As Expected

It's a fixed court system that CPD is always going to end up on the short end of:

  • Disciplinary hearings for Chicago police officers accused of egregious misconduct can’t be held in private, a panel of appellate judges ruled Friday.

    The appellate court upheld a Cook County judge’s ruling that cops could bypass the Chicago Police Board and seek arbitration in the most serious disciplinary cases, but they must face public hearings.

    The three-judge panel found that moving hearings behind closed doors would violate well-defined public policy, which favors “police accountability and transparency.”

    Law enforcement is charged with the duty of exposing crime, not concealing it,” the ruling stated. “When public policy is at issue, it is the court’s responsibility to protect the public interest at stake.”

Um....if there's a crime, then charges should be filed, a public trial should take place and a verdict should be rendered. That's just common sense.

It's the violations of policy and/or procedure that we would argue are the sticking points.

An appeal is expected, but it's the State Supreme Court, among the crookedest State courts in existence full of bought-and-paid for Machine shills.

Here's how you put an end to it. Someone or our union needs to file the same lawsuit regarding public hearing for teacher discipline hearings and investigations. You know the city won't allow it however if it's done to the police they cannot refuse it being done to the teachers as the courts would have now set the precedent. Can't only have it for one and not for the other it doesn't work that way. In fact let's take it a step further and do it with the Aldermen as well regarding complaints and allegations. Come on union fight fire with fire. Be in the offense instead of defense.

Gee, I forget, but WHOSE (Dem) wife was on that state Supreme Court that took away our insurance benefits years ago (Rahm- never let a crisis go to waste) while giving them back in FULL to the ISP? Crooked as hell!

As a retired career prosecutor of 30 years, the Illinois Supreme Court will not allow private hearings. That Court is a tool of Fat Boy Pritzker. No way they will protect the police. Not a chance.

Does it even really matter? Honestly, you can have the hearing in public. The arbitrator is going to go back to their office and over the next month or so or longer go over all of the information and make his ruling in private anyways. That ruling will be given out in private to the parties. The police haters just wanted some kind of a win from this massive ruling in our favor. If this is the win they get, so be it. Who gives a crap, public or private, and arbitrator will rule like arbitrator‘s rule. Arbitrators are not like these appointed communist on the police board. Arbitrators will rule based off of the facts and past cases.

The Appealte Court made up it’s own fictional policy and conflated matters related to public opinion and not state law. For the people in other city agencies this will be coming for you.

Misconduct hearings are an employment matter, not a criminal matter. The FOP should take it out of the state court system by filing a complaint with the federal Department of Labor.

Public means——pressure put on the arbitrator by “name the group” through protests at the house, and visits to the children’s school. Wake the f up. Public is a disaster and railroads the police officer.

I respect the disciplinary court "system" about as much as I respected the ANOV system. It is a kangaroo court. The city may as well let the officers off with a warning and a fine. Considering the Ed Burke, and Mike Madigan court proceedings, at least revenue would be generated.
