are given the most outrageous rights and ways to beat cases but we are continuosly FUCKED! Im so tired of just using the blog to vent, when in the fuck can we organize as a group and march or protest? DO SOMETHING. We rip the ghetto rats on here but you always see them making noise and getting whatever the fuck they want. WE NEED TO BE HEARD. Unfortuantely a little district p.o. doesnt have the power, or resources to direct such a thing. But YOU SCC Do! We need HELP NOW!
Last time I checked, in order to use someone's confession or in this case, statements against them, it has to be given freely and voluntarily. That's why Miranda exists, and the fifth amendment should apply. How is this any different than threatening to take someone's children away from them unless they confess to a crime. If I'm afraid I'm going to lose my job, how can I give a voluntary statement that can be used in court. Any detectives or lawyers have comments on this?
J-FED SAYS GET IN THE GYM AND PUMP IT UP. PUT DOWN THE BEER GIRLIE-BOY
then can they still force us to blow administravely when they have knowlegde that the results not only can be, but WILL BE used criminally?
I know the court said that consent was not an issue as to whether to allow the blow evidence ... but that's looking backwards in time from the court's point of view ... What about when IAD is sitting in front of you saying "If you don't blow you'll lose your job automatically" .. isn't that coercion?
I know the court drew a line between testimony/physical evidence, saying that only testimony is governed by the Garrity case ... but WTF? What if you killed someone - God forbid - and they tell you "give up the gun or you'll lose your job" ... and you give up the gun. Hell I feel the self incrimination thing applies to more than just testimony ... giving up physical evidence against your self can be far more damning that testimony.
I guess that's where I part w/ the court's decision: The Garrity rule should apply to more than just testimony, it should also apply to physical evidence.
The 5th Amendment says you should not be forced to incriminate yourself. If being forced to give up physical evidence against yourself is not self-incrimination I don't know what is.
Anyway, I think that's the weakness of the court's decision.
Regardless, let the union take up the issue. Ya, right
that's bad. I read the whole thing and it's really really bad. basically, and I'm no law student, the appellate court states in summary that it doesn't matter that you're ordered under threat of termination, if you're under arrest for DUI - ANY blow is admissible due to the fact that it is physical evidence. administrative investigations taking place prior to probable cause existing - different story. coerced statements (made under duress) - different story.
unfortunately, the only logical solution is to NOT DRIVE DRUNK!!! if you find yourself in the hot-seat though, you're better off not blowing and just appealing the suspension/termination. on the other hand, some old timers have related methods like the "attempted blow" where you're not refusing, but you provide insufficient samples. . . . can you be administratively punished? you complied right? stress related hyperventilation? who knows. . .
also, seems like you're allowed to secure council prior to them adminstering a blow, so just call some fucking lawyer from dekalb and tell him to get on tomorrow's fastest plane. heavy drinking will only last about a day in your system. . . . . . do you get paid overtime for administrative investigations?
any "experts" care to chime in?
I had to blow administratively one time. Somehow, it felt very comfortable.
Now, kees me you fool!!!
Is KIRBY running the show ????
WHY IS THIS POLITICO TEARING INTO WEST-SIDE BOSSES LIKE A HURRICANE ?? DOES SHE THINK SHES GOING TO BE MADE SUPER AFTER JODI TAKES THE FBI JOB ?? IS THE MAYOR PISSED AT US FOR CONTROLLING
THE WEST-SIDE DURING MAJOR CIVIL UNREST ??
What is going to happen is a few will be slaughtered and burned at the alter of the media and we will either realize the END OF ALL POLICE WORK IS AT HAND or WE WILL TAKE IT IN THE ASS AND KEEP WRITING OUR PARKERS,MOVERS,ANOVS FOR THE BOSSES INDEX .

I am not an attorney but after reading the ruling it appears that Garrity does not apply to physical evidence. Rule #1 do not drink drive. Rule #2 if you fail to follow rule #1 refuse all chemical testing as well as administrative breath test. It WILL be used against you in court. You will probably lose your job but a DUI conviction will also get you fired. At least you will have a chance of beating DUI in court.

Here's an idea, don't go to the parties. Refuse to buy tickets that they strong arm us into buying. SO you might get kicked off your team, big deal. I can't see any reason to celebrate anything on this department anyway and let's face it the teams suck now too. Celebrate with your family and friends but refuse to have anything to do with the department outside of work. I am an adult and am perfectly capable of making adult decisions, if I don't want to go to the watch/Christmas/retirement/benefit/whatever party I'm not going and I'm not buying your ticket either.
22nd District residents beware 3 copper's houses hit in last 2 days guns taken! Animals searching for vehicles with FOP medallions then kicking in the back door. I switched to zone 9 the night after 112 whipple was hot and 2211 was at 95 and Wabash 2211A was at 105th and State just 45 minutes after the burglary. Hey you worthless f*cks do your damn job and stay on or near your beat!!! Or get the f@ck of those cars!!
Thanks for the opinion post. Sounds like the Garrity protections is useless and from now on I would only drink from inside my house under my bed.(don't want to be video tapped violating any rules). Now I wonder in the future if the refusal of questioning will violate rules. Answer the questions and risk being prosecuted, don't answer and get fired. And what about refusing D.N.A.? When u are police DAMMED IF YOU DO and DAMMED IF YOU DON'T! NO RIGHTS, SHOULD OF CHANGED PROFESSIONS YEARS AGO!

What about the part of the admin warnings that says "WILL NOT BE USED IN CRIMINAL PROCEEDINGS"?

good luck getting people to the x-mas parties. there are 15 openings in my districts tac team. i don't have to buy anything. hahahahaa.

Well as fucked up as it may be, thats life. Dont blame the coppers, blame the fucking bosses and politicians. You are a fucking moron who obviously doesnt know DICK. Just another ignorant non working copper that bashes others and probably doesnt get out of his car for shit

Your post reveals a lot about you, Rat Bastard. You worked for a loving and had a a college education LONG before coming on the job? So, you are one of those losers who couldn't cut it in the private sector and took this job in your mid 30s or 40s? You fucks make the worst coppers and are often borderline retarded and are pussies, almost to the man. When you have a couple of friends shot to death in the line of duty then you will realize that this job is "working for a living" you pompous ass.
Here's what I'll do as the watch commander, you fucking weasel... I'll release him w/o charging before the deputy can make it to the station and I'll have a trustworthy copper take him somewhere that he can't be found till sober and that he gets some help for his drinking problem. I'll take my 10-30 day suspension like a man, make $ at my benefit, and ensure that you are fucked with the rest of your career.
I'm going to be drunker than Spaulding Smails in Caddyshack at my Xmas party!

11/19/2008 04:14:00 PM:
How about u do all us 022 humps a huge favor and work in the homeland? Wouldn't be asking if u weren't so badly needed. You can teach us worthless f*cks how to finally do our damn jobs. Better yet, show us how to respond to all the 30 sector bullshit AND be on 2211's beat at the SAME TIME. Please, Please, PLEASE! Join the battle and get the f@ck on those cars now!!
I spoke to the W/C on your behalf. Your ego and big balls can partner up on 2211, but your a$$hole will have to work alone on 2211A.
unfortunately, the only logical solution is to NOT DRIVE DRUNK!!! if you find yourself in the hot-seat though, you're better off not blowing and just appealing the suspension/termination. on the other hand, some old timers have related methods like the "attempted blow" where you're not refusing, but you provide insufficient samples. . . . can you be administratively punished? you complied right? stress related hyperventilation? who knows. . .
Faking the breath test and the next step is a compulsory blood draw to collect the evidence. Read the court decision. The key is probable cause. Who will articulate probable cause? Who will write the paper and administer field sobriety tests? White shirts are not cpabale of developing a DUI case. The truth is, stop drinking and driving. Avoid the issue.
I am an adult and am perfectly capable of making adult decisions, if I don't want to go to the watch/Christmas/retirement/benefit/whatever party I'm not going and I'm not buying your ticket either.

Do you honestly believe anyone at all cares whether or not you go to the party or buy a ticket? Because no one does.
P.S. Why do so many of the people "blogging" on here have such bad grammar. Wow!
11/19/2008 01:34:00 PM
@@@@@@@@
the whole truth is if blogging cops didnt have city of chicago publick or parochial edumacations they wouldnt spelt so badly.no smarts no job before c.p.d.how can they deal with grammar or spelling they never learnt'

Glad to see at least one blog that made any sense (about helping a another po).
To those of you who sound like you would put any po down are first class a/o's. Your making it sound like you'd be proud to put the po on the spot. Are you all affraid to make a decision on your own or do you always need a supervisor? You people should be ashamed of yourselves for thinking the way you do. Thats why your the weakest in strength. Stay separated in stead of together!!!
Your always going to have that 1% who don't care about being an a/o and push the envelope to far. That will be their problem and there will be no loss. If you people can't use your heads and are affraid of cameras and sound, then get off the street cause your useless.
I fully agree that times have changed, like rules also have changed, but geez you people go out of your way to burn one of your own. Keep staying apart and the Machine will continue in its power. What ever happened to watch my back and I'll watch yours?
With all of the Xmas/retirement parties coming up, it's probably a good idea to set aside a few 20's for a cab ride for door to door service.
-----------------------------------
Or bring a designated driver such as the wife or girlfriend. What should have been done in this case was to coordinate all the Christmas parties into the same week. With the manpower shortage, could they cover them all???
11/19/2008 07:37:00 AM
I usually bring both I get real horny when i drink
KEEP GOING GOING OUT THERE AND BUSTING YOUR ASSES FOR THIS DEPARTMENT OFFICERS!!!!!!

(Hint: It's a trick question.)
"11/19/2008 02:56:00 PM"
Yes, we know.
Fuck, everybody knows.
that means that this years xmas parties and new years parties will cost a few po's their jobs.
over under is, by my guess, 8 coppers.
boycott all xmas parties unless the rent a bus to pick you up at your door and drop you off.
Psst.. heard they are going after that 45min a day & hours sold back yearly by us bosses..
Immediately fake having a heart attack to buy more time. Go the hospital and hope they are busy. Don't give up a vein for at least an hour for the blood draw. Tell the nurde yo uare sick and might puke all over her.
wow seriously you are a jackass. so lets say God forbid one of us gets in an PI accident after having a few and you dont dui the copper and the victim somehow finds out about it who's in the trickbag now. not saying that i would ever want to dui or lockup a copper but sometimes you can only help someone so far
11/19/2008 03:18:00 PM
The original poster never said let someone go in a PI accident.
and to whoever asked about attorneys and breathalyzers
llinois courts have uniformly concluded that a defendant has no right, either constitutional or statutory, to consult with an attorney prior to submitting to a breathalyzer test. See People v. Thomas, 199 Ill. App. 3d 79, 556 N.E.2d 1246, 145 Ill. Dec. 344 (1990); People v. Cadwell, 160 Ill. App. 3d 495, 513 N.E.2d 539, 112 Ill. Dec. 125 (1987); [***4] People v. Gaddi, 145 Ill. App. 3d 227, 494 N.E.2d 696, 98 Ill. Dec. 574 (1986); Village of Cary v. Jakubek, 121 Ill. App. 3d 341, 459 N.E.2d 651, 76 Ill. Dec. 736 (1984). We see no reason to depart from the settled jurisprudence of this State. The defendant's refusal to submit to a breathalyzer is not a constitutionally protected act. South Dakota v. Neville, 459 U.S. 553, 564, 74 L. Ed. 2d 748, 759, 103 S. Ct. 916, 923 (1983). Nor is it an "interrogation" within the context of the Miranda decision. Neville, 459 U.S. at 564 n. 15, 74 L. Ed. 2d at 759 n. 15, 103 S. Ct. at 923 n. 15. Moreover, the refusal to submit to a breathalyzer test is not a "critical stage" of the criminal proceedings. People v. Okun, 144 Ill. App. 3d 1066, 1070, 495 N.E.2d 115, 118, 99 Ill. Dec. 50 (1986).
Good luck to JA and call a cab for the love of Christ, nobody wants to see anyone's career be them ASA, APD, AAG, CPD, CIA, FBI or whatever shitcanned over having some pops with the boys or girls.
Don't drink and drive and it will never be a problem for you. Anything else and you become a criminal.

STFU asshole, or troll or whatever. You don't have a clue as to what you are talking about.
After reading your comment, it is obivious you did not waste time in school.
obivious? Don't throw stones my man.
This case had been a biggger miscarriage of justice than Mike Mette in my opinion. Mette had a bad judge. JA is having law rewritten. This stinks of politics for a man who had the right of way.
Where is the ACLU for JA??? His civil liberties are clearly being violated!!!

Err.....wrong drunk, numbnuts.
Thank G-D Tom Plienes is defending the FOP member. He is very sharp.
11/19/2008 09:23:00 AM
Not true. the "member" was defended by none other than Dick Devine's godson himself, Danny Herbert. Tom Plienes had nothing to do with it.
Plenty of cops out there, like myself, who will explain the error of your ways to you as you are read your Warning to Motorist.

does this mean that the police can now act like the rest of the citizens. you pile up the ride and you are full boat, run like hell. then call 311 and report your car stolen-- works for the dogs all the time. some municipalities even allow you to report car stolen on internet without actually ever speaking to a p.o.

Absolute nonsense. Hospital will order a blood test as part of the treatment for a heart attack. If you refuse to cooperate with doctor, they cannot treat you and you pay the bill, not insurnace. Sorry friend, but with this case, no escapes. The appelaite court left no loose ends.

And you are not a cop, even if you may have found a way to scam yourself a button.
Off Topic... SCC here is a question to ponder and debate: Are Tac and Gang Teams the reason we as a collective brotherhood have no teeth in contractual issues with the City? By this I mean that the voluntary nature of these teams allow the powers that be to use these officers to supersede the contract on a daily basis (ie. changing DOG's and hours whenever they want, assigning to missions outside their district, etc...) basically pimping these officers out. I was Tac and in voluntary units for years but am now seeing things in a different light as the City keeps stepping on our throats. Just wondering how others feel.
I'll take my 10-30 day suspension like a man, make $ at my benefit, and ensure that you are fucked with the rest of your career.
11/19/2008 05:22:00 PM
So you'd take 30 for a fuck-up so that the fuck-up wouldn't have to take 30.
You are so full of shit I can actually smell you through the internet!
I'm guessing you aren't any where near being a Watch Commander anytime soon, but if you are one of those retards that got merit promoted to the rank of LT in the last 5 years, remember that you'd probably get fired for an action like that....unless your aldermanic clout saved your ass like so many before you.
So much for "no one is above the Law", eh?
I guess "this statement is not being given voluntairly" is pointless now
The military will boot anyone, even Commissioned Officers for a DUI conviction in the civil courts. General Discharge, no VA benefits.
Why should police be any different?
Yes he does. It is actually 7 coppers houses that have been hit in the last 2 months. Though you live in a descent neighborhood, pay attention when you leave in the mornings and if you can, stop by during the day.
Since us police believe it won't happen to us, we have the latest technology out in the open and we have all the latest high end fashion, electronics, etc. We work 2 and 3 jobs to take care of our families while the creeps run in and out of our neighborhod.
22nd District police, you do need to step up just as Area Two Detectives. We HAVE to live in the city and Beverly, Morgan Park and Mt. Greenwood are our best bet. Don't you think the bad guys know that also!!!

THATS NOT THE WHOLE STORY. That was alledgedly the last thing that was taken and the store finally had enough of it/him.... Dont forget though, the store just wanted him to not come back, the Department did what they did because of the complaint and witnesses. Too many people were involved and it allegedly was on-going. AP should of used his head and been smarter than that. He was a great guy and served his country well in Vietnam as well as this Department. He allegedly made a mistake and they severly punished him. Theft isnt something you want to be accused of as a PO. My guess is the "Mayor of 26th Street" was probably used to mom and pop shops handing over the occasional pop and snacks out of appreciation for his service to their community, but corporations have security staff to prevent theft/loss of their profits. On another note, DON'T USE A PERSONS FULL NAME HERE. You want everyone in your business? AP is a good man, and a career and lifetime of helping others on and off duty doesn't need to be ended like this.......
Please don't drink and drive. It really is just that simple. Other states have lost out on keeping admin sobriety tests out of criminal cases long ago. We are far behind. Wise up. Do not drink and drive, then there will be no problem.
Like old timers said, find a package goods store and buy there and take it home and then drink there.
Or get used to taking a cab or having someone come along who is sober and will drive the boys around. Rotate this chore.
But for God sake, do not drive drunk! How hard is that to understand?
"Give us incriminating evidence that WILL be used against you in a court of law or be fired!... Can I do that in my next interview with a homicide offender? I couldn't even lie to an offender and tell him that and get away with it!
KEEP UP ALL THE POLICE WORK MORONS... THIS CITY REALLY APPRECIATES US!
11/19/2008 03:45:00 PM
I am not an attorney but i did stay at a Holiday Inn Express last night.
AND U THOUGHT THE GOVERNMENT IS ONLY GOING AFTER SCOTT PETERSON!
CMON HEARSAY FOR HOMICIDES...
SO THE POLICE HAVE LESS RIGHTS!
DONT THINK ITS ONLY GOING 2 BE 4 DRIVING EITHER! IF U DO U R A SOFTBALL.
THE DEPARTMENT WANTS U TO BLOW FOR EVERYTHING LIKE A CHEAP WHORE ON MADISON IN THE 70'S.
GUESS WHATS GOING IN UR ARM, A NICE NEEDLE AT THE HOSPITAL!
CHECK THE FOP SITE FOR THE PROPOSAL AGAIN RANDOM ALCOHOL TEST NOT TO FAR IN THE DISTANT FUTURE. SEASONS GREETING U BETTER GO ON THE MEDICAL IF YOU R DRINKING ALL NIGHT U MAY HAVE TO BLOW AT WORK!
U MIGHT AS WELL GO AWOL ITS LESS TIME!
"11/19/2008 10:44:00 PM"
You might be missing the obvious here.
It was a budgetary motivated decision.
10 step if you can't step
1)Four can fit in the back of a cab.
2)Get there and then pitch in $4-$7 bucks each to take a cab home.
3)Drink on first R.D.O.
if you consume over 16 drinks.
4)not anyone you are the police and leave your credentials at home.
5) you have a one night stand, don't tell the girl you are the police.
6)ring your big buddy from college out with you who is not the police.
7) someone provokes a fight he can take care of it. You would have to buy a few beers.
8)drink at clean places leave your pistol at home.
8)f you end up at a hoochie mama club have one of your sober cop buddies armed.
9)rotate next week to be fair.
10) be friends with the bouncers and management.
10)tell'em you are a bouncer at a strip joint and do not let them know you are the police.
Remember these rules and may the force be with you
He allegedly made a mistake and they severly punished him. Theft isnt something you want to be accused of as a PO.
What about the time thieves within our ranks?
thought it was a horrible decision, both on law and interpretation....hope that it's taken up on appeal..
10:12 pm:
your the kind of first classs a/o I was referring to. You apparently didn't fully comprehend the two posters.
Finish using the city to further your education and then do a lot of us favor. Leave and join the private sector because you will not make it on this job!!!! you are a LOSER.
i can't believe that we still have officers that don't get it. we still have officers that are going to try and find a way to go out and have a few and still drive home.
**You can have a few and drive... it is legal.
Enjoy your cab ride.

The ACLU is a communist organization. It was FOUNDED BY communists (look it up if you dont believe me). The goal of the communist is to create chaos in our society in an effort to destroy it. Police are their enemy as we keep the order.

I have even heard that they are doing this to people on the watches and threatening to dump them to a different watch if they don't buy a ticket. So go enjoy yourself sweetheart, have a good time, maybe you'll wind up in some special spot after your night with some boss or maybe you will end up as the test case cop in a DUI and we'll all see you on the front page of the scumtimes baby.By all means go and have a good time pumpkin.
You 022nd District cops crack me up, you couldn't hold my jock; arrests, awards etc etc the point is some of you are worthless the night of the burglary at 112th Whipple it was dead both 2211 and 2211A were doing bullshit jobs assisting a citizen and a personal when they should be hunting the beasts that don't belong in a working nieghborhood. We pay taxes f*ck the east side of 022 let them die!! Everyone knows the people on those (2) beats are dogs I wish I could join the fight but apparently you need phone calls to go to 022. So stop acting like you care when your doing nothing to fix the huge rash of robberies, burglaries, beatings of PO's etc etc. You guys can't catch a 60 yr old white robber for christs sake!!

sorry oldtimer but you fucked it up for us. Remember when driving drunk was cool? that was then this is now. You put me in a trick bag and let's see who still has a job. You put yourself in that predicament nobody put a gun to your head and made you drink and drive. Same thing in 008 west end, maybe the commander could do something how about 2 tact teams west of cicero, maybe a tru unit dedicated to the area hell even a msf whatever they do also! Why give all the service over east where they do not appreciate the police?
Run silent... run deep.
11/20/2008 03:31:00 AM:
Wish you could join the fight in 022? More like don't want to because apparently it's easier for you to bitch here, Inspector.
It's TRU, 022 couldn't hold your jock; arrests, awards etc etc the point is you're the best we got, John Rambo. How about you take one for the team and relax that big throat of yours, you'll be in 022 the next day. Or volunteer during your 1B and 2A furloughs to hunt the beast vigilante-style. You bring the covert garbage truck, we'll get the pitchforks and torches.
Since we here in 022 have no clue what the f*ck we're doing, any help we can get from such a powerful police resource as yourself would be great.
Glad you're stepping up and realize we are all in this together.

We are supposed to enforce the laws, at least, last time I looked that was the deal. DUI penalties usually include a drivers license suspension, sometimes lengthy. Possessing a valid drivers license is a condition of employment. The police department will not let you come to work with a suspended drivers license, not just not drive a car, you cannot be on the payroll.
Lines have to be drawn somewhere. The rules are clear. Police officers cannot both get caught driving drunk and remain a police officer. Pick one, whichever one you like, if your idea of a good time is driving around drunk and you don't mind too much getting arrested for it and demand your right to keep doing it, fine, have a great time. But don't expect the Chicago Police Department to also supply you with a well paying job.
In other countries you get one shot at driving drunk. Get caught and you lose your license to drive forever. And in many you go to prison.
Only here, in Chicago, Cook County, Illinois, can a police officer argue how unfair it is that they would not be allowed to be police officers after they get caught driving drunk. That argument is simply indefensible.
And please don't bring up that alderman and judges etc. also have to obey the law. We police officers have the front lines of the law enforcement franchise, we hold the power of arrest, if you catch a judge or alderman driving drunk it is within your power to arrest said individual and charge them accordingly.
And if you do catch a judge, alderman etc, remember to immediately call
1-800-784-6397, thats NewsRadio 780, so they can dispatch a news crew to the station for appropriate news media attention.
"You guys can't catch a 60 yr old white robber for christs sake!!
11/20/2008 03:31:00 AM"
Stop gloating and turn yourself in.
"sorry oldtimer but you fucked it up for us. Remember when driving drunk was cool? that was then this is now. You put me in a trick bag and let's see who still has a job. You put yourself in that predicament nobody put a gun to your head and made you drink and drive. And no college has nothing to do with doing the right thing just common sense which i guess a couple of you old timers seem to lack."
I hate to bust your bubble kid, but I'm willing to guess that the MAJORITY of people on this job charged with alcohol related offenses in the past two years or so are likely to be people who have less than 8 years on the job.

Cops should be held to a higher standard.Time for all the nonsense to stop.
11/19/2008 07:40:00 AM
So should judges, states attorneys, and politicans. But the lawyers make the law. We are second class citizens at best.
11/20/2008 05:54:00 AM
Stop acting like second class citizens and in time you might no longer feel like a second class citizen. If you want respect, act in a manner that commands respect. Don't drive drunk and expect a break. Don't snatch trail mix as if it is your right to stuff free shit in your pocket when you walk in a store. Don't act like you are better than regular citizens. Want to be treated like Chicago's Finest? Act like it. Hold your own behavior to that higher standard.
Don't let the public and your family watch news cameras following you walking quickly out of 26th and California or the Federal Building, as an accused. Be always the accuser. Be above reproach always and you will sleep better at night..
Why after all the shit that's been comin down on us would you drink and drive? I've said it before on this blog..if you go out(to drink),leave your cpd logo shirts, caps and guns at home..take a cab or call a friend to pick you up..I go out all the time(to drink) with my wife and in 14 years have not had 1 incident off duty,I don't look for shit or start it..when I'm not drinkin you bet I'm packin..but even then if shit goes down call 911 and provide a good description...unless someone's beatin you, your wife, husband or loved one..fuck'em let the onduty guys handle it! or if you choose look the other way..
TO ALL ASA':
You are all on the radar now....all your hooiday party's, promotions, or just the end of a long day drinking binge somewhere in the city.......get behind the wheel and get pulled over ...dont even think of telling me your an ASA......YOUR DONE.....i dont usually do DUI's but now im polishing up my areas so I will be more than happy to check the $$$ box as I goto traffic court to slam ur ass.........its on ....and YOU COULD LOOK IN THE MIRROR TO THANK the person looking back at you for this........OH yeah JUDGES UR ON NOTICE TOO!!!!!!!!!
Your post reveals a lot about you, Rat Bastard. You worked for a loving and had a a college education LONG before coming on the job?
I don't know why I'm going to respond but here it goes. You don't know me, you don't know how much time I have on, you don't what I've been through on this job, so basically you don't know shit. If you are the W/C good luck with your decisions. I couldn't care less who gets released without charging. Your post also reveals a lot about you. I'll just leave it at that. Also don't forget to use the spell check. Be safe.
It's only a DUI if you get caught. If you made it home safe, it's a good night.
I'll drink to that...
I agree with the law of the land... but if you drink and drive, should we LOSE OUR JOB??????? If a doctor got a dui, would he/she lose their job? A lawyer?? A fireman??? HELL NO!!!!! So then why should we? Everyone makes mistakes... why should a police officer lose their job for a dui??? We aren't above the law, but we're not below the law either!!!!

Actually a lawyer would have to face disbarment a fireman would also be subject to the same disciplinary process we are, a doctor would have to go before a discipline board so yeah they could also lose their jobs too, you want to drink and drive and be safe at work? I think Taco Bell would be happy to have you.
11/20/2008 03:31:00 AM
You are a COMPLETE tool!!!! You couldnt match my arrests, awards...GET A LIFE!! I really hope someday when you get some time on the job, you can bring your hero ass to 022 and show us how to be the Police! You claim 2 cars were on "bullshit" jobs. Assisting a citizen and taking a personal are "bullshit"? I know...heroes like youself never take a break or maybe help out a citizen who needs assistance. I really can't wait till you can come to 022 and make this place the paradise you want it to be. Till then, stay in the ghetto and tell all the girls about your arrests and awards. Maybe they'll be impressed!!

Easy, Francis...u gots lots of anger issues. Yes I worked for a loving LONG before joining the CPD at age 51. When you have a family member killed by a drunk driver maybe you'll see things differently, but I doubt it. Your narrow view of the world won't allow you to change.
I regret someone picked on you in the 3rd grade when u shit down your pant leg. It just goes to show how one incident can change someone's life forever, and how your kind of bitter fuck make the worst coppers and are often borderline retarded and are pussies, almost to the closeted transvestite.
Stop blaming everyone else for your mental illness and learn 2 love yourself (not just your hand), because that's the greatest love of all.
P.S., Bozo and Cookie also look forward to attending your 30 days pending psyc benefit.
"....I usually get really horny when I drink..."
Do you have time for a white wine spritzer?
Now, kees me you fool!!!!
"....just the leather chaps and vest, no pants. Suuuuuper!..."
Do you have time for a white wine spritzer?
Now, kees me you fool!!!
Is it a bad thing getting a DUI on the way home from work?
So, does this mean that all department 'approved' holiday parties will be about 1/2 price this year because there will be no alcohol served? Or does this mean that there will be no more 'approved' holiday party signs hanging in the station?
10:12 pm:
your the kind of first classs a/o I was referring to. You apparently didn't fully comprehend the two posters.
Finish using the city to further your education and then do a lot of us favor. Leave and join the private sector because you will not make it on this job!!!! you are a LOSER.
11/20/2008 12:17:00 AM
Oooh...10:12pm hit this one right on the moo-la-la. So you were able to comprehend 11/19/2008 01:18:00 AM? Only because you're as big of an ass as he/she/it is.
On another note, DON'T USE A PERSONS FULL NAME HERE. You want everyone in your business? AP is a good man, and a career and lifetime of helping others on and off duty doesn't need to be ended like this.......

huh?
Once again, to the unpublished asshat:
Names of those convicted or published in the media are permitted at our discretion due to the fact that they have become public figures. That has almost always been the rule. Go read three years worth of comments to educate your dumb ass.
And whoever you keep thinking we are, you're demonstrating over and over that you're an idiot. Besides that, rule #1 forbids speculation on the subject. You really have no fucking clue

No, not at all. While you're at it, stick up a liquor store or two why don't you.
Maybe the Christmas/Retirement parties could be held at Chuckie Cheese from now on.
I do agree with the post about not attending the unit holiday party. It's always been about making the commander look good. To pretend like we all love to work for him or her. To give the illusion that we are all happy in our unit.
I realize that most Xmas parties also honor the year's retirees, and they don't deserve to be screwed. I'll throw in the extra bucks to buy the retirees' gifts, but I won't buy a ticket for the party.
I bet that most retirees don't even want to attend their unit party. Why get "honored" by some punk jagoff exempt that doesn't even know you? We just want to get the F out of here and forget about this job and this city.
Sadly you see that more and more. Nobody announcing their retirement, just walking away like its any other day of the week.
The system gets what the system wants. The department is designed to push your stress limits. Everybody handles stress differently. General orders are made for this department based on officer mistakes. They do not appear out of the blue.
When a officer violates a general order the department will hammer you. The department will fire you. Blue shirts can be replaced.
Learn from other officers and do not drink and drive. Ever.
Play the game or leave the game. Not the only job in the world. Just a illusion of safety. The police are over scrutinized and under appreciated.
Be a hero to your family and collect on the first and the sixteenth.

Yes disbarment, like Judge McGinnis, you do realize she is a lawyer right? Firemen may by disciplined, but they are not getting fired or taking major time. Doctor, the Doc who killed Kanye Wests'has been arrested for DUI multiple times and is still performing surgery and killing people. So stick it up your ass stupid. Theory and application are two different things.

Wow!
11/19/2008 01:34:00 PM

1. For years? How long ago did you take the CPD test?
2. I don't want to work with you if you are going to suck up my oxygen and complain about my grammar.
3. Your excited friends must have little to no time on the job. Therefore, I conclude that you failed some portion of the exam and are waiting to be rescored.
4. It's not "these blogs." It's this blog.
5. Refrain from dropping the "f" bomb. It might make you sound more like your grammar is less poor than it actually is.
puck u be wanna! HAHAHAHAHAHA
GREAT GRAMMER!
Yes disbarment, like Judge McGinnis, you do realize she is a lawyer right? Firemen may by disciplined, but they are not getting fired or taking major time. Um...you asked a question about the grammar used on this blog and failed to use a question mark at the end of your sentence. This would mean that you cannot punctuate properly-which I belive counts as grammar. Please get off this blog. You are a moron and no one cares about what you think on this blog and probably in life either.
