How Will it Fare in the Senate?

  • Over objections of Gov. Pat Quinn and Mayor Rahm Emanuel, the House approved a concealed weapons bill today that is aimed at ending Illinois’ status as the last state in the nation without a law to allow its citizens to carry guns in public.

    But the gun bill backed by House Speaker Michael Madigan goes to a Senate where President John Cullerton has denounced the proposal because it would override local gun laws like Chicago’s assault weapons ban.

  • The bill is designed to create a law that spells out who can carry concealed weapons in Illinois and where they can carry them, but the legislation’s removal of home-rule powers also wiped out local firearms laws—giving more fuel to the opposition of Quinn, Cullerton and Emanuel.

    Chicago Democratic Rep. Ann Williams said the bill would wipe off the books local assault weapon bans and taxes on gun purchases, Williams called for the defeat of the Phelps bill and for support of a stricter, New York-styled law to “reflect the realities” of differences between rural areas and urban areas like Chicago.

  • Quinn quickly issued a statement vowing to block passage in the Senate. “This legislation is wrong for Illinois," he said.

    “The principle of home rule is an important one. As written, this legislation is a massive overreach that would repeal critical gun safety ordinances in Chicago, Cook County, and across Illinois. We need strong gun safety laws that protect the people of our state. Instead, this measure puts public safety at risk. I will not support this bill and I will work with members of the Illinois Senate to stop it in its tracks,” the statement read.
We are constantly amused that Quinn and his ilk spout off about "gun safety in Chicago" where the streets run red with blood despite the presence of what have been called the strictest gun laws in the nation. And the comparison to rural Illinois is nonsense, too, seeing as how a higher rate of gun ownership there is in direct proportion to lower crime rates.

As someone said, we have one Illinois Vehicle Code for all of Illinois. One Criminal Code. One set of rules covering Concealed Carry ought to be plenty for Illinois.

    If they can't get a bill of their own liking passed, then that is their own fault for being unreasonable.

    Just wondering; would this be worded as the Current Residency Requirement for City of Chicago employees? The last time I read that injustice it said it applied to municipalities with populations of one million or more inhabitants. The difference here being that the NRA would absolutely challenge a narrow law such as our Residency Requirement if it applied to firearms. It has been my belief for years that a narrow law such as our Residency Requirement denied municipal employees fair and equal access to public education and representation. These next few weeks will be interesting to watch.

    What does this mean? I'm a civilian and live in Chicago. Will I be able to carry a concealed weapon and can I own an AR-15 if I live in Chicago? Thank you CPD for everything you do for us. It is terrible how the state and the city have not funded you're pensions. I enjoy coming to this blog cause your humor is awesome. This Mayor has an elitist mind set as did the last one. I cannot believe during this terrible economy this useless Mayor wants to spend money on a River Walk, the DePaul Stadium or Maggie Park. How did Daley find the 70 million dollars to court the Olympics? Are the aldermans pensions funded and up to date? Is it true that Daley's nephew lost 20 million dollars of your pensions money in bad investments? I'm new to Chicago and moving from Texas I cannot believe there is no transparency in the politics of Illinois. Why don't you plan a march on city hall, Daley's house and "tiny dancer's house?"     The concealed carry law passed by the house has a major flaw and could arguably be unconstitutional because it bans carry on all forms of public transit. That means that anyone who takes a bus, trail or "L" in the city is still banned from carrying. The public transit ban will have the practical effect of disarming millions of citizens and prevent them from exercising their fundamental 2nd Amendment right. Even the draconian New York carry law allows carry on public transit. This is another expensive lawsuit that the city will have to defend and will ultimately lose at great expense to the taxpayers.

    Similarly, the public park ban and street fest bans are equally bad. When traveling around any part of the city, I get the most bad vibes from people (i.e. wildings, bums, obvious gang-bangers that strayed north) on public transit, parks and in large crowds. They have basically prohibited carry in the areas of the city where, for many people, its needed and desired the most. Although preemption and "home-rule" is gone, this is still not a very good bill with many serious flaws.

    If Madigan had his epiphany a couple of months ago and backed the NRA backed bill, none of this would be an issue. Unfortunately, the lib-tards flipped at the wrong time and now we are stuck with a crappy bill that will require years of legal action to fix (or not).

    Every legal citizen should carry a concealed weapon. IN 18 years on the police Dept. never locked up a legit citizen for carrying or having a firearm or commiting a crime with a firearm. Only criminals, gang bangers and prior felons. Normal citizens don't commit gun crimes. They carry to protect themselves. It is absurd to say you can't carry on CTA. It's the one place you need it. The States Atty would never charge you except with a misdemeanor which would be thrown out.
    Every Law Abiding Citizen should carry a gun.
    Police officer 18 years.

    Hate to break it to you. Downstate Dems are starting to cave.Madigan holds all the power. I doubt even this will get thru. Its not over yet. Lots of Dems coming up for re-election. Madigan will blow them out if they dont go along. He will only need a simple majority if this passes. I wonder if they already have bills written to modify and gut this bill soon after it passes.     They want to make it a felony to carry a concealed weapon in the forest preserves, in parks and on the CTA, all places where an honest and law abiding citizen needs to carry concealed. OK then, no body guards for any politician or public figure. No armed security guards for public figures in the same venues.     If Quinn and Cullerton get their way, every city in the state will have the right to add onto the state concealed carry. It will be such a patchwork of laws no one will have a clue what the law is as they pass through cities on their travels. These liberal democrats want to make criminals of the average honest citizen. It is all about money with them. Look at these ordinaces in every city and town for red light cameras, now speeding cameras, loud car radios, objects hanging from your car mirrors, everything they can think of to get you cash. The shame of it all is these cities are using the police to collect money for them and I think that is wrong. The police should be about enforcing the law for safety reasons not to collect revenue.

    A CCW Law *should be* simple in IL since we already have to have a FOID Card; unlike other states with CCW but no FOID Card type thingy:

    1) Valid FOID Card.
    2) Fill out CCW app & remit w/ check for $50 to ISP.
    3) ISP does current background check.
    4) ISP issues you CCW Permit valid for Ten Years.
    5) You put CCW Permit next to FOID Card in your wallet.
    It should be that simple.

    IMHO The 'Certified Training' is problematic as nobody needs 'Certified Training' to exercise any other RIGHT. And we don't need it for a FOID Card, which sort of implies you're likely to be firing a weapon at some time.

    Make it Training mandatory for Voting and I'll think about it. Or just having to show a 'Certified ID' to vote may do it. Though I'd like see people having to show a 'Certificate' that they're Literate and have an IQ above 65 in order to vote.

    Bottom line, a CCW Law should be a no-brainer in IL. [We're full of Pols with no brains!]

    Since the State of Illinois has no problem with screwing over its' retirees and the state legislature cannot get it's act together on a
    workable Conceal Carry Law (unlike the other 49 states most of which have workable laws in place), I would LOVE to see the Federal Court create a law...
    ...and JAM IT RIGHT DOWN THE THROATS OF EACH AND EVERY POLITICAL HACK IN ILLINOIS GOVERNMENT!

    THEN, let THEM have to live with it!

    Many times during my 30 years in coppery I ran into legit citizens having a gun in their car and after checking them out let them go on their way. I especially recall a few honest ghetto mamas carrying in their purse on their way to anad from work and just told them to be careful.

    Why would that be unconstuitutional? Laws have exceptions to them and besides CTA, schools and courts wont asllow guns, so according to your logic, that also would be most certainly be unconstutional. What law school did you attend?

    1) Valid FOID Card.
    2) Fill out CCW app & remit w/ check for $50 to ISP.

    5) You put CCW Permit next to FOID Card in your wallet.

    IMHO The 'Certified Training' is problematic as nobody needs 'Certified Training' to exercise any other RIGHT. And we don't need it for a FOID Card, which sort of implies you're likely to be firing a weapon at some time.

    Make it Training mandatory for Voting and I'll think about it. Or just having to show a 'Certified ID' to vote may do it. Though I'd like see people having to show a 'Certificate' that they're Literate and have an IQ above 65 in order to vote.

    Bottom line, a CCW Law should be a no-brainer in IL. [We're full of Pols with no brains!]

    I concur. That would be the simplest -- in the future, like starting 2014.

    I posted the way I did in consideration of how long FOID Cards are valid. Mine is good until 2019, new ones until 2023. So there should be some way to verify that the holder's new background check came back clean.

    Granted it doesn't have to be a 'Permit' like in other states. We could have a CCW Sticker, like for our license plates and put that on the back of existing FOID Cards. And some FOID holders won't want to carry and won't apply (beats me why not. I like exercising ALL my Rights)

    Point was; A CCW law and 'permit' should be simple in IL.

    The ban on public transit most certainly could be considered unconstitutional. According to Crain's, a total of 531,960,253 CTA rides were taken in 2011. That astounding number does not include Metra. The proposed carry bill will effectively ban each and every CTA and Metra rider from carrying. Millions of people will be prevented from exercising their fundamental right simply because they take public transit. This is true even if carry is allowed at the rider's destination. The public transit ban is Madigan's transparent back-door method of disarming as many people in the city of Chicago as possible and is an affront to the federal court that mandated a carry law be passed so that everyone in Illinois has the ability to carry. I recognize that certain reasonable limitations are allowed and have passed judicial scrutiny. But the sheer number of people who will be denied the ability to carry just because they take public transit will bring severe scrutiny from the courts. This issue will be litigated immediately and at great expense to the city.

    Oh Hell, why can't a white man, woman, black man, women defend themselves against the shit eaters? Over 95% (GIVE A FEW % POINTS) is black on black crime. The problem is my peers. I'm 62, retired from the city and carry. Not registered but don't care. I will make it home and buy a new one when it's taken away.
