Drop a Slip, Get Paid

From the comment section, a "stupidvisor" who doesn't understand this is still the United States, even if it's in the Socialist Communist Paradise of Illinois:

  • OT. I was walking in to work before my tour. In the parking lot I was wearing my ICE hat. A supervisor stopped me and told me to take it off and that I could not wear it on department property. I was told next time it will be a number. So now the department is telling me what I can wear while off duty to work.

There was a lawsuit filed in a largish police department a few years ago where the members sued over the fifteen or thirty minutes they were required to arrive at work, get dressed, gather equipment and then report to roll call prior to their shift. 

Long story short, they won. So unless the City is willing to pay starting at the arrival time on the property, the "supervisor" should either be laughed at, ignored or told off in no uncertain terms that the clock doesn't start until XXXX hours and anything worn off duty shouldn't concern him/her/it.

This is exactly why the City, Department and the strokes over at COPA dropped any disciplinary actions and investigations against Officers who happened to be members of groups that the current socialists find distasteful. 

Once you're off the clock, you regain a lot of your Constitutional Rights. You gain even more in retirement. And yes, we're aware of the Rules and Regulations, which were written how many decades ago? And survived how many direct challenges in court?

Just make sure it was actually “before” your tour of duty.. most walk in 10 after and into roll call at 15 after.. 1 second after your tour technically starts weather in the station or not you belong to them… I found that out the hard way.. start time 1500, roll call about 1520-1525 every day and I did some stupid crap in the parking lot thinking I was on my time at about 1305.. I was wrong.. took those 3 days……..

If this actually happened, the copper needs to have another stupidvisor pull a number on this asshole.

Depending on how articulate this officer is, Rules 8 and 9 can surely apply. Either way, have another stupidvisor get the number and let it play out. Let them know you’re not a pushover to fuck with. Once they understand this, all but the dumbest will quickly back off and not try a repeat performance. Remember… Most stupidvisors wouldn’t hesitate to hammer one of us if the roles were reversed.

These motherfuckers need to be checked. And if they’re dumb enough to even entertain retaliation, be sure to make examples punitively out of every last one of them who participated.

We got enough to worry about to have these poseurs in white shirts going out of their way to add to the daily stressors. Hammer that motherfucker.

I could see this idiotic department and certain bosses thinking it's a violation of their catch-all rule 2. They might even try to stretch it to some form of political statement. J-kitty got dinged for his little stunt with the flag, which was a little over the top, but not taking a political stance. Police officers are supposed to support the flag, the anthem, the President, and the 2nd amendment. That's not political, unlike the blatantly political and despicable act of kneeling in support of the bullshit BLM movement. Showing support for ICE is simply showing support for the laws of our country and those who enforce them, which should be expected and demanded of police officers. But this is Chicago, so it will be called racist, extremist, anti-immigrant, political, intimidation, etc., and someone will probably even release a cute little special order or secret memo prohibiting wearing anything or making any statements in support of ICE. You could probably wear a "free Palestine" bracelet on duty and have zero worries though.

Maybe the commander of 12 should learn about what constitutes off duty and stop calling us coppers on off duty hours to fix reports after I am already home. We get it boss next rank. The lawsuits stemmed from the 2005 Supreme Court case Alvarez v. IBP where the court ruled the meatpackers were entitled to pay for the time employees spent putting on their gear and taking it off.

Santa Rosa PD officer sued in 2007 and LAPD officers sued in 2009 for the time it took to get ready for work and taking off their equipment. Judges ruled in the officers favor on both cases. Dress time and getting undressed is part of being on the clock.

More recently in 2016 the Supreme Court case Tyson Foods v. Bouaphakeo ruled in favor of the employees for the time spend donning and doffing.

What? Are kidding me? This was settled, gosh so long ago I can’t remember when. I retired in 92 from a Calif SO. We had always been required to be in the briefing room, in uniform, fifteen minutes before the beginning of our shift. After I retired, someone sued, and federal courts ruled if you were required to do something you got paid, this includes putting on a uniform and attending a pre shift briefing. Retroactive back pay was ordered for everyone except for those of us who had already retired. Pisses me off to this day. Then the canine handlers, God love them, jumped on the bandwagon, and got an hour or so overtime for feeding and cleaning up poop. The retroactive pay for them went back years. Maybe your union has dropped the ball and should get on this.

If the department doesn't reprimand officers wearing black lives matter shirts to work. Then everything else shouldn't be messed with. You can't pick whats acceptable. Just be fair.

The Good Sergeant is in the right. The sergeant actually did the officer a solid by not pursuing this issue and, at the same time, the sergeant is taking a big risk by not disciplining the officer, because the sergeant can get disciplined for not officially documenting the incident. Too many snowflakes on this job think that they know it all. You guys do not recognize a gift when it is given to you on a silver platter. Spend the time, do the legal research and read the general orders in order to understand the situation.

Maybe if you didn't fuck up your reports you wouldn't have this to complain about. If you're truly off duty, as in after the actual end time of your assigned tour of duty, tell the commander you'd be happy to fix the report on your next tour of duty, or drop a slip for OT if you have to fix it while off duty. You don't seem particularly bright, since this fixing reports thing sounds like a common occurrence for you. Maybe get someone to help you and look over your reports before you head home. Review officers should be able to fix minor mistakes in your reports, unless we're talking about TRRs or something, which it sounds like you might be, since you're getting calls from the commander. Certain reports are more time sensitive, like when an arrestee is heading to court, or when a TRR takes a few days to complete, raising red flags about your use of force. Finish the job correctly before heading home. They'll even pay you a bunch of extra money if you stay late. If none of this works for you, maybe another line of work is calling your name.

This is great advice if you want a bunch of people to get fired. You can absolutely use your cell phone as you desire. If that use involves disclosing information you obtained through your position as a police officer, even to other law enforcement like ICE, you could be in for a rude awakening. If you mistakenly assume someone is here illegally, maybe because they only speak Spanish, or because they tell you they were born in another country, etc., and you tell ICE where to find them, but they end up being a citizen or legal resident, ICE won't hesitate to share where they got their tip. You can only use info you get during your police duties for legitimate law enforcement purposes. Your department has decided that your duties do not include immigration investigations. You can roll the dice if you want, and take them to court for years if you get fired, but you'll be on shaky ground. Maybe don't use your cell phone that easily ties the tip directly to you, especially if you're also tied to the person you're reporting by your actions during your tour of duty. ICE says they got a tip from your phone number to pick up X at Y district, and you just happened to arrest X while working in Y district a few hours earlier. Won't take much to get you jammed up. More than a few police officers have had their personal cell phones become part of court proceedings, so you can't just do whatever you want because you're off duty.

You absolutely can be called back to fix errors on reports and arrest packets. Especially on arrest packets that would delay an arrestees appearance in court within a reasonable timeframe (and definitely prior to 48hrs). Fill out the OT for a call back and you get paid like you're going to court(credited a minimum of 3hrs). If you don't like getting called back... get your shit right before you leave at the end of your tour.

Can you cite the general order that states you can't wear an ICE hat while off-duty? I'm not saying you're wrong, but I haven't seen any that even suggest that would be a violation of anything. As was mentioned earlier in the thread, some supervisors may try to stretch this into a rule 2 violation, but that's a stretch, and definitely not as clear cut as you seem to believe it is. Please explain how you came to your conclusion that the sergeant did the officer a favor and also risked discipline himself by not disciplining the officer. It seems you may be a sergeant yourself, if not this exact sergeant, so I'd love to hear your explanation.

Except you don't just get to decide you didn't get a chance to take lunch and then assign it to yourself at the end of your tour. If you legitimately don't get a chance to take lunch or are denied a lunch, you can drop a slip to get compensated. Leaving 30 minutes before the official end of your tour is not a lunch unless a supervisor decides it is.

The assessment of the sergeant being in the right is correct. And all of the people who are on here saying words to the effect that they will wear clothing displaying “ICE,” please go ahead and do it. And after the incident gets documented, sue the department. You guys can sue and be set for life. Also, be a tough guy, like some of the people on here are suggesting, and defy a supervisor’s request to remove (and probably hide) the article.

What do injuries have to do with conduct off-duty? If you ride a bike into the lake, your socks will get wet. If you shoot paper in your basement, it doesn't count as your yearly qualification. If you type license plates into your home computer, you won't get LEADS results back.

Sounds like you need to drop a slip for having to answer your phone, go to the district near your house and redo the report, complaints (you can email them). They deny your OT slip fiel a grievance. Best piece of advice don’t answer your phone.

Being covered for "on the job" injuries that occur while you're not "on the job" is almost as ridiculous as thinking you get to do whatever you want off-duty. Take a gander at the rules and regulations for a few minutes. Maybe you shouldn't take the job if you don't understand any of the rules. When it literally says "on or off-duty," why is it hard for you to understand? Much like many other jobs, conduct outside of work can and should bite you in the ass sometimes. Wearing an ICE hat as a police officer isn't one of those times, but your point makes no sense and has no relevance to the situation being discussed.

Over my many years on the job I saw guys who were always pushing the envelope – not because they had any moral or ideological reason to do so – they just wanted the attention. It was almost as if they were saying “look at me, I’m an attention-seeking jagoff.” It usually did not end well for them. Shooting yourself in the foot usually doesn’t.

Let the Sgt’s do their job Commander. Things are just fine until useless commanders start micromanaging and creating chaos. Stay in your office commander, what’s the use of having sergeant and Lt’s?
