Who Saw This One Coming?

We did! We did! (<--click the link and read it). And so did about EVERY SINGLE ONE of our readers (read the comments section). Give yourselves a pat on the back. In the meantime, read this Sun Times story today:
  • The mother of a Los Angeles woman paralyzed in a fall from a Robert Taylor Homes apartment after she was allegedly raped sued the city and the police department Friday, claiming the woman never should have been released by police into the neighborhood.

    Kathleen Paine demanded $100 million in the federal lawsuit, which said her 21-year-old daughter broke her neck and back in the seven-story fall and is paralyzed below her torso.

Yep, all the fault of the police. No one ever takes any responsibility for their own actions or the actions of someone allegedly so mentally ill that they are able to fly halfway across the country with no supervision to engage in what can only generously be described as a questionable business endeavor.

Just for the record, we feel we've fixed enough of society's problems this past week, and we're sure all of our fine readers have done at least their share. So the rest of you slackers better start picking up the pace. SCC and friends can't do it all.

Predatory Lawyers and Activist Judges have certainly done away with majority rule and personal responsibility. No one accepts liability for their own actions anymore.

These types of stories are an outrage. But the ultimate "I am a victim" story was when that woman spilled hot coffee on herself then sued McDonalds for $2 million.

Now we'll see more knee-jerk reactions from The City - More G.O.s coming down on us, offers to settle with the "victims" as soon as possible, and a Cline/Daley TV conference indicting the desk officers who signed her bond slip.

Did you even read the story link we put in the first sentence? The Watch Commander probably never even saw her before she was I-bonded. And we made the point that there is still no proof that anyone other the lockup keepers saw her for more than 90 minutes at any one time - and we're sure the lockup people are trained as well as we are at recognizing the subtle signs of a bi-polar mentally unbalanced person (i.e. not in the least). The W/C might be a political hack captain, but certainly bears as little responsibility for this as anyone else. We aren't here to raise other people's kids. We aren't here to diagnose mental illnesses in people. And in spite of all that, it seems all we're here to do lately is take the fall for other people's errors in child-rearing and paying them money for it.

Los Angeles Foreclosures Increase Dramatically in the First Quarter Of 2006, According to Default Research

Monday April 10, 11:59 am ET

MT. PLEASANT, Pa., April 10 /PRNewswire/ -- The number of foreclosures in Los Angeles County increased by 63 percent in the first quarter of 2006 compared to 2005, according to Default Research , the rapidly growing real estate research company for foreclosure properties.

With Default Research's timely leads, their customers are able to approach and assist homeowners in distress, often allowing them to stay in their homes and overcome foreclosure.

"Our leads erase that financial problem and help both parties realize financial success in the process," said Bankaci, whose company provides foreclosure data that arrive two to three weeks ahead of the competition.

I just stumbled onto this, and I'm the one on the Zorn thread who debunked the BS posted by one or more about 5th amendment rights. I did not post previously on this thread, and am not the previous poster who is also posting that he is not me.

Heck, I don't even think I agree with this guy. At the heart of the story, I agree with SCC that the parents actions have now crossed the line into outrageous territory. Complete BS.

Here is a little legal lesson for everyone who thinks the City is going to pay out big to this tramp's family.

It ain't going to happen!

For the City to be liable it would have to be shown that, by letting her out of the lockup, it was foreseeable that she would be thrown out a window by a third party. This is the crux of the case. Her injuries are not foreseeable.

Now I know everyone on this blog pretty much hates us attorneys, but I'll still give you this free legal lesson in tort law.

AS A GENERAL RULE, A DEFENDANT IS NOT LIABLE FOR THE CRIMINAL ACTS OF A THIRD PARTY UNLESS THEY ARE REASONABLY FORESEEABLE.

What does this mean? It means that even if a goofy judge allowed the suit to go forward, and even if a stupid Cook County jury awarded the victim/defendant a large sum of money, the verdict would be overturned on appeal.

Moreover, the Chicago Police Department had no DUTY to keep the woman from bond simply because her family alleged that she was mentally disturbed. In this case, the CPD did everything according to the book.

To be honest, I can't wait to see how the City handles this lawsuit. My gut tells me the Corporation Counsel will have to fight it. If they don't and just settle, it will open the door for a shitload of similar suits.

Well, thats all I have for now. Let the lawyer bashing begin!!

This is a concept I am still trying to figure out. The below article is about how the residents of Mt Greenwood must come up with money to replace an outdated playground. We the residents, who already pay our fair share of taxes now have to chip in additional money to build a publice playground at our park.

Where is the 1.2 millinon a year that our alerdman gets for projects like these?????? Must have been spent up in beverly again

The way things seem to be going is that if say the fire house or library new to be reconstructed they will ask you for additional money for that to or say to bad we are not going to build it

The money is starting to roll in for the new Mount Greenwood Park playground.
No donation is too small and the opportunities to give are growing, said Mary Vogwill, one of four mothers spearheading the $800,000 effort.

Half of the money has been raised through a $200,000 park district grant and $100,000 each from state Sen. Ed Maloney (D-Chicago) and state Rep. Kevin Joyce (D-Chicago).

Students at Mount Greenwood School chipped in $300 from a recent dress down day. And the project has been awarded a $10,000 grant from Kohl's Cares for Kids.

Proceeds from a July 31 showing of "Charlie and the Chocolate Factory" at Mount Greenwood Park will benefit the playground fund.

The playground fund should also get a boost from brick sales and a raffle launched this week. Tickets are $50 and prizes start at $7,500. The drawing will be held during the Party in the Park on Sept. 9.

In order to properly answer your Fifth Amendment question, I need to the context in which its being invoked.

Is the officer invoking it in court or during a deposition, or is it being asserted during the course of a C.R. investigation or other Department inquiry?

If its the former, then the Department would not be able to fire the officer per se for this alone. That being said, the officer probably has a much bigger problems on the horizon if he or she feels the need to refuse to testify for fear of self-incrimination. That being said, all officers are required via general order to testify completely and truthfully in court. So it is possible that refusing to testify under the Fifth Amendment could result in a C.R.# and some time off.

In regard to the latter, an officer would most certainly be subject to termination for refusing to answer during the course of a Chicago Police Department administrative investigation. The reason being is there is no Fifth Amendment right applicable to administrative matters within the Department, as whatever evidence gained cannot be used in court against the officer.

An example of this would be where a copper is arrested for a DUI. During the criminal phase of the investigation, he or she is free to refuse the field sobriety tests and breath analysis. However, during the administrative portion of the investigation, the officer is given a direct order to comply with these tests. If he or she refuses, they will be terminated for refusing a direct order. Thus, they are coerced into performing the tests. It is for this reason that the results of the administrative portion of the investigation cannot be used against the officer in court during the criminal trial.

I hope this helps answer your question.

You don't explain this in your post, and you also acknowledge that an officer could be disciplined. The question arises with respect to a grand jury looking into allegations of police misconduct (i.e., looking into allegations related to your duties as a police officer).

You followed the quote above with:

By General Order, an officer MUST co-operate fully in all investgations. Asserting your fifth amendment rights in court would result in an IAD finding of "Seperation". If that Seperation would be upheld by the Police Board, I don't know. That must depend on how connected the officer is.

There is a playlot in 008 on the east end about 64th and like washtenaw or rockwell not to sure exactly. It was a old house that was torn down , land purchased from the city and made into a playlot with all the top end slides and toys. I never have seen a sole in the playlot playing. If her condition was caused by her previous auto injury, maybe she is also not truly "bi-polar"; what kinds of meds does she truly take? Is confirmed that the Canadian raped her, i.e. his DNA in her hot pocket or his videotaped confession? Maybe the city can claim that their pilot attempt to offer Crisis Intervention training to some officers showed a good faith effort in responding to these types of bizzare situations, but it obviously had no impact on this particular incident. The police took back the south end of 001? You should be embarrassed to say as a new policeman you were assigned to 001 out of the academy. I handled a police shooting in 001 3 years ago where neither the 2 year officers or 6 year Sgt notified the WC about a weapons discharge for 2 hours. The WC found out about it because the officer who shot was inventorying his own gun and went in to ask the WC could he come to work without a weapon.

We are a police department, not the infantry. We dont take and hold ground. Obviously you must not have studied Economics or Sociology at Wright Junior College during the 5 years it took you to get 60 hours. You have to love an employer that doesn't care where you got your credit hours or how long it took you.

The first time I got in a car with one of the new elite officers he spent the whole night trying to find some copper broad on the PDT that he met at a detail. Next he asked me what my probable cause was for stopping a car with expired registration. Then he sat in the car sending messages to the broad while I did the stop. You know it's bad when dude tells you your partner is "bogus". Needless to say he was dropped at the station and told to explain to the WC why I was going to be a 99 unit the rest of the tour.

My favorite is the two guys in 010 who spend the whole first watch competing against one another on their PlayStation Portables. Yes, we boomers welcome the Nintendo Generation with open arms. Just remember this job was here before you and it will be here after you. You're nothing special.

The better thing to do is to continue pushing the savages out of the city from the inside. Send them south, from whence they came.

And don't even think that this applies generically to blacks generally.

If you work in 009, patrol the south end and keep pushing. If you work in 002 or 021, KEEP PUSHING.

If you could have armed Generation X it might have turned out differently. Alas, the oldest of us was 11 in 1975, and you guys just couldn't hold out til my generation came of age.

I can see defending your own actions (which I applaud), but nobody with any sense whatsoever defends your generation as a whole. Do you?

Name one thing that your generation accomplished. One thing. You wrecked our cities, you wrecked our record of military victories. You surrendered every freaking thing you ever held. Values, ground, government, all gone.

When you have no argument to the contrary, resort to name calling and whining like little six year old girls. The "me" generation at its best. At its only, as we've never seen nor heard another thing from you as a generation.

Two things saved the future of this nation. Ronald Reagan and generation X starting to turn 18 in 1982. From the day you guys started adulthood in 1964 to the day we started adulthood in 1982, it was all downhill. Since then, a shining city on a hill, being scrubbed down to remove the stains you've made everywhere.

We are the cleaners and you are the soiled. You should be thanking us every day God graces you with our presence.

I've been up for three days now. I'm cranky. Nobody will admit to being a surrender-monkey, a deserter, a draft-dodger, a doper, or a runner. Yet, it describes 70-90% of your generation. Let me guess, you heroes were all the exceptions, right?

Now just tell me a story 'bout the first time you raised the ole starless spangled handkerchief, and I'll go to sleep. Heck, by now I could have written a book of just your generation's surrenders I know about, and had one of you read me a chapter.
