Chase? Pursuit? (UPDATE)

So the Tribune or someone else has scanner tapes regarding the death of the child in a stroller. We listened to them all, then promptly lost the link, but we're sure someone will post it in the comments. It appears that an off-duty Department of Aviation officer witnessed the shooting and was following the car as it fled the scene, calling it in to 911 and attempting to get CPD to respond to his location.There was a description broadcast and the time between the actual shooting and the crash appears to be lengthy.

So what constitutes a chase exactly? Merely being given a description of a vehicle and a last known location isn't a "chase" by any stretch. The lag time between the off-duty giving his location and it getting out to the units can be seconds or tens-of-seconds or minutes.

One of the audio clips has a portion of what may well turn out to be a pursuit, but the entire clip is over in seconds, with almost no time at all for a termination order to be determined and issued, given the severity of the crime and the "balancing test" to be applied.

Are we rapidly approaching the point where even a murderer is safe to flee the police because the danger to anyone outweighs the chance we might actually catch a criminal? This is the "balancing" we're supposed to administer - the ultimate crime (first degree murder) is just another report to be cut and no one is to be chased for any reason whatsoever?

The clearance rate of 30% will drop to 10% overnight. You will literally, be able to get away with murder, just by being in a car.

I remember a knucklehead back in the day always teasing kids to chase him... well one day he got his chase, and ran smack into the 2 inch width side of a door as it was opening-- splitting his head open, letting the dark blood leak out.

ever since then, I think twice to chase.

Is motorized pursuit worth the extra loss of life and injury? The answer is no. Foot pursuit is OK, motorized pursuit is too great a risk to the general civil population.

Mr. Gardner estate got 5.6 million dollar judgement as a result of meeting his creator. In this scenario the 1 year old baby killed as a result of police work merits another judgement. There are a different set of values in each set. The bad guy is starting to win!

Vehicle initially pulls over then takes off. Officer goes after with siren in the background. Seconds later officer asks for an ambulance for the child. Too short in duration. Not a pursuit. How many times has it taken blocks for a drunk to even know a squad was behind them with full lights and siren? Thats not a pursuit either.

The judge said two counts of the lawsuit can stand for now, but may fall later because Brown's parents may not be able to make those claims for Brown, who was 18 years old and an adult when he was fatally shot, the newspaper said.

Among the four counts that were dismissed, two were not in dispute, U.S. District Judge E. Richard Webber said, as they addressed claims related to state civil rights, the Post-Dispatch reported.

Two other counts related to claims against former Ferguson Police Chief Thomas Jackson and former Police Officer Darren Wilson were also dismissed after Webber deemed them "redundant," the Post-Dispatch said.

Brown's family filed the lawsuit against the city of Ferguson, Missouri in April. The shooting triggered national outcry over excessive force by police against minorities.

In the lawsuit, the family sought $75,000 in compensation and unspecified punitive damages. It also called for a court order prohibiting the use of police techniques "that demean, disregard, or underserve its African-American population."

Yeah, all the rates will drop because there are chases every night of homicide offenders..... Last time a chase of a homicide offender happened for a case I was working? About 4 years ago. It's not common, especially when everyone these days just responds directly to the person shot to see the body and stand around with a rifle... God forbid touring the area for the offenders... When I heard this story I was sickened, the loss of this innocent,beautiful child is heartbreaking and an unbelievable tragedy. Eventually after the initial grief and sorrow the blame game will begin and unfortunately those sworn to protect us will be the fall guy instead of those who choose to break the law. There will be no mention of the criminal mentality that thrives in black neighborhoods and is even rewarded in the cases of Eric Garner,Michael Brown and on and on. Only when the community chooses to say enough is enough will this behavior cease and it isn't anywhere close to happening. Remember this baby in your prayers and the next innocent child which is inevitable.

I've searched and searched and I can't even find the article in the Trib that had all the audio clips. The article might have been behind the Pay Wall anyway.

I did read the article yesterday and listened to all the audio clips. What I got was that the off duty Dept of Aviation Officer was *Following* the suspect's car, NOT *chasing* it. And no CPD squad was in a 'chase' either.

Also, as sure as Sprig follows Winter, there were the STOO-PID comments by the usual suspect libtards :
---- a) There was a 'chase'
---- b) Police should NEVER chase any suspect. Yep they said "any" suspect and "Never".
---- c) The accident & baby's death was the fault of the CPD for 'chasing' the killers.

Clearances can also be for offenders who are never proven they are the offender but end up dead from another incident.

The City throwing those Detective to the wolves(posting OT) just because they are doing what the city wants Homicides cleared NOT solved. The lock up are empty and interviews are few and rare. States attorneys wanting confession that make sense and clear surveillance video. My favorite part is the supervisor in the "D" who are clouted in from patrol who have no idea what going on but run to the "xo" to fill them in how they are solving the current heater case.

Read the vehicle pursuit general order. You the patrol officer has to conduct the "balancing test" while engaging in a vehicle pursuit. Plus, all of our actions have to be "reasonable". That is a pretty tall order. The city can simply blame you for anything that goes wrong and say you did not conduct the "balancing test" or was not "reasonable". I am in favor of doing my job and doing good old fashioned police work. But how can I do my job if my own general orders make me the fall guy whenever something goes wrong? Some may say I am scared to do my job. But that is not sensible. As police officers we are restrained from doing our jobs in a sensible manner with all of these crazy rules, orders, laws, etc. Common sense and logic is thrown away in favor of passing the buck. In the end who suffers? The people who work like dogs, try to save money here and there and the decent person.

Sorry but the shy came on the air asking why chasing. 27 seconds later the crash happens. Guy from 004 on the air with dispatcher for 36 seconds giving updates about the chase on zone 7. 461b says squad 3rd district is chasing the car on zone 7. If the car takes off from a Traffic stop and the squad car drives one foot even with the lights or sirens on in an attempt to view, stop or follow that vehicle it is 100 percent a pursuit. The radio tapes are the killer here. It was a pursuit. They will get paid as they should. However, I don't fault the officers or supervisors here... It was a carload of offenders wanted for homicide.... The chase is legit.. But don't try to say it's not a pursuit. It was a pursuit and it was a lawful pursuit and a pursuit that conformed to general orders so stop freaking out. You don't have to hide that it was a pursuit because it was.. If it's a legit reason then it's a legit reason.. End of story. Extremely tragic ending but the officers are covered if it was made into a pursuit and everything was articulated as it should have been

Balance and reasonability are the city's and CPD's plausable deniability. They can say that chases are allowed but make the restrictions so tight as to render it moot. With ALL the onus on the chasing officer they insulate themselves from responsibility at the expense of an officers employment and possible freedom. Work hard at your own risk. Remember: 99% right is 100% wrong!

The Aviation Police, are in fact the police under Illinois law and can carry weapons on and off duty. However, Daley prohibited this during his term and it seems that it continues. I have had some contact with them while working at the airport and I can say that some are retired CPD, but others are just clouted and not someone you would like to see carry a gun. Nothing more then security guards.The same goes for the Cook County Hospital police. Just more patronage jobs.

Why not play the one continuous tape from zone 7?

So two tact guys from 004 make a comment that they believe it's a chase because they are listening to the zone? They were not on scene. When officers are under stress they are very hard to understand and and the tact guys from 004 may have misinterpreted what was going on. However, the guys in 004 will now know first hand that everything they said they will be questioned, deposed and cross examined.

You give the media too much credit. They are master manipulators and masters of telling only part of the story as is demonstrated here jumping from tape to tape.

They will get paid as they should. However, I don't fault the officers or supervisors here... It was a carload of offenders wanted for homicide.... The chase is legit.. But don't try to say it's not a pursuit. It was a pursuit and it was a lawful pursuit and a pursuit that conformed to general orders so stop freaking out. You don't have to hide that it was a pursuit because it was.. If it's a legit reason then it's a legit reason.. End of story. Extremely tragic ending but the officers are covered if it was made into a pursuit and everything was articulated as it should have been

I agree they should get paid but why should the City pay? The Officers did nothing wrong. They didn't shoot anyone, hold a gun too anyones head and say run away. They were doing their jobs in a lawful manner. The people that should pay are the criminals that shot the other thug in the first place and then took off and caused the police to pursue them.

The city can simply blame you for anything that goes wrong and say you did not conduct the "balancing test" or was not "reasonable".

Then you could face this scenario: You make a traffic stop. The motorist waits until you exit your vehicle and then takes off. You already ran the plate and it comes back clear so..........having a minor traffic stop and a vehicle coming back clear you use the coveted "balancing test" and decide there is no "reasonable" reason to pursue.

However, 10 mins later, you hear a call of a pedestrian struck by a speeding vehicle. You find out that it was the same car you pulled over but took off on you.

When you get home, you turn on the news and see a story of a man that was a victim of a hit and run. You also watch as an eyewitness tells the reporter he had seen the same vehicle before the accident, stopped by the CPD and they did nothing! They allowed this motorist to go free, resulting in the near tragic death of a citizen.


Good luck explaining the balance test when you are sitting in court facing that 5 million dollar lawsuit.

The excuse to disarm the Aviation Police was that it would "intimate travelers" when the real reason was that Daley did not want a creation of Harold Washington to survive. However, the FAA had help set up the Aviation PD - so he had to keep them or repay the FAA . Every time I'm at O'Hare I'd like to rename Maggie Daley Park "Shortshanks Square" for an idiot who STILL has CPD protection - even though he bankrupted "the city that he loves."

The Aviation Police, are in fact the police under Illinois law and can carry weapons on and off duty. However, Daley prohibited this during his term and it seems that it continues. I have had some contact with them while working at the airport and I can say that some are retired CPD, but others are just clouted and not someone you would like to see carry a gun. Nothing more then security guards.The same goes for the Cook County Hospital police. Just more patronage jobs.

I believe the Illinois law enforcement training and standards board would say differently. There are requirements that need to be met to keep up your Illinois certification....they meet none of those requirements

How about this.....its just stupid to have an unarmed PD. There are lots of active shooter incidents going on and if there is one at the airport they should be able to get themselves out. Arm so that they can help protect and assist CPD if something were to happen. CPD should stay and keep on with 19Paul for everything. APD armed to be able to assist and access control.......Yeah yeah there are Idiots on APD that you wouldn't want with a weapon but CPD has them too....Ken n Barbie tac

Huh? We don't have crystal balls in our cars. I don't recall anyone being sued for deciding NOT to continue a pursuit after weighing all the facts.

Actually the suspect should be the only one paid by the city, with more fucking charges!!! That's it! Good God what the hell is this world coming to? It's just getting worse and worse in every way. It's hard to even look at the shitheads, politicians, media, and all the people that love to talk a whole bunch of shit about things they know nothing about or even understand.
