McDonald Decision (UPDATE)

Here it is:
It seems City Hall took delivery of 30 or 40 oxygen canisters early this AM. Daley is in full hyperventilation mode, blaming guns guns guns and attempting to ram through a whole bunch of delaying tactics or blatantly illegal ordinances that will accomplish nothing but wasting taxpayer dollars - which as we all know are few and far between nowadays.

Give it up Shanks - we can't protect everyone all the time and you are actively seeking to create more casualties as the city spirals into Detroit II. Give law abiding citizens a fair chance to defend themselves, their loved ones and their property.

I agree that you should let a person (a law abiding - no criminal background person) have a handgun in their home and not have to worry about getting arrested for it and your gun getting seized and melted down.

It's time for the Cook County Judicial System to get their head out of their ass and enforce the gun laws that are already on the books.

Ya know, I don't live in the city but I cover all of these stories. I have to ask....Is Daley really as stupid as he sounds? Are his top level people really stuck so far up his ass that they cannot even tell him how the legal system works? This guy used to be the Cook County States Attorney and he has no clue how the system works?
In the Sun-Times article he is quoted:

“What does a first-responder [do when they] come to your home, if you have 50 guns and you pointed a gun at your wife? You have a legal right to a gun,” the mayor said.

“Can we interfere with that display of a gun if you’ve shown it to somebody in your home? Of course not because everybody wants to sue the city. They want to sue you, the taxpayers, to try to get money out of your pocket…That’s what we’re worried about.”

Really? I mean really? This guy has no clue of the difference of "pointing" and "displaying" and has no idea what the Domestic Violence laws enable us to do.

He really not only makes himself look like a total dumb ass but makes it appear that we have no idea what we are doing on the street.

My sympathies to my brothers and sisters in blue in Chicago for having to deal with a total moron like this.

Well said... When seconds count, the police will be there in minutes. Chicago compares to war zones around the world, because of the greed amongst the political ruling class... Pathetic. Stopping gun violence means ending the Dumbocratic reign and doing everything differently. It's too bad that we are going to become a California/DC hybrid, and very little will change. You'll still never see concealed carry, which is the only real "common sense" solution to all of the city's woes.

The Scum Times story headline says the decision "casts doubt" on Chicago's gun ban. Casts doubt? It OVERTURNS Chicago's gun ban.

"If the ban is overturned, we will see a lot of common-sense approaches in the city aimed at protecting first responders," Daley said. "We have to have some type of registry. If a first responder goes to an apartment, they need to know if that individual has a gun."

Why is this suddenly an issue? Chicago's been registering guns for years and to date, I've NEVER seen an indication on my PDT that there's a legally-registered gun on the premises. How about including other important information, such as "a known police fighter resides at this location", etc.

The only warning I've ever seen on my PDT was "Do not park in front of the building" when going to 11th & State years ago.

Daley's LYING (again).

I’d like to recommend the following to my South Side neighbors. 1) Chuck’s in Riverdale. He’s put up with the Reverends’ (Jackson and Pfleger) demonstrations at his store for years. Let’s give him payback. 2) Freddie Bear in Tinley Park. No car? No problem! Take the Rock Island to Tinley Park (Oak Park Ave) stop and walk 1 block. 3) Rink’s in Lemont. Worth the drive. Small shop with range and great prices – and no Cook County sales tax! 4) Skip the “Mega” location(s). You’ll get better service and better prices elsewhere.

The mayor is talking about making training a requirement to own a handgun. I see it now, 2-3 year waiting list (like the carbine program) to get in. And where are they going to do it at the area ranges where (when its not down for ventilation issues)they can qualify maybe 10 people a day?

Don't make no difference, at least in the short term (pun intended).

Daley has and will ram threw the city council new ordinances that will make it hard for any LAW ABIDING citizen to arm themselves.

Those ordinances will be challenged, probably all the way to the Supreme Court. Tax payers will foot the bill and in the end Daley will lose and the city will be millions of more dollars in the hole.

Does anyone remember when it became state law requiring any citizen that made a formal complaint against a police officer to sign an affidavit to the facts and that if found to be fraudulent, they would face criminal charges? What was Daley's first reply? He stated that he would not enforce such a law because HE thought it would make citizens afraid to complain.

Anyone who has common sense knows that this ruling means nothing to the illegal gun buyer. It’s obvious what the causes are for gun violence in this city, there has been post after post correctly pointing a finger and this change in the law won’t affect any of the illegal carriers: a 20yo still can’t buy a handgun, a convicted felon still can’t buy a gun, any criminal act with a firearm is still armed violence, etc.

The only real change is that now every law abiding homeowner in 008, 016, and 022 who wishes to acknowledge what they already own or go buy a new weapon will be able to use it without fear against the shit-bird elements that have been spreading like cancer into the last bastions of the city. So now that the piece of crap who rides his baby’s mama’s section 8 coat-tails to pollute what used to quiet neighborhoods spreading the influx of Spanish and black gangs has to think twice before furthering his property crimes career knowing that there is a chance another 80yo man might blow his worthless head off. If you don’t believe the cancer mass is spreading, look at the new CHA unit maps.

Now that the Supreme Court circus is over, let’s concentrate on battling the useless laws that Daley and his minions will attempt to enact. Be sure to voice your opinions, join the NRA and ILRA’s efforts to trounce what will be Daley’s efforts to over-tax and regulate the legal gun owner. Remember, if you sit passively while others lobby for you, you don’t have a voice and truly cannot complain when you do not get your desired result. Now I’m off to the gun store before they raise prices even more.

The Daley dynasty will continue doing what it does so well -- making gun ownership so onerous that it's difficult-to-impossible. In any case, the Mayor's first line of defense has always been police officers behind district desks who are simply "out of" gun registration forms -- and it's been white police officers in predominantly white districts who've repeatedly done this to quiet, polite, clean white working people.

You know who you are.

Funny how those forms magically appeared when the officer saw that the citizen "knew someone" at the station, exchanging greetings with them as they happened to walk through the lobby.

As a lifelong Chicagoan, I wonder what this will mean for the city. More shootings? Less shootings? Heck if I know. My guess is we won't see the numbers change too dramatically either way, at least not for a while.

Personally, I'm kind of torn on this issue. As much as I'm sympathetic to the idea of gun ownership, I'm also leery of the idea that more guns will magically solve everything.

Still, the writing is on the wall, and I agree that the City needs to stop tilting at this particular windmill if it just means a waste of taxpayer money.

the mayor said his primary goal would be to protect police officers, paramedics and emergency workers from being shot when responding to an incident at a home. He said he also wants to save taxpayers from the financial cost of lawsuits if police shoot someone in the house because the officer felt threatened.

It helps us when we have statues against guns. I'm sure you hear on the news and read in the papers about all the shootings across the City each day. Without those laws against guns, we will be less effective as an organization to arrest gang members and drug dealers owning these weapons in the City of Chicago. I understand the U.S. Constitution and the Second Amendment. This right is useful in more rural areas, however, we live in a large city and the need for firearms are not as great. The more firearms that are available gives an even greater opportunity to get into the wrong hands and increase the amount of shootings that we already experience.

"Statues against guns" typo aside, I sent the Sgt this email in response:

Sgt. Weiglein,

Thank you so much for your quick response to my email, but with all due respect and gratitude for your experience and your service as a dedicated Chicago Police Officer, my family will have to disagree with you.

We’ve owned our home in this neighborhood since 1969, and have had the fortune to meet and get to know dozens of “2534” officers over the years who would disagree with you, given that as recently as last Tuesday, a Spanish Cobra had the audacity to flash a piece to a passing car on Wabansia at Kildare.

Fr. Pfleger may enjoy his time in front of the camera, but for those of us who live in one of the busiest districts in the city, we know full well, from experience, that the CPD can’t always be there when we need you to be.

The Olsen and Anderson families will continue to respect the law, as well as the men and women who are sworn to uphold it. However, please know that the residents of 16** N. Kildare Avenue have every intention of living within our constitutional rights, regardless of how many hoops the City determines we should jump through.

Here's hoping that the street cops we know on our beat have the courage of the convictions they've been discussing with us for over 40years now.

Accountability and CPD morale cries out that we are entitled to an explanation. Today, I mailed the following e-mail with copies to Mr. Grossman and the accused:

Please advise me on the status of my complaint of COWARDICE vs. CPD Supt. J.P. Weis from nearly three months ago. As you know, while only 45 seconds away from a murder that just occurred at 6948 S. Paulina St. (Beat 725), Weis refused to assist fellow police officers in harm's way by fleeing the scene ("gotta run"). The homicide of Reginald Myers remains unsolved. Three weeks after he failed to respond to the Good Friday, April 2nd fatal shooting, Mr. Weis publicly offered the preposterous and pathetically transparent "excuse" that the murder scene was "secured" (despite the fact that the unidentified shooter escaped on foot) and that had he responded, he would be a "distraction".

Certainly, you must agree that COWARDICE and LEADERSHIP are mutually exclusive.

To Mayor Daley:

Do not be concerned about the courts striking down the chicago gun law. It goes against the 2nd admendment, you always knew that.

The gangs will get guns whether your law was their or not.

What you could do if it makes so compromise is this:
1) Maybe have people take a gun ownership training class so they know how to aim and pull the trigger, this way when they do shoot at the person breaking into their home they could hit them square where they wish. I do not think that would be a big deal to gun owners.

2) Secondly, please offer these same classes to the gang bangers as they always seem to hit inocent by-standers and little kids. This way the gang bangers would be assured of hitting their target be it the OTHER gang member. This would then help to get some of these gang bangers some self confidence, and they would be happier with themselves. Kind of touchy, feely stuff that all the shrinks talk about. A happy gang banger is less likely to keep trying to shoot people if he knows he can take out the other gang banger with one shot.

3) Keep knocking down the last of the few projects and don't build replacements for many years, this way they will have to to to the suburbs and get vouchers for housing or section 8 housing. That get's the gang bangers out of the city.

4) Then you put a big wall around the edges of the city, kind of like the wall of China. I really think your dad used that idea as the walls inside the city. He had the Dan Ryan and the Ike put in just the right places to protect Canaryville and Bridgeport. Great idea on his part to keep the bad elements together, kind of like playing battleship game, great game, did your dad buy that for you for christmas?

5) Anyway, forget about #4, I was reading John Cass and writing at the same time.

6) Will you be allowing gun stores to open in the city? I cannot see where they could not get licensed now that this will be legal very soon, very soon! They could sue the city if you do not allow them to open up.

7) I also think you should allow open weapon carry, just like the cops do. It would really help as a visual to anyone even thinking of trying to do something stupid like robbing a place and someone just sitting there carrying.

8) All these things will help to also aleviate prison over crowding, as you will have less criminals on the street, as they will be done in by the other gang members that took the class, home owners will take care of more of them as they try to break into peoples homes. You will also help free up the cops as they will have less issues to deal with as their will be less crimes.

See it all works out good in the long run, don't you think Mr Mayor?

The only bad thing is their will be more traffic at the gang banger cemetary on 115th, I guess you could just set up speakers their that just play that song, I can't remember the name but they say "Another one bites the dust" or something like that. Hey they play music at New Orlean funerals, we could start something new here that would sweep the US!

Mayor Delay of Chi is going to put all sorts of obstacles in the path of prospective handgun owners. You wait and see!
First you must pass a weapons safety course.
Then you must a qualification course for marksmanship. And PASS too of course.
Then you must have a certified lock placed on the trigger and trigger guard. With a certified authority certifying that it is a certified lock.
Then a reg that says the weapon must be kept unloaded unless you use in self-defense, and then the ammo must be kept in a spot a certain distance from where the weapon is stored. Weapon and ammo both in a locked box with a certified lock on the box [in addition to the lock on the weapon itself]. A lock on each box that is certified as being certified by a certified authority.
And a department to check all this out. With extraordinary but of course necessary powers to demand to see your “set-up” at any time.
And registration by certified authority with special tax to pay for the certified authority.
Mayor Delay has it all figured out.

I don't know if Jon Burge commited the crimes that he has been convicted of, but I do wish that some people on this site would do a little reading before posting. I believe Jon Burge was indicted by a Grand Jury that was seated in Feb 2008, indicted in Oct 2008. I believe our current President wasn't elected until Nov 2008, seated in Jan 2009. Just saying...

Right after you get Illinois State labor law changed for that is the problem, it is written in Illinois labor law. Police in municipalities of over 1 million in population (Chicago) cannot negotiate over residency issues.

Let us know when you get that done. Then we go to court. It has been tried in court previously. We lost.

True, the commenter made a stand-alone comment about the leanings of the current president and the current attorney general, but the comment was about the foundation of the current administration and it was among other comments made about conditions in our government and its agencies. The commenter never placed blame on Obama and Holder for the Burge indictment.

I wish you had read the original comment with a bit more comprehension before posting. Just saying...

I don't know this Sgt Weiglin that you refer to but having grown up and then later working on beat 2534as a Police Officer, I can tell you that you made the right decision. As far as Sgt. Weiglin goes, remember that he has a political position. He must spout the company line or he will be gone. It's a simple as that. No more steady day, weekends off. Or perhaps no more Fri/Sat or Sun/Mon off. So keep that in mind when dealing with him. Me, as a long time member of the CPD, I personally would not trust ANY Police Officer that spouts the company line knowing full well that that line places you and yours in danger. I know your beat very,very well. It is probably one of the most dangerous beats in Area 5. Thanks for the kind words and stay safe.

Here in 013 and across the way in 014, where I have several properties, I can't go and take care of issues in my tenant's apartments without coming across some goof sitting on my building's front steps or hanging out in the alley...twice I've had to call 911 to get the assholes to leave, because they don't understand being "nice" when I ask them to leave for non-payment of front step occupancy rental. So, if I were to carry, in THOSE neighborhoods, you're telling me I won't catch GRIEF??? PUH-LEEZ!!! They don't call the Fightin' 14th that for nothing!!!

Greetings from Montana, most of the homes here in Montana have guns. 95% of the folks here are armed. We have very low crime rates.If I choose to I could carry a gun at all times. I don't. it is legal to carry and to have one in your car.When I lived in Chicago I would no leave my house without a weapon-the reason I survived to move away.Honest people in Chicago need to have weapons to defend their persons and homes.
