Guilty....as Expected
The man accused of throwing a Big Gulp full of root beer on former Cook County State’s Attorney Kim Foxx during a road rage altercation near her Flossmoor home was found guilty of one felony and not guilty of another on Monday morning.
Prosecutors charged William Swetz, 35, with aggravated battery in a public place and aggravated assault with a motor vehicle following the June 2024 incident. He took the case to a ench trial last month.
On Monday, Judge Tiana Blakely found Swetz guilty of the battery charge but not guilty of vehicular assault, according to court records. She set a January 8 hearing for post-trial motions.
Two assholes come into conflict, but one is heavier than whale shit.
He had to know the fix was in. No idea why he opted for a bench trial.
There was a plea deal in place for a felony with zero jail time, now who knows if he'll get "time served" or something else.

A true abuse of power.
Try getting felony charges approved when the victim is nobody.
But a naked f/1 can steal a police car and try to run over a police officer but be found not guilty.
Swetz should have played the insanity card.
A felony conviction. Whether pled to or convicted. Still a felony conviction.

Hopefully Swetz will appeal. Sadly this will be a very expensive course.
There is no precedent in Cook County for such a minor altercation to result in a felony charge, let alone a felony conviction.
Way too often, the Cook County SAO looks at the victim and the victim's background when determining whether to file felony charges. Victim is a crackhead? Victim is poor? Victim has a criminal background? No felony charges approved. There is nothing in the statutes to deny charges based on these things but it happens everyday. It does happen for protected classes but everything we know about this case is that foxx was not engaged in official duties and she was not "targeted" because of her job. Now we have this case, that every cop knows is at most a misdemeanor.
This is a case of revenge.
But the subway sandwich thrower gets found not-guilty ?!!

So many serious crimes went unpunished with Kim as the SA. She would flat out reject murder charges just because. Now, some poor bastard is now a convicted felon for a violent crime or at least it reads that way ,for tossing a root beer at this jackass. I hope there’s an appeal being typed up.

Between Dem judges and Dem juries, trials have become a farce. IF, in fact, most even get to trial. Downgrading, dropping charges, have become the Dem way of life. And this felony conviction- for what is a misdemeanor incident- is just a show of POWER by a failing system that Foxx brought this city. I ran into Kimm at Midway Airport last year at the luggage claim area. I walked up to her and introduced myself and asked her how she was doing. She said she "was doing well and didn't miss the politics" No root beer throwing was involved.
I remember one time in court the bailiff announced as the judge took the bench….”Hear ye, hear ye, this branch of the Circus Court of Cook County is now in session”. True story, the assembled cops waiting for their cases to be called had a good laugh.
I remember calling in an agg bat for a victim who was stabbed in the back while walking down the sidewalk, on the public way, and felony charges were denied because the said they required the victim to have surgery not just stitches for great bodily harm.

The bench trial was a mistake. A jury could have nullified this. This judge was pressured to make it a guilty verdict. Not long ago people/folks were shooting at each other and Cabrini Kim called them mutual combatants with no arrests and we have this.
There are people you can f with and people you can't f with. For all of her many failings, she's one of the latter. Would have been far better to have muttered under his breath and driven on.
Cook County States attorneys 100 stitch rule. If victim does not have more than that the offender was charged with a misdemeanor.
