Um, Duh?

  • The Chicago Police Department struggled Friday to explain why the third-highest ranking member of the Chicago Fire Department was neither tested for alcohol in his system nor charged with drunken driving after crashing his city-owned SUV this week near Lake Shore Drive in Lincoln Park.

    The Chicago Fire Department has concluded that John McNicholas, who ran the Fire Department’s Bureau of Operations, was under the influence of alcohol at the time of the accident.

    But the Breathalyzer test was administered hours after the crash happened, at Fire Department headquarters at 35th and State, by the Fire Department’s Internal Affairs Bureau.

    Chicago Police officers were on the scene of the accident on LaSalle Drive just off Lake Shore Drive for up to two hours but never administered a field sobriety test or Breathalyzer test, sources said. Four squad cars were dispatched to the scene and were there from 30 minutes to two hours.
Anyone else think that there are a couple careers about to be sacrificed in order to give Eddie Johnson credibility as a "reformer"? You know he isn't going to take any action on the cheating scandal that involves his betrothed. That would point the spotlight at too many people in the past who "assisted" their minions into positions of power - the same minions who are currently picking the next generation of "merit" fuck-ups who will continue to drive this department into the ground.

Rahm has to be jumping up and down with glee - his handpicked superintendent who was already under a cloud for his proximity to this stinking exam scandal, is now obligated to hammer the involved officers, a sergeant or two, maybe even a lieutenant if one showed up. Voila! Reform! Burnished by a couple of hefty suspensions and/or firings.

And to the inevitable trolls who are going to blame the blog for this seeing the light of day, this was all over the Fireside Chat blog almost immediately after it happened - McNicholas is roundly despised among the CFD - and the interested parties had already e-mailed this with numerous photographs to every news outlet they could find. We were at the bottom of a long list of e-mails, so spare us the whining.

Here is the bottom line.

You pull someone over on a traffic stop OR you arrive on the scene of a traffic accident.

You ARE NOT by order entitled to give everyone a "field sobriety test".

Through ones experience an officer can tell if someone seems to be "under the influence".

On many occasions you CAN NOT tell if they have been drinking or on narcotics, therefore you do NOT order someone out of there vehicle to administer an exam.

Since this guys employer had a policy of giving an administrative breath test it was discovered he was over the legal limit.
WITHOUT that breath examination machine there is a good chance 100 individuals would never have this political hack was ever intoxicated.

THEREFORE, the mayor, the media and all the rest of the police haters can take the CR number that was issued to the officers on the scene and STICK IT UP THEIR pompous asses.

Why officers who KNOW that this dept. is being held hostage under the scrutiny of so many outside agencies would allow this miscarriage of justice just boggles the mind. Johnson has no choice but to go after all of those involved who blew off their duties/responsibilities, and well he should. Should anyone lose their job over this, it's their own damn fault.

What good will that do? Most of the cheaters have already been promoted in the first class. Throwing out the list would just hurt everyone who actually scored well. It's not like they are going to demote the new lieutenants.

while off duty. And officer was stripped, fired and now studying law......

Unions fought and lost it. Officer fought and lost it.

Went all the way to State supream court.
IAD sergeant had to do tests

CFD did tests, they can determine what level of intoxication was at time of
accident.

That's not true. Threat that CFD administrators is somehow different then what the CPD does. Something similar happened a few years back and the process used &/or epuipement doesn't meet the standards for law enforcement standards. But it would of been mince to see him get hammered for this. But I do hope that none of the street cops gets tied up for giving him the pass.

Johnson was on the Dorothy Tillman show this morning( 4/23), and one of the callers immediately made reference the fire boss being "Irish" and demanding to know why he got a pass. Johnson said the matter was being reviewed by two separate agencies, fire and CPD. Now the initial reports were that he was charged with reckless driving which is fine. However, he hit a City pole while driving a City vehicle and caused damage to both. If he was not issued a bouquet of citations, especially for damage to City property; the officers might have problems. Johnson also answered questions about the latest video of alleged CPD misconduct involving the woman fleeing the armed robbery. He claims he is reviewing others as well. Remember, that video goes back to 2011! Stay Fetal. Baby "G"

I completely disagree with you. A driver with a high BAC will exhibit signs of impairment while sitting in a car. I do not know what 100 individuals you know but a trained police officer can spot a impaired driver while talking to him. It might be hard for the paper car handling the crash to explain why he did NOT suspect impairment. With a crash the driver must exit the car and there are always some actions that show impairment. If assigned to a carsh and a boss is involved, whether CPD or CFD do your job or you will pay the price.

Ask Eddie and the new merit / cheater lieutenants how many DUIs they have done in their career. The real truth is that most officers are very reluctant to do a DUI on anyone. Look at the statistics. Only a few officers do the majority of the writing.

Just because you are involved in an accident is not necessarily grounds to suspect a dui. There must be reasonable suspicion. You will have to justify your reasons on paper and in court. I had several cases where the offender never displayed any signs of impairment, but when taken to the hospital for treatment, the medical personnel informed us that the person was over the legal limit. If you don't have reasonable suspicion, you would have normally have a reason for not administering one, but in this police hatred climate, they department, politicians, public and media are out to hang you. Don't give a test if you don't suspect. They will get you for violating their rights.

This CFD boss hit the blow administratively. The CFD brass would have taken care of him. I agree with the professional drinker comment. The dick wouldn't have admitted to anyone especially himself he was drunk. He jammed himself up. The shit storm this crotch created will fuck our guys on scene. They need to stick to their narrative: no apparent overt suspicion of dui, traffic duties to prevent further accident and the administrative blow as a backstop. I would add that only a complete piece of shit drinks at work and to have attained a rank so high in the CFD would have put him very low in totality of circumstance in regards to reasonable suspicion so that would not have entered my mind. I would have assumed by his age conjoined with any apparent cognitive impairment and duty status that he was having a diabetic episode.

Who approved what? Who said anything about ignoring a DUI? Could it be at all possible that the firefighter involved did not exhibit signs of impairment? Could it be that there is no cover-up, that he had an accident and it was the determination of the officer at the scene that there was no, or little indication of impairment? The assumption of impairment came during the administrative phase of testing required by the CFD. If you come to work under the influence, not falling down drunk, but yet under the influence, is it likely that you would be jammed up? No! If the Random Unit called, well, just like this fireman, you would be found out and be jammed up because you would blow hot. Everyone is screaming cover-up, and coppers going to lose their jobs, and bosses ordered them not to write a DUI or professional courtesy gone overboard, when this could just be a simple case of the investigating officer either not recognizing the signs of impairment or there were none and the fireman blew hot in spite of not exhibiting the classic signs. There's even a female black boss at the Fire Department screaming cover-up. What a piece of shit, and for any of you who are touting it, STFU until you know the facts, which you never will so just STFU! If the officers involved are reading this, there are a lot of us that understand that not everyone exhibits the classic signs of impairment and that's fine. Just continue to do your job like you're supposed to and don't worry about this crap. Think about it, how many people get stopped for a violation and in reality are legally drunk and could be written a DUI but they don't exhibit the signs or they're not over the top classic DUI drunk and just drive away with a ticket, or even a warning and a goodnight? Most of the alderman in this City are contemptable buffoons. They are incorrigibly shady and wholly unethical and you want to “bring them in on this”? Like they’ll help you push this through? Everyone in this City hates the politicians for many, many obvious reasons and you want them to champion your nutcase cause? Here is the level headed truth: Not everybody that has a beer is drunk. Some that drink just over the limit drive as well as most drivers. By no means am I advocating drinking and driving, but I am not ready to side with the Nazis on the other side. You should see how they get their statistics and how they manipulate them. I am pretty sure most of the critics here cannot look in a mirror on this one, either.

Not everyone over the limit in an accident gets written. We don't have enough officers to for that. Blind drunk, easy to spot, they get written. Anything after that is subjective. Add to that, not every copper is proficient at DUIs. Again, not enough coppers on the street for that luxury. There is just too much to do out there and not enough of us to do it. That's why you have different coppers good at different things.

For you civilians out there; coppers and firemen face more scrutiny in this area than you ever will. It wasn't always that way, but you can be sure it is now.

Same thing happened in Indianapolis police a few years ago. An on-duty officer running code slammed in the back of V motorcycle is killing 2. Despite numerous officers at the scene. No one knew that he was nearly twice the legal limit until 2 hours after the accident when by policy he had to take a blood test. It was only then that it was determined that he was DUI. As anyone with experience and making DUI arrests will tell you you can sometimes be fooled by the behavior that the person exhibits especially if they are problem drinkers.

Who approved what? Who said anything about ignoring a DUI? Could it be at all possible that the firefighter involved did not exhibit signs of impairment? Could it be that there is no cover-up, that he had an accident and it was the determination of the officer at the scene that there was no, or little indication of impairment? The assumption of impairment came during the administrative phase of testing required by the CFD. If you come to work under the influence, not falling down drunk, but yet under the influence, is it likely that you would be jammed up? No! If the Random Unit called, well, just like this fireman, you would be found out and be jammed up because you would blow hot. Everyone is screaming cover-up, and coppers going to lose their jobs, and bosses ordered them not to write a DUI or professional courtesy gone overboard, when this could just be a simple case of the investigating officer either not recognizing the signs of impairment or there were none and the fireman blew hot in spite of not exhibiting the classic signs. There's even a female black boss at the Fire Department screaming cover-up. What a piece of shit, and for any of you who are touting it, STFU until you know the facts, which you never will so just STFU! If the officers involved are reading this, there are a lot of us that understand that not everyone exhibits the classic signs of impairment and that's fine. Just continue to do your job like you're supposed to and don't worry about this crap. Think about it, how many people get stopped for a violation and in reality are legally drunk and could be written a DUI but they don't exhibit the signs or they're not over the top classic DUI drunk and just drive away with a ticket, or even a warning and a goodnight? We have like 20 cops who do DUI s on a regular basis, odds are one of them didn't handle this accident, a lot of cops don't know what to look for with a drunk driver and a lot of cops want nothing to do with a DUI especially a city worker, some think you have to do something different , you don't , just a notification and a fax. Most cops will continue not to do them for whatever reason, let's just hope you don't come across a city employee hitting a city pole not on city time and you look the other way cuz they work for city, be smart

I got a one car traffic accident assigned to me by my D.C. and Tact lieutenant [both black; I'm white] that happened on my beat. The driver [black] was totally stumbling and slurring drunk.

The DC said to me when I arrived at the scene, "Blank", it's your job, do what ya gonna do", we're outta here. While being told this, I have to keep yelling at the driver to shut up and get back in his car. Ya gotta love a circus.

Old boy had slammed into a light pole. He was alright. The light pole and car definitely had problems.

I wrote him a ticket for damage to city property, called for a tow, and took him home after he signed off on refusing CFD treatment.

Naturally, when the DC calls in a job, ten cars race to the scene. Later in the station, everyone was flabbergasted that I didn't write a DUI since the DC would also have seen that the driver was completely blotto. They all thought I was screwed. My response? Hey he killed a lightpost and his car, why totally ruin his life more than it already was. Yeah, I know, by not writing him, he might drive drunk again and kill someone. Guess what; like with most drunken drivers, particularly him being in his seventies, no court case has ever stopped a drunk from driving again anyways.

The DC and Leftenant? Never a word was said to me.

Point?

We used to be able to be the real police and make our own decisions based on all shades of black, white, and gray. Even the bosses lived by that rule.

You also are not required to take a "field" breathalyzer and can request going to the calibrated machine in the area or district or have blood drawn at a hospital.

Absolutely right on all points. However, if you want to do the driver a "solid" you can do the followind: Do the 501 that has holes in it big enough that a truck could drive through. You might take a day or five because of sloppy work, but you can't be fired for NOT doing your job.

Since he resigned his #3 spot and returned to his lower rank....29 days Suspension is the best they can do to him unless his prior rank isn't Career Service and a union job.

He will be getting about $8,500 a month which is $102k a year for doing nothing. Sure it's less then what he was getting working and on call 24/7. But he has ties to vendors. In fact it was because of him that we use the air packs that we do. He will just go to work for a vendor and make more selling shit to the city. He's got the inside track.

OK Troll. Seeing as he was an Exempt Rank Employee. He becomes an "at will" employee. He doesn't get to automatically get to step down to his last civil service rank position. Also if you are exempt rank driving with under the influence gets you fired. Also he wasn't on duty but had a take home car because of his position. No suspension for him. He stepped down and then was separated from the department. But he will receive his pension which of thCFD allows for him to only get it based off of his civil service rank salary. Not his salary based on his appointed position.

A lawyer buddy of mine who was once a cop that used to teach DUI's told me, if need be, to stumble into the calibrated machine and then be able to claim that the machine was out of calibration as a result.
