Chalkie 2016 Update

From the comments:
  • I just received the following from the USOC. Apparently, the words "CHICAGO 2016" are the "intellectual property" of the USOC.

    Dear Chalkie,
I appreciate the good work you do and your efforts to honor and support the Hundred Club. Unfortunately, by using the mark CHICAGO 2016, you are creating an unauthorized correlation between your fundraising activities and the Olympic Movement. The USOC has a well established practice of registering trademark sequences that include venue cities and year components. Therefore, the mark CHICAGO 2016 is also covered under our legislation, making your use of that city/year mark unauthorized. The fact that it is being used commercially to raise funds without USOC oversight or permission places your use squarely in violation of our legislation.

I restate my request that you select an alternative mark that does not feature the intellectual property of the USOC.

    Respectfully,
And hopping over to the site, it appears that the USOC lacks any sense of humor or proportion.

We'd hate to see this worthy cause fade into oblivion, so we suggest any of the following remedies:
  • "Chalkie 2016" as a catch phrase;
  • a reader suggested "Chalkie World Tour" with a listing of homicides by district on the back;
  • "Tokyo 2016" instead - the USOC isn't threatening the Japanese, are they?
We're sure our readers can come up with dozens more.

Okay guys! Put down the beer and put on the thinking caps. We need a new catch-phrase!

Personally, I think the Chalkie figure with "2016" superimposed over it would be fine and copyright free.

I'd say that it's worth a legal challenge, but whatever. "Chalkie 2016" does an excellent job of getting the point across in re: the Olympics. The "World Tour" thing is nice and generic, though. And it'll require a new shirt every couple days.

The Illinois Congressmen listed below have not signed on as co-sponsors of the Social Security Fairness Act of 2009. HR 235 and S 484 provide for our retirees and their spouses to receive the full social security benefit to which they are entitled. Please help us in our efforts to pass this legislation by contacting these legislators. FOP members who live in these districts would be particularly beneficial.

If this is a real letter from the IOC, does this mean that perhaps they are aware of all the murders in Chicago? That it's not the safe, beautiful city the Mayor says it is?

Cops protest pension deal with mayor's nephew

John Gallagher Jr., executive director of the police pension fund (center), is surrounded by off-duty and retired Chicago police officers holding protest signs at a fund board meeting today. (Kuni Takahashi/Chicago Tribune)
Dozens of Chicago police officers jammed a pension fund board meeting this morning to question a deal with a real estate investment firm involving Mayor Richard Daley's nephew, Clout Street reports.

The Tribune recently reported that the city's inspector general, David Hoffman, is investigating the public employee pension fund investments in DV Urban Realty, which includes mayoral nephew Robert Vanecko and Daley ally Allison Davis.

But pension board officials say they are not obligated to respond to a subpoena from the inspector general, who is empowered to probe potential wrongdoing in city government.

One officer at the police fund meeting wanted federal prosecutors to look into the DV Urban deal. The officer held up a sign reading, "Hey, Patrick Fitzgerald, would the pension board ignore your subpoena?"

Chicago 2016 Dot-Com-troversy Heats Up

Friday, September 26, 2008 9:16pm EDT GB Editor
Font size:
"Chicago 2016" is a trademark of the USOC
The Chicago 2016 bid's attempt to quickly take control of the coveted Chicago2016.com domain name from entrepeneur Steve Frayne has failed and it will now be up to U.S. Federal courts to sort out the mess - a procedure that could take months or years.

Chicago's Olympic bid committee sought to enforce their "Chicago 2016" trademark by filing a claim with the World Intellectual Property Organization (WIPO) earlier this year and claiming that Frayne was using the domain in bad faith. However, Frayne and his attorneys filed a motion to suspend the proceedings so that the issue could be heard by Federal courts. This week WIPO granted the motion and terminated its involvement in the case, according to filed documents.

The issue is not a simple one.

THIS GUY BOUGHT THE DOMAIN NAME CHICAGO 2016 AND NOW THEY ARE TRYING TO STEAL IT FROM HIM--NOT SURPRISING, HUH?

DOES SEEM TO SUBSTANTIATE 'CHICAGO 2016' IS INDEED TRADEMARKED HOWEVER.

SCC:

Sorry for the long post.

Pension Board Meeting

I attended the Pension Board meeting today. For the purpose of this posting, I will refer to the Pension Board as members and the attendees as contributors. Approximately one hundred contributors attended. We were immediately met with John Gallagher advising us that only 44 people were allowed in the room so as not to violate the fire code, which meant only 26 contributors were permitted in the room. This was not well received. Contributors were allowed to remain in the hall, many of whom could not see or hear the proceedings. Unit Representatives were not accommodated.

The first topic of business was the subpoena to the Board by Inspector General Hoffman regarding Vanecko’s Investment Firm. Mike Shields attempted to speak several times and would not be recognized by the Board. Not until a contributor stated he wanted Shields to speak was he afforded the opportunity; he was repeatedly denied. The members stated they have complied with the FOIA for the Sun-Times and Tribune, and if Hoffman would apply under the FOIA, the members would comply. Their reasoning for denying the subpoena is that there is an Ordinance not allowing Hoffman to subpoena the Board. I suspect this would be same Ordinance enacted to castrate Hoffman after he did not behave like a “machine employee” and conducted investigations into elected officials, also known as Aldermen.

A member then went into something about tapes. He stated tapes cannot be provided without a Judge’s order and only after the Judge has listened to the tapes and found them to be relevant. I found this to be very concerning. I feel the answers to our questions lie in these tapes. That may be where the real story is.

Member Steve Lux was not very interested in the meeting. He was eating his donut and dismissive of the whole proceeding. Thank you, sorry to interrupt your breakfast.

A legendary contributor asked if there was nothing to hide, why won’t the Board comply with the subpoena. The response: “If we volunteer something, where does the road end.“ This contributor certainly would be a good candidate for FOP. He was relentless.

Shields stated there should be transparency with regard to the Pension Board and the pension issues. This kid is very articulate and has a big future at the Pension Board, FOP or politics if he so desires. I would hope all of the readers and contributors support him fully.

Health Insurance was discussed. The Board feels provisions for insurance will not evaporate in 2013. They are forming a committee to address this issue. The committee is to be announced shortly. Hauser has been nominated for the committee. I hope he enjoys it; there were a great number of retirees in attendance and they’re not playing. Hauser’s future with the Board appears to be bleak.

We were informed Medicare costs would decrease due to stimulus. I hope the decrease amounts to more than the six dollars I see every payday that the stimulus has provided.

FOX 32 arrived and the reporter stated his camera crew was not allowed upstairs. The Board President allowed the camera crew in.

Sid Davis (FOP) asked if the Board would appear in a venue which would accommodate more contributors. They said yes but could not guarantee the full Board would appear.

Portability was discussed. There is a bill in the House to for legislation to include the Aviation Police.

When the Board was asked about a specific investment firm that has continuously been losing money, they stated the firm has recovered and the investment is up 20%.

The Board stated the city is not in arrears in pension funding and the city always meets it’s obligation. I found that to be very surprising. I guess after forgiving millions of dollars owed by the city, they decided to keep up with it.

The pension fund is 45% funded. When an inquiry into additional contributions by the city was made, the Board responded that they ask the city by letter every year for an increase in contributions and it is denied.

The Board President gave some very gracious comments before adjourning the meeting, and stated there is a lack of communication between the Board and the contributors and he would find a way to remedy that.

My opinion: With the exception of Shields, every elected member should be voted out and replaced with representatives that will be a thorn in the sides of the appointed members every day of their lives.

I think this is B.S. And not from the USOC. If it is then the City is also in violation since they're using it as well. And, using it to raise funds from the private sector to fund the fiasco/Olympics in Chicago.

According to the email I just recieved it sounds like Chalkie is not the only one in hot water for wrongful trademark usage. Email follows below:

I have received a call that FOP State Lodge President Ted Street is an applicant to fill the position of Executive Director of the Illinois Law Enforcement Training and Standards Board (Tom Jurkanins position). I was asked if I could provide the names of the selection committee and the Board chairperson.

As you know the issue of fraudulent fund raising using the name of the Police Memorial has been turned over to the Attorney General for investigation. I would think the fact that Mr. Street authorized that fundraising tactic by the FOP should disqualify him. I also believe that His long time position in FOP would be a conflict.

Anybody want to lay odds that Donahue is eyeing the State Lodge Presidency as his parachute outta here? Another reason to keep dragging out the contract huh Mark?

We were told that only about twenty of us could be present in the room due to the fire code, we questioned it but were told they would not begin the meeting until some of us left the room. We then filtered into the two adjoining hallways but no one left.

The big issues were the release of information regarding suspect pension investments that were requested by the Chicago Inspector General's Office. The Bd says they will release any and all information to any entity that files a proper Freedom of Information Request. Those in attendance let the Bd know in no uncertain terms that the membership wants the information released, we want full disclosure and transparency.

The second big issue was retiree health insurance to which they responded that they are currently trying to work on it and that in their words people who are under the belief that the benefit will simply be removed are mistaken. Stay Tuned. (But really how much more could we afford to pay for our ever diminishing benefits we pay more and get less in return.)

Finally, someone asked if the city is behind in their contributions and they said no, however they say they have approached the city numerous times in an attemt to increase the contributions and help stablize the fund but that the city is stalling. The result is that our pension fund is currently funded at 45%. They claim in the 90's the fund was at its highest level, 70%, now were down to 45%. more reason to open up the books.

Make no mistake, we ruffled some feahers today. It was uncomfortable for everyone on the Bd other than Mike Shields who was trying hard to hide the shit eating grin on his face. In the end there was an agreement to find a larger venue where all reps and members can meet with the Bd in an open forum. I urge everyone who can attend, to attend. Will post info as soon as it becomes available.

Use of a period signifies the end of a sentence and thus must be considered two separate phrases, distinct from their registered trademark.
(You might dig up the wiki on trademarks too...)

So try:

Again, fair use comes into play.

Beyond that, neither the IOC or the USOC can lay claim to a year. Think about it, if they did, every other 2 years would be off limits.

They'd be better off letting it go and not drawing attention to themselves, but you just know if they keep it up it will break in the MSM.

Which, of course, would defeat the purpose of what they're currently trying to do.

This may sound stupid but does that mean that no calendars in the year 2016 can be printed for the city of Chicago? For some reason using Chicago 2016 doesn't really sound like something they can make claim to. If so I'm going to get Chicago 2010, 2011, 2012, etc registered in my name so no one else can use those to make any money with them. I think they're just blowing smoke, fuck them and Daley.

As has been written here before, changing residency is first off a matter of changing Illinois labor law. That law says we (chicago police officers) cannot bargain for residency since we live in a city over one million in population. that one line in Illinois labor law prevents only Chicago Police Officers from ever bringing the issue up at contract time.

On another contract topic, I was looking through an old FOP newsletter, a contract summary dated August 2, 1996. That one has a summary of the contract that went from July 1, 1995 through June 30, 1999, some fairly good years for the economy.

We got a total raise of 14.5% for that 4 year contract. That comes to 3.63% a year.

The raise that was most recently on the table was 16.1% over 5 years. That comes to 3.22% a year averaged over the life of the contract. And that is in some fairly difficult economic times.

Historically the 16.1% raise is not too far off from 1995-1999. Forget what the aldermen get or anyone else. Look at what we usually get. Look at old contracts. It is in the ballpark. If it is ever again on the table it will likely get accepted if we do not file for arbitration.

Ask a GM worker if a 16.1% raise is acceptable.

I know, this is heresy, no keeping up with cost of living etc. But all in all, not very far from we have been getting for years. But then again it is not even on the table any more.

I personally like the Shields brothers. However, unless they had a falling out with Daley, I would argue they ARE clout heavy.

At one time their sister ran the Chicago air & water show as the Daley appointed head of the Mayor's office of special events..yes?

Maybe I am misinformed. But, either way Danny got to fly with the Navy Blue Angels while they performed because of his clout.

Good luck to them, they saw the light!

Hey USOC, Don’t beat up on our friend Chalkie,

Remember, as Shortshanks has forgotten, that you need the police more that they need you.

The Olympic$ might have been a good thing, IF WE COULD AFFORD IT AND IF THAT IDIOT MAYOR TOOK CARE OF THE CITY EMPLOYEE’S FIRST!

Maybe, in the future, when times are better, under different, more sensible administrations, all the way up to the White House, we might welcome the Olympic$.

So come to think of it, if you are going to lay claim to the phrase,
“Chicago 2016”…

then I will claim…

“Chicago 2020” and
“Chicago 2024” and
“Chicago 2028” and
“Chicago 2032” and
