Tattoos Stay Covered

  • A federal judge this week threw out a lawsuit filed over the summer by three Chicago police officers who challenged the Police Department’s new policy requiring officers to cover up their tattoos.

    U.S. District Judge Charles P. Kocoras ruled Tuesday that the city’s goal to have a professional-looking department with uniform restrictions outweighs the officers’ interests in expressing themselves by keeping their tattoos visible while on-duty, according to court papers.

    When they filed the suit against the city in July, Officers Daniel Medici, John Kukielka and Dennis Leet argued that the department’s policy violated their First Amendment rights of freedom of speech and expression. The officers all served in the military and have tattoos on their arms.

    Kocoras argued that the trust officers are trying to establish with the community might be compromised by allowing them to show off the tattoos.
Was the argument made that there was no restrictive policy prior to this arbitrary decision and if the officers had been hired before the policy was put into place, then they had a decent argument to being "grandfathered" in? Could the Department show even a single instance or complaint of an officer being unable to perform any particular function due to having exposed tattoos?

Has anyone checked the Department of Transportation (aka the Department of Tony - How you doin'?) for their professional appearance?

UPDATE: The Grievance process continues apace, possibly making the arguments we stated above. We'll see.

The Dept like any other employer has the right to determine how their employees look while at work or representing the employer.

The employees right to self expression takes a back seat to the needs of the employer.

The employee can express himself while he is on his own time not the Dept.'s

Lawyer gave the judge a lame argument you get what you pay for. if you think the FOP is going to put a top dollar experienced lawyer for your tattoo beef then you need to wear a burka.

Next time put your cash in if you want to really challenge the City. Good luck with the cover up make up . Go down to 311 and ask the captives what they think of this lawsuit?

Is it true that if you have a tattoo and are ordered to wear long sleeve shirts but you have a letter from a Doctor who says that you should not wear long sleeve shirts because of a medical condition that the city will then send you to call back??? If so is there an order that says that because I cant find it.

No movers, no parkers, no anov's, no contact cards (why anyone is doing these is beyond me), and no arrests unless absolutely necessary. In light of the anti-police climate we are experiencing, the rush to judgment in SC, and the department fucking with people over tattoos (no, I don't have any), it's time to say "fuck you" to everyone...rahm, Garry, the alderfucks, the rest of the politicians, and the libtards. So the city's goal is to have a "professional-looking department"? Does that now mean funky-assed dreadlocks, decorative fingernails, Mr. T jewelry starter kits and makeup that'd put Tammy Faye Baker to shame will not be tolerated either?

Question: has anyone actually been subject to disciplinary action for non-compliance to the tattoo coverup requirement? I would certainly hope supervisors collectively said "fuck that" and are leaving things alone. But knowing how things work here, no doubt some jagoff Bosshole(s) had to flex their chevrons or butter bars and make an example outta some poor schmuck.

If so, it'll be high time to make some serious noise about the inequities in enforcing uniform and appearance standards. It shouldn't be too hard to document the shit out of standards not being applied evenly across the board. Why, a slick attorney might be able to make the argument that racial discrimination factored in to how this issue was addressed.

I don't have a single tat, but I sympathize with those that do who are now required to conform to yet another whim that this fucking city/job created just to further fuck with its police department. I really can't wait til the weather gets warm again to see just how much this is or isn't enforced. Oughta be interesting.

There are many officers with tattoos that I would want coming to help myself or my family if in need. These officers should not be forced to lose what little morale is left. One day it will come full circle and people wil want policemen not pussies to come to their aid. Hopefully it's not too late.

Would a federal judge say that my veil does not conform to the professional uniformity of the department? Something I always wondered....

I smell bullshit on this one. Looks like someone had the fix in, but I am a big conspiracy theory guy. How in the hell can't you make an argument for grandfathering in these guys. Hey at 21 years on I can wear a leather jacket but after 2013 other guys can't. Guys pre 92 could wear that 3/4 satin jacket but I could not. Pre 91 guys could carry a revolver and now guys can't. The list goes on and on. WTF?

NYPD here. Outside of recruits in the academy I have never seen a cop on the street covering up tatoos since this was enacted in 2007. Its just not enforced at all. The story behind the initial rule was that a middle eastern recruit had "Allahu akbar" or some other terrorist slogan tatooed on his forearm and no one picked up on it until he was in the academy. Right after that investigators began photographing all candidates tatoos.

Well officers if you are firmly against this policy then make the FOP BOARD of DIRECTORS vote to go forward with the appeal. Last time u checked the 1st amendment TRUMPS a desire to look professional. They can appeal but ol DEAN won't authorize it unless the BOARD approves it.

I agree with this decision, though I thought that military tattoo's should have been exempted. Too many of us look like slobs, and all of the sleeves, neck tattoos etc look unprofessional. SCC there is no comparison between us and the "department of Tony" as you refer to Streets and Sanitation.

Thats the argument that should have been made initially. You cant change the rules in the middle of the game. Should never have been argued as a uniform change. The marines changed the policy, grandfathered the current marines in and also now the new policy does not allow the current marines to get any additional tattoos.
Our lawyers werent thinking to well with their argument about uniform change has to be negotiated.
Historically on the CPD and throughout the United States when you were hired was the time the restrictions had to be in place/
Even when the weapons were changed from revolvers to automatics, the older officers were grandfathered in and were allowed to continue to carry their revolvers.

In order for an officer to be grandfathered in, ALL officers hired before the determined date would have their arms, hands, neck and head photographed, and their tat's (even if they did not have any)noted.

That would never happen.

What about those who have tattoos on their hands?? It seems like they would now have to wear black gloves at all times. Is that happening??

Dumbest argument ever. Freedom or speech and expression. Did they think they were going to win with that? If that was allowed then a po could come to work with a bone through his nose as freedom of expression. Or the women could have pink hair.
As far as freedom of speech, po's could say screw the CPD , the city ,etc.
I have tattoos so I'm for allowing them for those hired, but their argument was terrible.
As far as the standard,why is the city following CALEA , a private company that sets the standards? Who are they? Some do nothing sits in 35th St just trying to mess with the po's on the street. They used that as an excuse to do this. What happens if the CALEA standards arent adhered to ? Nothing , thats right , nothing No federal money is lost, nothing Most departments ignore CALEA.
Then having an old judge decide the case. An old guy and his view of tattoos. Yea, thats going to be a winner. Its like having NOW decide a discrimination case.
Ive seen po's get accepted in the community and have more trust by the community because of the tattoos. The young people relate to them. Been stopped many times and had the young people ask about them and even compare. but some old guy who is isolated from the west side and most parts of society is going to push his will. Enough of my ranting

Visible tattoos in police uniform = unprofessional. Either stop trying to look like a biker, or be prepared for lots of clothing and skin colored tape in the summer. CPD should just make a rule that after 2016 nobody can be hired if they have tattoos visible on their body while in uniform. The tattoos on officers in this department has gotten completely out of control.

If you have a condition that prevents you from wearing long sleeve clothing then you probably shouldn't be the police in the first place.
Also, I suggest you move to a warmer climate where you don't need to wear long sleeves for three quarters of the year.

I'll help you. What the fuck kind of medical condition could you possibly have that somehow allows you to be the police, but does not allow you to wear long sleeves? What do long sleeves do to aggravate your medical condition? When you took this job, the uniform requirements included wearing a long sleeve shirt at certain times of the year. Shit, I'm sure you wore one to your academy graduation. I'm sure you wear long sleeve shirts, sweaters, sweatshirts, jackets, etc. when you're not at work. But let's all make up a ridiculous "medical" argument because we don't want to wear long sleeves. Why not hit the medical for your long sleeves disease? Then your "doctor" can write you a note to keep you from ever having to work again. Collect disability for longsleevitis and just enjoy life. Moron.

What a miserable mush. Typical copper who has never worked a real hard days of work before taking this job. If you knew what real work was, you would value this job. You must be a real pleasure to be around in your home life... I'm sure your significant other heavily invests in wine and tinder/Ashley Madison... i have both arms sleeved and it's really not that that big of a deal. The department should be fighting bigger problems not this nonsense. How about equal furlough time since people in even days offs get only 20 days while odd dog gets 26. What about un doing the lame furlough by watch. What about man power/equipment issues? How about getting the damn pension fully funded??? This is a losing argument and FOP needs to let it go. I worked the entire summer with sleeves rolled up and guess what never once had a heat related issue.

The department of transportation is not involved in the process of talking to suicidal subjects, mediating domestic disputes, or taking away peoples liberty. They can look as professional as ditch diggers need to look. I am not about to reduce the expectations of my level of professionalism, which should be reflected in my appearance, to that of a ditch digger so that people can wear visible tattoos.

The comparison to women that wear too much makeup is also ridiculous. Visible tattoos are an absolute. It is a matter of them showing up or not showing. They department is not about to gauge an arbitrary look like how much eye shadow is too much. Stop the crying

There has always been a double standard between the CPD and the CFD. OUR RULES NEVER APPLIED TO THEM AND EVEN WHEN RESIDECY applied to both it was not enforced equally

Even now after you see a federal judge upholding the tattoo's, you won't see the CFD putting out an order on tattoos. We are more professional than paramedics and firemen

The judge who ruled is the Chief Judge for the 7th Circuit and a Carter appointee. The 7th Circuit Court of Appeals has not and will not rule against him. FOP had little or no chance of winning this in this judge's court room or another room in this circuit. They only took it to court because what the city did was wrong but legally under their authority. It sucks thou.

Tired of this remark that we are unprofessional with tattoos. Unprofessional?. Hardly. Because I'd rather be helped by a clean cut clean shaven Officer that has an 82nd Airborne tattoo or 1st Mar Div tattoo on his forearm than a fat beer gutted unshaven slob that hasn't washed his vest in 10 years and 19p's everything. While some tattoos are over the top, and piercings are generally stupid otj (in my opinion), this policy should be grandfathered, or regulated on a case by case basis via the Officers immediate superiors to avoid the tattoos you call "unprofessional". Meaning non military or hideous works of offensive art tattoos I.e. "thug life" or "white power" or naked chicks or some bs like that. There are a huge number of ex military or even current military Officers on this job, that served proudly, and shouldn't have to cover up their tiny tattoo they got to honor their fallen brothers, and sweat their ass off in the summer because the city wants to gain a few million in whatever by adhering to calea.

Let me tell you something pal. I would much rather work with a BIKER than an over educated snot. Bikers are among the most loyal brotherhood I have ever had the pleasure of knowing. I am not a biker but am accepted by them for the ways I have helped them by being a part of the brotherhood that raises around $200,000.00 per year per club for needy kids.

I'd like to see you say that to my biker brothers face.

What happened to the "Scar Doctor"? When we were processed to be hired, we were all lined up and had to go from table to table to have blood pressure, hearing, eyes etc checked and than looked over by an old doctor who would judge if you had any visible scars and or tattoos that would be exposed to the public. He told several people to get into another line.
Thinking back, you probably had to take your wallet out in the other line...

Please SCC help me with this. Is it true that if you have a tattoo and are ordered to wear long sleeve shirts but you have a letter from a Doctor who says that you should not wear long sleeve shirts because of a medical condition that the city will then send you to call back???

Why dont you just stay in your mothers basement and beat off it easier and does involve the rest of us. moron

Does not matter if the rule was in place when they took the job. The union can change union form requirements when ever they want, uniform committee is only advisory. The only exception is if new uniform requirements are imposed causing purchase of a new item, then the city must pay for the first purchase. Officers are already suppose to own long sleeve shirts and get a uniform allowance.

Wow! So much anti- tattoo sentiment. I am the police and display a visible tattoo. When I respond to service calls my demeanor and body language commands respect. Police need to learn how read people rather than work on another worthless college degree. Stay safe everybody, we are all we have.

I don't mind tattoos. I have none and never seen one offend me or intimidate me. If someone needs to permanently mark themselves for whatever reason it is their choice. Its like really big boobs. If someone got huge implants could that possibly offend someone? Maybe. If someone had a really ugly face, could that be offensive? How about an oddly shaped head with disproportionate face features? Acne and otger skin conditions? Where will it end? Crown cap with cargos? Crown cap with molle vest? What are they thunking? Gave me a car with over 100k miles and roof is gray due to chipped paint. No working pdt or printer in station. Broken fax machine, denied days off, unstable pension and now tatoos? Really? I understand the talk about professionalism and the other koolaid ideas but at least let the guys and gals be grandfathered in. Ya know? And these bosses wonder why they don't get what they want. Squad give me my 30 at the station.

Let me tell you something pal. I would much rather work with a BIKER than an over educated snot. Bikers are among the most loyal brotherhood I have ever had the pleasure of knowing. I am not a biker but am accepted by them for the ways I have helped them by being a part of the brotherhood that raises around $200,000.00 per year per club for needy kids.

I'd like to see you say that to my biker brothers face.

SCC, your title of this stream is incorrect. the FOP had nothing to do with this lawsuit. below is the reaction from the Fop on this decision.

Reported in yesterday’s local media was a case that dealt with three (3) individual officers who sought out and hired their own private attorney to challenge the Department’s new Directive on Tattoos/Body Brandings. It needs to be clear that these officers did not call the Lodge for representation. Simply put, their argument sought to attack the Order on First Amendment grounds (Medici, et. al., v. City of Chicago, 15-CV-5891). On October 27, 2015, Federal Court Judge Kocoras granted the City’s Motion to Dismiss the lawsuit and explained that no First Amendment violation exists and dismissed the case.

For further clarification purposes, the Lodge was not part of this federal lawsuit. When the Department unilaterally issued the new Directive, and did so without bargaining with the FOP, the Lodge explored all of our options. The Department described the new Directive as including “major revisions,” such as on-duty officers would be required to cover (at all times) tattoos and body brandings and be prohibited to the future wearing of the previously approved baseball caps and knit caps.

It was the Lodge’s determination that a federal lawsuit would not be successful, as proved by Judge Kocoras’ October 27th decision. Instead, the FOP chose to file both an unfair labor practice charge with the State Labor Relations Board as well as a grievance. At the last General Membership meeting, we reported that our arbitration hearing took place on September 9, 2015. The Lodge will file its Post-Hearing Briefs and/or a written submission of our arguments, on November 12, 2015.

A decision from the Arbitrator handling our case is expected by the end of the year. As always, the FOP will continue to keep the membership apprised of any new developments.

SCC you are always criticizing the accurate reporting from other sources, I'm sure this was not intentional but it would be nice if you posted a clarification.

First let me respond to the ass hole who thinks their is a GENERAL ORDER stating if u have a doctors statement saying u cant wear long sleeves then u can be detailed to call back. Dumb ass NO such order exist. Secondly, only two officers were excepted in call back during the summer months until the suit was finalized now that the weather is cooling off they will be returning back to the streets. The Verdict is in. ( YOUR punk ass will cover up your tattoos and do the job your ass was hired to do... Thirdly Do you know how many people would love to be making the money your ass is making. So stop whining like a little BITCH.. Lastly, Call Back does not need another Thief, Drug addict, Child Molester, Racist, Wife Beater, in the unit. That unit is for officers who suffer from life threatening illness. IE; Liver Cancer, Brain Cancer, M.S. , Lupus to name a few. One of CHICAGO FINEST who once belonged to UNIT 376 took his life after a long battle of severe MS . You see this officer gave 28 years of service until he fell ill and then was forced off the job. Prior to him being forced out he never missed a day, and was not a medical abuser. He never once complained about being in pain. So guess what u think I care about your CANDY ASS not wanting to wear a long sleeve shirt. As a matter of fact the way I see it if your weak ass can not wear the prescribed uniform then u should be forced off the job like the many good officers in 376. You probably are one of many officers who could care less about the sick officers in call back who were fighting to keep their jobs and are still fighting as I type this comment... But you want to come to call back and take a spot from a sick officer because u do not want to wear a long sleeve shirt. FUCK YOU and YOUR DAMN TATTOOS.
