Best Explanation So Far

CWB doesn't only report crime. They did something that no other media outlet even considered as far as we can tell:

  • It’s the question everyone is asking: Was Judge John Lyke required to release suspected cop killer Alphonso Talley under the SAFE-T Act?

    Talley, a seven-time convicted felon with armed carjacking and armed robbery cases pending before Lyke, later escaped from his ankle monitor and, prosecutors say, brutally robbed a store cashier Saturday morning and then shot two CPD officers, killing one.

    To understand whether Lyke had any real choice in the matter, it helps to walk through exactly how Illinois’ pretrial detention law works.

And then, by God, they walk through it, step by step. Here is the real meat of the article:

  • Then, and this is where Lyke crossed the Rubicon, the judge made his finding: “This court cannot find that the state has met its burden by clear and convincing evidence that there is no condition or combinations of conditions that this court can impose to protect any person or persons in the community when weighing everything with a fresh set of eyes and understanding.”

    At that point, the SAFE-T Act required Lyke to release Talley on the least restrictive conditions Lyke believed were necessary to keep the public safe. He had no choice in the matter. A judge cannot decide that electronic monitoring is sufficient and then keep someone locked up anyway. The law does not allow it.

    The answer, then, is yes. Once Lyke determined that conditions existed that could protect the public while Talley awaited trial outside jail, the SAFE-T Act required him to release Talley on those conditions.

Simply put, Lyke's determination that....

  • a multiply convicted violent felon, 
  • with additional pending violent felony cases 
  • committed while already on Electronic Monitoring

....wasn't enough proof that Talley was a danger to the community. So the only way forward was to release Talley on yet another useless Electronic Monitoring anklet because Lyke closed off every other avenue to himself. That "under-developed brain" bullshit was Lyke just closing another off-ramp that would have kept a violent repeat felon in custody.

Fata$$ was actually technically correct - this one is on the judge, a useless DEI hire who misapplied the craptacular law that Fata$$ signed into existence. Plenty of democrats to blame for this one.

This is his much of a pos Lyke is; There were 6 cops on the arrest team at 26th street, they handled all the security calls too. Two of the deputies were asked to sit on an in custody detainee that was being difficult in Lykes courtroom. Against his lawyers advice he wouldn’t take the deal that Lyke offered so the attorney wanted the guys family to talk to him to urge him to take the deal. Lyke told the 2 deputies to let the inmate, his attorney and some family members meet in the empty jury room. The attorney told the deputies to leave the room and they refused. So he went to Lyke and told him he didn’t want the deputies in the room. Lyke “ordered” the deputies to leave them alone in the room. The deputies refused and said they were just gonna put the inmate back in the lockup. Lyke told them, “if you take him back to the cell, you can join him because I’m holding you in contempt of court!” After a huge ordeal because of it he refused to apologize to the deps and bragged about it saying, “they can’t do shit to me.”

People want this dei judge don’t Lyke jailed. Many are so man. None of these criminals require a get out of jail free with a bracelet card.

He’s not alone in the dei hire nor the let them go. He’s openly stated he doesn’t like seeing brothers behind bars.

Sick of these open racists dei pass throughs. Anyone “different” would have been held.

Lyke needs to go from the bench to keep all public safe.

It is a bad analysis. Lyke was not required by the law to release him. His determination as to whether he was a danger was his to make. That was his judgment. The law didn’t require him to say a defendant with four violent cases would not pose a danger.

That was 100% his discretion.

After seeing the clerk who was pistol whipped by the shitbum who shot our two officers, I would hope that the fundraiser that was recently concluded, the event organizers would seriously consider donating at least a grand to her as she cannot go back to work now due to her serious injuries. Even injured, she still called 911 which started the lookout for these two assholes.

After reading this CWB article. And then reviewing the several criminal cases that Talley had prior to the shooting of the officer. There was plenty of evidence to hold Talley in custody. But the Judge continually overruled the States Attorney’s request and gave Talley another release.

It clearly shows this judge should be removed from all active court procedures immediately. The chief judge needs to review this!

After Talley was arrested then given his first release. The courts should not have continued to release him again and violating the original release conditions! This is on the entire Safety Act. There is no law in the land that violates the civil rights of any citizens more then this pretrial release disaster! Talley was arrested and has the right to a speedy trial. But the future victims of Talley deserve the civil rights to be protected from his continual crimes……

If Talley was in custody for his prior criminal acts……an officer would still be alive and another would not be fighting for his life.

Ironically, judges in the 101 other IL counties seem to find a way to make necessary incarceration work, or apply a suitable work around. Which begs the question, are they really that much smarter than Cook County judges?

Exactly. Once he made the determination the he wasn't a danger, yes, he no other alternative. But deciding this long-time violent offender wasn't a danger is totally on the judge. Not a SAFE-T Act issue

Note to Judge Lyke…previous behavior and criminal acts are an indicator of future behavior. This Talley criminal continued to commit crime again and again. To release Talley to commit more crime goes against logic.
Does Judge Lyke lack logic and common sense? Time to step down from the bench as Lyke’s decisions place the citizens at risk.

OT: somebody should ask Kwame Raoul if his newly appointed chief of staff Deborah Witzburg is such a great investigator, why did she never figure out the wives and girlfriends and other crooked promotion tactics used by CPD? word out of hq: that big promotional class of 37 lieutenants, plus sergeant retirements starting this month wiped out almost all of the 51 sergeants that got made in march. cpd hr formally requested a summer class of 50 sergeants, which has not yet been approved, in addition to a fall class of 50.

snelling wants it and so do the consent decree folks, but no word yet.

Recruit classes all summer are scheduled in advance with ILETSB. But city hall said fuck no and cancelled all recruit classes until September. not a single one until mid-september.

and last night, 12 PO's, 4 SGT's and a LT were dumped from the academy back to districts due to poor performance.

I agree. I’ll admit that I was confused by the analysis. I couldn’t tell if they were giving Lyke a pass or not, but it seems to me, committing increasingly violent felonies while out on pretrial release does in fact signal that he was a danger to the public. Didn’t SCC just post an example in DuPage a month ago where someone was in fact held bc of similar circumstances?

Let’s look to broaden CWB reach by publishing a hard copy , monthly or bi weekly of the best CWB true crime stories each month - let’s work to find some $ deep pocketed more “Conservative” or just not a liar media baron such as Rupert Murdoch used to be with the British Tabloids.

One of the secrets to Rupert Murdoch’s huge success as the UK and Australian tabloid Newspaper king was:

Populist, nationalist editorial positions, truer coverage of crime, celebrity gossip and a pretty swimsuit or topless model on “Page 3”.

That’s what the public in the UK, Australia was buying then and the Fox News TV was very similar - populist, Center Right perspective, more honesty about crime (O”Reilly) and very attractive women presenters such as Meagan Kelly.

We could do something similar here in our Chicago.

I’m not a Cook Coumty lawyer, but I suggest that someone file a complaint with the Judicial Inquiry Board. Google it.

The JIB defrocked a downstate judge several years ago (see judge Adrian) for screwing up on a sexual assault case. He found a guy guilty of sexual assault
which required a mandatory DOC sentence. At sentencing, he felt sorry for
the guy. He vacated the judgment and gave him probation. People were pissed and reported him. JIB ordered him off the bench.

Will this work with Lyke? Who knows? But he will need to retain an attorney (not me; I’m retired) to represent his sorry ass before the JIB. That will cost tens of thousands. It will not bring Officer Bartholomew back to his family, but it will cause some grief to this shithead.

Local radio reporting - Tally pistol-whipped the lady clerk at the dollar store by Lawrence/Pulaski - where his latest eruption began - so badly she has two black eyes and a lot of other disfiguring facial injuries.

Him and runnin buddy got about $106.00.

...but she was able to call 911 somehow.

Detainees and their lawyers are entitled to privacy when discussing their cases. Law enforcement can never be present / monitor these conversations.
The family members can be present for these discussions with the consent of the detainee and his lawyer and the permission of the Judge.
The room can be secured from the hallway, as there is only one doorway and the windows do not open in the jury rooms at 26th St.
