Acquitted? Acquitted?

  • A 92-year-old woman was acquitted Monday of misdemeanor battery to an off-duty Chicago police officer who fatally shot her husband in a dispute between neighbors.

    Hazel Jones-Huff had already been found not guilty last month of a misdemeanor count of aggravated assault stemming from the same incident in the Gresham neighborhood.
Those of you who aren't up to speed on this one, the families were having a feud. It went on for years. People got locked up, investigated, etc. A lot of neighborhood nonsense. It escalated over the years and culminated in the 92-year-old woman striking an Officer's wife with a broom in the head. The Officer heard the commotion and came out to do what any husband would do.

The 92-year-old told, TOLD her 86-year-old husband, to go get his gun, which he did and shot the cop's wife with a shotgun. The Officer killed him and when grandma went for the shotgun, he shot her, too, all on OEMC tapes.

But no one heard about this part until Monday:
  • Jones-Huff was arrested in April after the argument between her and her husband and the off-duty officer and his wife who lived next door erupted into gunfire. Her husband, Joe Huff Jr., 86, was killed. The officer's wife, [...], 54, had her right arm amputated and was blinded in the right eye as a result of the shooting, authorities revealed for the first time Monday.

    Jones-Huff, who recovered from gunshot wounds to her arm and leg, was the only one charged.
And now Cook County Associate Judge Matthew Carmody found this elderly offender not guilty?

Pardon our French, but what the fuck? The Officer's wife lost and arm and an eye due to this woman telling her husband to get a gun, and no responsibility is assigned to anyone? Are you fucking kidding us?

Well bet some blame ends up being assigned when the inevitable civil suit is filed.

Does everyone see why we vote "NO" and encourage voting "NO" on all Cook County judges?

On the news, her family is crying about how all the po-leece wanted to do was go to the hospital and throw their momma/auntie in jail. Makes me sick.

And I did vote no to every judge. Did any of them lose their spots?

The officer needs to file a counter-suit against the woman so when the city settles they can go after that settlement, for his wife's loss of arm, blindness, pain, suffering, emotional, and psychological stress.

Couldn't have said it better myself, SCC. When I was reading this and even before I got to the bottom of the article, I was thinking, "This is why we vote NO on ALL judges!" WTF??

I would say that posting the Judge's name would get people to Vote No. But as with every election, people are so dumb they continue to follow this simplest advice in the world. I will continue to Vote NO on all judges, elections after election, but apparently me and a couple people on here are the only ones with common sense.

I agree, SCC, she deserves the maximum sentence for the crime that she committed. She is guilty in my mind, regardless of the ruling of the justice, and life in prison is the only sentence that she should have been handed. Though in all honesty, that would mean what... a month or two served? She is 92! I doubt she knew what she was on trial for. She probably didn't even recognize them as her neighbors, if she could see them at all. Let her walk and move on with what little life she has left.

Caught this story last night on NBC 5. Truly some unbiased fucking reporting! Fuck! OF COURSE they start the piece with a 911 caller describing the last half of the incident and COMPLETELY OMIT the fact that the officer's wife lost an arm and eye!

This shit makes me sick to my stomach. If you cannot even defend your loved ones and yourself on your own property, all is fucking lost!

We are TRULY second-class citizens. Our lives are fucking worthless in the eyes of this city.

As I have said on more than one occasion:The FOP should have a list of judges to specifically vote against, but they fail to do so. Cops and their families are targets of Cook County Injustice on a regular basis. Any judge who shows disrespect to officers or is responsible for this type of decision should be removed from the bench, and the condition of this woman who was a victim should have been a headline in our bias Media. How can this woman have lost an arm and is blind, without anyone knowing it until now? Come on, are we to believe Nobody Knew?"G"

You can't always blame the judge. Sometimes the ASA puts on a really bad case. That's a problem we've seen before: a good case gets lost in court because of a bad state's attorney.

So the next question is: who was the assistant state's attorney? did Anita put her best attorney on the case, or did she leave it to the neophyte, fresh-out-of-law-school ASA who was only cutting her/his teeth in the branch court?

Age and Health are mitigating circumstances for Sentencing. Not for Guilt or Innocence. If the judge shows mercy in her sentencing, that is acceptable.

I voted No to every Judge and so did my family. This is THE WORST place to be a victim and honest member of society. It's run by corrupt clouted and dumb people. Judges are weak and not qualified and put friends and politics before victims. If a judge has any remote connection to the defense it's freedom for the bad guy. Only thing we can do is avoid the courts.

I hate to Monday morning quarterback but...if that was my wife, as soon as the old lady would have screamed to her husband to go get a weapon, my wife would have quickly retreated into the safety of our house.

Maybe his wife did not have time, or did not hear the threat. Ashamed she lost her arm and has been disfigured. This whole situation could have been avoided with cooler calm heads.

Be safe people, and take this situation as an example how quickly things can go bad.

Perhaps someone who was at the trial could chime in as to why there was an aquittal.
As far as the judge is concerned, he was not on the ballot for retention.
All judges up for vote were retained, including Carothers, who the FOP did publish a post to vote no.
The problem lies in the process; a blank vote counts as a yes. Just think, how many people flipped that ballot over, saw how many judges to vote for, and said fuck this, I'm done. You get your ballot scanned and the election judge says "it's incomplete, do you want an override?" There is no way even a huge push for a no on someone can overcome this. It needs to be changed.

Obviously the emotional trauma and embarrassment of being stripped of your police powers should be incentive for all such officers to take advantage of every resource the Department offers regarding counseling and administrative time off to recover from the induced guilt of having your treasured police star and ID taken away. 13 new associate judges named in Cook County

The names of 13 new associate judges, selected in a vote of Cook County Circuit Court judges, were announced Tuesday by Michael J. Tardy, Director of the Administrative Office of the Illinois Courts.

Ballots listing the names of 26 finalists, chosen from 277 candidates, were distributed to 257 circuit judges. Ballots were due April 25, 2014.

The Alliance of Bar Associations and the Chicago Bar Association evaluated the candidates. Each candidate was interviewed by an 11-member nominating committee, comprised of Chief Judge Timothy C. Evans of the Cook County Circuit Court and 10 presiding judges.

Judge Evans certified the 26 finalists to the Administrative Director on March 28, 2014.

In accordance with the 1970 Illinois Constitution, the Administrative Office conducted the election pursuant to the provisions of Illinois Supreme Court Rule 39 which directs that twice as many candidates as vacancies be nominated. Supreme Court Rule 39 provides that the term for all associate judges expires on June 30, 2015. The 13 judges appointed today, as well as those associate judges currently serving, must be reappointed July 1, 2015. Cook County seats 146 associate judges.

The following is a list of the newly selected Cook County associate judges. A brief biography of the thirteen associate judges named today is attached.

Guilt determines the finding..
Age and circumstances determine sentencing.
A finding of innocence opens the door for lawsuits against the neighbor, the cpd and the city.

I think some of the commenters are missing the point.

Yes she is 92 and she might not be MUCH of a threat to anyone including the neighbor that she directed her husband to shoot and then attempted to pick up the gun herself only a few short months ago.

However the reasonable solution would have been a finding of NG and suspend the sentence. Or to have state knock it down to a bullshit plea with probation.

The problem with this judge's solution is it now opens up the cop and his family and the CPD to a lawsuit. And these fuckers don't deserve a dime.

I am a former member of the CPD and also a former ASA. Matt Carmody was one of the BEST prosecutors I have ever worked with. He did not change over night. He is a GOOD Judge but in order to find someone Guilty the evidence has to be properly presented by the prosecutors to the Judge, it wasn't. If you are looking to place BLAME, start with bringing this type of case to trial and not being properly prepared with your witnesses and evidence. Matt had represented members of the CPD with success over the years because his cases were properly prepared.
