Controversy

So this comment appeared yesterday. We posted it knowing it was going to generate controversy, and now we're probably going to provoke even more:

  • So a copper in 020 pulls over a 73 year old woman for making a left turn at 4:10pm where it says no left turn from 4-6pm. Copper sees the fop sticker and asks if it’s hers. She says no it’s my son’s. Copper then writes her a ticket for the left turn and no insurance because she can’t pull it up on her phone. He then takes her to the station and takes her car. He claims it’s the law and he has no discretion. This guy needs a fucking life.

So let's get this straight:

  • elderly driver;
  • disobeys the law;
  • falsely represents her vehicle as being owned by an officer;
  • can't provide proof of insurance;
  • gets TVB-ed;
  • car gets impounded....

And the officer, in this day and age of body cameras, POD cameras, in-car cameras, all mic-ed up and recorded in living color....writes tickets and applies the law as written, but he's going to get hassled because:

  • she's old? Maybe someone should take away her license if her faculties are that bad;
  • she's related to a cop? That's going to look really good at the IAD/COPA investigation;
  • she can't produce insurance? She brings it to court and that one is dismissed;
  • we won't even speculate as to racial profiling....but imagine that one;

The impound seems a bit over the top, but if there an underlying circumstance that necessitated the impound? They exist and the comment isn't clear, but can you imagine if the car wasn't impounded? You'd be lucky to get a three day suspension.

We're sorry, but this is what the citizens of Chicago have voted for, more so the lakefront liberal crowd, but pretty much citywide, countywide and statewide....nationwide if you like. We've advocated for (and the city is insisting on) NOT enforcing traffic laws across the board. but if you dip your toe in that pond, you better be 100% in the right lest you get suspended. 

You aren't going to be popular, your personal vehicle might take "parking lot damage," you might even be confronted by the mother's offended son. But you can rest assured that you probably created a voter who thinks government (that's you) has gotten too mercenary, too rapacious and too out-of-control. It might even work out in thirty or forty years.

Feel free to disagree - politely. We stopped writing tickets for anything other than accidents once cameras were installed on light poles, squad cars and police officers because we knew eventually, they'd be used against any "discretion" we once had.

There are people not many that follow the rules to a t. Never leave early uniform squared away. Cuts a report always comes clear as soon as you leave the job etc. You have to at least respect that. But traffic is always discretionary unless license is suspended revoked or involved in accident. So if this guy is that guy ok fine. But if he isnt then fuck him. There were probably 50 more people that drove past him more deserving.

Yeah, Will for sure politely disagree. No matter the situation, BWCs or not, we still have the ability to use discretion. She absolutely can be told to leave the car, call the son and verify. Sometimes I let my mom use our van to get the kids to sports or school. I’ll admit all my insurance is on my phone. If she got stopped no idea if she would be able to find it, she’s 70 years old. More than capable of driving and doesn’t need her license taken away. Sorry, but I’ve allowed hundreds upon hundreds of drivers off with a warning on BWC.. actually the majority are let go with no movers none of whom are the police or related to the police. If I make 10 stops I may write 2 or 3 and give the rest a warning. My BWC would prove that yes I have her a break, but it would also show I gave many others a break that day too….. if this was her first CB in 73 years with a copper as a son then shame on him.. these are the reasons people hate the police.. we take law abiding good people and hammer them for revenue.. revenue for the city and mayor.. be the police, not a pimpy revenue generator for the mayor..

COPA is viewing ALL traffic stop BWC videos from EVERY district CITY WIDE now.

ALSO, they are viewing every "Request for Supervisor" job where sergeants are dispatched to.

I'm sure the 73 year old voted Democrat a few times in this SHIT-HOLE city a few times in the past half century.

Not saying this lady was acting like an asshole, but there’s a whole lot of “My brother is a cop!!!” bullshit I’ve come across.

Yeah, your brother would be embarrassed you’re trying to name drop him. Also no one gives a damn. Unless I personally know the copper, if asshole is acting like an asshole they’ll get treated accordingly.

I don’t care who you know. Coppers got jammed up for not DUI’ing the Super some years back. It’s all on camera kids.

He took the time to ask about the sticker why then? A couple more questions verifying he is on the job and he then could use his discretion and give her a pass. He doesn’t have to write a ticket, or is discretion illegal now ? The job is truly in the tank.
Her son should tell her to just take off like everyone else does now then, since she didn’t get treated any better for stopping and being courteous.

I’m actually embarrassed to tell people what I did for a living for 30 years.

I have seen all kinds on the job. Yes you can write it. But what is that going to accomplish. You might have to work with the Officer who’s care it is. That’s why they still have discretion for traffic. When I first got on the job I would write 1 out of 5 vehicles I pulled over. Writing your co-workers mother would only be for something serious or she was just getting out of hand.

No insurance = automatic citation. Don’t care who you are. The fop sticker does more harm than good, don’t want to be accused by a bystander, which is absolutely possible nowadays, of favoritism/bias policing. It’s all on camera I’m sure, officer did the right thing in citing her. Her age is of no factor since once again officers must not act with bias towards anyone for any reason including ageism.

If your mother can’t drive and can’t show insurance she shouldn’t be on the road.

Taking her to the station and impounding? Are you sure it wasn’t a tow or these were the only two citations?

Sorry to say, FOP stickers are sometimes handed out like candy to the wrong people by cops.

Do any cops really put these on their personal cars still today? I stopped doing so over a decade ago.

Do you think the tweakin' cop puts his on and hands them out to friends?

Over the years I found an FOP sticker on a car driven by a suspended gang member with gang warning from LEADS (TVBed and charged with misdemeanor impersonating) and another gang members with felony weight of two illegal substances whose brother was on the job (also arrested, charged and convicted of impersonating). Never heard from their FOP family members.

Name me one incident where an officer was admonished for not giving out a ticket.
Especially to a family member.

Hasn’t happened!
The cop that wrote the ticket is extremely myopic.
Even in our oath it states about not being “officious”.
I suggest that officer and a few other “traffic cops”’ read up on that.

Why is it always the “traffic cops” that pull shit like this? Beat up a little too much in High School?

Let's get a grip here.

If the stop was really for a right on red or whatever ten minutes over the time posted, the fella stopping this car was fishing for something else.

Upon reaching the window and seeing an old lady, run the license, find it to be valid and move on. No one is taking a suspension for reminding her to mind the sign next time and filling out a blue card.

What likely happened is guy thought he had a felony stop, she said some mean shit to him, and his feelings got hurt and he took it all the way. So yeah, guy should get a life.

Cameras don't remove your discretion for minor traffic violations or compliance violations. She could've been given a warning for the turn and been on her way. Not knowing all the specifics doesn't really help though. Best practice would be not to pull over old ladies for minor shit. Time restrictions on turns is minor shit.

Tough situation , old lady driving without insurance is a huge liability . If she had hit someone the cop would be fired .. I guess he could’ve called the son down and him drive the car or call for a sgt to the stop . Tough one to be in either way you’re being arm chaired on Monday .

The original commenter is correct. This was overkill. The entire stop could have been a simple warning. I get the point the blog is trying to make but both things can be true at the same time. Voters have actively voted against police using their discretion and this entire traffic stop did not need to result in car being impounded.

Years ago prior to cameras everywhere the police had discretion. A lot of guys and girls got a play based off of their behavior , attitude and severity of the situation. However, these days with all the cameras you are truly bound to follow the letter of the law to the “T”. That’s why you shouldn’t stop anyone you’re not willing to hammer. It is what it is.

First off it wouldn't be an impound. No license/insurance is just a tow. Suspension/revocation is an impound. Having license and no insurance is just a ticket on top of the no turn ticket. We are missing details or the PO is poorly trained and the Sgt should have caught this.

We still have discretion. I've given a lot of breaks myself and I know of other officers who have also given people breaks and none of us have gotten into trouble for using our discretion. Also, I'm sure TAC and PRT give people a lot of breaks everyday on their traffic stops. Now, if I ever get into trouble for using my discretion, I will never give anyone a break.

73 year old ladies are required to obey traffic laws--and routinely ignoring any and all traffic signs is routine up here in 020. As a taxpaying law abiding driver-more traffic enforcement would be much appreciated. (am just assuming the districts are so short handed no one has time-- not that officers and supervisors just dont care.)

A simple rule is , you are a productive citizen, you have a job, equals just a simple explanation of the infraction and to be careful . I can verify I have an asshole relative. There was an especially unhinged time I was afraid he might be throwing my name out there. I actually told a few officers I had contact with because of him, “Spread the word. Arrest him, you’re not doing me any favors letting him go.”

If there’s truly not more to this story than what’s been reported (she was nasty, had other infractions etc), he had discretion to especially not impound the car. 73 is not that old and most people still very capable & not reckless. If that is all true, the officer is a loser and I know exactly the type. It’s the same guy who’ll pretend to make himself busy when a call for a 10-1 goes out, the same guy who’ll avoid all real or challenging police work, the same guy who’ll stand there with his hands in his pockets as fellow officers have to get hands on. Same guy who does nothing 90 percent of the time until they need to show activity for easy OT. Yep, I’ve seen this guy dozens of times.

Sorry, but I continually see Officers utilize discretion on gangbanging POS's and illegal immigrants. If an elderly police relative can't be given a "blue card" warning, the involved Officer should hang his/her head in shame. Whoever doesn't agree: Never, ever complain when you or your relative get cited for anything and everything. Further, I do not want to hear about how you and your relatives follow every traffic law perfectly and have never committed a traffic violation. Please save that story for gullible, fucking idiots.

Every district has an asshole like this. We had a guy write tickets to coppers family members, off duty suburban cops, elderly, etc. The watch commander finally called him into the office and said he would be on a foot post in th projects on midnights 99 if he continued with the bullshit. That watch commander in that district should have stepped in and non suited the whole fucking thing. I another incident, one of the guys on the watch was an absolute beast. Ex boxer, martial arts and weightlifter. Was running late to roll call made a bad turn. Got stopped outside of his district by another district car. He apologized, had his equipment with him and stated he was trying to make roll call. One of the traffic POs decided to have fun with him by running his DL over the air while pointing out "he says he works in 18". Put the guys personal info right on the air. A year or so the PO looks over in the locker room and sees the new guy in the district changing. Guess who the new guy was? Luckily for the new guy a couple of other POs were able to grab the Big Guy, enabling the traffic specialist to run out to his car. Like his pants were on fire. The moral of the story is you might have to face the guy you fucked over sooner or later. BY YOURSELF. MAN TO MAN.

Discretion is a wonderful thing. I can’t tell you how many drunk coppers, fireman, teachers, city workers etc I’ve stopped over the decades and made arrangements for regarding getting them and their vehicle home. Passed out waiting for that train? No death or great bodily harm as a result of a fender bender? Yeah, I think that we can figure something out here amicable to all parties involved.

I’ve also given similar plays to the average ghetto resident, whether it was traffic, dope, etcetera. Respect, honesty and a cordial dialogue goes a long way on both sides. You’re gonna start the exchange out by motherfucking me and telling me that “you only stopped me for being ____________ “. Well, that’s pretty much a guarantee that things will not be working out optimally for you.

A polite demeanor when stopped. Producing the requested documents without trying to spin me with a variety of cockamamie excuses for not being in compliance and/or proof of being gainfully employed always tilts the scales in your favor. The occasional comedian with a great sense of humor or those who pled an articulate defense were also regularly given passes on mundane shit like “gang loitering”, open alcohol or throwing dice on a corner.

I’ve returned loaded firearms to old timers in the ghetto who were found to be veterans trying to walk to the corner store for lunch meat. “Officer, I can’t hang with these young bucks no more…”. “Understood, have a blessed day, sir, and thank you for your service”.

Sewers were made for dumping a few bags of weed down. Car keys tossed in the trunk and vehicle locked until you or your people came back with a license and/or insurance. Your imagination was your only limitation when figuring out how to police in the real world. Yes, there were no BWCs recording every second of your day, but discretion can still be used today if you know how to play the game properly.

Years ago an older man well into his 80’s was leaving the secretary of state office at 99th and King Dr. after he had just renewed his DL. And within only a few blocks from the facility was involved in a traffic crash. I look at his freshly brand spanking new drivers license and see his last name which was very unique and i’d recognized as the same last name of an A/2 property detective. I pulled him to the side and quietly asked if he was related to the detective and he said that yes it was his son. This man should have never been given a new license because not only of his advanced age but because of his obvious confused mental state. The guy he struck was or course suspended and had no insurance so guess who was ticketed. The detective saw me later and thanked me and related that he took his father’s license away immediately. The moral of the story is take care of our own when you can. I worked with a bwc at the end of my career and fully knew what trouble it could bring so don’t think i’m an old timer without a clue like some are apt to do on this forum.

Migrantos sometimes show up to traffic court. No license, no insurance, minor traffic infraction- case dismissed. And that includes accidents with personal injury. No court mandated fees. Just a thank you for coming to court, drive carefully and get a license. American citizens under similar circumstance during the same court call were given the mandatory fine for operating without insurance, mandatory court fees all after obtaining a valid license and showing proof of insurance. Level the playing field.

1-2k events per day for traffic stops. Every event would have to auto attach to the BWC video which is very rare. Not enough minutes in a day to review even a quarter of these videos…. It is quite alarming majority of the comments are saying it is okay to use discretion for no insurance. In case anyone has forgotten, NO INSURANCE, is mandatory court. It is one of the few offenses where your use of discretion places the liability on your shoulders without taking enforcement action. A citation at the bare minimum covers you. There's no excuse to not provide a required document per the law. You as a driver are responsible for any car you drive.

Dummy, unless the words "must", "will" or something similar appear before an action it is discretionary. You will find those words before the actions required when encountering a person with a suspended/revoked license and the proximate cause of a crash with a CPD vehicle. Use the search function in the Department Directives application and you will find them. Sorry I can't recite which specific order it is. What I can say confidently is that orders so exist because I am not a fucking mouth breather who can find answer for myself without relying on the traffic robot whose knowledge was passed down from another socially challenged robot with no critical thinking skills.

Number of years ago, prior to my entering "old lady" status, I was stopped for a minor traffic violation, didn't make full stop at stop sign. I didn't have my insurance card with me, so I got a ticket for the traffic violation and one for no proof of insurance. Went to court with proof of insurance, so that ticket was dismissed. Paid the fine for the other. Seemed fair to me. Have to admit that impounding the car seems a bit over the edge.

My father was CPD. He would always call the new officers into a meeting when they got to his district. He would ask them " Do you know why the public like firemen? Because they don't write tickets!" He would inform them that is absolutely the worst PR for the department. Don't hassle the public. Be polite, tell them why you stopped them, let them off with a verbal warning, and be done. If they are major jerks, use your own discretion. I have met policemen who worked with my dad and the irony is many have told me about his ticket speech and how he was a cop's cop. Wish he was still with us.

I don't understand why the car was towed or impounded. It only gets impounded if her license is revoked/suspended & has no insurance. That's a $1000 fine. It only gets towed if she has no valid DL & no insurance. That's a $150 fine. If she was only missing the insurance, there is no tow or impound. Maybe that was the problem. Otherwise, if he gave her a ticket than tough shit.

If you are in 020 on a bid, you probably don't care about "activity", but if you are there on management, do what you have to do. It takes less than an hour to write 5 parkers and one or two movers.

Allll you morons keep saying tradfic cars... when over 75% of the arrests in the Q from every district are from traffic stops. So I guess 75% of the cops working are "traffic" cars. Wtf does street stops now a days .. hardly anyone. I agree it was a unnecessary ticket and tow .. but these are the coppers they are hiring these days. Without a pdt, dept cell phone, LPR, or any other tec, these cops now a days couldn't find a law breaker if it was in their lap. Point being that back when I got on you would be lucky to have a pdt in your car.. and if you did it worked 50% of the time. This made you have to learn to use all your senses to establish PC, ie learning what was the right car, right person to stop vs that old lady, but if you did you also learned the art of making that stop be informational rather than criminal. Even if this old lady mf this office, and he was "offended", thats the generation they are hiring and wanted when all the bs started. Again, thats what the department wants and is hiring, so you cant be madd at him for being a softball, be madd at the public who wants these types of officers, until they are pulled over. Again, you made the stop, approach see its an old lady, quickly advise her to be careful and be on your way. Don't ask for anything, run her name, etc, just turn around and go back to your squad and carry on .. no harm no foul.

I have let so many people go with a verbal warning because we CAN and they were giving me the chance to use discretion. Why he did what he did? I couldn't tell you. He could have had her call her son/family member to send them a picture of the insurance, not a big deal. However, if she named dropped her son, datawarehouse him, do IL Officer lookup on ISEB(if he's a suburb cop or you know their full/partial name) and then be on your way if she's cooperating. IF you did this because you can, you are an idiot. I don't write people unless it's for serious shit, non-discretion stuff, or the other obvious. I use that relation because I know if they see me on a major scene they'll continue be more forthcoming to tell me things/what they saw/heard etc. This is what I learned from older CPD vets, and still use it to this day, it yields me results for case building. I would HOPE this officer is not a dick, but this could tell me otherwise. Don't expect the community to talk to you, drop you some intel nor back you if something major comes out on your zone/watch/call.

In my 15 years on the job I’ve never seen a department as divided as ours. No comradery at all!! I do blame most of it on this newer generation of cops.

No back bone, terribly trained, and afraid of their own shadow. Not all recruits are like this, but the majority coming through the academy are. For all those in the comments, whether you agree or disagree, discretion is the most important tool...not on your belt, use it!

It is not our job to jump through hoops, make a traffic stop a 20+ minute fiasco, make calls to their insurance, etc. You might want to read the very simple statute. You ask and they provide, if they don’t, they don't have it. Period. Glad to see you take everyone on their word. Idiot. You probably also believe “they aren’t my pants” too.
