Blackberry OT?

  • Like millions of Americans, Chicago Police Sgt. Jeffrey Allen's job had him on an electronic leash of sorts.

    Even when he was off duty, Allen says, he performed work on his department-issued BlackBerry. Now he wants to get paid for the off-duty time he spent on the device.

    Allen has sued the city in federal court, seeking overtime pay for up to two years. His lawsuit, filed earlier this year, seeks OT for similarly situated officers, too.

While it would be nice to establish work rules regarding what the Department can and cannot expect during off-duty hours, most of these spots that require the "extra effort" are volunteer spots or clout assignments. And the sad fact of the matter is, if someone doesn't want to do it for free, there are ten other people willing to debase themselves and undercut contract provisions for a spot wearing blue jeans, an early duck, a company car or a slot in a "sooper-seekret study group."

When I saw this on the news tonight, my thought was that this really wasn't about the money but an effort to set some boundaries to stop this 24-hour nonsense with the Blackberrys. If the city has to pay overtime, they'll give some thought to whether they should be emailing or calling on your day off. I wouldn't want a position where I have to answer or respond 24/7.

Back when I first made Sgt. if you worked afternoons, and you made calls in regards to CR investigations during the day, the boss would throw you a couple of hours o/t. Typically it was two hours, unless it was a very indepth CR then it might be three. If do work when you are not on the clock, that is o/t and you should get paid.

Oh, go on, say “I’m full of shit”… or “He doesn’t know what he’s talking about!”… Just look at ANY Tact Team in the CITY! Seventy-FUCKING-five Tact Teams are getting screwed over, and NONE, that’s: NOT ONE of those Officers cares!

Go on, do your details, change your hours, bust your ass to fill the book, go out and get those heads… My paycheck is the exact same ass yours on the 1st and 16th! With a whole hell of a lot of less stress!

OT: CLTV was doing a story about the city deficient today which they ended by reminding the viewer that the city has to pay the greedy police 160 million in back pay. Of course they didn't remind the viewer that the contract expired in 07 and this is why we're owned the money. Daley's media is doing all it can to take the spotlight off of him and onto us and other city workers.

Agreed the blackberry was originally for exempt, who do not get overtime because their salary is so ridiculously high. But then blackberry made its way through many units down to sergeants.

Granted there are slugs of every rank on this job. But there are workers who do put unfathomable amounts of ot in for free.

It is out of control now. If you don't answer that blackberry in five minutes these exempts start calling your house, your personal cell,your emergency contact, your doctor, your neighbors. Todays exempt took complete advantage of the blackberry and everyone in this department as we know.

But they only get mad at the workers who dont answer and never the slugs and clout ridden. Which is usually one in the same.

You also need to ask yourselves these questions: If you're in a unit and are either "on the clock" from home or "enroute" to a UC assignment, if you get involved in an accident, an altercation or a shooting, what rules apply? Are you indemnified by the city? Will they cover your ass if litigation is involved, or will they throw you under the bus, force you to pay punitive damages (if any are involved), and make you put up your home or any savings/assets that you have? These issues have never been adequately addressed or codified. Back in the day when I worked units, it was usually a wink and a nod, you were covered by your boss(es) and there was no need for defining any of it. Things were just understood. On the other hand, you didn't go out there and do "dumb stuff" and get yourself jammed up! Nowadays, you step in it, you're on your own. There is no real trust between the bosses and you; there is no real support among the rank and file, with the exception of the District Beat units and some specialized outfits who must stick together.

Oh, and one other thing: The guy who posted those disparaging remarks about beat units/assignments. He needs his ass handed to him and I doubt if he spent much time in Patrol. Guys who are assigned to the Districts are the main folks that need to be supported. They are the true face of this organization. If you don't support them and give them respect, you are disrespecting yourselves. Like in the Army, the Infantry is the focus branch. All of the other branches are designed to be in support of the infantry. Likewise in our organization. It's good if you work a unit (there are a lot of them) and are not assigned to patrol. But you can always end up back there, without the perks, the overtime, the take-home-car, the Blackberry, the travel/extradition and out-of-jurisdictional assignments . . . doing what these guys and gals wrestle with every single day. It's in your face, relentlessly and unwaivering, but they continue to deal with it and are entitled to bitch about it.

Truth be told, they should be making the bulk of the money because they do the most difficult work. Period.

When Mayor Byrnes body guards were tossed out after Washington won the election, all of them sued for TO claiming they were told not to put in slips. Despite the fact that records showed none of the bodyguards took a sick day or comp day the entire time they were on the detail, even for furlough extensions, all of them did get a settlement. It appears that this sergeant had come clout and lost it and now wants money for something he gladly did so he could keep a cush job. I have no sympathy for those pimps.

I don't know this Sargeant and I really don't care what anyone's opinion of him is, but I'm on his side with this one.

Why should anyone be forced to go on the clock just because of their unit of assignment or rank?

Whenever I'm off duty and I see a 773-869-XXXX or 312-746-XXXX number I don't answer it. I let it go to voicemail then I decide if I want to respond.

So just because a supervisor is assigned a blackberry that automatically gives the Department the right to disturb someone's day off, kids little league game, family picnic etc. and not compensate the member for it?

Maybe I'm just from the generation of dial televisions, Hawks on On-TV and no lights at Wrigley. Maybe this generation is so used to being electronically connected to everyone at all times that to not be is foreign

He will win the lawsuit because all that matters is that he is in a non-FLSA exempt position, and is therefore equivilant to an hourly wage employee. Daley, of course, is an idiot and doesn't know what he's saying, and the CPD command staff ARE FLSA exempt so they aren't eligible for OT.

I don't know the Sgt and he may be a whiner, but what's right is right.

And who is under stress? From reading your post, I wouldn't be suprised if you dropped dead from a heart attack two minutes after finishing it.

I do this job because I like it. I committed myself to at least 20 years when I signed up. With only a few years to go, I'll do this job as long as I like it, and if I don't like it, I'll find something else to do.

Stress? Stress is comming to work fuming angry about what the shitheads and media are saying about the police, what the department is making you do or doing to you, what other coppers are doing, what other coppers are not doing, who is getting screwed over, how bad, how much....

That's stress and that's why almost half of all police retirees are under ground within 10 years of retiring.

Easy on the anger, officers, it's killing you. Kick back, don't do too much, don't do too little, keep things nice and balanced.

Follow one rule and all your stress will fall away. What other coppers do on this job is of no concern, only be concerned with what you do or plan to do.

Look around. Things are not as bad as you make them appear.

Funny how this JO who was despised in OCD and cried to anyone and everyone after getting the heave ho files suit. Nobody listened so here comes the lawsuit. I truly hope this clown gets two pieces of charcoal and a bottled water. I hope he remembers the city has a long memory. This won't be forgotten.

SCC already said this, OCD and places like it are not the same as the Patrol division. There are sacrifices when you leave the uniform. The benefits outweigh the things you give up.

It pisses me off especially when its night, I'm chllin in the flat with a girl sipping some duck and watching a movie. The phone rings which I have to have on and its a real bummer. Then we end up pissed and we don't GROW closer the rest of the night. But its part of my job and I bet thats the rule for many that are fortunate to have a job; not the exception. So double ditto with the 1st poster. If you are that tight, transfer.

You are always bitching about how the city always is messing with you, yet you still complain when someone takes action against the city. That's the problem with this department, if someone could possibly be getting something that you are not you bitch. Me me me attitude. So just because he was in a unit he has to be available 24/7 without any compensation. Just like in the other post I read about getting billboards to make others aware of how bad the department is. How mnay comments were there about, "I will gladly put some money towards it, let me know when it gets started". How about YOU getting it started, why are you people waiting for others to take action. That is what this Sgt did HE got the ball started but now you crusify him.. Typical attitude of many I see these days..

They run the administrative part of the district as opposed to the District Secretary, who runs the administrative part of the district.

hey, wait a minute... what the hey... oh boy, they have TWO people who run the administrative part of the district! Well who would have known that? Jeez. Hmmm, that is sort of a duplication of effort sort of. And an extra salary too. And also an extra job to hand out to those who you want to do a favor for.

Actually, when this District Manager position was first being tossed around, (1992-1993) it was the intention to eliminate the assistant Secretary and the District Secretary and replace them both with one administrative district manager.

The Commanders howled like hell, they didn't want to lose every PO in their office. So they let them keep their Secretary as a PO position. for a while. the District Secretary was still slated to be slashed after the District Manager got up to speed.

That never happened. In fact, the number of PO's in the District office climbed back up there and now there at least three PO's inside in the office and a number of civilians.

As to what do they do... well, the best way to find out is to shit can a few and see what get's left undone. Very little if anything you will find.

It is another salary with benefits that the CPD could chop tomorrow and never notice anything was missing.

Are you bloggers high? Reading the comments on here make me disgusted with the way we treat each other. We only like one another when we're at another policemen's funeral.

We are suppoed to have solidarity. If an officer files a lawsuit to increase a benefit to an officer, we shouldn't be so full of hatred toward his rank or clout. This man stepped up to the plate, put aside any possible promotions in the near future, and put himself front and center on a lawsuit and in the papers.

I do not know Allen, but I salute him for his fotitude. He hired a lawyer that isn't scared to roll up his sleeves and fight for the rights of rank and file (non-exempot ranks).

Let's be better to each other on this blog.

I don't consider Officer a crybaby whatsoever. I applaud him, regardless of chance for positive outcome.

Unfortunate, but CPD suffers from what most of corporate USA suffers- major sweat-shop mentality on part of management/ownership.

It's downward trend in how USA employees treated since 9/11.

Feels Communistic, for lack of better term.

Lost my job to jobless "friend" I felt sorry for, helped, who then offered to do my job for strictly commission only- basically for free, in this economy.

Didn't matter I'd been on call 24/7, took emails/calls/texts at all hours of day/night, incl. Christmas Eve/Christmas Day while with family. Didn't matter I produced. Didn't matter clients loved me.

Sweated all those extra hours/days/weeks for ZERO compensation, for fear of losing my job. And look what happened. All work NO PAY/NO JOB.

If you don't think that is going on all over this country in many occupations out there, think again.

As for Daley, in his arrogance to say, that this CPD SWEAT SHOP scenario is OK, puts him on par w. serial killer in my book. They think what they are doing is ok as well, no matter how destructive/anti-social/anti-humane/cruel and damaging to the victim's family this is.

I'm glad this copper spoke up. God bless him! Godspeed!

As a Sgt I was the ranking third watch supervisor (coordinator) in a very nice unit for 9 yrs..did as much as some Lt's..you just do your job , stay low profile....been to the west side...don't want to go back

O.K. How about those lines in the Court Notifications which tell (ordinary P.O., not Secret Squirrel type) P.O.s to PHONE a Parole Agent on their Off Duty time?

"I called Parole Agent Joe Schmoe from home about Parolee John Dokes who I arrested last month for who knows what and was on my own phone for 10 minutes so give me 3 hours pay." Like that's gonna fly.


I know of some cases where a check from a lawyer comes to the P.O., instead of signing it over to the Finance Division, he deposits it to his own account. Before that he calls and talks to the lawyer so he earns the money and does not put in for O.T. for a deposition.

To 1:05 pm I agree with you 100%.While many of you loathe or have little sympathy for people in a unit,THEY ALSO GET FUCKED OVER BY 35th Street.Maybe he is pissed off for all the sacrafices he made for the unit only to get dumped and now is fighting back,who knows.I cant tell you this, bosses who keep telling you that you are in a unit and have no union protections is getting old. I can tell you from experience getting assigned details(no seniority respected) and working ot without a yellow slip on many occasions with long hours with the promise, We Will Take Care of You Later, and then it never happens. Hey if this is a thorn to daley and J-Fled that COWARD KUDOS to Sgt.Allen!

This guy might have been dumped but the federal law protects employees from being abused in this way. This is not about this officer but about all of our rights being violated as employees. So what if he got the balls to sue after he got dumped. Often being dumped on one too many times is the catalyst for change. We're getting close to getting fed up. I suspect lots more lawsuits coming from CPD. God knows there are many instances of unfairness. This guy is paving the way. We should wish him luck because if he wins, the floodgates are gonna open. I'm not in a unit but I sure do hope any cop that is treated unfairly gets paid.

The city may not understand that by requiring exempt members to take a day off without pay each week, or even every other week, knocks them out of FLSA exempt status. It makes their new status an hourly employee. This means they too are entitled to OT for any hours they work over which is a lot since they work over every day. I hope one of them gets the ball rolling on that so we can get our money back into our pension that the city is not paying when these people aren't working full time throughout the year. I need my pension money for me, not to cover the pension if those forced off. I read the law. Seems like a slam dunk. Hope this guy wins. He is in the right.

Wrongo. The federal law applies to all employees that are hourly whether it's the private sector or public. Why do you think the law exists? We know no coppers beefed so the Feds listened and made a law. Thank the private sector for their complaints. It's about time somebody said something. All you guys talking about this guy crying after a dump, you guys don't cry to anyone but this blog. Don't knock someone for standing up no matter what caused him to do it, he's in the right.

Half of those 'bosses' in OCD won't even answer their phones if you were to call them off the clock. Try this: Call the new Deputy Supt. of Patrol, EB on his blackberry. If he doesn't answer (and he won't), TRY to leave a message...you can't! His voice mail is full all the time! His Dept. blackberry is always 'incommunicado', and it doesn't seem to have hurt his career at all.

No intrusions here. I don't answer the phone or return text messages after work hours if I have even a hint they are work related. Period. That way there are no misunderstandings.

Work time is work time. My time is my time. I maintain that division clearly and absolutely. No resentment or lawsuits or public complaints on any blogs as a result.
