Foxxx "Stunned"

  • Touching on an issue often raised by police when discussing Chicago's ongoing problem with gun violence, Cook County State's Attorney Kim Foxx said Tuesday that she was "stunned" to learn how few gun cases that go to trial result in convictions.

    Foxx, in an interview with the Tribune's editorial board eight months into her job, said her office is working with law enforcement officials to collect better intelligence and build stronger cases against gun offenders.
Really? Because we can name three cases right now where officers brought in a convicted felon, apprehended with a firearm, who were RWOC at the direction of Felony Review when the ASA made the case status "Continuing Investigation."

What's there to investigate? They were caught with a gun. It's pretty self explanatory. So Foxxx has to resort to the typical song-and-dance routine:
  • Foxx also pledged to be more transparent than her predecessors in leveraging community involvement and data-driven approaches to help reduce crime. She said officials from her office will meet with Chicago police on a monthly basis to share the data on cases and strategize how to build stronger cases.

    "What we realized is there's a big disconnect — police finish, they clear their case, they drop it off and they move on to the next. We have our cases, we either win or lose and we move on to the next," Foxx said.
This is what happens when you elect people for offices that operate waaaaaay beyond their competency zones.

Friend told me of a case in Saturation. 3 "Foxx supporters" all on parole, all convicted felons get caught with a pistol in a car. One resists...good case. Felony review doesn't approve charges. Gets overriden by deputy. Goes to bond court and all the charges are tossed!!! All of them! Resisting, pistol, warrants, etc. They walked free. Shotcago and Crook County....this is the type of garbage you vote into office. Congrats Rahm, Foxx, Prenkwinkle, Durbin, Gutierrez! Police haters and criminal supporters.

It is rumored that the former (now retired) active trustee M.L. has secured a part time job with the pension board as a $40k investigator to root out scammers.
That M.L. wants and needs Tom Benya in position as trustee to ensure his board vote to hire M.L. part time.
If this is true, there's a real problem with the pension board.
Why would they hire a former patrolman to investigate anything?
Why would they hire a former patrolman that hasn't worked the street or an investigation in more than 30yrs?
If they wanted to hire a retiree I can think of a lot of retired detectives that have much more experience conducting an investigation than M.L.

I hope this is not true.

Please do your homework before you blatantly vote for M.L.'s choice to succeed him.

And remember that S.R. was the active trustee when Daley was given his pension holiday that was never paid back!!!

Go back years ago and there were police chiefs heading to Springfield to talk about violence because Illinois law is too garbage. "So-called sanctuary policies make all of us less safe because they intentionally undermine our laws and protect illegal aliens who have committed crimes," Sessions said in a statement. "These policies also encourage illegal immigration and even human trafficking by perpetuating the lie that in certain cities, illegal aliens can live outside the law. ... We must encourage these 'sanctuary' jurisdictions to change their policies and partner with federal law enforcement to remove criminals."
The conditions apply to one of the Justice Department's most popular grant programs, which provides police money to buy everything from bulletproof vests to body cameras. And the requirements will apply to cities seeking grants starting in September.

The Trump administration strengthened its crackdown on so-called sanctuary cities Tuesday, announcing a new policy that says local governments will lose some federal grants if they do not give advance notice when illegal immigrants are about to be released from custody and give immigration agents access to local jails.

Let's do the math...

According to Foxx:
80% plead guilty
between 30% and 42% of the remaining 20% are found guilty at trial
so between 6% and 8.4% of gun trials produce convictions

That means the conviction rate for gun cases filed is between 86% and 88.4%. Seems to me that the Officers are bringing pretty damn good cases forward.

So why hasn't the FOP reached out to the editorial board to counter this clearly false bullshit. The police don't just "drop off a case" and walk away. They are supposed to be an integral part of the case through the disposition. It should be pretty simple to demonstrate and prove that she is either "lying or incompetent" (we know it's both). Whether they actually report it or not is a different story . . .

Hint to any real "journalists" out there: sit in the felony branch court and watch how much of the docket is cleared by "finding no probable cause." Then start your foia on state's attorney felony review decisions. You may also want to foia "any and all memoranda, emails, or documents related to policy and procedure for prosecuting gun crimes WITHIN THE LAST FIVE YEARS. Compare policies and guidance from the previous SA to this one. The numbers will add up quickly and point to two entities: the courts and this state's attorney office for a concerted effort to subvert justice by releasing dangerous felons to do it all over again . . . and again, and again. It takes jury nullification to a whole new and scary "institutional" level.

Since I went fetal and learned the new way to do no real police work, my blood pressure is down, I appreciate my family more, love the extra money OT, I even get along with the dog asses on the job, and stopped taking the bosses serious. Another benefit with being fetal, it give me time to plan ahead. That's right, planning the great escape and making damn sure I have enough bread to live good and long life. Oh really, Kimmy. You were Shocked and appalled at the embarrassing numbers of convictions. Yeah sure, I bet you didn't know that Gambling was going on in Rick's Cafe either. [blatant Casablanca plug ;-)]

Anywho Lil' Kim, here's a simple way to get convictions on gun cases -- Turn them over to the Feds for Prosecution. Your 'over-worked staff'(/s) will get a break and you won't have to worry about Cook County judges screwing the pooch, or them making an asinine ruling in spite of the evidence.

Nor will you have to worry about the state Parole Board freeing them after a couple years. The Board lets so many hardened criminals free who re-offend shortly after getting out the Parole Board *almost* could be charged with Aiding & Abetting, or an Accessory before the fact!

In Federal Court they take this shit seriously. From the Judges, to the US Attorney's who try the cases -- especially now with President Trump's goal of making the streets safe again (and with AG Sessions in Charge) -- to the Federal Prison system where Ten Years means Ten years. (see: Project Exile)

The fact is that historically Cook County has the lowest number of gun cases that's turned over to the Feds for prosecution. YOU Kimmy, can put an end to that. That is IF you are serious abut getting this scum off the streets and behind bars where they belong.

But that WILL cost you votes. It's why these mutts have basically been handled with kid gloves. So what do you say Kim? Do you want Safe Streets again? Or do you want to be a shoe-in for reelection based on votes from a Gangbanger's family?

Inquiring minds want to know.

Disconnect? That's the environment the Cook County SAO has fostered for years, in my experience.

With few exceptions, when working with some of the few outstanding prosecutors there, we never worked together. The relationship was adversarial from the start.

And that's the very reason I began looking at it this way: Once I've done my job & put handcuffs on the guy, I've won. I'm done. It's the SAO's job to win the case.

In my eyes I never won a court case. I never lost one though!

That M.L. wants and needs Tom Benya in position as trustee to ensure his board vote to hire M.L. part time.
If this is true, there's a real problem with the pension board.
Why would they hire a former patrolman to investigate anything?
Why would they hire a former patrolman that hasn't worked the street or an investigation in more than 30yrs?
If they wanted to hire a retiree I can think of a lot of retired detectives that have much more experience conducting an investigation than M.L.

He had no part in a pension holiday, he posted the billboards downtown and on the expressways and he hired Pat Camden to speak up for us to the media. He did not fuck us. The powers that be did not want Shields in there, so they set him up and fucked him. When it comes down to it, I want the guy they do not want. We would have been a lot better off with Mike Shields as our union president.

A couple of officers were working VRI on Michigan Avenue by Millennium Park a week ago when a nut wanted to fight with them, wrapped his fist in a chain and took a boxing stance. Officers were able to get him into an ambulance without incident. Upon arrival at the hospital, one of the officers got head butted and ended up with a broken back trying to keep the mental from fleeing out of the back of the ambulance.... This savage , with this battery to PO arrest, had been arrested 3TIMES IN 6 MONTHS FOR THE SAME THING. 59 ARRESTS TOTAL.. Now a good copper and a great guy is going to be stuck with a continually deteriorating back for life... CRIMINAL MACHINE JUDGES!!!!!

Before I retired as a Cook County Assistant State Attorney, we got a memo to ask for pen time on all UUW gun cases since they became felonies. We got three Not Guilty findings on slam dunk cases in a row and the prosecution minded Judge called me into his chambers.
Judge, "Why are you arguing so hard on these cases? These are people who are carrying a gun simply because they are scared of crime and I am not going to convict someone of that."
ASA, "You want my answer on or off the record?"
Judge, "Off".
ASA, "We got a memo to argue for penitentiary time on all these felony UUW cases and since I didn't get elected State Attorney, I will follow their policies. Sometimes they order transcripts to see what happened. But deep inside you make me happy with a finding of Not Guilty on these cases that cross the line with the Second Amendment."
Judge, "Well I am going to keep making you happy a lot."

The Judge next door was doing the same thing.

Kim Foxx is also the person who, with a great tone of confidence and certainty in her voice, told a reporter on NPR that in Illinois, murder is a Class X felony punishable by 6 to 30 years in the Illinois Department of Corrections. EXCEPTTTTTTTT, IT'S NOT!

I hope one of her underlings has educated her that in Illinois, murder is a Class M offense punishable by 20 to 60 years in the Illinois Department of Corrections. Or perhaps I am naive to believe that any one of her top people are aware of it either.

Her ignorance and incompetence is beyond disgusting. But I am sure she is making her mentor and political patron Toni Preckwinkle very happy. Clearly Toni did not want a real prosecutor in that office. Toni wanted someone who would dismantle the criminal justice system. Toni doesn't want Cook County to have a real prosecutor. Toni wants Cook County to have a public defender sitting in the seat that should be occupied by the State's Attorney.
