BIS Program Fallout

What's this all about?
  • ###ATTENTION###
    To all the P.O's that received their letters in the mail from the FOP regarding the BIS program DO NOT SIGN IT. If you do, it prevents you from seeking any form of compensation in the future. The FOP has some balls entering into an agreement with the city concerning this matter without even consulting the people that were in the program to begin with. Then trying to order the P.O's to agree to it.

    Fellow P.O.'s if you were placed on BIS or Personal concerns and received a letter in the mail pay attention. DO NOT SIGN THE AGREEMENT! It is the City and the FOP's way of trying to mislead us and not have any responsibility for their actions. REPEAT DO NOT SIGN THE AGREEMENT!

We're aware that the City recently admitted to "mistakenly" placing or keeping a few hundred officers in the BIS program. With such an admission, why wouldn't everyone be entitled to some sort of restitution, compensation or what not?

Someone care to enlighten the masses?

The City and FOP in bed together as usual, attempting to do damage control. A little to late for that after destroying these officers reputations and hurting them financially. Yes, regardless what you say, SD and TF, these officers were damaged, therefore there should have been damages agreed upon and awarded.
The nerve to agree to such a settlement and then to use language telling the officers they "must" sign the agreement. Whose agreement, it's surely not that of the officers. All indications point to a back-door deal made between the City and FOP. Time to organize brothers, can you say class action lawsuit? Stay tuned.

BIS is Behavioral Intervention System, it part of the Personnel Concern program. Look up BIS in the automated directives it will explain in detail.

Although I don't mind our brothers and sisters getting compensated for the misguided actions of the exempts.

However, I believe these exempts acted purposely and willfully and so it is my opinion punitive damages should be sought. If you get an attorney- make sure they list the entire chain of command on the law suit and not just the City of Chicago and Police Department and Superintendent.

Remember it was Da Mayor, Cline and Starks, any of the Deputies, chiefs, commanders, etc...at that time. You cannot blame the current administration on this one.

Accountably for their "exempt" actions created a liability for the taxpayers. They should not be let free of any exposure to individual wrong doing and an example needs to be made to the new administration that they too will be held personally and financially responsible for their over jealous behaviors as well.

Class action status approved!

Someone needs to take the initaitive and contact an attorney. No not the one that you know from 26th st or the one that did your real estate closing but an actual lawyer that specializes in labor law and see what he advises.

It is time to take legal action. This is the only thing the city responds to. Unfortunately, the FOP will have to be named in the suit, because it failed to perform it's duty. Could there have been a secret deal here? Absolutely, that would explain that recent letter.

The officers who worked the street in patrol were not trouble makers, they were officers who refused to do Illegal police work or circumvent the constitution by jamb citizens up. Insofar as the department was concerned they use this system as their own personal bully and fucked with officers. Dulay comes to mind as one of many bully's that used BIS without grounds.

To the anonymous response that stated that those officers are all trouble makers. I am one of the officers that was placed on the B.I.S. program. I work for the citizens that live in the City of Chicago and I have done my job to the best of my ability and have made hundreds and hundreds of arrests (yes a lot are B.S. subs and drinkers, however many are quality arrests) in one of the worst parts of this city. I was placed on the program without meeting any of the criteria in the G.O. Some of the CR #'s where unfounded and exonerated, yet the city counted them. When you do your job and arrest these gang bangers and criminals they will complain if you do your job. The activists don't understand the life of the police and the horrible scenes we see on a daily basis and the low life that causes harm to the hard working people of this city. If you are not the police maybe you won't understand but if you are then maybe you just pretend to be an officer of the law. I received a letter stating that I was mistakingly placed on the program after I had to jump through hoops and live with the additional stress of performing my duties.

The FOP Board of Directors meets Tuesday, 01 JUL 2008 in the a.m. You can check out the FOP website for the exact time. Time is set aside for the members to speak directly with the Board. Go to the meeting and ask them to explain this to you directly. You will have every one of them on the hook for the answer.
If you can't make it, then you don't really care that much, do you?

The officers who were in that program cannot recover compensation because they have no damages.

If they sue, this is strictly a breach of contract case. The city clearly violated the contract.

There are NO punitive damages awarded for a breach of contract. There are also no emotional distress or other non-specific money awards in a contract case. The officers continued to get paid while they were in the program.

Unless an officer can prove he was denied a promotion BECAUSE he was in the program, he has no case. The fact that an officer might have received a merit promotion if he was not wrongly put into the program is not enough.

Don't fool yourselves. You got screwed, but you won't get paid because of it. You'll only waste your own time and money on your own lawyers suing for money you'll never see.

The city went after these officers with a vengence. These were the hardest working guys and gals out there. And as a thank you for all of thier work, the city using the media, attacked the charcter of these officers. All the while they should have been thanking them. As a result, they slowed down and crime has now sky rocketed. Does any one else see the correlation.

Also, in thier time of need, they turned to thier representitives FOP, and were for the most part grossly misrepresented.

Now the city and FOP together want the affected members to just shut up and go away. But we are not going away.

There are damages, officers were harmed financially, on many fronts. Each officers case must be looked at on a case by case basis, and damages determined individually, not as a whole based on the entire program. This will take much work, and should have been done in the first place, so laziness was certaintly a factor. Lawyers have been contacted, and some are jumping to take it. It is going to get ugly, and many skeletons will be unvieled, but it is necessary.

While you might want to check with an attorney, I can tell you officers from personal experience that punitive damages aren't allowed against the City in employment litigation.

There may be compensatory damages if you suffered enough emotional distress. Be advised that cases can take up to 2 or 3 years to reach the Seventh Circuit.

Most lawyers will take any case. But a couple that know labor law have advised that this case is a loser since you still received full pay while you were on it and you were compensated for all the silly shit you had to go to during it. What will you sue for because the city made you feel bad. They will laugh you out of court. If anyone has heard from a lawyer that specializes in labor please chime in.

Don't have to. The question was raised at the last FOP meeting by an officer. FOP made it known what their stance was and they're sticking to it. Also, conversations with certain members of the Lodge resulted in persuasive speech to not sue the Dept. I think it went something like this, "You can hire an attorney and pay him money and in the end you will lose and the attorney will keep all your money, so go ahead officer and try suing."

There is obviously a lot of spin going on here. The comments against a law suit are likely being posted by FOP folks like the Judas, Mark Donahue. And of course there is the side of those of us that have been dealing with the hardship of this witch hunt perpetrated by the City of Chicago. We will play this out in court, and in the end, all the nay sayers will be proven wrong.

Anybody can say any thing that is why the adversarial system is in place, to hash things out. And to the BIS members, don't be frazzled by the FOP spin doctors who keep saying you will have to spend your own money to hire a lawyer. Lawyers have agreed to take this suit and collect in the end. If we win than they win that is how it works. So, a bit of fear mongering is going on by the Judas and his crew. I wonder how far the 13 Pieces of silver were spread.

It is not unprecedented for members of a union or collective bargaining unit to sue that body. Plenty of cases are available to look at on-line. I for one am looking forward to this.

My arrests, work history, evaluations, complim history, time on job werent even considered! I was told I was the problem. Well guess what, I and we were'nt the problem, but we are gonna be one now! IF you are serious about a lawyer who agreed to take the case, I suggest we start to organize. Lets get some fliers printed and pass them out to all the districts and units so that we can know amongst each other who was all on the list.

Lawyers have agreed to take your case for one of two reasons:

1. They will ask for retainers from you and then they will proceed to bleed you dry.

2. They will convert the case into a class action suit where you pay nothing. Unfortunately for you, that is a case where the lawyer(s) take all of the settlement and the plaintiffs (you) get nothing.

Do not fool yourself. But, more importantly, do not let yourself get fooled by a lawyer who tells you he has your interests at heart.

Yes, the news conference proclaims that Joe Shithead has won big in his suit against the police.

In the end, Joe Shithead gets shit. His lawyer gets it all. Fifty percent of the settlement + fees + testifying expert expenses + travel + deposition costs = all of it.
