Question on the Double Standard

How is it possible to be an active police commander with an active Order of Protection against you? Isn't that some violation of State Law concerning the surrender of firearms? Can someone from Callback let us know about that? Because we're pretty sure there are a few dozen people down there under the same sort of Court restrictions who are wondering the same thing we are.

There's an open CR. There's a case report. There's an Order filed - an e-mailer claims that the victim was removed from his regular duties today so as not to violate his own Protective Order.

Things that make you go "Hmmmm?"

Once the OOP is there, IF there is in fact an OOP. W weapons restriction is standard unless waived by the judge. Being as this is, from what I understand, a "telephone harassment case" I doubt such OOP even exists. I think this whole thing is pretty much bull shit. Its an argument where one side gets the story out first to the front page, leaving the other side for a page 10 answer.
Not sure though, just guessing

An order of protection doesn't necessarily mean there is a firearm restriction.

An order of protection DOES mean that a CR is initiated and OPS investigates the allegations.

If there is no firearm restriction, the member continues to work. I've only seen members stripped if they were charged criminally.

If there is a firearm restriction, the member is in a no-pay status until (if) it is lifted. Usually that means going to call-back until the CR is finished....assuming it doesn't warrant being fired.

don't know about an order, but..if there is one, does it involve possession/surrender of a firearm? As far as moving "the victim", don't they normally "move" the offender in a domestic beef?

If there is an active order of protection, she has to give up her weapons. Enough said. If not the city and police department are opening themselves up for HUGE civil case. How about this commander, who i dont know, be subject to a a "Fitness for duty evaluation"? Blood , urine, and psychological exams. If it was a P.O. that's exactly what would be happening.

The victim didn't show up in 011 today to do his daily mail pickup, and that had us wondering what kind of shit they were maybe trying to pull with him.

It's nice to see the clouted get their comeuppance. But time will tell if Henny Penny's reverend network of noisemaking fools will go to bat for her dumb ass. If she lands on her feet after this mess, it will forever reinforce the statement that "clout rules" on the CPD.

This couldn't have happened to a more deserving useless piece of shit - kind of like karma coming back around to make amends for the stupid stunts Penny's pulled in the short time she's been the D.C. Like ordering an E.T. to document bathroom stalls because someone called her on wanting all black officers working the desk. Or throwing a fit about homemade ornaments hanging on the district Xmas tree. Or bragging that Eric Washington was dumped because she would be the one to make a difference in 011's morale and crime statistics. The list is virtually endless in the short time she's been at the helm.

Anyway, enjoy what should be your demise, Penny. You WON'T be missed by anyone here other than your useless pawns in the front office.

Dear Sirs,
If you are charged with Domestic Battery / VOP; as a condition of your bond (Usually) you are required not to carry a firearm. This puts you in a no pay status. Your weapon is not surrendered, at least not in my case (Domestic Battery). An active Order of Protection does not preclude you from carrying a firearm. It is simply a judicial order, with no restrictions, unless there is a special remedy attached. If the VOP is violated an arrest is mandatory by general orders. An arrest on a Domestic Battery is not mandatory.
If you are a blue shirt and you get sent down to callnback, get a locker. You are looking at 2-3 years wasting away taking reports for lost wallets, and nonsense.
Hope this clarifies the issue.
BTW dont look for help from the FOP. They are about as useful as tits on a boar hog. That includes GB

This is just one more example of the two-tier system of discipline on the Chicago Police Department.

1. Those who have CLOUT are not subject to discipline or the CPD Rules & Regulations.


2. Those without CLOUT, "the UNCLOUTED" lose their jobs, take heavy time for nonsense, are made Behavior Alerts, Personal Concerns, psyched, stripped and placed in ARPS, demoted, dumped, involuntarily transferred and so on.


The Chicago Corruption Machine protects its own.

The city where CLOUT counts.

With the order of protection, it is up to the Judge to decide who gets to keep their gun. AND I am sure there would be no influence from city hall that would make a judge sway towards the City's girl...Ha Ha Wink WInk

THe funny thing is at the last CAR meeting Jfed and his crew were kissing Penny's ass...They gave her huge kudos for recognizing that the MSF commander and his analyst discovered a crime pattern in her district. You would think she solved the robberies when in reality she didn't even know they were happening.

All orders of protection are not created equal. It is not mandatory that guns be confiscated or restricted; that is up to the judge.

And, if the judge DOES order the gun pulled, the subject of the order has the right to go into court and asked for it to be amended, so they can carry their gun for work.


It used to be that guns were automatically restricted and a lot of police and security people were getting hit for their guns, then weren't able to work, and often it turned out the claims against them (in order to get the O.P.) were falsified intentionally to very deliberately force the person out of their employment.

Why was the victim punished? If there's a valid OP, the named offender should be removed from the equation so the victim's normal life isn't affected. He should continue on in his normal assignment. Maybe SHE should not.

Aren't we supposed to be in the business of protecting the VICTIM, not the offender?

(14.5) Prohibition of firearm possession.

(a) Prohibition of firearm possession. When a complaint is made under a request for an order of protection, that the respondent has threatened or is likely to use firearms illegally against the petitioner, the court shall examine on oath the petitioner, and any witnesses who may be produced. If the court is satisfied that there is any danger of the illegal use of firearms, and the respondent is present in court, it shall issue an order that any firearms in the possession of the respondent, except as provided in subsection (b), be turned over to the local law enforcement agency for safekeeping. If the court is satisfied that there is any danger of the illegal use of firearms, and the respondent is present in court, it shall issue an order that the respondent's Firearm Owner's Identification Card be turned over to the local law enforcement agency for safekeeping. If the court is satisfied that there is any danger of the illegal use of firearms, and if the respondent is not present in court, the court shall issue a warrant for seizure of the respondent's Firearm Owner's Identification Card and any firearm in the possession of the respondent, except as provided in subsection (b), be turned over to the local law enforcement agency for safekeeping. The period of safekeeping shall be for a stated period of time not to exceed 2 years. The firearm or firearms shall be returned to the respondent at the end of the stated period or at expiration of the order of protection, whichever is sooner.

(b) If the respondent is a peace officer as defined in Section 2-13 of the Criminal Code of 1961 [720 ILCS 5/2-13], the court shall order that any firearms used by the respondent in the performance of his or her duties as a peace officer be surrendered to the chief law enforcement executive of the agency in which the respondent is employed, who shall retain the firearms for safekeeping for the stated period not to exceed 2 years as set forth in the court order.

(c) Upon expiration of the period of safekeeping, if the firearms or Firearm Owner's Identification Card cannot be returned to respondent because respondent cannot be located, fails to respond to requests to retrieve the firearms, or is not lawfully eligible to possess a firearm, upon petition from the local law enforcement agency, the court may order the local law enforcement agency to destroy the firearms, use the firearms for training purposes, or for any other application as deemed appropriate by the local law enforcement agency; or that the firearms be turned over to a third party who is lawfully eligible to possess firearms, and who does not reside with respondent.

Order of Protection from Illinois Code of Criminal Procedure
The provision isn't automatic but has to be requested by Petitioner but it's one of the basic remedies that are usually asked for.

As long as the judge waives the issue surrounding the weapon, and does not issue a restriction for work especially, you can still carry your weapon and work. We have at least 8 P.O.'s and 3 Sergeants with a similar issue. I can go to court and get a Civil Order of Protection with no case report, just on my word, and my wife could have not done a thing. With the right story, I could put Speilberg to shame!

He's part of the CPD courier service, meaning he drops of the interdepartmental mail and picks up the mail at districts. He also transports inventoried evidence of crimes. Having a gun might be handy.

I think maybe many of us are missing a finer point. Regardless of the threats of force by the CO (have you seen her?) it is my understanding that she is is on tape threatening to mess with his job. So here you have the commander of a district, a position that wields quite a bit of power, threatening a blue shirt with whatever underhandedness they might think of. How cany any boss let a supervisor, who has knowingly threatened to abuse her station, remain in place? What message are they sending us? Think long and hard about that. In my mind the abuse of power is as bad as it gets, because the powerless have no recourse.

The mere fact that there exists a double standard of discipline within the Chicago Police Department is proof of the failure of the leadership of the organization.

Have we not all heard within the CPD the refrain that "rank has it's privilege?" This is usually spoken with disdain and scorn. What is means on the CPD is that those of high rank get to do what they want. They get to flout the rules, the very same rules they are charged to enforce over those of lesser rank.

While rank has privilege, rank is meaningless if it is not steeped in responsibility:

Responsibility to those of lesser rank.
Responsibility in every way to ensure the very best of treatment for those of lower rank.

Ultimately those who exercise high rank will ask those of lesser rank to make sacrifices. And those of high rank surely will not succeed if those of lower rank have only been used, and not responsibly led.

The real test of leadership is not in conquering the enemy’s weakness.

The real test of leadership is conquering your own weaknesses in pursuit of the welfare of those whom you would choose to lead

There have been a few good leaders on this police department. There are not now any that I know of. Our superintendent failed as a leader when he chose to exercise his power to punish one of us of much lesser rank who had already been punished.

Rather than train and teach our superintendent chose to imprison. Everything he tries to accomplish after that is an exercise in futility because he has already failed.

What now? Stay safe and take care of each other and pray that somehow good leadership will arrive soon.

A judge can give a special order to allow an OFFICER to use his weapon for employment purposes. I have seen this done in domestic battery cases in Chicago.

rod blagoyevich was the individual responsible for passing this law and it includes peace officers--- if you are arrested then you will be stripped and not be able to carry you firearm--- if the judge does not write a special condition onto your bond waiving the gun restriction then you will be placed into a no pay status until the judge writes it or the case is adjudicated--- if you are stripped you keep your guns locked up but if it is a domestic issue you have to surrender your weapons--- when judge orders weapons returned you will need a valid foi card to retrieve weapons from erps per general order.... if you are just a named offender in a case report it is up to the ccsa whether or not you will be charged and does not automatically mean that you will be placed on restricted duty(stripped)....

I am tired of this two-tier discipline process that ends as a cover-up for the white shirts/exempts.

Granted, I've seen more sergeants taking hits lately then ever before, but most of the time if you are wearing a white shirt and you break a department regulation or commit a crime, you walk with nothing more than a slap on the wrist.

One day there will be a civil action because of this and hopefully it will result in a big payout to the blue shirt who is unfairly disciplined or lose his/her job because of this double standard.

Finally, what is going on with the media that they don't jump on these stories? Oh, that is right, THEY HAVE DOUBLE STANDARDS, TOO! I guess they can't report on the same people they share a bed with.

It's a chain of evidence(custody) issue. It was dealt with years ago and the decision was that a sworn officer must pick-up/deliver, inventoried drugs, money, guns, etc.

regardless of the DISLIKE for the person involved, we NEED to remember that the person is part of our department. We need to keep the "dirty laundry" within our house. Personal matters of anyone should be kept personal. We don't need to open windows for those sharks outside, who will erode the declining morale of our department. If the leaders in this dept want any credibility, they should start treating the brass the same way they treat the underlings when it comes to CR's, investigations, stripping, etc. If anyone from callback is being held hostage for the same crime, ie. domestic beefs with OOP, they should be screaming discrimination. If there is a firearm restriction, the member is in a no-pay status until (if) it is lifted. Usually that means going to call-back until the CR is finished....assuming it doesn't warrant being fired.

Clarification: without the lawful ability to carry a firearm you are detailed to 376 (ARP) status: restricted duty (civilian dress- no police powers/auth).
Been there ; done that.
Note: In my 30 years, I have never seen any rank higher than Lieutenant detailed there (triggs).

I think our pension is governed by the state. Its not a contractual issue. All other industries like pilots, teachers, etc when they have a two tier pay scale, always start with new hirees, not people that were in the old pension. Lets hope it stays that way. Also when reading about the pension shortfalls and the recommendation from committees, they recommended that all new hirees would start a new pension system, not changing anything for the people already in the pension

Residency isn't a state law it is a city rule. The state law states that citys with populations over 1 million can make own ordiance via home rule. Pension is guaranteed but the constitution can be amended if the city state convince 60% of voters that it needs to be changed. Nothing will happen to Penny. The phone stuff is inadmissible because of eves dropping laws in state. You don't automatically go to call back when if there is an order of protection against, even if you don't have clout, depends on circumstances. Judge can decide not to take your gun. Ernie Brown has experience in this type of thing so he is probably being consulted.

The problem is not any of the above, but the fact that as an exempt member she should be an example. Plus, isn't she violating a rule by bringing disrepute to the Department. A real boss would resign their gold star for the good of the Department. But being she is not a real boss.....

From one who has gone down this road before.

NO matter what, the guns are to be surrendered. If there is an order of protection in place, per IAD they take your weapons. They physically come to your house and remove all weapons you have. You are put on a "no pay" status until the order of protection is heard by the court.

When the order of protection is heard and the person is exonerated in court your weapons can then be picked up at ERPS....... After you give a statement to IAD

Secondly, this person can go to ANY court in ANY state and again and again and again and try to get the same order of protection. Everytime, IAD finds out about another order of protection the next day, the officer is then stripped AGAIN, no pay status.......

In my case, my nutty ex husband got one on me in Cook County, they retrieved my weapons, I was cleared through the court and then had to give a statement at IAD where they found a ruling of unsustained. When that happened, he then went to an Indiana Court and got the same ex parte order against me, which took me a month to get a court hearing. The Order of Protection said that I WAS NOT BRADY DISQUALIFIED, meaning I COULD carry my weapon...... IAD STILL STRIPPED me and took my guns for a second time on a no pay status.

So this is all bullshit. Been there done that, and have the court documents to prove it.

IAD RULES state if you have an order of protection you are stripped. PERIOD!

Clout rules on this one obviously!!!

True story. I have a friend who is a police officer in a suburb of detroit. They were given the option of staying in their pension fund (traditional like ours) or going to the 401k....he stayed and is enjoying his pension...the 401k group lost alot due to recent economy woes and are still working after 25 plus years

Some of us that read this Second City Cop blog have been retired for a few years before Weis took over and are not familiar with who Henny Penny is.

I for one would appreciate it if those in the know can just say the full name, There seems to be no problem saying "Dump Daley," or "Weis and Masters" so say the name.

Off topic...

Some p.o.'s think that there are other p.o's that make it worse for us on the job. I really never looked at it that way - that was until I was informed of a special attention. This special attention involves a non-working female p.o. who resides in 12th. So over the weekend, this p.o was "victimized". Dig deeper and ask around and you will find that this p.o. is in my opinion- the type that makes us look bad. You know, the one who mentions they're the police for every possible self-benefit, flaunts it, throws her power around. Apparently, she has had various negative interactions with a few of her neighbors before.

Will I pass any more than usual? NOPE! She made her bed with her ways, now let her lay in it. Any p.o. who makes this job harder and our reputation suckier doesn't get my special attention.

That smile doesn't fool me. Then again, this is all in my own opinion.

Your logic is severely flawed. Illinois has a 2 party consent for recorded conversations unless you have a court order approving a wiretap. When you call a phone and the message says: "leave a message" then beeps and you leave a message, you gave tacit consent to have your voice recorded. Thus, the evidence will stand and it appears it is quite irrefutable and damning.

It's not eavesdropping if you leave the message on voicemail. The law says that both parties to the conversation must know they're being taped. She knew he was leaving it on voicemail he knew he had. All admissible.

Sorry, you are wrong. She freely voiced messages on his phone, she knew she was leaving a recorded message, the eavesdropping law doesn't even apply here.People making so much money in these leadership roles should be role models and setting examples. They are expected to behave in such a manner that won't discredit the department. Command ignored Aunt B's drug house so I won't be surprised if they ignore this, but is sends out the wrong message to the 8000 police officers on this job who would be in callback on midnights if it happened to a blue shirt.

More importantly...it's not that they get what they deserve, it's that, eventually, they reveal their true nature. When people are put in or ingratiate their way up to positions they have no business being in, they can only hold their breath so long before they end up doing what comes naturally to them. When that happens, they embarrass not only themselves, but the people who put them there, which is like an extra added attraction and makes it doubly entertaining. You get to watch the self destruction of the idiot and watch their patron wiggle out of the catastrophe.

As an aside, many years ago me and a friend had an acquaintance who while hanging out at a bar told us how she jammed up some cop she was dating with allegations of d/v. As the story unfolded it was clear that the female was a drunk and a whackadoo and the cop must have figured this out and moved on so she decided to fuck up his career. Since the cop was a friend of a friend of a friend, and we thought this was very fucked up, the next day we went to the district he worked at and asked to speak to the Commander. I remember he was kind of an asshole and his nose glowed like it was radioactive but after he was sufficiently done patronizing us and realized we would follow through on whatever was necessary for the officer, everything got straightened out. I have to admit, while this bears no resemblance to the Henny Penny debacle, I remember a time when the number one problem for cops were the goofy broads they dated. Don't know if it's still true.
