Disbarment is too Lenient

  • The trial of a lawyer charged with letting her murder-suspect client use her cellphone in an Area 2 interrogation room two years ago started Tuesday with testimony from a Chicago Police officer who made the suspect get off the phone.

    The video recording in the interrogation room had been turned off to maintain attorney-client privilege for suspect Timothy Herring Jr. and his lawyer, Sladjana Vuckovic. But when Lt. Brendan Deenihan walked by and heard the voice, he said Herring Jr. appeared to be talking to himself.


    “It was a one-way conversation, which was odd since he was with his attorney,” Deenihan testified Tuesday, describing what he heard before he peered in and saw Herring chatting on Vuckovic’s cellphone. Herring had been arrested in connection with the fatal shootings of Chicago Police evidence technician Michael Flisk and former CHA Police Officer Stephen Peters.


    Investigators will never know if or how Herring used those phone calls to advance his own case, Cook County prosecutors argued at the opening of Vuckovic’s trial.


    Vuckovic, a CTA lawyer who was acting as a First Defense Legal Aid volunteer when she counseled Herring, is accused of bringing contraband to a penal institution, a charge that her attorney claims is excessive.

A CTA lawyer? That tells us "heavy" right there. And a bleeding heart to boot.

The Media made very little reference to this incident, I worked with Mike and his sister and this is the first time I even heard of this incident. Claypool is a Political Hack who was too naive to go after the Cook County Presidency when he let Stroeger Jr. take the post. Is he now too cowardly to take a stance on this attorney?

Off topic.... I learned today that two thirds of the corporations in the state of Illinois pay no state income tax. Laurence Msall the president of the Civic federation is in the paper today saying retirees should pay significantly more for health insurance or possibly even expect to have no insurance at all. This is the same person who daily demands reductions to our pensions. The Civic federation is made up of local corporate leaders. Hey Larry you want to help the city and state so bad why dont you demand that two thirds of your buddies pay their taxes. Think of all the revenue that would be generated. Then you wouldnt have to worry so much about our pensions.

The attorney will not be convicted or disbarred. I agree that what she did was wrong but there are too many loopholes in police policies regarding prisoners or those under interrogation. No signs prohibiting cell phones to be taken into these rooms, attorneys are never searched or asked to leave bags or briefcases outside of rooms and the department , itself, allows arrestees to make telephone calls.

Trust me,,a CTA Lawyer? After 25 years at the Authority the last 12 in management, retiring in "99", unless things changed, I wouldn't hire their Lawyers for a traffic ticket charge. They definitely weren't the sharpest tools in the shed. Any real legal work was farmed out to connected firms. Phelan Pope and John was one that handled the more serious suits. Run of the mill crap was handled by in house incompetent buffoons.

If he is in Police custody he does not have the right to use the phone while being questioned or at any time prior to being booked. I'm sure he used the phone to order a pizza, donate to cease fire or some other innocent thing, rather than using it to hinder the investigation such as getting someone to ditch the murder weapon before the Police could find it, or maybe get someone to kill a witness (yes, that would be sarcasim).

She was charged because she committed a crime, plain and simple. This crime was aiding and abetting a double murder, plain and simple. Her actions were disgusting particularly because the victims spent their lives protecting the public, plain and simple.

There is no "too harsh" for her. Disbar her and put her in a cell for a few years. Lawyers NEVER go to jail or get disbarred. It's almost like there is a "code of slilence" with both judges and lawyers.

Funny I worked in A/2 from 98 until it closed and now work north. I never, ever allowed anyone in a room with a phone, nor did anyone I worked with. Officers coming in with prisoners were always reminded to take their phones. I might let someone use a phone when it was good for me or because I promised them they could have a call before they hit lock-up. What the hell is wrong with you? Merit sgt? D unit scholarship sgt?

You know very well the only reason this is being prosecuted is because her client murdered a police officer. The officer was an excellent man who gave his life for the city. However, the actions of the attorney was not illegal. The States Attorney is doing this as a favor to you guys.

Hate to say it, but I've got a feeling this will end in a "not guilty" verdict.

Don't think the prosecution was forceful enough.

Seeing the family there was heartbreaking. They've gone through enough as it is, and now this.

Good grief. You make no sense. Every attorney who has practiced even a month in IL knows it's illegal to give a prisoner access to a phone.

Why aren't you more concerned with the fact that a cop killer was able to make calls to his homies to hide the gun he used to commit two assasinations?

If a shithead is willing to ambush and kill a cop and a victim, what do you think that person would do to you?

Compromising a police investigation is an egregious act.

Sleep well at night my friend. But keep in mind there are a lot of boogeymen out there, and they're not wearing uniforms.

Probably let more than one prisoner use my personal cellphone without giving it a second thought. I'm willing to bet that the vast majority of P.O.'s that have passed through there didn't know that it was a problem but when an unthinking or unsuspecting lawyer allows a "client" to use her phone, all of a sudden she's the "scum of the earth" and an accessory to a double murder. Please get real.

Disgusting. And also in the news, a PO is charged in a PI hit and run and then he files a false police report. Perhaps HBD? At any rate now he is really screwed, two felonies including false police report. His career is over. And another one of "us" that makes us all look bad.

Undercover? You have been watching too many Tv shows. U/C cops don't drive around in police department vehicles. Further, there's really no such thing as a "tactical Officer". They are common patrolmen allowed to wear civilial dress clothes sometimes, also, an outdated concept. A 4 year old could pick them out as police.

Why are some Chicago Police allowed to dress in jeans etc... I can see detectives dressing in business casual, or true undercover officers but that's it, otherwise the standard uniform should be worn. Also on the south side, I've seen a lot of the blue jean cops just look downright unprofessional in their dreads, beards, etc. Also the unmarked cars are a lot more dangerous to drive around in an emergency compared to the regular police cars. Im not a cop but if I was I would be proud to wear the uniform.

What is disgusting is that this case was filed in the first place. Thank God that every once in a while, a jury is there to rein in runaway prosecutions like these. We all wish the murder of the officer wouldn't have happened, but that doesn't mean it's OK to pervert justice so that we can dole out some punishment based on her doing something that you folks allow to happen ALL THE TIME. Her real crime was giving any kind of aid to the cop-killer, and your hatred for that is understandable, but it is not to have the imprimatur of lady justice behind it. This prosecution was a travesty and an embarrassment to the state's attorney's office. The assistants who prosecuted it should have resigned rather than try the case. Now they get to carry out this stinking albatross for the rest of their careers. Thanks, Anita.

At first I thought you were just stirring the pot. Now that you have posted this nonsense multiple times and pointed the finger at the States Attorney, I see you have a specific agenda.

This women aided a double homicide offender. That is clear. She should be disbarred and sentenced to the pententiary PERIOD.

You must be a friend of hers or another lawyer that thinks your job is to get your client off at any cost. That is a perversion of our justice system.

Your job is to defend your client and see that justcie is served to all. NOT to get a double homicide offender off to make a name for yourself so you can raise your rates for the next criminal you try to get off.

I know lots of coppers. Seen very few bad ones. I know plenty of lawyers. Most of them make me sick. The percentages for good cops and bad lawers are about eaqual, and that's not sarcasm or silliness.

8:51, you've lost your perspective. We all have roles to play. It turns out that yes, I do represent criminal defendants for free, but not for any reason other than improve the quality of the defense lawyering in the state and federal courts.

And while I can't speak for anybody but me, I wouldn't try to "get someone off" at any cost. But I will fight. I will fight hard. If you lie, I will try to catch you in that lie. If you make a mistake, I will ask the court to evaluate that mistake, and I might argue that it ought to result in my client walking. It is the defense lawyer who keeps you honest. Because you and your department will not keep you honest. Anita will not keep you honest. Only me. All those rights you (and I mean you, if you ever do screw up or if a loved one does) enjoy -- the state didn't give you any of them, and it fought in the courts to oppose them and to claim you didn't have them. It was I, the defense lawyer, who stood up for them when no one else would.

So we all have a role to play. Yours is critically important, and yes, I do respect it. But I get a tad offended when I see a very lazy state's attorney allowing her office and the system to get hijacked by the understandable fury over the death of an officer. This lady should never have been prosecuted. She never should have faced the threat of disbarment. She wasn't perverting justice or doing anything of the sort -- but she was very careless. It didn't warrant your monster hunt. You can put away the torches now.

As for 8:08, bring your spare pen, the judge will love to hear all about your shenanigans, your vindictiveness, your pettiness. Piling on the punishment just because of what somebody does -- i.e., opposes you. You're a disgrace to the uniform. I love this blog because we get to see the great attitudes that some (and I stress some) of you have.

You all keep your noses clean out there because we'll be watching. I don't know what you're whining about; you win almost all of the time anyway.

The Lt. and the States Attorney Felony Review should both have known that a police station interviw room does not fit the legal perameters of a "penal institution".
Penal= Latin for punishment, aka prison/jail, after finding of Guilty in Court. Interview room = non-penal, still presumed innocent by law until tried and found guilty in court.
Merit CPD Supervisors and politically correct non impartial ASA's at work costing the Taxpayers Millions in Lawsuit Payouts. Thanks, Rum-Dums.

Penal institution is defined in the statute to include any place for the custody of a person under arrest for an offense. No need for a Latin dictionary if you read the statute and apply a little common sense.
