Gun Case Rises from the Dead

  • A judge issued an arrest warrant Wednesday for Chicago steel-company heir James B. Finkl on misdemeanor gun charges in a case that had fallen into limbo for nearly three years, until a report in the Chicago Sun-Times prompted a new look at the case.

    Cook County Judge Clarence L. Burch ordered the arrest after Finkl, 49, failed to show up in court Wednesday. A City Hall lawyer told the judge the city had tried several times to notify Finkl he needed to be there.

    “Issue a warrant,” the judge ordered.

  • Finkl faces 40 misdemeanor counts that accuse him of possessing unregistered guns and ammunition within the city limits.
You knew this one had to come back after the Sun Times made it the crux of a hit piece. IAD got involved, FOP got dragged in, the current state of confusion and indecision on gun laws in Illinois make it bendable to all sorts of interpretations.

Or contract negotiations have hit a critical point. Aren't the sergeants counting their ballots this weekend?

First off, they are not misdemeanor charges they are city code offenses. The other part that isnt being reported is that the bond is $100,000. I've seen people shoot people and not get that. WTF?

They want this guy bad, what the hell did he do to piss someone off that bad?

One would think that supporters of the Second Amendment would be against such an arrest. What was wrong with him owning the firearms? They were not registered? that's a city ordinance, not even a state law, and wasn't said ordinance ruled unconstitutional? even if it's not the same ordinance, why can't a law-abiding citizen of this country, who has a job and employs other American citizens (as opposed to employing illegal immigrants) have as many guns as he wants? The charge for possessing ammunition without a FOID (how many other states issue FOID-type cards to gun owners?) is a charge that the CCSAO has dropped in almost every single gun case i've seen in almost 20 years.

the man's political connection to Shields is just a small sideshow compared to the bigger issue of why can he not own as many guns as he wants to, and why do we have to register our guns, a right given to us by U.S. Constitution, to a municipal authority, which has no authority over the U.S. Constitution.

Do we have to register our right to free speech? to practice religion? to due process? why should the exercise of a Constitutional right cost money?

Just remember that the Scum-Times has been part of the Mayor's Press Office for two decades. You have to wonder if the City is pissed at FOP and the We Are One Coalition for denouncing the Sergeant’s proposed contract offer.

Rahm hates Labor. Remember that:

1. The first thing he tried to do was to chance the makeup of the Pension Boards to get around funding the ARC (Actuarial Required Contribution).

2. Tried to get retirees out of FOP by a By-Law Change.

3. Proposed a contract offer to the Sergeants to lobby against the rest of organized labor in Illinois.

Rahm will not stop until he gets to break organized labor in Chicago.

Anyone that willingly answers the door for any type of law enforcement is a fucking goof. If it's important or bad news, I'll find out about it sooner or later - probably sooner.

If I'm a bad guy and I think/know the law is at front door looking to arrest me for something, there's no way in hell I'm opening that door. If you want me that bad you're gonna have to work for it. I won't be perched on the roof with my carbine, but I sure the fuck ain't putting the cuffs on myself and jumping into the back seat of your squad car, either.

Finkl has bottomless pockets. When the gun smoke clears, he's gonna be having the last laugh at all the people trying to make his life hell with this contrived loser of a case. The involved officers. The Corp Counsel. The media.

If I were the officers involved - especially the one that wrote that warrant - I'd be especially worried. You may have crossed all your T's and dotted all your I's, but that house...all 14,000 SF of it....is rumored to be wired for sound and video. It's also rumored that the police who came to take that mans guns from his own home let loose with those same guns in the mans basement shooting range. If true, how hypocritical is that? And on camera? Time will show.

This warrant was as petty as they come. EVER. I would be embarrassed to tell anyone I was part of that incident. Same goes for the stroke in 016 that yanked the citizens rifle from the trunk of his car while returning from the range. Absolutely pathetic.

Which brings me full circle. As an officer I advise Joe Citizen to NEVER open the door for the cops unless they have a warrant to come in or YOU called THEM. You can see from these two latest incidents involving LEGALLY OWNED WEAPONS that some officers just don't give a shit about your Constitutional rights. Why cooperate with some jagoff that wants to break it off in your ass?

Imagine he comes home with a new rifle and sets it on his front porch, then goes into his town house leaving the rifle because he forgot he had it? He makes the Dems case for gun control. Greetings from Montana,99% of the homes here have at least one gun or more however we have almost no gun crime. Its not guns its the people who misuse them. So happy I don't live in that shithole city,its been 16 years since I left. No amount of money is worth living there.

There is much more to this story, he was arrested fingerprinted at the time, given his ordinace violations and went to court. City nollie case due to not having to go thru hearings on sw. the records say nollied, but when the sun times looks for the file, its lost, as k the city to produce your anovs from three years or wehat happened in court with them. As a matter of fact can someone tell what screen to run, to see how many anovs somebody has reveived. Another scumtimes trying to dirty up us for contract negotiations and also its their argument to ban assault weapons which by the way there was four of them.

The Chicago Gun Registration ordinance is full of "gotchas".

Always has been that way on ammo. You can't possess ammo unless you have a gun registered for that ammo.

So you ammo collectors are SOL.

Gun Registration is a big waste of city time, money and resources. It serves no purpose in and of itself. The only reason to have a gun registration scheme is to facilitate a future confiscation action.

None of the pols will admit it, but that is what their long-term aim is. Even Steven Chapman, the Trib writer, does not get it. While the Constitution may prohibit confiscation, it also prohibited Chicago's gun reg ordinance.

But it took 25 years to be affirmed.

And how is a citizen to know what the ordinance says? Why doesn't Chicago put its ordinances up on the web for all to see?

What angle would this story take if it turns out that a p/o or his brother purchased the guns and they were in Finkl's house. What would happen if they were later transferred to Finkl after his FOID was approved by the State? Would the purchase of guns and the possession of the guns by a self admitted person with diminished mental capacity be a crime? Would that crime be worth covering up if the possessor was also a business partner and contributor to some type of elected non-government office election? The real question is if this is the case, why would the p/o put his fellow brothers on the job in a tough situation. Because he or they are very calculated self centered people that only look out for their own interest. Thats what we should all worry about with the ongoing contract talks. Who's losing what and what is the end game for the person acting on our behalf.

My 2 cents are not worth shit, but there is more to this story than we all know.

Hey Dumbfuck, the original post was about being served papers for a court appearance, not a search warrant. You can't bust a door in to serve a summons, numbnuts.

Furthermore, an arrest warrant by itself does not allow law enforcement personnel to boot down a door without being able to articulate probable cause that the wanted offender is home at the time of forced entry. But guys like you will always concoct that PC. We'll be reading about strokes like you in the papers when you step on your dick too many times.

Reading is a skill, simpleton. Learn it sometime. Knowledge of the law is also a good thing to have, dumb-dumb. Maybe you're the one that needs to "go back to law school".

The first thing they do when you buy a gun is register the #'s three times to Sunday with as many agencies as they can .. which would mean that UNLESS someone had a gun BEFORE they started doing the paper work there is no way ANY gun can be unregistered..

Maybe a layer can chime in here..but did Jim need to register his guns if he was or worked for a licensed private security contractor governed by the Department of Professional Regulation?
I thought 8-20-140(f)of the municipal code exempts him from registration?

Maybe I'm not understanding the charges or he is unlicensed with the state?
