Swiping Arriving

And the FOP says just go with the flow until (A) someone gets harmed or (B) some judge or labor board issues an injunction.

The FOP reply:
  • Today, the Department released its final order and will implement Employee Resource E02-03-04 with an effective date of 30 September 2019.

    Our attorneys will file an Unfair Labor Practice with the Illinois Labor Relations Board tomorrow as the City refused to negotiate with the Lodge over the impact of this order on our members.

    Members should comply with this order on its effective date and continue to comply until the Labor Board issues a decision.
Which means a whole lot of nothing.

The question I want answered is how the department plans to comply with the FLSA mandate of overtime compensation for hours worked over 40 in a 168 hour (7 day) period. For example, those in day off group 61 had two weeks in August that 45 hours were worked. Now that's going based off 9 hours. If you go off of 8.5 hours it's 42.5. Federal law states we are owed overtime compensation. The FLSA even goes so far as to name Police, Fire, and other first responders as NOT exempt from this. It also further states that collective bargaining agreements may enhance but not diminish this provision. Just Google FLSA overtime exemptions.

Does this mean all the desk jockies, Holman Square units, D-Units, and all specialized units now have to work a full day when swiping in and out? Don’t get caught swiping someone in or out! Ok, first I’m perfectly fine with working the full tour that I’m being paid for. Many have been doing it for a long time and that’s what we’re paid for. BUT, as we all know the Chicago Police Department has different rules for the connected or special people. If it’s not connected to payroll THEN THE CONNECTED AND SPECIAL will continue to break the rules.(few even swiped in) Everyone knows how this works on the CPD. IT HAS TO BE THE SAME FOR EVERY EMPLOYEE! It can’t just apply to the “anus” of the department, the beat patrol cop. Capts Lts, Sgt’s, Tact, CAPS, Detectives, etc. If others are excluded, it’s an unfair labor act. Problem is, if it’s not connected to payroll, then the leadership will only enforce it on the unconnected. Everyone else will scam. This is a continued set up for the tradition of selective enforcement if it’s not tied to payroll. I encourage everyone to make notes of who goes to the swipe clock regardless of rank, and keep records. If a Lt attempts to discipline you, you need records because we all know they won’t be swiping out. Fair is fair, right? We all work the same shift, right? Hahahahaha. This is the perfect storm for creating total division and outrage. If city hall really knew how the CPD worked they would connect in directly to payroll. Watch and document everything. Challenge them about the honesty of who will REALLY have to swipe out. Good luck.

FOP orginally said not to swipe out at all. After speaking with their attorneys, who advised them that the labor board would not look to kindly at that practice, they changed their tone. Regardless, the labor board will never side with the union on this one. The contract already says members are required to work a 9 hr day and swiping in is just a function of that requirement. Sorry folks, this one is here to stay and just wait until it's actually tied into payroll. Then it will really be time to go...

The only people that care about swiping out are the corrupt and entitled. I have no problem with it but IT HAS TO BE THE SAME FOR ALL! Supervisors must swipe too! No more covering for each other. The(laughable)consent decree says “supervisors must lead by example.” In the name of transparency I would like to see the swipe report for each unit posted on the unit wall. I know it will never happen. Corruption will continue.

What is the FOP advising for desk personnel? They are never able to get lunch and personals where they can leave the desk. They try to eat up there but still have to answer phones and deal with walk ins. If they make them stay, then FOP better tell them that they should leave the desk area for the entire lunch and personals. Same goes for the desk sgt. Imagine if he walked away for a half hour or a full hour a day while on lunch and personals? How’s this going to work?

The issue becomes what will happen if you DON’T swipe out.
The city will surely punish you in the form of SPAR/Suspension, but the problem is that the punishment they dole out has neither been negotiated or agreed upon.
Of course the city can tell us to swipe out, but they just don’t get to put a new system in place out of the blue, and then arbitrarily get to dole out punishment for not following it. That punishment should be delineated at the time the swiping tajes effect, not later.

But why would we expect our union to go to bat for us?

In theory, none of us should be swiping until the punishment t for failure to adhere to the policy is determined.

IF Sgt or Higher Rank wants you to stay later to finish up something, put in a slip.

Make them refuse you the OT to finish that GOA or TVB or what the F ever that you happened to catch 25 minutes before your watch ends. Then you have them cut and dried and even FlOP can't ignore it.

I truly love the part of the order which states that if we are given a LATE JOB THAT MAY GO INTO OVERTIME, THE JOB MUST BE APPROVED BY A SUPERVISOR FIRST BEFORE YOU ARE ALLOWED TO TAKE IT!!! Wow, wonder how many supervisors balls will be flapping in the wind when overtime is approved and they have to explain why. Oh well, its the price you pay when you want to wear a white shirt nowadays.

According to the order on Payroll and Timekeeping, you may take ONE 15 minute personal if approved by a supervisor. There has NEVER been a provision for two. Knowledge is power!

We're not salaried. Those yellow slips for OT or taking time say otherwise. In the real world if you are a salaried employee you don't get OT, you work until the project/job is done, and you come in on Saturday if need be with no extra pay. All you morons who've never worked in the private sector should STFU.

I always love how people post comments without first reading the order. The commander can exempt anyone he wants from having to swipe. The commander also will get a report of the swiping so he can do what he wants with the information. Of course the special people will be covered and still allowed to do whatever they want.

All the complaining on the blog in the stations, means absolutely nothing we are going to swipe in and out and the people with the bullshit talk that they’re going to go to later rest to many of them that would be their first arrest, also the one saying they’re going to make that late night traffic stop what would that be your first traffic stop? The bottom line is the employer is the city of Chicago we have no confidence in us from the text being public or very little bit of confidence due to the Democrats bastardizing us and the news media slanting us at every turn.

One thing I know for sure is that this will bring morale to an all time low. The city and the department have played a lot of games in my 20 plus years on this job but nothing that impacts people's life as much as this. There is also a provision in the order that exempt members can submit a to-from listing personnel who they believe should be exempt from swiping in and out. You know the clouted are already on a list submitted the superintendent.

The order also states that swiping in and out is for the transparency. So the FOP should FOIA the list of people that will be exempt from swiping in and out and the reason they should be exempt from swiping in and out. I’m all for transparency

So here is the bigger problem and it needs to get to the media, the public and those monitoring the consent decree. I can only speak for districts that have the 9 hr work day. There is 1 1/2 hour difference between start and end of tours from watch to watch for example 3rd watch early start is 1400-2300 and late 3rd watch start is 1530-0030 and early midnights starts at 2100 with late midnight start being 2230 and not to mention approximately 20 minutes for roll call. With this being said we are very short of cars we will need and extra 10-15 actual cars per district because this is what is going to happen...there are not enough cars for everyone and every day so either the oncoming watch or outgoing watch is going to have 12-16 officers just standing around in the station for an hour and half waiting to swipe out. Both 3rd watch start times will be on the street and no officers from midnights will have cars for their tour as they will be waiting an hour and half in station. We have already been told to just hang out in the gym or somewhere in the station for an hour and half. How do you think the taxpayers are going to like 12-16 officers getting paid full salary just standing around doing nothing. I'll be calling fox news to make them aware of it. FOP YOU NEED TO PUT THIS OUT THERE SEVERAL TIMES.

Actually the Capts and Lts won’t be unhappy because they won’t be swiping out. This is not connected to payroll so it’s only going to be subject to enforcement by the white shirts themselves. Does anyone really believe supervisors will discipline other supervisors or their friends? Please. The consent decree mandates supervisors must lead by example so everyone should do as they do not as they say.

This city is insane. As a non LEO even I understand this is stupid for the job. You aleady have time clocks. Are they paying the difference between swipe and time clock punch?

Some companies use this to determine building access and who's in the building in case of emergency. However, this makes no s3nse if you swipe out at end of shift and not when leaving the building. I don't trust this city.

Correct me if I’m wrong, but when your RDOs (4 - 2 schedule) falls on Wednesday/Thursday or Tuesday/Wednesday, you will be working 5 days that work week. 8.5hrs x 5 = 42.5hrs. That’s 4hrs of ot right there.

Maybe you could use your lunch for wasting your time documenting what's already being documented by the fucking machine. It records the time each person swipes in and out. Why do you think your notes will mean anything? Are you planning on staying when someone else is on OT to make sure they swipe out at the right time? The desk crew starts before you. Are you going to come in early to make sure they all swipe in on time? Concern yourself with shit that you can actually control, and let someone else worry about who swipes and when. You're going to give yourself a heart attack if you try to keep track of when everyone swipes in and out. Worry about yourself. Make sure you swipe in and out at the right time every day. We wouldn't want someone taking notes of your swipe times like you plan on doing to others.

That's not how it works here. The city violates the contract whenever they want. Then it's up to your union to call them on it and fix the problem. Guess what happens though? The union caves and the city gets away with whatever the fuck they want. It's always been like this and it will continue to be like this until the end of time. If you choose not to swipe, they'll release their report of who isn't swiping as required, and then you get a SPAR, and eventually some nice suspension time. But hey, at least you don't have to swipe when you're serving that suspension time.

I honestly don't know how this will physically work. There are literally not enough radios, let alone cars with 2 shifts out. So now, let's say you're late car on Midnights. Early 3rd watch will have just checked off when you're getting out of roll call. So their equipment will have to go to early cars. Now you'll be in the station waiting for keys until 0030 hrs for late 3rd watch. It's either that or you come in an hour early to give your equipment up. So what, just a whole watch of coppers waiting in the station for an hour or two next to the swipe machine? It seems like just a petty thing from Lori just to fuck with us.

The question I want answered is how the department plans to comply with the FLSA mandate of overtime compensation for hours worked over 40 in a 168 hour (7 day) period. For example, those in day off group 61 had two weeks in August that 45 hours were worked. Now that's going based off 9 hours. If you go off of 8.5 hours it's 42.5. Federal law states we are owed overtime compensation. The FLSA even goes so far as to name Police, Fire, and other first responders as NOT exempt from this. It also further states that collective bargaining agreements may enhance but not diminish this provision. Just Google FLSA overtime exemptions.


Better look at subsection 7(k) a government can have a 28-day period. Trust me, they do this to benefit them.

If we are required to be at work for 9 hours for a “Working Day” then why after 25 years with. “Working Day Furlough” are we given only 200 hours? My math tells me it is 225 hours and ends up costing us our comp time to actually get to 25 days. If the city even wanted to play the 8.5 hour tour, it still figures out to 212.5. If the city wants to play pimpy hardball make our back pay for this flagrant theft part of our retro on next contract. I can’t remember when this changed but I’m sorry but 12.5 hours over the life of this sleazy rule is a nice chunk of change.

if i recall, it changed not this (exp) contract but the one before it. And yes, stupid coppers only saw retro pennies and accepted change without forethought to adjust for future schedule changes

I agree completely. This looks like an easy win for the FOP if they beefed it. Before anyone says, “Hey dumbass, furloughs are by hours not days”, I say, hey dumbass read the contract. Section 29A.2, Page 50. Read it! It says as of January 2016, Officers with 10 but less then 15 years get a furlough of 22 working days and Officers with 15 years and over are entitled to a furlough of 25 working days. Nowhere in the contract does it say anything about hours. Nowhere. Officers who work a 9 hour day get 23.5 furlough days, not the 25 days the contract clearly says we should if we have 15 years or more on the job. Divide 200hrs by 8.5hrs(9-1/2hr for lunch) = 23.52. We have been getting screwed out of 1.5 furlough days since 2016. Not my opinion, it’s in the fucking contract. WORKING DAYS!

Listen up , it’s time to play the game with the city. Read the list of simple things alot of Officers give to the city for free ,
1. Stop volunteering for translation. Your not paid to translate and if you do you should be compensated.
2. If your CIT trained you should be compensated for it.
3. If your first aid trained, you should be compensated.

Fire department gets pay increases for every type of training they get, up to 4 % in pay, so why are you volunteering to get trained for free and then get stuck with all these jobs that others can refuse? Stop volunteering for these until you get a bump in pay. The city will keep taking advantage of you because it doesn’t cost them anything. The more training you have, the more pay you should receive !

all the other depts started swiping 20 years ago. alot of wailing and gnashing of teeth. everyone where i worked up to supers swiped, no clue about downtown heavies. alot of work arounds were tried, a lot of people got fired. we had weird street issues like mentioned here where you were on an emergency with no swipe boxes and over rides and audits had to be done and the lazy time keepers often wouldnt pay you for legit time until you got a big boss involved. daley started this shit, its your turn in the box compliments of your biggest fan, mayor walleye. its legal, its common today and our unions who are light years ahead of fop couldnt alter it in any way. the only way it will go away is if the mayor wants it to go away. sucks. and the one person that said move the boxes so civilians cant use them? they are not cpd boxes they are city boxes for all employees. we were given a list 20 years ago of boxes. i worked city wide all different hours, police stations are the only things open 24/7. fire houses were often locked up at 5:00 am and other times and on a few occasions police doors were locked and the desk crew pretended not to see us banging on the doors so we would go around back thru open locker room doors and hope not to get shot. great security there guys. proving attendance is not a violation of contract or rights, its here to stay, IT ABSOLUTELY SHOULD BE FOR EVERYONE OR NO ONE though. from what im told it wont work, will be a clusterfuck, ruin morale and cost money instead of saving money. but when have you ever heard a democrat say their failed policy was a failure? if something fails you didnt do it hard enough, double down on that dogshit. general order says swipe, swipe. let the mensa crew downtown untangle the mess. swipe, fetal,lunch,fetal,personal,fetal,swipe and its miller time.. .....shouldnt have to be told twice to do nothing

What happens if I miss my lunch? Oh you’ll assign my lunch time. What happens if I get a call before that? Get a paper job, take it to the station, and never go down on lunch but either eat something quick at the station or pick something up on the way back to the station if I can. Or fuck it, do my paper AT my lunch location without going down on lunch. If I don’t pull the event # for it, guess I’ll have to submit my online overtime slip of Ot to compensate for it. Thanks Lori for the bountiful OT opportunities i can finally receive. Clearnet just makes it easier to grieve if a SGT or LT doesn’t approve it so hahahahahaha

You've demonstrated a complete lack of understanding as to how any of this actually works. You already have an assigned lunch time. Any lunch you take outside that assigned time is because your sergeants and lieutenants allow it. Your sergeant can have your call assigned to someone else so that you can take your lunch during the assigned time. Every time you change your location while on a job, you're required to notify dispatch. You don't just get to run around picking up food and eating while on a job. Any of this that you've gotten away with before is because your sergeant allowed it. If you're legitimately unable to take a lunch because of assignments, or are denied a lunch, then you get compensated for it. Your cute little plans are all fundamentally flawed and just set you up for failure. Just take a lunch, use it to eat, and then do your job. This isn't as difficult as you'd like to make it out to be. I'm sure everyone will be very impressed with your whiny crybaby routine when you don't get an official lunch event number, but your coworkers and supervisors see you sitting at subway, stuffing your face while on a job somewhere else, or on a personal. Better make sure you do everything completely by the book if you want to start playing these stupid games. Judging by your lack of knowledge, you won't be able to implement your amazing plan without stepping on your dick repeatedly. Good luck though!

We're not salaried. Those yellow slips for OT or taking time say otherwise. In the real world if you are a salaried employee you don't get OT, you work until the project/job is done, and you come in on Saturday if need be with no extra pay. Swiping is not new. Been around for years with other police departments. Wouldn’t you think all these questions about desk crews, going to court would put us over the 40 hr weekly limit, lunches, etc would have been addressed and worked out. Seems other departments have figured it out. I sure don’t want swiping but I think there are answers available to all the questions especially with the federal law regulating the number of hours allowed weekly before OT kicks in

all the other depts started swiping 20 years ago. alot of wailing and gnashing of teeth. everyone where i worked up to supers swiped, no clue about downtown heavies. alot of work arounds were tried, a lot of people got fired. we had weird street issues like mentioned here where you were on an emergency with no swipe boxes and over rides and audits had to be done and the lazy time keepers often wouldnt pay you for legit time until you got a big boss involved. daley started this shit, its your turn in the box compliments of your biggest fan, mayor walleye. its legal, its common today and our unions who are light years ahead of fop couldnt alter it in any way. the only way it will go away is if the mayor wants it to go away. sucks. and the one person that said move the boxes so civilians cant use them? they are not cpd boxes they are city boxes for all employees. we were given a list 20 years ago of boxes. i worked city wide all different hours, police stations are the only things open 24/7. fire houses were often locked up at 5:00 am and other times and on a few occasions police doors were locked and the desk crew pretended not to see us banging on the doors so we would go around back thru open locker room doors and hope not to get shot. great security there guys. proving attendance is not a violation of contract or rights, its here to stay, IT ABSOLUTELY SHOULD BE FOR EVERYONE OR NO ONE though. from what im told it wont work, will be a clusterfuck, ruin morale and cost money instead of saving money. but when have you ever heard a democrat say their failed policy was a failure? if something fails you didnt do it hard enough, double down on that dogshit. general order says swipe, swipe. let the mensa crew downtown untangle the mess. swipe, fetal,lunch,fetal,personal,fetal,swipe and its miller time.. .....shouldnt have to be told twice to do nothing


Well, I used to be on a task force that had jurisdiction in Indiana and often started work from home or the trunk of my car. How would I have swiped in then. My wife works from home for a big ten law firm and swipes from home. She has to keep track of her time to bill clients not just for payroll. The boxes are pain and always in different places.

If the city starts getting out of control they will have no choice except to do something in order to push the police department to do anything. We actually hold a good hand of cards we just refuse to learn how to play that hand. Public safety is a major political issue. If we sit, only answer calls and do not go above and beyond or proactive one bit then crime will jump big. But, the 2 and 3 year or hack units will continue to work because they need the B.S. “excitement” of the job wearing blue jeans or need to keep that unit spot. Hey skippy, if the entire unit lays down they aren’t gonna get rid of the entire unit. Wake up!!! Nobody ever learns. Lay down and do zero!

Anyone who has ever seen these clowns knows full well that this is the biggest scam going. Sounds like someone keeps responding to these comments thinking they are know it all boss from the department or from the mayors office. Read a few responses and are pretty much the same as to how there’s a lack of knowledge how the system works, stupidity,etc... seems we have been infiltrated by a know it all trying to sway opinion and action by comments. Assigned lunches never worked, that’s why anyone with half a brain doesn’t enforce it. The blow hards usually attempt enforcing set lunch times as a punishment to the watch, but soon that stops again after the realization that it can’t work in our work environment. Its been tried by many and fails every time.
