Ignorance

Reagan once said, "...the trouble with our liberal friends is not that they are ignorant, but that they know so much that isn’t so." The same could be said about so very many people every time there's a police shooting. The arm chair quarterbacks, street corner lawyers and community organizers pop out of the woodwork with all sorts of ways to "fix" the police instead of having citizenstake actual responsibility.
  • An Evergreen Park woman is accused of posting a threat on Facebook to shoot any police officer who pulls her over and asks her to get out of her car.

    Jenesis Reynolds, 24, was arrested Friday at her home and charged with disorderly conduct. She’s accused of posting a Facebook message saying: “all I know is if the police stops and request me to get out of the car I’m shooting instantly.”
Has anyone pointed out to her (or those like her) that the police have an absolute right to order you from your car? Pennsylvania v Mimms gives police that authority. Yet here is an ignoramus saying she's coming out "shooting instantly." And she is hardly alone in her ignorant thinking. You think that doesn't play into the scenarios running through police minds?

But this attitude (and worse) runs through the ignorant portions of certain communities, claiming the police have no "right" to stop them, to direct them as to proper lawful behavior, to restrict their movement and indeed, their freedom of movement, especially during an arrest situation. If certain people (or folks) would merely comply with lawful orders, things would be a lot simpler and less violent. A street cop knows way more about the law and what they are or aren't allowed to do.

There is no right to resist - it's written into the law. It's also written that an officer need not retreat in the face of resistance. The government wrote it that way on purpose. Sorry.

The populace have civil remedies in the face of unlawful actions, but two wrongs don't make a right. If a person thinks they were unjustly detained, hire a lawyer and sue the authorities - it's the American way.

You fight it out on the street, a whole bunch of people are going to get hurt or worse.

Good point SCC about the Mimms case, but some officers think you need a reason to get someone out of there car, you don't need a reason, if it's a lawful stop, that's the key, lawful stop, Mimms said its ok to get driver out and Maryland v. Wilson says you can get the passengers out, it says " Due to the inherent danger of traffic stops for a police officer, he MAY order the passengers out of a car on any lawful stop" boys and girls these are cases from the US Supreme Court, they gave us the green light to get people out of the car, use it, be smart and hopefully you have supervisors who have balls to back u up, again to be clear. YOU DONT NEED A REASON to get them out, don't have to say I smelled something, he dropped something , if he did that great, if he does nothing you have case law on your side, again be smart and be safe.

The LAW means nothing. The FBI Head showed that about Hillary. She and he aides broke several laws, yet they go are not held accountable. So, don't quote the law to citizens, they know the law ranges from meaningless to optional. Cops need to learn to be more respectful and less demanding, because their law no longer exists.

It's a nice try but a misdemeanor and Cook County.
More of an inconvenience than a penalty. It's not like she will be applying for a high profile security clearance job.

Btw, a squirt of pepper spray in the defrost vent helps.

Don't do traffic stops. If you're pestered by the DSS...put their name in the witness box for insisting you can't drive a mile without observing a violator. Believe me, No exempt was ever a traffic hound or a blue shirt long enough to tell you what's better.

“Citizens may resist unlawful arrest to the point of taking an arresting officer's life if necessary.” Plummer v. State, 136 Ind. 306. This premise was upheld by the Supreme Court of the United States in the case: John Bad Elk v. U.S., 177 U.S. 529. The Court stated: “Where the officer is killed in the course of the disorder which naturally accompanies an attempted arrest that is resisted, the law looks with very different eyes upon the transaction, when the officer had the right to make the arrest, from what it does if the officer had no right. What may be murder in the first case might be nothing more than manslaughter in the other, or the facts might show that no offense had been committed.”


The most important thing missing is Plummer has been overturned by statue. It is no longer good law in most States'... See Wright at 387-88 (covering the common law rule, 36 of the 50 states prohibited resisting unlawful arrests); see generally Miller, at 953 (only 13 states allow resistance to an unlawful arrest).

Exactly most cops don't know because of lack of in service training, ive been out of the academy 4 years and now with what i know from the street ive got questions about scenarios that the stupid e-learning can't answer !

How about teh coppers that were bricked,chunks on concrete dropped from overpasses on them, fireworks used as bombs thrown at them! Hopefully some good people get sick of this and use their skill-sets to stop them in anyway necessary!

It comes down to Freedom of Speech versus Public and Police safety. Is it Hate Speach? Is it yelling Fire in a Movie Theatre? Possibly. Should she be arrested for it? Does anyone get arrested for saying they'll shoot anyone else?

“An arrest made with a defective warrant, or one issued without affidavit, or one that fails to allege a crime is within jurisdiction, and one who is being arrested, may resist arrest and break away. lf the arresting officer is killed by one who is so resisting, the killing will be no more than an involuntary manslaughter.was ignorance. Your statement was no one has a right to resist. Problem is the courts do not agree.


That decision was from 1899. It has since been rescinded by 36 states that passed laws stating the is no "right" to resist, even an unlawful arrest and further court cases have weakened the standing of that decision.
