Prickwrinkle Surrenders

  • Cook County has withdrawn its legal motion to exact $17 million from retailers that sued the county over its controversial sweetened beverage tax, County Board President Toni Preckwinkle's spokesman said Tuesday.

    The move came days after Preckwinkle defended the effort during a WGN-AM 720 radio interview. The criticism was mounting, though, with newspaper editorial boards bashing the effort and county commissioners looking to curtail her authority to sue for damages in such cases.
The political backlash is only growing. Sales across the county - from gas to groceries to fast food establishments - are down significant percentages already according to everything we've read, been e-mailed, told in conversations. This was a "tax too far" by all measures. And her overreach via a lawsuit is going to reverberate for a long time - possibly up until election season.

Richard Boykin, a Cook County Board member, is thinking about running for County Board President. He voted against the tax, said it wasn't about health but was about revenue, and the revenue expected from the tax could have been made from budget cuts and job vacancy eliminations. Here's a quote from a Sun Times story on their site right now:

"...“It was a bad tax from its inception. We ought to repeal it right away,” he said. “She has continued to make mistake after mistake on this tax. It was her decision to sue [the Illinois Retail Merchants Association].

“It was a vindictive action carried out on the taxpayers’ credit card. It was as if she was the queen and she made an edict. It borders on abuse of power,” he said. ..."

I knew nothing of this man before this tax issue went to court, but I'd vote for this guy in a heartbeat over her.

I drove to the Costco in Mettawa, IL on Rte. 60 and I- 294 today. We drink Gatorade and Vitamin Water, four cases would have been an additional $16 in Cook County, plus an additional $8 for two cases of pop. It wasn't a bad drive, we ended up spending almost $400 in groceries and household items. Now Cook County gets none of that tax.

Yesterday I talked to the Coke driver at Jewel in Mt Greenwood and asked her if the the tax is hurting business. She told me that on average that particular Jewel would receive three pallets of Coke products and on that day they only needed 1, thats a 66% reduction. She also mentioned that this is occurring at all stores on her route.

My guess? Somebody's lawyer got a call from the Retailer Association lawyers. Their opening ask was probably a multiple of the $17.5 Million Prickwinkle suit. Juries, even Chicago Juries will like Civil Rights suits against a government bully like Toni. Especially a tone deaf bully that raised the cost of their soda pop.

They didn't just quietly withdraw the suit, they publicly folded.

I talked with a Jewel Store manager on my beat, the Jewel manager said store sales are down 40% across the store, since the tax started.

Jewel manager told me, he may have to layoff staff, to meet his store sales target, if the trend of lower store sales continue because of taxes!

One longtime customer told the Jewel manager that it was cheaper to drive to Indiana to shop than stay in Chicago\Cook County!

Many people are thinking the same thing in the real world!

This tax is a real timebomb on store sales!

Chicago better start planning on more empty stores and people unemployed!

I had the privilege of paying the "sweetened beverage tax" on an unsweetened cup of iced tea yesterday. The cashiers and the retail food establishments do not know which beverages are subject to the unfathomable tax, so everybody is being clipped by Bullwinkle.

Live in Garfield Ridge, 20 minute drive to Super WalMart in Darien. DuPage County. Saved on soda tax, sales tax. On a Tuesday afternoon the beverage aisle was nearly empty of product! At least a dozen customers at registers with carts filled with only sugary beverages.

Short drive to Costco in Bolingbrook yesterday from the west end of 008 to pick up groceries including some cases of soda and Gatoraid (already going that direction to see family on my day off). I couldn't believe how soda was flying off the shelf out there. I saved over 7 bucks in taxes. Comrad Prickwinkle doesn't get it that people can make a short drive to save lots of money on these Crook County taxes. Oh, and I stocked up on some on sale ammo at Bass Pro and bought gas too while out there (no ammo tax in Will County). Heading to Indiana today to see family also and once again picking up more ammo and buying gas!

Is she had any business sense, she would have known how to run the County Government in a financially viable manner. This means she wouldn't have needed this tax. If she had any business sense, she would have known what the repercussions of this tax would be. If she had any political sense she'd be adding up how much she's gonna be able to collect from all her pensions. Eventually there will be a price to pay at the polls.

Purchased a pack of Gatorade at Walmart and asked the cashier what the tax was costing me, it was $1.98 or just say $2.00 for a $4.65 purchase. I didn't buy the item and the cashier said a lot of people when they hear what the tax is costing, they don't buy the beverage. Will County here I come..........

Funny thing is, like the two main newspapers in this "welcoming" town and everything that is taxed thru the roof, I find that we can live without it! Semi annual trips to Indiana to pay respects to parents graves usually return home with trunks loaded with everything from ammo to full tanks of gas!

I think I have a solution I would like to offer Taxwinkle. Build a big wall around the county. Every vehicle entering the county would be searched and if found to contain untaxed ciggy butts or pop, the occupants would be sent to re-education camps for an indefinite period of time. Illegal immigrants of course would get a pass.

Just a civilian here, but I support police officers 100%. Content of the class varies from one class to another? Could this be deliberate, to sow seeds of confusion and to divide the police? Don't know how realistic this is, but it appears to me that the FOP needs to protect its members by putting together its own class. Something that helps cops defend themselves (as much as possible), to minimize the casualties during this war on the police. Not a physical class, of course, but maybe something online or downloadable. Something that details every step of your self-defense. Godspeed, men and women in blue. Decent civilians are still counting on you, but we do understand your situation. At this point, I agree with Stay Fetal.

And this is what I still don't understand about this tax. I went into a Walgreens and was told the same thing by a worker there. My wife likes to drink the unsweetened iced tea by pure leaf. So I walked out buying nothing. Told her from now on we give these democrats nothing more. We give them enough of our money. All our grocery shopping is in Dupage from now on. Just have to plan a little better is all.
We're not big pop drinkers to begin with. But still found ourselves drinking more water lately.

Or maybe, just maybe, the attorney of record for the County woke up and realized that this thing had SLAPP Suit written all over it, that he or she would certainly face discipline or disbarment from the ARDC and told Pricktinkle either we withdraw the case or I quit.

Certainly isn't worth losing your law license over something like this.

Pricktinkle scans the room and asks "Anyone else want to be the new lead attorney on the case?". After 20 seconds of dead silence and seeing all heads staring down at their smartphones, she folded.

Yes I will be visiting the Costco in Lake County off 90/94 as well. Spend $500 to $1000 there every month. While I'm out their I may have lunch and visit some other retail establishments. Of course I'll fill up the tank. Maybe even check out some real estate and relocate in the very near future. These politicians need to learn that for every action Sancutary City soda tax there will be a reaction. They may keep the south loop, west loop, Lincoln park, the Gold Coast and some other trendy neighborhoods but they're going to loose the northwest side and south west sides. That's a lot of square miles to police. Young cops and fireman can share a rental and go out the the house on the weekends. Let's push for 10/12 hour days and work 3/4 days a week.

If she Really Lost $17 million dollars; then she had an OBLIGATION to make an effort to retrieve that lost revenue. But the Reality is that she is full of shit and cannot prove that the tax will bring in $17 million a month. Like Rahm's bag tax, the projections are inflated. And every time I have gone shopping in recent weeks, I note almost everyone brings their own bags to avoid Rahm's tax. Some who forget their bags simply drive their carts to their cars and unload there, rather than pay Rahm's tax. And everyday, I see more and more storefronts for rent or lease. Small businesses are being driven out of the City at an alarming rate, and my observations are from the relatively secure North side. Stay Safe & Do Nothing! Baby "G"

Word is that Cook Co Commissioner Boykin is mulling a challenge to Two Pension PorkWinkle and he's just the first.
Boykin brought up her sugar pop tax on non-sugar beverages, lay-offs, the $17mil suit (she just dropped) as examples of her knee jerk decisions and mean spirit (Dem buzz word).
Chewy Jesus could be the spoiler if he jumps in on County Bd President election.
Who knows, it might even prod Chewy & Porks to reconsider being a Rahm challenger.
Very expensive election coming with just 7 months to stockpile cash just for the primary.

Revolt may be coming again to the Kook Kounty Board just like the overthrow of Toad Stooger.
And Rotten Rahm hopes for a County power fight to keep him from a 2019 runoff.

I took a starving college student to lunch yesterday in Lake County. After lunch, I stopped to buy a couple of cases of beverages that are taxed in Cook county now. And I also spent about $125 for other items. Free bags. No beverage tax.
The cashier told me 'you wouldn't believe how many Chicago people are shopping here now and telling me the same thing'.

Read Neil Steinberg's column in Sun Times today. Great article about the soda tax. He was charged the tax for unsweetened Dasani water Even after he got an email and proof from the county that there was no tax due, they wouldn't give him a refund. Said he should save his receipts. There is no uniform enforcement of the tax and every store is administering it as they please, in most cases taxing all liquids. Walgreens already has been sued for charging the tax on liquids not covered. Toni will get her 200 million next year. The problem is half of the money will have come from products that weren't supposed to be taxed

SCC posted a few days back that Preckwinkle may have violated state law, namely 735 ILCS 110, the Citizen Participation Act. I pointed out that a violation of state law would have to be adjudicated in state court. How's that gonna work out in Illinois?

Then I mentioned a couple of sections from Title 18 of the US code, 18 USC §241 and §242.

A civil rights lawsuit filed under the two articles mentioned above (18 USC §241 and §242) could result in PRISON TIME for the defendants. This is a golden opportunity to shovel a whole bunch of extra gritty sand in the jockstrap of the Chicago / Cook County / Illinois Machine. The DOJ could take something like this and leverage it towards starting to clean up the whole state.

The admission from Boykin that the suit was retaliatory sure sounds like a conspiracy case could be made. The trick is finding a lawyer who isn't part of the Machine. So . . . hire one from out of state. Illinois currently has reciprocity agreements with 32 other jurisdictions, including all 5 neighboring states.

The civil rights violation occured with the filing of the suit against IRMA. There's blood in the water, and IRMA could really crucify Foxxwinkle in court on this. The damages would be nice, and seeing some of these elected officials pissing themselves every time the phone or doorbell rings would be hysterical, but the REAL meat would be in the leverage available through the plea deals.

Foxx? She's kind of low on the totem pole. She might be able to plead down for a reduced sentence, but what does she really have to offer in return?

Preckwinkle, though . . . that's another story. She probably knows where enough bodies are buried that she could really do some damage if she turned state's evidence.

Remember when Tod Stroger was assured a lifetime job as Cook County Pres until he pissed off everyone, including his base, by raising the sales tax? That's how we ended up with Preckwinkle. Now she has shot herself in the foot with her outrageoous tax and could suffer the same fate. I feel bad for the small businesses on the outskirts of the county who will suffer the most. I now shop in Will County.

This does not surprise me at all. It's what I'll call the "tip of the iceberg".

Sure, Prickwinkle might have suspected that some people would cross the county line to save money, and just on general principle. And that is certainly happening.

What they failed to take into account, is that people will not just buy pop and return to Crook County. Oh no, they'll look around and see how much cheaper EVERYTHING is on their shopping list is and buy it there as well. Both to save money and also to save time, since they're there anyway.

Huge economic blow to Cook County.

Call the next case. Not a cop.

after reading this thread it's pretty clear & obvious that the all powerful Rahmista's need to pass laws that make it illegal for anyone who lives in Cook County to purchase AnyThing outside of Cook County....If you IDL is a Cook County address you can be randomly "trunk searched" when entering the Rahmista Jurisdiction & you can be arrested on felony "buying outside of Cook County" charges & fined heavily, very very heavily

You guys will either learn to heel at the Rahmista's side or you will be forced to heel...Your choice but one way or the other you will be brought to heel

Customers not getting soft drinks at fast food restaurants is a big hit to their bottom line. Because it is not just a significant part of their sales, it is a major part of their profits. Soda is a huge profit item.

My guess? Somebody's lawyer got a call from the Retailer Association lawyers. Their opening ask was probably a multiple of the $17.5 Million Prickwinkle suit. Absolutely. Coca cola does not fuck around and they are a corporate powerhouse. When the big soda companies feel they might take a hit in sales drop they're not gonna sit there and accept it. Piss off retailers and you chip away at everyones profits. Especially by some bullshit tax hike disguised to be implemented for people's health. Link of course was exempt. That's how you know this was bullshit in the first place. Of course it never affected any of preckwinkles constituency so she assumed she was safe.

Preckwinkle's hand picked toady Kim Foxx filed the motion asking for the $17 million in damages. Has no one taken notice of that? The State's Attorney isn't supposed to take orders from Preckwinkle - unless that State's Attorney is Kim Foxx! Foxx could have refused Preckwinkle's directive.

Why is Kim Foxx escaping all scrutiny on this? Preckwinke must go and Foxx should be shown the door along with her!

Today it took me 20 minutes to drive from Edison Park to the Lake Forest Costco (Lake County) and then went to the Mariano's in Vernon Hills (5 minutes from Costco). I got gas for $2.34 a gallon and then loaded up on sugary beverages, waters and all my other groceries & apparently on Wednesdays this Mariano's gives double off on any coupons. It was such a nice day.

Cook County democrats have got to be some of the stupidest people ever to hold office.

Yes I will be visiting the Costco in Lake County off 90/94 as well. Spend $500 to $1000 there every month. While I'm out their I may have lunch and visit some other retail establishments. Of course I'll fill up the tank. Maybe even check out some real estate and relocate in the very near future. I live right by will county. Went in to a store in Crook county. Nobody buying soda. Parking lot wasn't full. Asked one of the workers if soda sales were down. She said yes, by 50% at least. Grocery sales were also down. People are buying outside of the county. Be prepared for store closings and Crook county going broke.
