Botched Investigation?
Mayor Daley’s nephew received no favored treatment from the “thorough, fair and impartial” investigation that followed the 2004 death of a 21-year-old man who got into an altercation with a group that included the mayor’s nephew, a high-ranking police official said Monday.
Although witnesses were recently re-interviewed, Deputy Police Supt. Ernest Brown said the investigation into David Koschman’s death was never technically re-opened.
“The investigative portion of the case was completed. ... Based on the [Freedom of Information request] from the Sun-Times, we realized that, because of an administrative oversight, the case remained unclosed. So we shifted it to a different area for a comprehensive review of the entire investigative process as it stood,” Brown said.
“That review revealed that the facts of that investigation remained unchanged since it was initially investigated, and it will be closed shortly.”
Brown was asked whether he’s confident R.J. Vanecko, the mayor’s nephew, got no favored treatment in the case.
“Absolutely. ... I’m confident that we conducted a comprehensive investigation — a thorough, fair and impartial investigation,” said Brown, chief of the Bureau of Patrol.
Pressed to explain the delay in questioning witnesses, Brown said, “That’s as much as I’m at liberty to answer right now.”
Asked why the case was re-opened, Daley initially changed the subject to his push for stricter gun laws, the purpose of Monday’s news conference.
“I know you want to talk about other things. [But] this is gun violence. Would you ask a question on that one, please? Ask one. Can you ask a question on gun violence? Why not? ... Knock-knock. No one is there,” Daley said as police and community leaders who joined him at the Homan Square police warehouse laughed along with him.

The dead guys friends looked at a lineup and nobody could identify Vanecko. No ID in a lineup means no charges. Witnesses interviewed told the detectives the dead guy was the aggressor. The dead guy's group said he was punched once and fell back hitting his head. Punched once by someone they could not identify! People get shot or stabbed and there are no charges placed by the ASA on some occasions because the dead guy was the aggressor. So you have a dead guy who received one punch, who witnesses said was the aggressor, and the dead guys friends could not identify who punched him. Cozzi got royally fucked because of Jody, but he's on record being at the hospital per EMOC radio logs and hospital video. He's observed on video hitting the jagoff(who deserved it in my opinion). There is no coverup or charges to place in this Vanecko thing.

SCC you aluded to the reasons why Brown is laying it on really thick, is anyone asking why it was not the Chief Of Detectives handling the press? This case ultimately became their investigation. FYI: THIS incident gave birth to the idea of an Entertainment Detail in 018 -- to protect the clouted both on and off the job.
It first came to me in an IOD vision after I was battered in the head with a fire extinguisher at a parking garage across from McFadden's, and was formalized a short time later on a piece of semi-used toilet paper at Northwestern Hospital, while my ego was recovering from another IOD sustained after my APV was "cut off" by an invisible car. The victim's friend stated the victim charged the group as they were trying to pull him away. Offender was protecting himself from this victim. One punch to the face. No one could pick out offender in a line up. Case presented to the ASAO. No charges because the victim was the aggressor. CCX'ed the case. No Cover up. Victim starts the war but loses the battle. Case Closed.

If today's follow-up contains elements of the truth in several respects, a few folks in Area 3 deserve to be named.
According to the mom, a dick at the Area told her she'd be "impressed" with the other people involved in the altercation. The dick also told her that the lawyers for the other people came in to talk to the dicks, whereas her son's friends came in with their moms.
Everybody knows not to blindly take hindsight personal recollections at face value, but the lack of ANY credible official record lends a bit of credence to the mom's tale here. Daley and anyone carrying his coattails should rot in hell for a million things, this being only one.

Hitting someone for TALKIN SHIT is NOT self defense...it's a Simple Battery and if that person dies as a result of that Battery then it is HOMICIDE!! The other posters are right, if this was the other way around the kid would be in the joint for murder.

The Cook County States Attorneys office and Command of CPD were prevented from conducting a fair and legitimate investigation due to relationships to Mayor Daley
I believe the media and Feds will eventually get to the true facts in the case.

I don't think anyone is faulting the dets. But the powers that be over ride investigations if it suits them and believe me brother if the roles of victim and offender were switched and all of the above played out exactly the same the SAO would have charged the case.
The dead guys friends looked at a lineup and nobody could identify Vanecko.

Do you think the fact Vanecko altered his appearance by shaving his head had anything to do with the friends not being able to identify him? Or maybe because Vanecko had on a hat the night of the incident and no one in the lineup had on a hat?

Where are the reports? Why was the case just reopened by the CPD? Is there any evidence that the mom or the friends are lying?
If this woman was treated by the dicks the way she describes now (i.e., no investigation, blown-off at the area, suggestion that she should be "impressed" by Vanecko and his friends), the dicks are the last fucking people that should be investigating this case.

Wrong. There was enough circumstantial evidence to present the case to Felony Review. If the evidence wasn't presented to FR, then, it was a poor investigation or the fix was in.
