Springfield We Have a Problem
As of 01 January 2024, "assault weapons" are banned in Illinois and you can only keep them if registered with the State Police. Same thing for certain accessories and certain caliber ammunition. The rumor that the ISP website went down due to a massive attempt by Chicago gangbangers to register all of their "assault weapons" appears to have been false.
According to the Illinois State Police website and interested parties, compliance topped out at something less than five percent. Might be as low as half-of-one-percent, but no one really knows. The ISP has said you can still register the weapons despite the now past deadline, but what moron is going to hand the ISP proof of your disobedience of State Law? You would automatically be banned from possessing all firearms.
So the lefties and democrat politicians (but we repeat ourselves) are in a bind. They passed a "law" in the dead of night, gutting an insurance bill and substituting anti-gun language in it, and pushed it through in under 72 hours without public hearing or comment, in violation of procedural safeguards.
Now over 95% or more of Illinois gun owners have refused to comply and around 96 (or so) county sheriffs (out of 102 statewide) have stated they will not be enforcing anything in regard to this registry.
Gun grabbers now face a couple choices:
- A - ignore the fact that 95% of gun owners have given them a giant middle finger, or
- B - selective enforcement in places like Cook County, where Dart never met a gun law he wouldn't personally perform fellatio on, or
- C - order all sheriffs to start door-to-door confiscation AND prosecute sheriffs who refuse.
Failure to enforce a State Law means the government loses legitimacy, and who runs Illinois at this very moment? This is also a national election year with the DNC holding its convention here in Chicago. Not the look that the dems are looking for when Fata$$ is in the running to be drafted for the top slot when Mr 10%-for-the-Big-Guy steps aside. And prosecuting County Sheriffs? These are elected officials. How very Hitler-esque.
We're certainly in for an interesting couple of months ahead.

The way I see it:
Option C is absolutely out, even in Crook County. Officer safety is a must and this is a dumb idea. If they come to your door, remember: "I object to the search / search warrant, but will comply." A good attorney will be able to sort this out in court.
Option A is not very viable for long. What other rules will we not follow? I guess we need to wait for further clarification from the SC.
Option B is most likely. My understanding is you already know if a driver is FOID / CCL. When an opportunity presents itself (911 call to residence, traffic stop, traffic accident, Red Flag complaint, etc) probable cause to search after a bit of verbal judo and a check of the serial numbers against the confiscation list. We received a email from The CaptIns Association spelling out exemption to the law. One is active law enforcement are exempt as well as retirees who can otherwise qualify for the IROCC card. They said you don’t have to possess a valid card just be able to pass the same rules to get one. (Ie left in good standing, pass background check etc). They suggested to just go and get an IROCC card to make sure you are good. That way nobody can say you’re not qualified if THEY issued you a card saying you are.
How would they do door-to-door confiscations? Are they going to find a judge that gives them a warrant to search the house of every FOID holder who didn't register something just to check? That seems devoid of probable cause for even the corrupt Illinois judges.

Are ILL gun shops required to keep records of gun and ammo sales? For how long?
Are the gun shops required to forward these records to the county or state?
Can the government get a warrant to force the gun shops to divulge this info?
Comparing the gun shop records with the compliance list would be anther lead.

As many of you should know a search warrant is required to enter private property or a signed consent to search. A search warrant must establish specific items to be seized and establish probable cause to believe that the items are at the location to be searched. The fact that a person bought a now banned item 10 yrs ago does not mean that item is present where the person who bought the firearm lives and therefore one of the elements that is needed for issuance is not there. It's not a guessing game and factual, believable probable cause must exist. Any law enforcement person who would go out on a limb to perjury themselves to conduct a flagrant illegal search is looking at some serious civil and possible criminal issues. Remember that compensatory damages will more that likely be paid by the agency but in many instances punitive damages could very likely be leveled against individual officers who would have to pay out of their pocket. I'm sure that there are some readers of SCC who may have had this experience and can tell a story about providing a list of all your assets to the judge presiding over the lawsuit. It isn't fun.

Everyone needs to really read the PICA act. Pump shotguns would be covered, hence illegal. PICA bans a lot of stuff, not just AR15s and AKs. Only semi auto exempted is a M1 rifle (Garand).
