General Order Folly Continues

This disaster of an order keeps getting worse the more we read it:
  • Section VIII-J-2-EXCEPTION:

    Bureau of Patrol members will not complete the automated Arrestee Debriefing Module when the arrestee is charged with any of the following: [...], Justifiable Homicide, [...]

Would someone like to point out that there is no such charge as "Justifiable Homicide," and the fact that a situation is "justifiable" means there is no basis for charging or holding a subject in any case? Oh wait, we just did.

Could anyone with a legal background school these New York morons in the Illinois Compiled Statutes before they put out some more drivel that is going to get coppers sued and the city paying out millions to assholes set on a lottery payday?

Maybe an actual fucking lawyer could read these things before McDumbass signs his name to it. Or has Legal Affairs been gutted like everything else in this Department?

1. SCC, you are correct. It is not a charge.

2. I was going to give the legal analysis. But I decided not to do the job of the "experts."

This one along with the "Legitimacy..." order where written by knuckle daggers who are trying way to hard to appear educated. They have an I.Q. Of under 40. But I have to print these orders. Some people are incredibly stupid. That must be a requirement to teach at the academy or to put these orders together.

Suburban police officers can carry anywhere in the state, as can CPD, but can be restricted from entering certain establishments (ex: United Center) while carrying off-duty. If the suburban copper happens to be Auxiliary Police, he can only carry on-duty with his chief's permission. I had a problem getting into the House of Blues with my gun while off-duty. They can and did refuse entry even though I'm CPD. I can just about guarantee you that the back of every event ticket reads that you can't enter with a weapon.

The misnamed federal law called LEOSA is the minimum standard.

It does not override whatever state and local restrictions there might be on carrying by LEOs in a publicly owned facility, or in private facilities as determined by the ownership of those facilities.

Unless the ownership of the place specifically prohibits it, it is probably OK.

At the border crossings into Chicago from the suburbs we have checkpoints in which you will stop, surrender your firearms and pick them up on the way out. So leave it at home or be prepared to check it.

Any sworn "peace officer" in the State of Illinois can legally carry their firearm in Chicago. Not so for out-of-staters unless they are on-duty.

If you read that order in its entirety, one of his New York friends had to write it. It reads like no other order we have. The language is just all wrong. (and yes, we do have at least one order written in *almost* ebonics,(verified by the initials next to the task number on the bottom of the order) but yet this order is totally different.

I can't comment on the United Center as every private venue has it's own rules. Most concert venues do not want you to bring a gun in. Some will tell you to take it to your car, some used to lock it in a safe, but someone screwed that up, as usual. Unless YOUR Department says you can't carry outside of your jurisdiction, as long as you have ID that proves you are a copper from just about anywhere, yes, you can carry in the City.

The ILCS applies evenly throughout the state to all peace officers but pantywaist asshats put their own spin on things citing private property bullshit. An example is Great America or the music venue in Tinley Park as examples where we cannot carry. Those examples are wrong as they are licensed premises NOT private property but no one has the balls to challenge it (hint hint FOP and PBPA). What if Woodfield Mall put out a sign that said no guns allowed including police? Same for the big stores, K-mart, Wal-Mart, Jewel Foods.....big signs saying no guns allowed including police....what then? Under the same logic they are private property and can bar us from carrying our weapons. Something needs to be done and the FOP, PBPA and our fellow officers in the state legislature need to move on clarifying legislation to stop this anti-gun, ANTI-POLICE policy that's going on unabated!

If your a sworn officer in this state you can carry your shit where ever u want in this state or the other states for that matter. However, some private venues can restrict that like Great America, its privately owned, soldier field, park district owned, etc... The only large public venue I know that refuses to adm it armed police is Shit Flags America that's why I haven't been there since 1988. Now some departments can administratively restrict your ability to carry off duty.

CANNOT CARRY INSIDE UC. There is a room for police with lock boxes for your pistol. That said, I carry it in there anyway ;) every venue is different. At Allstate there is a log you have to sign but you can still carry. Soldier field doesn't allow carry, no log, no lock box.

i'm a lawyer. i appplied to CPD in 2008 or 9 (cannot remember exactly) went all they way through BG check. still listening to the crickets chirping for my date. but, i'm turning 40 soon, so my 12 years of expertise a an attorney in the criminal courts won't be put to use to make SURE that the arrests that are made stick and that the DB's go and get their just desserts when they commit a crime. i was willing to take a 50% paycut to be a police officer as i really felt i had a lot to offer the department and the community. gues that's not what the higher ups want.

I've been to the UC with my weapon with no problems. Concert venues and of course six flags are a different story. And if you don't know the laws I suggest you learn them. It wasn't too long ago a copper got jammed up for attempting to arrest a cc sheriff for uuw thinking he couldn't legally carry a weapon. There are many different agencies operating In the city that can carry weapons. Us, all cc sheriffs (co's, police and the court guys) feds. But as someone else added a suburban agency could administratively bar their ofcs from carrying off duty.

All venues are have different rules about cops carrying. I'm not the original poster, but I AM the police and I don't know what the rules for us are at all of these types of places. The suburban cop was asking a legitimate question.

As a Dick, I have problems with this GEU secret reports. There is not access to them at all, other than the hard copy officers write. Of course, these reports only circulate within the GEU. The topper I have had is when they arrest a guy and in their arrest report narrative state "read report (GEU)" Which they do not provide. Genius.

The only place I have been denied entry with my weapon was GreatAmerica.
Since I was there for an event with my daughter, I was forced to lock it in the gun box. The private security there are rude and hate the police and I will never go there nor will my family.
There was a four foot tall female captain of security who told me to get the fuck out if I didn't like it.

OT... a suburban officer was told by CPD today that he could carry his firearm at the United Center tonight. SCC..what are the rules and laws for suburban officers carrying in Chicago??

Did not the US Congress enact a law allowing off-duty carry throughout all 50 states?

The 011 District runs so efficiently while a certain LT is on vacation. Just amazing how much can get done without any micro managing from the Station Supervisor's office.
But GT and MB will be sure to call and facebook the LT about what is going on so he can stay informed in the event he is needed for a Press Conference.

The only place I have been denied entry with my weapon was GreatAmerica.
Since I was there for an event with my daughter, I was forced to lock it in the gun box. The private security there are rude and hate the police and I will never go there nor will my family.
There was a four foot tall female captain of security who told me to get the fuck out if I didn't like it.

i'm a lawyer. i appplied to CPD in 2008 or 9 (cannot remember exactly) went all they way through BG check. still listening to the crickets chirping for my date. but, i'm turning 40 soon, so my 12 years of expertise a an attorney in the criminal courts won't be put to use to make SURE that the arrests that are made stick and that the DB's go and get their just desserts when they commit a crime. i was willing to take a 50% paycut to be a police officer as i really felt i had a lot to offer the department and the community. gues that's not what the higher ups want.

You are much better off not here. Really. I sat in a squad car with more than one lawyer. This job needs only a high school education. And these days you will go to the ghetto and stay there for years. The City did you a favor. The smarter you are and more education you have the more bored you will quickly become.

Go practice law.

016th Dist "The Special ONE"
they talk about all of us having to follow the General Orders and for most of we do try to follow them, using them as tools to help guide some of our desecions. Then there are always the few that like to go their own way and do what they want. We all know who they are in jeff park, everybody has talked about them in some form or another. Two of them most recently have been addmonished for some or their choices that they made are now getting their just dessert. Then there is that very one I like to call her "THE SPECIAL ONE" we ALL know her. She is that one we all have made comments about for the way she has done and handled those few jobs "she takes". We all had a great laugh about the way she handled NATO as the SPECIAL driver for the one poor tactical team. You remember when all the other teams were jumping back into the vans getting sent to the next spot to control the crowd. There sat the lowly 016th dist tact team wait for their SPECIAL Driver to take them, then upon her return the tact team and the crowd cheered her arrival with laughter. Then the time when she was assigned a traffic crash as we all get and she told the dispatcher, she was too far away from the job and if she handled it she would be on O.T.. The sgt assigned it to her and she clearly stated on the radio "NO" I can't I'm an eight hour car. So what happen another working officer had to get the job reassigned to them to handle. She comes to work at her pace when the boss calls for her she replies somehow over the radio ok I am coming and she walks over to her car and gets into it and goes off to do do who knows what. Oh yeah thats right protray a Crossing Guard Supervisor, at least when Joe did it he worked his tail off. We all understand that there are things we all need to take care of but doing the job is why we are all here. This brings me to the point of the General Orders, it does state in the general order not verbatim, but very close to it the folloowing: What ever officer is the first officer responding to a radio call assignment or an on view assignment that officer will become the primary investigator of the assignment if they are the first responder on the scene. So I ask you then this Why if the you respond on the radio as "Emergency" i have just on-viewed a accident in which I was almost hit but I am not involved and the striking car has hit two other cars. WHY can she say "squad send another car to handle the crash report" and the sgt's allow it to happen. Who is not following the General Orders. The after the ON-VIEW OFFICER doesn't do the paper, then she trys to be the police and tell the Re-assigned Bt car what to do with the accident until that officer tells her either I handle it or you do. We have all said to one another about the SPECIAL ONE. Someone out there is either real happy or someone has some real good connection to be able to let this continue. Personally I think it's bullshit and some white shirt has to put their foot down and put a end to it. Either we all go by the same standards or we don't. Yeah I understand if you work hard and do what the bosses ask or expect us to do your seen as a worker, and those officers get the breaks they get, but when this gets let to continue this is WHY!!!!! Moral is not what it should be. You make your own view of it I stated mine. Becareful and lets keep backing each other up so we can all go home on time to our families.
