Old News is New Again

When your circulation is dropping, your ad revenues plummeting and your entire industry is circling the sewer like a particularly nasty turd on the way down, PLUS you don't know one day to the next if you won't be out in the real world trying to actually earn a living with a worthless J-school diploma, we suppose recycling old stories looks like a good thing at first.

This gem from the Slum Times Monday:
  • New Chicago Police Supt. Jody Weis will take a "hard, close look" at taking further action against an officer suspended after a surveillance camera captured him beating a man handcuffed and shackled to a wheelchair, a police spokeswoman says.
A case that has already been adjudicated before the State's Attorney, a judge, a previous Superintendent and heard before the Police Board. We won't make any judgments as to how a conclusion was reached, but it was reached and a two year unpaid suspension was the end result.

The fact that this entire finished and finalized investigation can be reopened at a whim should be more than a little disturbing to everyone. It's politics writ large and it looks like this is going to be the "test" case that will set the tone for the new regime. We're also assuming that the officer will appeal any further action based on the fact that he, too, signed off on the punishment and the agreement in place has standing in a court of law.

the officer followed the process put in place by department and the police board gave 2 year suspension. the board's decision means officer goes back to work in apr-2008. now they want to reopen an investigation-- reopen what-- its been settled. but we all know that the city does whatever they want anyway. who cares what the law says or the contract says. good luck bill-- got your back 100 percent.

Sorry, SCC, while your point that this whole incident has already been investigated and adjudicated is a valid one, your assertion that the Sun-Times is just recycling an old story is not. The NEW story is that the NEW superintendent is taking a look at an OLD incident. If that officer had not slept through the class about how to deal with an ignorant passive resistor, the media wouldn't have the opportunity (once again) to publicize this regretful behavior. We don't need the Sun-Times to make us look ridiculous, we make ourselves look ridiculous.

As a retired P.O. I enjoy reading the blog and know now why I retired. In reference to the Scum-times article, this morning on the Don Wade and Roma Show, Roma stated that the other "Police Officers" who watched the incident should be suspended. If she would have looked closer she would have observed that the others in Uniform were Hospital Security. A question for the class here, "Double Jepoardy" does it not apply to Police?

Are you kidding me troll? we can't get someone charged who shoots someone unless they are on their death bed, but you want someone charged for hitting a combative subject with a sap? he had to shackle his legs, that in itself tells you he was a problem from jumpstreet; once the shackles were on it should have been over though. He is an idiot and should have been fired but they decided otherwise and gave him a 2 yr. suspension, that's about $144,000 penalty, more than anyone else pays. To re-open it now after it was settled is a definite double jeopardy issue.

Therein lies that problem....what exactly is a good cop? Obviously, a thief is a bad cop. And a cop who pulverizes people for shits and giggles is a bad cop. But a good cop used to be respected at the least, and perhaps feared. It kept us SAFE. Is a fair yet heavy-handed cop a bad cop now, or a criminal? I mean fair is fair. If little homie can call me every name in the book as I try to save his neighborhood from HIM, can I tell an inspector exacctly what I think next time I'm written becaseu I have project mud on my boots? Bill is a good guy.He'd give you the shirt off his back.His intentions were good, he just went about it the wrong way. At his party he was visibily scared to death of going to jail! Who wouldn't be? But the fact remains that under the old system he was punished ,did his time off and now the new regime wants to try and fire him?! What wasn't said either was that the hosp. security had asked him to help because the guy was drunk and hit one of the hosp staff. Did anyone notice you didn't see that in the tape? Good luck Bill! It's news because they got their hands on the video.

The City always wanted to fire him. The PB disagreed (Carney dissented, and said he should be fired.)

The City already has an appeal pending in the Circuit Court.

What Weis is saying is nothing new. He's just reacting to the headline by saying that the City will fight to fire him. But the City's already fighting to fire him.

His best hope is that the judge hearing the case isn't swayed by the headlines, and the new pressure likely to be brought on him by the City.

Those judges have a pretty good record on this. They are more likely to overturn a decision against an officer than the other way around. They understand that a man's career should not be shot to hell by headlines.

This officer had a stellar career, and one very bad day. Sure, he screwed up big time that day. But he got two years off, and apologized. Judges do understand that people who screw up once should be given another chance. Here's hoping this judge understands that.

A young copper comes over and insults the father and tells him to "shut up you animal, you live like an animal and so you'll be treated like one".

The best advice I can give to people is live your life both professionally and when you are off work as if a camera is monitoring your every move. A lot of people don't like us and if we do something wrong, they will send that tape to Carol Marin and then your ass is toast.

Double jeopardy is not in play here. He was found guilty and given 18 months supervision. The non injured wheel chair bound moron was not hurt. I do not condone what he did but I am telling you he was happy to get his 125k and a walk. The only reason this is up is that a certain aldercreature running in an upcoming race leaked it to the media and they got the video via the freedom of information act. So he could play it up for his upcoming loss in the upcoming election.

The officer was wrong for what he did and has brought this on all himself but he did go thru the process and he should be allowed to come back.

The issue is not double jeopardy, the issue is one of sovereigns. While it is true that the Cook County S/A, on behalf of the State of Illinois, prosecuted this police officer, it is not true that this very same police officer could not be prosecuted at the federal level. The very same deeds or actions this officer performed could be used to prosecute a federal question-perhaps civil rights violations. The Constitutional protections against double jeopardy would attach to neither the resulting prosecution, nor the resulting conviction. Still want to kill all the lawyers? What would you people do without them?

First off, isn't the Department doing everything it possibly can? They're appealing the Police Board's decision to merely suspend Cozzi. What else is there? What other action could the police department possibly take?

The only thing that makes this newsworthy is the fact that the video was just recently obtained by the Sun Times. Now that there's video, it must be timely news.

BTW, Cozzi's not the sharpest tool in the shed. I worked with him several years ago. Seems to me, when I first heard the story two years ago, I thought the incident would be much worse. When I saw the video, I realized the guy was being an asshole and wouldn't shut up. Cozzi was just poking him a bit. Not worth much more than the $125K they settled it for.

I don't think it's anywhere in the contract. It was a deal that was presented to the P.O to avoid jail and/or felony charges. He pled guilty to misdemeanor battery.

People! If J-Fed reopens the case it is NOT double jeopardy. The criminal case is complete. It would be the administrative case that is reopened.

However, the G could look into civil rights violations and charge him in federal court. Seeing as the state court signed off on the case, I bet it is unlikely that the G will waste the resources.

I was willing to give the guy the benefit of the doubt until he officially took over. While others moaned about him being an outsider and crazy rumors were flying around about what he was going to do, I thought we should wait and see what he's about before bad mouthing him. But now, F this guy! The only reason he said he wanted to look into this incident was political correctness, nothing more. If he's such a straight shooter he should have told the media the truth. "It happened before I arrived. It was investigated criminally, investigated administratively, and the decision of the police board was made before I was even a candidate for this job. The system in place at the time determined the officer's punishment". Is there a politician or high ranking police official anywhere in this country with a backbone?

Copper should have realized that he was in a hospital, which is private property. The hospital has security. The problem in the wheel chair is THEIR problem. He should have just walked away and told them it's not his problem, its theirs.

A sgt who worked academy two years ago had two domestic violence case reports against him for dating recruits and committing battery. Crimes were covered up and sgt moved to ERPS. ADS at time, a civilian covered the two crimes. WS now works in corp counsel office. Same story. If you have clout, crime is covered up. No clout and you are charged. Hopefully, new boss will bring respect and fairness to discipline system. Clout is rampant.

You obviously are not the police or have been one for a day. So, STFU asshat until you know what its like out there dealing with the elements. Cops are human and humans make mistakes. Trust me I know Bill Cozzi and he is a good policeman and person. We were all very worried about what Bill would do when this shit happened.(If you know what I mean). He has paid the price for a screw up where no one got hurt. More than I can say for the average citizen.
So before you shoot your mouth off know the whole story. I truly hope you never have to deal with something like this cause you obviously think your beyond making a mistake.

I love these sort of comments. I would have to agree that this guy does deserve to be fired. There is a world of a difference between making a mistake (i.e. a minor driving accident, forgetting something to do, not having a field case report in your bag, etc...) and fucking up really bad which is not a "mistake" as you categorize it (i.e. drinking and driving as a copper, going lights and siren towards your lunch location, punching a man who is handcuffed to a wheel chair and is refusing services at a hospital, etc...). YOU are the ASSHAT and you should be the one STFU'ing because you want to defend this kind of an officer? As a person I am sure he is a nice guy and I might even want to have a couple of drinks with him. But what sort of judgment and reasoning skills did this officer employ when dealing with a piece of shit who didn't want any hospital services? Even a fresh recruit coming out of the academy understands the use of force model! And this was a seasoned veteran? I don't get it when some officers defend idiots like this officer in question. Oh, in case you are wondering, I am a real cop, I have 13 years on the job and YES, he ought to be fired!

I may be wronmg but I believe that the department (city) has the right to appeal to the courts if they feel that the police board made the wrong decision and they can proceed to the state supreme court if need be appealing for his seperation....
