Sue the Dead Assailant

  • In an unorthodox move, lawyers for the city of Chicago are seeking to sue the estate of a teen shot to death by a police officer two years ago, alleging he was responsible for the death of a bystander the officer accidentally killed as well.

    In a motion filed Thursday, the lawyers sought a Cook County judge’s approval to bring a lawsuit blaming Quintonio LeGrier, 19, for the shooting that also killed 55-year-old Bettie Jones.

    The proposed suit rests largely on allegations that LeGrier tried to hit Officer [...] with an aluminum baseball bat before the officer opened fire, killing both the teenager and Jones, a neighbor standing nearby.

    If successful, the suit could shift some of the city’s potentially hefty financial liability for the death of an innocent woman onto LeGrier’s estate.
Officers here and elsewhere have sued assailants and won, getting liens against any future assets that might arise via ghetto lotteries. We aren't sure if this is a first for Chicago or any municipality. It (amazingly) attempts to hold a criminal responsible for his actions and the resultant actions of responding personnel and injured bystanders. Sort of like the "felony murder" statute.

Actually it is probably closer to the ACCOUNTABILITY statute.

The whole situation is and was a terrible tragedy for the family of the bystander killed and the officer involved. To have to take a life in the line of duty is a traumatic experience. Cannot imagine the anguish at taking the life of a bystander.


Deepest sympathise for all, especially the officer.

But had the assailant survived, he could have been held criminally liable for the woman's death by accountability.

Sounds like the City and Roll-Over Rahm want to settle this case with the deceased families but the situation is complicated by the officer filing suit. The City does not want to settle with him. Nor do the other parties. So let the courts decide.

The FOP should be putting out this list and circulating it widely, inside and outside the department. Many cases where this happens never see a bit of publicity, but officers are aware. One combined list from all sources is what is needed. Include data from CPD and CCSD. Get the list into the main street news. an ad in the Times and Trib. It is time for the FOP to start fighting back against the politicians and the judges are a good start. Divide and conquer, judges might start rolling on their clout if they start getting called out.

A good idea. Should be done routinely. Sue the estate and any possible family members who might conceivably have been involved or supported the criminality. Cast a wide net to discourage any possible ghetto lottery players.

This is "Remarkable" and possibly a Turning Point. The City has paid hundreds of millions of dollars since Rahm took Office for the actions of police. In almost all of these cases, the City has just rolled over and paid to law firms that specialize in suing the City because they see the City as Easy and not willing to fight.There are even specific amounts that the Corp Counsel is allowed to pay, without any question to make minor lawsuits against the police, just go away. (It used to be $30,000.) The Legacy of Weiss, though many disliked him, was that he said "Fight" these lawsuits against cops, and for a while it was done, and the Connected law firms started to lose cases. Now not to diminish the way this case evolved, let us not forget, that this all started when the Officer in this matter, himself sued the estate of the deceased, because the deceased forced him to shoot. When this began, it appeared as if the City and Media were in typical Rahm era fashion, going to blame the Officer. Instead, the Officer was Proactive by retaining an aggressive attorney on his own, and turned the case around. The Officer and his attorney, made it clear that the Officer himself was the First Victim, even though, the Assailant and Bystander were both killed by the Officer's gunfire. Also note, this shows what Armed and Unarmed is all about. Many in the public and Media are naive or ignorant as to the Use of Force. There are misconceptions that a knife, baseball bat, or just brute force do not warrant a deadly force firearm response. If you are a 120 Lb female Officer, and a 190 Lb man begins to smash your head into a wall or concrete ground; you have become a victim and may use Deadly Force to respond to actions that may result in YOUR death or Great Bodily harm as in brain damage. Remember Trayvon Martin in Florida? If someone is coming at you with a baseball bat, it is 'Reasonable", even in Cook County to consider that Deadly Force warranting a Deadly Force Response, as in using your firearm. However, many are ignorant of that fact, and many of those ignorant find their way onto Cook County juries. The strategy undertaken by the Officer in this case should have been a tactic deployed by FOP on behalf of Officers years ago. Now Officers should begin to sue whenever an unfounded complaint is made by a citizen since those complaints cause Unreasonable Stress on the Officer's personal life, and often lead to alcohol abuse,and even prescription drug abuse as a result of injury caused by the incident, divorce, etc.. Hopefully, by the time this case is over, there will be No Money to be made by the Offender's Bottom Feeder Attorney! Stay Safe. And Never be afraid to realize when YOU are the "Victim". Baby "G"

Since when does a plaintiff need permission from a judge to sue??? You file the complaint and force the defendant to answer it or otherwise file motion to dismiss. This looks like a crock of shit. Anyway, it’s a good move on the city. But if there’s a little bumps’ in the community road, the city will pass and give up even more free cash than they would have saved suing the batty dead dude.

However, this type of legal action is that I’ve been advocating in the comments section for years, something all Injured PO’s should seriously consider, no matter how slight.
Sue the estate and/or put a judgement on them should they come upon an inheritance.

Think about that $30 mil just handed to the Englewoods 4.
How much did the dead victims family get?
Why would the city pay feral jailbirds at all?
Wrongful arrest, just because lawyers said so?
Pay them the wages they were earning when they left for jail times the years spent in jail.

Find a quality PI attorney, include the County and City for allowing the feral criminals to roam free too.
Hurt in a crash...sue them.
Break limb during a resisting...sue them.
Trip and fall in that abandoned building...sue them.
(Please include the media wherever you can for spreading bad information about you too.)

Nasty assesd personal injury lawyers have gone to great lengths to sue Chrysler, Enterprise and everyone in between for injuries sustained when their ‘client’ crashed a stolen rental car. Airbags didn’t deploy, seat belts not accessible enough, warning labels not large enough and the best is that their ‘client’ didn’t have the capacity to understand what the safety belts were for and should have been educated on the importance.
This is not a joke but a sleazy attempt to blame everyone and grab as much “settlement” as possible.

Staying Fetal is better than getting hurt, but sometimes it happens, when you least expect it, like it or not.

Hey this is off topic but I have something to get off my chest. All these agencies asking for donations are really starting to get to me. I consider my income taxes my donations because we have no children, not by choice, and because we have no children, we get taxed more than everybody else. We're paying for public school for everyone else's kids and for people who are here illegally so consider that my donation! We have worked hard all of our lives and are paying for services for people who are just living off the fat of the land... people who don't want to work for anything and expect handouts and everything given to them free. Anyone sucking off the government's tit should have to spend at least 20 hours out there cleaning up streets or schools or something. Okay, I've said my piece. Thanks for letting me vent SCC.

Off topic this is how stupid the city is. My baby cousin was invited to take the power test a couple of weeks ago he is 19. He told me that it was about 50 guys there all between the ages of 18-19 the guys administering the test realized this and sent them all home and told them they were at the top of the list but they were to young to get started. I mean the city can't even get competent people to check birthdays before they enter the academy.

So Commisiober Boykin called for a UN intervention in the violence in Chicago and Eddie rightfully and wrongly said they have no jurisdiction. My response would be they NEED to send in investigators to determine the root causes which are (1) Black Mens reluctance to be responsible for the children they bring into this world and (2) our courts systems reluctance to properly remove from civilized society the cancerous out of control youths spawned by Black Men. Unless people acknowledge the ugly and hard truths nothing will change and the cycle will continue to grow and expand. It's time and if the UN wants a spokesman or face of this they should make an outreach to Charles Barkley and Sheriff David Clarke and EVEN Lil Wayne. It's comparible to Swedes living in a desert and not acknowledging their children need sunscreen and hats to protect them.

Well any balls that the City Legal Department thought they had were cut off this afternoon by Rahm. I really had to laugh in the Tribune Article, one paragraph describes LeGrier as an "engineering" student and Lori Lightfoot describes him as "mentally challenged". I mean WTF lady, get your story straight.

And then there is 9.5 kissing the ass of the father who called the police to rescue him from his son and started this whole incident. If this story does not convince any Chicago Police Officer with less than 10 years on the job to seek employment elsewhere in a police department in another part of the USA which will appreciate and respect your talent and skill, then I don't know what will.

Why should the responsible person be held accountable? The City has unlimited funds. We'll just take it from the police and the chumbalone citizens.

CTA busses have cameras and drivers have cell phones. Think there might be a CTA phone on busses. What other security do you want. Not ideal, but what do you want a CRA or CPD Officer on every bus and train. Actually you would have to have two probably

Glad to see the new sgt's get assigned to their new units. but what I do love is the fact that a certain someone that was already assigned to a unit, makes a call and gets detailed to another unit, is lucky enough to make sgt and then mysteriously get assigned to the 1st district. its all legit here kid, right? Just like his initials its all BS! the rich get richer while the rest of us get crapped on.

I consider my income taxes my donations because we have no children, not by choice, and because we have no children, we get taxed more than everybody else. Not having children and you get taxed more. True but the small amount you get taxed is nothing and I mean nothing compared with the expenses of children. You lose what ? $4000 DEDUCTION per child so u have 2 kids $8000 deduction which in the $25% saves you $2,000 cash. Compared to what the average parent spends on each that is negligible. I forget that during the year. Seriously as far as the money part goes you have no idea. The rest of us who have children the same two because we also pay CPS taxes and can’t send our kids to the public schools, pay over $15,000 each for high school, Loyola academy or $30,000 a year just for high school
I’m just saying financially this shouldn’t be a real big issue for you financially

He told me that it was about 50 guys there all between the ages of 18-19 the guys administering the test realized this and sent them all home and told them they were at the top of the list but they were to young to get started. First, I agree the city has a lot of incompetent idiots working for them, but alderman friends and politicians friends need job too. LOL
This could have been the first test after the written and had nothing to do with the hiring right now. Maybe they do the physical because it is cheaper than spending all the money for psych, polygraph test, background , credit checks, etc
Now how could the kids have checked before reporting and thinking they were getting hired. I agree they shouldn’t have to and if I was applying for a job I would do what they told me
But I would also say to myself something is wrong. I’m 18 or 19 and I know the requirements to be a CPD officer is 21 years of age, this is not right.

Contracts don’t mean crap. Here’s a perfect example. You get transferred, that’s ignored and the dept just details you. Why have transfers. Details weren’t instituted for things like this
But then again, it’s not surprise been going on for awhile, getting worse and sadly “you ain’t seen nothing yet”. Rules don’t apply

How about suing his dad for molesting him when he was a child and his mother for not addressing it. They screwed the boy up mentally. Tell the real truth about why he was raised by a foster mother, which is a friend of the family. Both lost custody of him and both are cashing in. Has anyone looked into why he was chasing his father with a bat? Antonio confronted his father about what happened to him as a child. Father hid in the bathroom and asked the neighbor to call the police. The estate and the father should be sued separately for putting the neighbor in harms way.
