Simplify Weed Tickets?

A step in the right direction - but did anyone run this by the people who actually write the tickets?
  • Chicago Police Superintendent Garry McCarthy said Friday he will recommend changes to the failed ordinance that decriminalized possession of small amounts of marijuana to free officers to write more tickets.

    “There are some parameters we’re lightening up, which is going to lead to the issuance of more [tickets] vs. arrests because that’s the goal,” McCarthy told aldermen at a City Council hearing on the veracity of crime statistics.

    “We don’t want to put people in jail for things they don’t need to go to jail for and we don’t want to take officers off the street at the same time. It’s doesn’t make sense for management.”

    Two years ago, an emotionally-torn City Council gave Chicago Police Officers the option to issue $250-to-$500 tickets to anyone caught in Chicago with 15 grams of marijuana or less instead of arresting them.

    But, the more lenient treatment did not apply to those caught “openly smoking” pot or who possessed it on the grounds of a Chicago school or park. Young people under 17 and those of all ages without “proper identification” would also continue to be arrested.
Emotionally torn? Over a weed ordinance? Wow, we didn't realize that passing brainless legislation was such a burden. We guess this is just one step on the road to get aldercreatures SSI payouts for post-traumatic stress disorders.

Again, weed tickets are way more complicated than they have to be and waaaaaaay more time intensive than a simple weed arrest. This is an attempt to move away from the "time intensive" part of it, but without testing it on the streets against the clock, it's just more noise.

I am not going to write anov's for weed arrests. I will always make a physical arrest. I suggest they scrap the idea because it is clear that officers are not buying into the ticket idea. It is a huge pain in the ass to deal with.

Ok who the fuck do you think these tickets will adversely affect????? If you said African Americans and Latinos you win a prize. So when we "all" white police start writing these tickets instead of making arrests that will get dismissed in court, guess what happens when all of these minorities start getting tickets and the city puts a huge financial brick on these unfortunate souls....... After PC was established my Partner for the day(I didn't know him so U know that thing where it can either go up or down)we have that kicking. In addition the Field Lt was driving toward us for back up. My Partner and I have a sack of nuggets(just a little more then 1/4 ounce, so easily personal use marihuana. Before we get out of squads and inform the Lt. what we had, my Partner said "Dude, I'll ANOV en, but I'm not locking em up." This Dude is most certainly not a lazy Copper, he just was being realistic.
Who cares about that stuff. If U, God Forbid, U get in a car accident on the job the medical community will give U strong narcotics like Norco, Vicodin, or heaven forbid something else. These R real drugs. How many Coppers "have smoked, but didn't inhale"
Have a feeling the number wood B shocking.
Let's sell it and bring a substantial amount of money made from the sale to OUR PENSIONS!
If it comes down to some people using it for personal use or that money going toward a lasting solution for our pensions I can deal w/people using it for personal use.

Possible Complications:
-Dealing with the desk
-Obtaining a Test Kit
-Obtaining a Cannabis Affidavit

Arrest - Case Report, Arrest Report, Inventory, Complaints
Possible Complications
-Dealing with the desk
-Dealing with lockup
-Hospital Detail (It's possible, especially if they have to go to county for being gang affiliated)
-Approval of Case report

The first time doing the ANOV does take a little time but after you do it a few times that you'll get the hang of it. I'd rather do the arrest, but to say it's faster, nevertheless way faster, is crazy talk.

Sun Times stated; McCarty is putting 150 more Police Officers and Sergeants who currently working the desk on to the streets. As a summer heat force to help with the summer violence that is expected with warm weather.

Are these fantom units, there are not many working inside and the few that are left are needed. I called a dozen numbers in the FOP Department Phone Directory a while back for 35th Street and no one answered the phone.....

Ok so this is completely off topic but....
Just finished working my second day at Lollapalooza. A lot of questions/comments came up with those I was working with. First, there is an incredible amount of people there. I don't want to make a guess but let me tell you it is A LOT. The main problem that seems to occur is kids passing out from messing with drugs. Is it right?- no. But the ones getting hurt is themselves, they are not hurting others. Second, for the number of people there the amount of fights or other violent crime seems very low. I don't think I heard a single "person with a gun" call. Third, it is my understanding that Lollapalooza makes A LOT of money. Which leads me to a specific part of our discussion.... Why has the Taste turned into what it has? The short answer.... It is ran by a private company as opposed to being run by the City. I won't get into the clientele....... Bottom line is the City cannot run anything without fucking it up.

They keep telling us crime is down but they expect the arrests to keep going up. Then they say 5 good "touches" (contact cards) are better then one arrest. Then they complain that arrests are down. Contact cards are just proof that you stopped the guy NOT doing something illegal.

The thing I don't get is it being 0-15 grams since possession of 10-15(30) can be a felony with a previous conviction. Do now they want to take away more aggravating factors after just removing "Other" last week? I guess the "reasonable likelihood that it will keep occurring" is still there though.

I've done 2 anovs for weed so far. Just to do see how it goes. I really do not like the concept of coming into the station to do an inventory and deal with the desk without a head.

Get rid of the inventory and I'll do more. I don't need to test alcohol for an anov.

I like when all the politicians and police brass say we should spend more time on gang violence and shootings ignoring marijuana enforcement. But ignoring the blatant proven evidence that gangs, drugs, and guns are ALL interrelated. Where there is one, many times you have a connection to the other. Good job Mayor, Superintendent, Alderman, Governor! Great way to send a message that drugs are okay. Oh wait, I forgot Quinn just last week made it permissible for little kids to have hash if they have documented stress that they have school homework to do. I always was raised one must stay clean, out of trouble, and respect the laws of the land, do good deeds but I see that most of us on here are a dying breed. So sad to see our city and state in this down spiral direction where anything goes, rules don't apply, and the greed of money & power is paramount. Thank God I don't have young children, because our future looks much more depressing and empty than it does now. But I guess if everyone is high on narcotics, I guess they won't know or care.

The push to decriminalize or legalize weed is contrary to the latest medical research results. Consider the following from Dr. Stuart Gitlow, and addictions specialist on the medical faculty of Dartmouth University:

The New York Times editorial board think that risk is worth taking, as it promotes legalization of marijuana sales and use. Why would it and other marijuana proponents put the public in harm's way?

As a society, we will not make money -- we will likely lose money, just as we do with tobacco and alcohol. Taxpayers will need to pay more in order to make up for the productivity and illness-related losses that marijuana taxes won't come close to covering.

It was only a mere 11 days ago did we read that the former mayor was TOO SICK to be deposed for the Park Grill debacle but now we see that he's healthy enough to travel to one of his favorite spots for drinks, dining and socializing.

ANOV's are a great tool and certainly have a purpose. I do not agree in writing one for weed. The subjects we come across with weed need to go to jail. Writing ANOV's are most effective when dealing with cell phone while driving, smoking on CTA platform, etc.

I would like to see a statistic as to how many of these tickets get paid.

Like any hood rat is going to spend $250 on paying a ticket. That's $250 he could be, and will be, spending on...you guessed it - more weed.

Until there is a consequence linked to not paying the ticket, no hood rat will care if you write him a ticket. Now, seize his LINK and Obama phone (and make him ineligible to declare them "lost") as collateral until he pays the ticket, and you might get somewhere.

In the meantime the only weed arrests I will make is when they have it in the car and I can tow their ghetto sled. Nothing says "consequence" like the $$$ needed to get that wheeled roach motel out of the pound. None of them have insurance anyway, so I don't want these filthbags driving their cutlass up LSD at 80 mph with no brakes to crash into some decent person.

Law enforcement is only effective if there's a consequence. I will keep making the arrest that sticks it up their ass before I write the ticket that they wipe their ass with.

It's not all about the anov. sometimes people, especially the shithead dope dealing gang banging drains on society need to go to jail. Me and my partner can finish all the paper work for a simple weed arrest in about 15 minutes so who cares, the rest is on the desk sergeant and lockup. Thats the problem with the new selfie police, that is what we are calling them right? they are buying into the anov bullshit way to much. Maybe it's all that time on foot patrol We are the police we take people to jail when necessary.

The citywide fact is that overall arrests are down. No matter what it's for. If you realistically want to impact crime then you have to increase arrests. Every shitbird arrested for something that is bullshit, like weed, but is against the law, is one less victim or criminal on the street. Lock 'em all up. Let God sort 'em out. If not, pretty soon we'll be issuing ANOVs for battery, trespass, theft, etc etc etc.

THis is stupid...administrative stuff still has to be completed on a daily basis to run the Department. Who is going to do it...they laid off the civilians years ago. This is the kind of bs you get when the bosses in this department (or any fed, state, or local) coddle to the public and politicians. You run this department like a Police Department! People break laws they get arrested. The PO who is handling the job decides what is warranted (warning, ticket, or locked up). After that occurs good bosses (leaders) look out and support the POs lawful decision. If citizens or politicians complain then they have choices. 1 is become the police and do the job (easy enough) 2 go to court and prove the offenders innocence 3 vote or run for office and change current laws and penalties. It is not very difficult.
Too many bosses have been bred under a corrupt system that has always allowed the citizens or politicians to influence their decision making. Bosses that are worried about the next promotion, how popular they are or what someone may say, causing them to not do the right thing by the PO or the Police Department. Leaders that are respected often make a decision based on right or wrong. They support their troops. Even if it's not the popular thing to do, they do it and support them, because it was lawful and it was the decision the PO made.
Just a thought that is being thrown out there.

When the weed is confiscated it stimulates business for the drug cartels as the offender now has to go back and buy more. This in turn helps fuel the violence south of the border creating a crisis that Rahm will not allowed to go to waste.

Does anyone really think that these tickets are teaching anyone a lesson so the offender "will not do that again"?

It's not much different when a smartphone gets ripped.

The corporations love it as the victim has to go out and buy a new phone or ends up paying for the rest of the service contract and gets nothing in return.

Chicago crime has become the number one industry here. Crime drives the economy. Crime creates the crisis that is used as Rahms tool to import more unaccompanied illegal immigrant-runaway wards of the state so he can stand at a podium like a dumb ass and ask "where are the parents' -- like his hands are clean in the whole operation.

The apparatchik here could just legalize and tax the weed. We could use the tax revenue. It would create jobs and we do need jobs. It would free up man power and we do need manpower.

However. legalizing the weed would take away the central command and control from certain people and their egos just can stand for it.

Where would the fear they use as a tool for more power and taxes come from as the illicit drug turfs dry up?

The drug cartels profits would take a hit and we couldn't have that.

Central America might just become a habitable place again.

THEN WHAT? WHERE WOULD WE GET ILLEGAL IMMIGRANTS TO EXPLOIT?

Most of the people we encounter with small amounts of weed are gang bangers. Gang bangers don't get tickets. They go to jail for a few hours. - that's a few hours they are not on the street shooting at someone or being a target for some other gang banger - and if we can impound their car - bonus. Plus no I Bonds. - send them to court if we can -

I was in on the developing stages of this nonsense and the city was only thinking of the revenue that these tickets would generate. I kept saying you'll be lucky if 25% pay....they thought I was crazy! We'll 2 years later and the collecting is at 21%..... Never listened to reason if you have a gold star! They were so sure people would pay rather then have it on their record...I told them that most won't give a $hit... Ha the city is so stupid

So according to the municipal code if you're arrested for drinking on the public way you can be fined $100-$500 or 6 MONTHS IN JAIL! But less then 15 grams of weed its just a $250-$500 fine. That makes sense, right? And don't get caught rockin a piss in public it's 5-10 days in jail

I agree with the poster about, " attesting" to the fact they do posses weed. We don't inventory alcohol, but we do write ANOV's for it. Soooo, just have them attest to it, write it, and have a disposal can in the station. Eliminates a whole useless process that is time consuming and costly.

Just finished working my second day at Lollapalooza. A lot of questions/comments came up with those I was working with. First, there is an incredible amount of people there. But the ones getting hurt is themselves, they are not hurting others. Second, for the number of people there the amount of fights or other violent crime seems very low. I don't think I heard a single "person with a gun" call. Third, it is my understanding that Lollapalooza makes A LOT of money. Which leads me to a specific part of our discussion.... Why has the Taste turned into what it has? The short answer.... It is ran by a private company as opposed to being run by the City. I won't get into the clientele....... Bottom line is the City cannot run anything without fucking it up.

You missed the most important point. Lollapalooza charges an admission, the Taste doesn't. That means any and all fools can come done for free and screw up the place. Thats the difference, the admission charge.

I brought in weed after issuing an ANOV to inventory, and guess what we couldn't find? Needless to say, after looking for a kit for an hour, we eventually created a case report and explained the scenario. The bosses can spout off about how they are creating ways to make the job more efficient for officers, but once reality sets in, they are only making things more difficult. If they want to help the efficiency of the department, start with the little stuff; working vehicles and PDT's.

Off Topic but of Interest.

Pfleger was on the news the other day calling for Cardinal George to declare all Chicago Archdiocese Catholic Churches GUN FREE ZONES.

When leaving mas this morning I had a short discussion with the Pastor of our Catholic Church. I told him I was thinking rather un-Christian thoughts about Father Pfleger and his trying to dictate to the Cardinal to declare all of our Catholic Churches GUN FREE ZONES and mark them on their front doors.

As always this (expletive deleted) and the Democommunists are trying to disarm the wrong people.

I didn't mention to the Pastor I was a P.O. but if there was an incident I would put myself between armed assailant and my family the rest of the parishioners. If there was such a ban imposed I said I would probably move our worship (implied $) to the nearest parish outside Chicago.

The Pastor responded that he didn't think that such a ban as going to happen and he wasn't going to enforce it anyway.

I thanked him and reminded him of the large stained glass window of our church that is almost every Catholic Church. It features St. Michel the Archangel with a fiery sword, a firearm.

My girlfriend and I were walking along the lakefront with our dog in the early 70's. We started talking to a blue shirt (younger guy like us). I bent down to point something out about our dog and lo and behold out from the pocket of my dress shirt fell a joint. Hit the officer right square on the top of his shoe. I swear it made a noise louder than a 100' tree falling to the ground. The copper just rolled his eyes.

We stood and talked to him for what seemed 2 hours. We were afraid to walk away. When we did it was without incident.

The point? I dunno. Over the years I had many dealings with the CPD. Yeah there have been some JOs, but you know, all and all I have never seen a better and more professional police force anywhere in the world.

Bratton is dismantling most of the strategies that McCarthy put in place in NY. On what grounds does the mayor let him go? How about these just for starters:

1. He has created the most toxic environment the CPD has ever known to include no one desiring to do anything but just get by. Horrible/non-existant leadership.

2. He is more politically corrupt than any previous Supt. Wait until the CH merit promotion scandal and the associated merit promotions furthered by Chief RT really blow up and become public.
Talks the talk but doesn't even try to walk the walk yet thinks people believe him. The arrogance is truly astounding.

3. He has absolutely no credibility with the CPD because he lies (e.g. meritocracy speeches, see above, has the working cop's back which we all know is BS, etc) and knows very little about anything other than a beat car which is valuable but not nearly enough to run an entire police dept. No conception at all about how the different parts of a police dept. can contribute to lowering crime, especially in a gang environment. The public is starting to figure this out as well.

4. Does not have the ability to adapt to any organization if it does not do things the NYPD way because that is all he knows and does not understand anything more thereby forcing strategies and polices that have been a disaster (eg DSS position, XO's, etc. too many to list). He did the same in Jersey and we are starting to find out how that all worked out.

5. He is so self absorbed that all that matters to him is him. He doesn't care about the CPD or its people in any way, shape, or form and it is obvious to everyone at CPD. He believes we midwesterners are just stupid and will believe whatever nonsense comes out of his mouth. Absolutely the worst environment to work in because it violates one of the basic tenets of leadership.

There are so many more failings that can be listed but I think the point has been made. No leadership, no ethics, no integrity, very limited job knowledge, and an ego the size of New York. He was bound to fail in a big way but he had a lot of people fooled in the beginning. The question becomes how does this all get fixed if it's even possible.

PS The original poster writes in a way a New Yorker would. Nobody here calls him or anyone in that position the "super" or "our super", and no one here believes the manipulated stats are accurate. "Super" is what people in New York commonly call a building superintendent. Also, who pays that much attention to what is going on in the NYPD except a former member. So it's either McCarthy or Tracy. I'm guessing Tracy but could be either one. We are not so stupid after all.

Ha, ha, NC. If that were me I'd have laughed my ass off. Plenty of good people smoke weed. some do all sorts of other thing and are still decent citizens. I know, I an hear the wheels spinning in some heads. Adding to the mayhem. Funding crime and terrorism...yada yada. All that may be true, but it's way above my pay grade.

I lock people up that need lockin up. I let more than a few people keep their roscoes over the years. Same with traffic. I let almost everyone go with a warning, but believe me I do make a lot of stops. That's what we do, serve and protect. I never forget that. I am here to keep things safe and let the decent people go about their lives. Not for everyone on this job, but I sleep well at night.

I like your attitude. The year I graduated high school, a group of us were out drinking and being stupid. We were pulled by a couple of under covers for some admittedly very unsafe driving in 024. We were very respectful and the coppers who nailed us were very kind. They could have hauled us in and our parents would have kicked our asses, but these guys were cool. They removed the booze and weed (about an ounce) from our vehicle and followed us home to ensure that we got there safely. This goes back 30+ years, but I'm still grateful to those guys. A lesson was learned that night: 1. We were stupid and dangerous to others and ourselves 2. Don't be an asshole when you're pulled over 3. Appreciate and understand the bullshit that coppers have to deal with and be respectful. Had we not been pulled over that night, given the way we were driving, we could have really fucked up our lives and/or someone else's lives. Those guys explained that to us and went above and beyond in an effort to keep us safe, avoid an arrest and the wrath of our folks.

EV and WL, our esteemed number crunching bosses, have them locked up because the district wrote so many they fear an increased index for next year. Thanks to the taxi Nazi sgt on the entertainment detail, ANOV numbers have exploded.

Not a cop here, but a question:

Correct me if I am wrong, but isn't there a standing general order that prohibits city employees from going out to work every shift without all the necessary equipment and required gear needed for your shift?

If that's correct, I would think every officer that isn't in possession of an ANOV book could reasonably tell their Sgt that they can't leave the station without their Ticket Book.

For over thirty years as log as I had my uniform, star, shield, body armor, gun, ammo, handcuffs, flashlight, nightstick and radio I had all the necessities.

Everything else was just bureaucracy.

There has always been shortages of everything, manpower, cars, ticket books, report forms, if the city had to pay for it we ran short of it.
